<legis-type>A BILL</legis-type> 
<official-title>To amend the Public Health Service Act to establish grant programs to provide for education and outreach on newborn screening and coordinated followup care once newborn screening has been conducted, and for other purposes.</official-title>

<section section-type="section-one" id="H0999C3BB653A47D300ED5119D2CFB76D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Newborn Screening Saves Lives Act of 2004</short-title></quote>.</text></section> 
<section id="H952790211EDB45EFACD2C4A5AEC872D7"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HB9C90C269D6E4BCBBE3B1258C763D32B"><enum>(1)</enum><text>Currently, it is possible to test for at least 30 disorders through newborn screening.</text></paragraph> 
<paragraph id="H8BEBC25213E94C8BB22C9C7378A03381"><enum>(2)</enum><text>There is a lack of uniform newborn screening throughout the United States. While a newborn with a debilitating condition may receive screening, early detection, and treatment in one location, in another location the condition may go undetected and result in catastrophic consequences.</text></paragraph> 
<paragraph id="HB0AA4A3DFD9944D5BEE928D85EEC213F"><enum>(3)</enum><text>Each year more than 4,000,000 babies are screened to detect conditions that may threaten their long-term health.</text></paragraph> 
<paragraph id="H0ADD5B6FFF254FB2806B7513A9B2BDFE"><enum>(4)</enum><text>There are more than 2,000 babies born every year in the United States with detectable and treatable disorders that go unscreened through newborn screening.</text></paragraph></section> 
<section id="HD5C153FC3AE948B19E76DF4DD3257EA"><enum>3.</enum><header>Amendment to <act-name parsable-cite="PHSA">Public Health Service Act</act-name></header><text display-inline="no-display-inline">Part Q of title III of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/280h">42 U.S.C. 280h et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H4C4B93A62F5B419596FFAF153EAD4C44"><enum>399AA.</enum><header>Newborn screening</header> 
<subsection id="H5206582E1F37407DBFEC4091DC44E118"><enum>(a)</enum><header>Authorization of grant programs</header> 
<paragraph id="H698DFD157CF44AE4B753D428F668276E"><enum>(1)</enum><header>Grants to assist health care professionals</header><text>From funds appropriated under subsection (h), the Secretary, acting through the Associate Administrator of the Maternal and Child Health Bureau of the Health Resources and Services Administration (referred to in this section as the <quote>Associate Administrator</quote>) and in consultation with the Advisory Committee on Heritable Disorders in Newborns and Children (referred to in this section as the <quote>Advisory Committee</quote>), shall award grants to eligible entities to enable such entities to assist in providing health care professionals and State health department laboratory personnel with—</text> 
<subparagraph id="H098B2AF89F6D4009B2F9844D41970410"><enum>(A)</enum><text>education in newborn screening; and</text></subparagraph> 
<subparagraph id="H8EC4A4A8A7DE4EFAAC595E800000CC70"><enum>(B)</enum><text>training in—</text> 
<clause id="HDFEAEA6EA2F94615B3DF1761C2BBBD9B"><enum>(i)</enum><text>relevant and new technologies in newborn screening; and</text></clause> 
<clause id="H6D3D6E5BA977431E8DEDFCF3A00F280"><enum>(ii)</enum><text>congenital, genetic, and metabolic disorders.</text></clause></subparagraph></paragraph> 
<paragraph id="HA1346CDD819A47D0AAB80000CF09D42D"><enum>(2)</enum><header>Grants to assist families</header><text>From funds appropriated under subsection (h), the Secretary, acting through the Associate Administrator and in consultation with the Advisory Committee, shall award grants to eligible entities to enable such entities to develop and deliver educational programs about newborn screening to parents, families, and patient advocacy and support groups.</text></paragraph> 
<paragraph id="H39ADB07AECB541218EF47D58CC39E3D0"><enum>(3)</enum><header>Grants for newborn screening followup</header><text>From funds appropriated under subsection (h), the Secretary, acting through the Associate Administrator and in consultation with the Advisory Committee, shall award grants to eligible entities to enable such entities to establish, maintain, and operate a system to assess and coordinate treatment relating to congenital, genetic, and metabolic disorders.</text></paragraph></subsection> 
<subsection id="HC8309F5D11534EB0806F5B4E5FA150B6"><enum>(b)</enum><header>Application</header><text>An eligible entity that desires to receive a grant under this section shall submit an application to the Secretary at such time, in such manner, and accompanied by such information as the Secretary may require.</text></subsection> 
<subsection id="H5C2454F8BDC34D93A21843CC0099C6BC"><enum>(c)</enum><header>Selection of grant recipients</header> 
<paragraph id="H948085D61AC54243B828B3FA86FF54BE"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after receiving an application under subsection (b), the Secretary, after considering the approval factors under paragraph (2), shall determine whether to award the eligible entity a grant under this section.</text></paragraph> 
<paragraph id="H47630B8127E8415B8B35E29612565BF2"><enum>(2)</enum><header>Approval factors</header> 
<subparagraph id="HEC42D0CAC86B4D41828278D24618C014"><enum>(A)</enum><header>Requirements for approval</header><text>An application submitted under subsection (b) may not be approved by the Secretary unless the application contains assurances that the eligible entity—</text> 
<clause id="H47D4B14AAAA84DA4BB10D859E772D00"><enum>(i)</enum><text>will use grant funds only for the purposes specified in the approved application and in accordance with the requirements of this section; and</text></clause> 
<clause id="H2B9A60BAD0074398AA77BD3BA12889E2"><enum>(ii)</enum><text>will establish such fiscal control and fund accounting procedures as may be necessary to assure proper disbursement and accounting of Federal funds paid to the eligible entity under the grant.</text></clause></subparagraph> 
<subparagraph id="H463A2C3647B547D2A37E161CCF5B3510"><enum>(B)</enum><header>Existing programs</header><text>Prior to awarding a grant under this section, the Secretary shall—</text> 
<clause id="H0C8251DAFF804DA08EDDB42895561F1D"><enum>(i)</enum><text>conduct an assessment of existing educational resources and training programs and coordinated systems of followup care with respect to newborn screening; and</text></clause> 
<clause id="HE308A50EEFBC4CF5AFC6E12053604EF"><enum>(ii)</enum><text>take all necessary steps to minimize the duplication of the resources and programs described in clause (i).</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H284B72CFF746454A831DAA8E5E1FAA68"><enum>(d)</enum><header>Coordination</header><text>The Secretary shall take all necessary steps to coordinate programs funded with grants received under this section.</text></subsection> 
<subsection id="HE5BE6A83B568486D8F101333658FBE5E"><enum>(e)</enum><header>Use of grant funds</header> 
<paragraph id="H7E91C3BB234D43D3B325878087965914"><enum>(1)</enum><header>Grants to assist health care professionals</header><text>An eligible entity that receives a grant under subsection (a)(1) may use the grant funds to work with appropriate medical schools, nursing schools, schools of public health, internal education programs in State agencies, nongovernmental organizations, and professional organizations and societies to develop and deliver education and training programs that include—</text> 
<subparagraph id="H95DF2EB97B1A428B84B58FC53E2512C"><enum>(A)</enum><text>continuing medical education programs for health care professionals and State health department laboratory personnel in newborn screening;</text></subparagraph> 
<subparagraph id="HD9C72E415A7F48838D63CDD0C5C200C5"><enum>(B)</enum><text>education, technical assistance, and training on new discoveries in newborn screening and the use of any related technology;</text></subparagraph> 
<subparagraph id="H79F2AECF26BC459A81F7F6F152FA88C"><enum>(C)</enum><text>models to evaluate what a newborn should be screened for and when and where that screening should take place;</text></subparagraph> 
<subparagraph id="H83208D5B10C646FBA8AB00CACA98B34"><enum>(D)</enum><text>models to evaluate the prevalence of, and assess and communicate the risks of, newborn disorders, including the prevalence and risk of certain newborn disorders based on family history;</text></subparagraph> 
<subparagraph id="HE53DB259071443679810F2E3CFA936BD"><enum>(E)</enum><text>models to communicate effectively with parents and families about—</text> 
<clause id="H2C81A338B30B4F34AB2EE9008F42F088"><enum>(i)</enum><text>the process and benefits of newborn screening;</text></clause> 
<clause id="H69FD1329AEE5430198C67C8B91CE44F2"><enum>(ii)</enum><text>how to use information gathered from newborn screening;</text></clause> 
<clause id="H5B19BB6C86894F23A129B95475BE8EEB"><enum>(iii)</enum><text>the meaning of screening results, including the rate of false positives;</text></clause> 
<clause id="H0CC149B12FE149E9A4A65B77BD005815"><enum>(iv)</enum><text>the right of refusal of newborn screening; and</text></clause> 
<clause id="HB74745B867D54AD2A6AA35F5289B843F"><enum>(v)</enum><text>the potential need for followup care after newborns are screened;</text></clause></subparagraph> 
<subparagraph id="HAEE9DFFA3A1A4C8F92E0AF8E1E45F483"><enum>(F)</enum><text>information and resources on coordinated systems of followup care after newborns are screened;</text></subparagraph> 
<subparagraph id="HB6D630C291B5416D9E28F0BE7400ACAF"><enum>(G)</enum><text>information on the disorders for which States require and offer newborn screening and options for newborn screening relating to conditions in addition to such disorders;</text></subparagraph> 
<subparagraph id="H14622F00305C4DA89673E75B371D8115"><enum>(H)</enum><text>information on supplemental newborn screening that the States do not require and offer but that parents may want; and</text></subparagraph> 
<subparagraph id="HABE68CD35E6E472784E436AC9A29C8C"><enum>(I)</enum><text>other items to carry out the purpose described in subsection (a)(1) as determined appropriate by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="HDC7DAE0416F243778E41FE1822ED5C8D"><enum>(2)</enum><header>Grants to assist families</header><text>An eligible entity that receives a grant under subsection (a)(2) may use the grant funds to develop and deliver to parents, families, and patient advocacy and support groups, educational programs about newborn screening that include information on—</text> 
<subparagraph id="HA5E50AFC698F4BC3B19C0096E26FAF24"><enum>(A)</enum><text>what is newborn screening;</text></subparagraph> 
<subparagraph id="H1827666AEF524626B36B3B1E5C4293C3"><enum>(B)</enum><text>how newborn screening is performed;</text></subparagraph> 
<subparagraph id="H2ED10A85A1F0437C8CB2967C047B0095"><enum>(C)</enum><text>who performs newborn screening;</text></subparagraph> 
<subparagraph id="H2B2E3B37385B43A8B8D9DE642332B266"><enum>(D)</enum><text>where newborn screening is performed;</text></subparagraph> 
<subparagraph id="HD38783AE07674C05BC70D649A2D3D8C"><enum>(E)</enum><text>the disorders for which the State requires newborns to be screened;</text></subparagraph> 
<subparagraph id="H0F7B1667B89D42CF94694E26019C84C0"><enum>(F)</enum><text>different options for newborn screening for disorders other than those included by the State in the mandated newborn screening program;</text></subparagraph> 
<subparagraph id="H46816DB40FE44416AC3B64FE003C9BCF"><enum>(G)</enum><text>the meaning of various screening results including the rate of false positives;</text></subparagraph> 
<subparagraph id="H56834D900C314D06884FD5AB82ABB312"><enum>(H)</enum><text>the prevalence and risk of newborn disorders, including the increased risk of disorders that may stem from family history;</text></subparagraph> 
<subparagraph id="HD8F1D09C04D34A84B13DEFAC31A5BE84"><enum>(I)</enum><text>coordinated systems of followup care after newborns are screened; and</text></subparagraph> 
<subparagraph id="HF78B6A634D364F2F92F4151F94E6352B"><enum>(J)</enum><text>other items to carry out the purpose described in subsection (a)(2) as determined appropriate by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="H2E8B88D9544142BB8EF7FE434C00D44E"><enum>(3)</enum><header>Grants for quality newborn screening followup</header><text>An eligible entity that receives a grant under subsection (a)(3) shall use the grant funds to—</text> 
<subparagraph id="H502CAA1A89EE470C9217592C5380EA6"><enum>(A)</enum><text>expand on existing procedures and systems, where appropriate and available, for the timely reporting of newborn screening results to individuals, families, primary care physicians, and subspecialists in congenital, genetic, and metabolic disorders;</text></subparagraph> 
<subparagraph id="H2CEB81F3A2DE4EE28F10B17BDC30059F"><enum>(B)</enum><text>coordinate ongoing followup treatment with individuals, families, primary care physicians, and subspecialists in congenital, genetic, and metabolic disorders after a newborn receives an indication of the presence of a disorder on a screening test;</text></subparagraph> 
<subparagraph id="HFFBAD5F1745D44C293893D78296CF925"><enum>(C)</enum><text>ensure the seamless integration of confirmatory testing, tertiary care medical services, comprehensive genetic services including genetic counseling, and information about access to developing therapies by participation in approved clinical trials involving the primary health care of the infant;</text></subparagraph> 
<subparagraph id="H5869D371CEFE49BE98E88BB140142D2D"><enum>(D)</enum><text>analyze data, if appropriate and available, collected from newborn screenings to identify populations at risk for disorders affecting newborns, examine and respond to health concerns, recognize and address relevant environmental, behavioral, socioeconomic, demographic, and other relevant risk factors; and</text></subparagraph> 
<subparagraph id="HDDBF891C41884B729DFDCD1524351BFD"><enum>(E)</enum><text>carry out such other activities as the Secretary may determine necessary.</text></subparagraph></paragraph></subsection> 
<subsection id="H96A7EB7BA8CE49BFBDBE3900E883326F"><enum>(f)</enum><header>Reports to Congress</header> 
<paragraph id="HD9510A45CD4C4952899F38264B00F5D1"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Secretary shall submit to the appropriate committees of Congress reports—</text> 
<subparagraph id="HA752E0ED561541F79F0393933FDF79F0"><enum>(A)</enum><text>evaluating the effectiveness and the impact of the grants awarded under this section—</text> 
<clause id="H8235A346D8A94D91BA95A2F82CD7DE5"><enum>(i)</enum><text>in promoting newborn screening—</text> 
<subclause id="H0E1F366821B0440681FF655B39E1AAC1"><enum>(I)</enum><text>education and resources for families; and</text></subclause> 
<subclause id="HD40715A51F1C493F8F788E67C5B30FE"><enum>(II)</enum><text>education, resources, and training for health care professionals;</text></subclause></clause> 
<clause id="HE51B4CCC0C184B3C9F8E1B276DA11EFF"><enum>(ii)</enum><text>on the successful diagnosis and treatment of congenital, genetic, and metabolic disorders; and</text></clause> 
<clause id="H890CE33F585F4E3CB8DF7FC7B4C2CB"><enum>(iii)</enum><text>on the continued development of coordinated systems of followup care after newborns are screened;</text></clause></subparagraph> 
<subparagraph id="H18A287A4DC7D46AFAE8DF024264D50B3"><enum>(B)</enum><text>describing and evaluating the effectiveness of the activities carried out with grant funds received under this section; and</text></subparagraph> 
<subparagraph id="H26766F2E6CF24B1FA0DBD25EEC4DBDC9"><enum>(C)</enum><text>that include recommendations for Federal actions to support—</text> 
<clause id="HE5F2B52705754E819DE4817492A6F9AA"><enum>(i)</enum><text>education and training in newborn screening; and</text></clause> 
<clause id="H68BA07D3E6A64EEABB09D04EE34E826"><enum>(ii)</enum><text>followup care after newborns are screened.</text></clause></subparagraph></paragraph> 
<paragraph id="HA72C6CB7C7FF46A9A4ED54A8994DC62"><enum>(2)</enum><header>Timing of reports</header><text>The Secretary shall submit—</text> 
<subparagraph id="H4F57B5CFE09E4AD5983354A2BFD16367"><enum>(A)</enum><text>an interim report that includes the information described in paragraph (1), not later than 30 months after the date on which the first grant funds are awarded under this section; and</text></subparagraph> 
<subparagraph id="HD7847C38CF4847DB8B399E004DE91655"><enum>(B)</enum><text>a subsequent report that includes the information described in paragraph (1), not later than 60 months after the date on which the first grant funds are awarded under this section.</text></subparagraph></paragraph></subsection> 
<subsection id="H2D9E25DFD7F349A5B3C1256EB61DDAEE"><enum>(g)</enum><header>Definition of eligible entity</header><text>In this section, the term <term>eligible entity</term> means—</text> 
<paragraph id="H1732CE52FFA9450DB005E67697EACC22"><enum>(1)</enum><text>a State or a political subdivision of a State;</text></paragraph> 
<paragraph id="H9BF2B82706F24B3AA6FFC0E836F7396E"><enum>(2)</enum><text>a consortium of 2 or more States or political subdivisions of States;</text></paragraph> 
<paragraph id="HED612BE91D324B0E85C24098C3E2968E"><enum>(3)</enum><text>a territory;</text></paragraph> 
<paragraph id="H0C3F105B0AE7455AA6CEBC38781E80CB"><enum>(4)</enum><text>an Indian tribe or a hospital or outpatient health care facility of the Indian Health Service; or</text></paragraph> 
<paragraph id="HA0A8D84EF561498DACB127BE97DC0045"><enum>(5)</enum><text>a nongovernmental organization with appropriate expertise in newborn screening, as determined by the Secretary.</text></paragraph></subsection> 
<subsection id="H965BE66CB7BE4FCCBE3F63EF51EF87D7"><enum>(h)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section—</text> 
<paragraph id="H772619C638ED4C70BA11B465C19BD2C5"><enum>(1)</enum><text>$15,000,000 for fiscal year 2005; and</text></paragraph> 
<paragraph id="HDC1E0B043E8944F9930990C5E424D1B7"><enum>(2)</enum><text>such sums as may be necessary for each of fiscal years 2006 through 2009.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
