<official-title>To provide for acquisition of subsurface mineral rights to land owned by the Pascua Yaqui Tribe and land held in trust for the Tribe, and for other purposes.</official-title>

<section id="H7E35865325CE4F1AB6E199B283B9C8D2" section-type="section-one"><enum>1.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act, the following definitions apply:</text> 
<paragraph display-inline="no-display-inline" id="H4096A2780A21486198AF8ECEB5DA4465"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="H98E25D348C7344B784BC7ED9B2FC010"><enum>(2)</enum><header>State</header><text>The term <term>State</term> means the State of Arizona. </text></paragraph> 
<paragraph id="H1EB5457CC2624A08B680B617E69205F4"><enum>(3)</enum><header>Tribe</header><text>The term <term>Tribe</term> means the Pascua Yaqui Tribe.</text></paragraph></section> 
<section id="H5F823CC3EA1845519ECC9F91C2254289"><enum>2.</enum><header>Acquisition of subsurface mineral interests from the State for the Tribe</header> 
<subsection id="H2DCFE3E88D474108B61D00D677CE55DC"><enum>(a)</enum><header>Acquisition authorized</header><text>The Secretary shall acquire, by use of the powers of eminent domain, and the Department of Justice is authorized to act on behalf of the Secretary to do so, pursuant to the laws and regulations of the United States governing use of the power of eminent domain, but only with the consent of the State, the following:</text> 
<paragraph id="H7B0CA507CB954B07924142AD33F6A920"><enum>(1)</enum><text>Any trust mineral estate of the State located beneath the surface estates of the Tribe in land consisting of approximately 436.18 acres in Pima County, Arizona.</text></paragraph> 
<paragraph id="H804E25C1900F4A88BCEB8F61E680CF82"><enum>(2)</enum><text>Any trust mineral estate of the State located beneath the surface estates held in trust for the Tribe in land consisting of approximately 140.18 acres in Pima County, Arizona. </text> </paragraph></subsection> 
<subsection id="H77B02C76E12248DD95B321F6BB61DA48"><enum>(b)</enum><header>Consideration</header><text>Subject to subsection (c), as consideration for the acquisition of subsurface mineral interests by the United States pursuant to subsection (a), the Tribe shall pay to the State an amount equal to the market value of those subsurface mineral interests as determined by—</text> 
<paragraph id="H57F08F70FF3E4DFFBE332B41B18366AE"><enum>(1)</enum><text>a mineral assessment completed—</text> 
<subparagraph id="HEFD1E4E3DDE746EF9F95526B1B4593E8"><enum>(A)</enum><text>by a team of mineral specialists agreed upon by the State and the Tribe; and</text></subparagraph> 
<subparagraph id="H59BD735B4A924225BCE2D400C16EFB"><enum>(B)</enum><text>reviewed, and accepted as complete and accurate by a certified review mineral examiner of the Bureau of Land Management;</text></subparagraph></paragraph> 
<paragraph id="H6FC125C068EE4001BADA076EB3C7B133"><enum>(2)</enum><text display-inline="yes-display-inline">negotiation between the Tribe and the State in order to arrive at a mutually agreed price; or</text></paragraph> 
<paragraph id="H1B353270ECE24B469197078930435CC"><enum>(3)</enum><text display-inline="yes-display-inline">in the event the Tribe and the State cannot arrive at a mutually agreed price, an appraisal report completed in accordance with subsection (d)—</text> 
<subparagraph id="H767AB2AFC54A4B3B9DFCC10364B0A737"><enum>(A)</enum><text>by the State and reviewed by the Tribe; and</text></subparagraph> 
<subparagraph id="H73538037806B43DFAD78A9EBB718B120"><enum>(B)</enum><text display-inline="yes-display-inline">if requested by the Tribe through the Bureau of Indian Affairs, reviewed and accepted as complete and accurate by the Office of the Special Trustee for American Indians in the Department of the Interior.</text></subparagraph></paragraph></subsection> 
<subsection id="H8252B31A3C7F464FBB5D5F68AAA5554"><enum>(c)</enum><header>Conditions of acquisition</header><text>The Secretary may make the acquisition under subsection (a) only if—</text> 
<paragraph id="H375F6469A55A4CF00099DB1F34F10076"><enum>(1)</enum><text>the payment to the State required under subsection (b) is accepted by the State as full consideration for the subsurface mineral interests acquired by the United States under subsection (a); and</text></paragraph> 
<paragraph id="HC742199E601740D3A28CC3607DB41C32"><enum>(2)</enum><text>the acquisition terminates all right, title, and interest of all parties other than the United States in and to the acquired subsurface mineral interests.</text></paragraph></subsection> 
<subsection id="H52CC7E5DBFC0445581AB4E26F005995"><enum>(d)</enum><header>Determination of market value</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, unless State and Tribe shall otherwise agree to a stipulated market value, the value of the subsurface mineral interests acquired by the United States under this section shall be determined in accordance with the Uniform Appraisal Standards for Federal Land Acquisition, as published by the Appraisal Institute in 2000 in cooperation with the Department of Justice. Any appraisal shall be subject to the review and acceptance by the Land Department of the State and the Office of Special Trustee for American Indians in the Department of the Interior. </text></subsection> 
<subsection id="H89C49B3EBEB444518342D7CA3BA54123"><enum>(e)</enum><header>Description of land</header><text>The exact acreage and legal descriptions of the land and interests in land acquired by the United States under this section shall be determined by surveys that are satisfactory to the Secretary and the State.</text></subsection> 
<subsection id="H664E6FCD70884D9A910061233B3E06CE"><enum>(f)</enum><header>Additional terms and conditions</header><text>The Secretary may require such additional terms and conditions in connection with the acquisition of subsurface interests in land under this section as the Secretary considers appropriate to protect the interests of the United States and any valid existing rights.</text></subsection></section> 
<section id="HBF738789A54946868595C67B00641C07"><enum>3.</enum><header>Interests in land taken into trust for the Tribe</header> 
<subsection id="H731D82407B1C45AA82DCBDB1834919A3"><enum>(a)</enum><header>Land transferred</header><text>Notwithstanding any other provision of law, after the Tribe makes the payment described in subsection (b), the Secretary shall take into trust for the benefit of the Tribe the subsurface rights, formerly reserved to the United States, to the approximately 360.23 acres of land located in Pima County, Arizona, the surface rights to which are held in trust for the benefit of the Tribe.</text></subsection> 
<subsection id="H5A0AD92FC5BF42C9BB894D9317FB3154"><enum>(b)</enum><header>Consideration and costs</header><text display-inline="yes-display-inline">The Tribe shall pay to the Secretary all transaction costs associated with assessment, review, and transfer of the interest in the estate authorized to be taken into trust pursuant to subsection (a).</text></subsection> 
<subsection id="HB1BC496D86874BF4B825946108925749"><enum>(c)</enum><header>Determination of fair market value</header><text>Notwithstanding any other provision of law, unless the Secretary and the Tribe agree to a stipulated fair market value, the value of the subsurface mineral interests taken into trust under this section shall be determined in accordance with the Uniform Appraisal Standards for Federal Land Acquisition, as published by the Appraisal Institute in 2000 in cooperation with the Department of Justice.</text></subsection> 
<subsection id="H54E7D8864E1F4021BFEBD226F0430082"><enum>(d)</enum><header>Description of land</header><text>The exact acreage and legal description of the land described in subsection (a) shall be determined by the Secretary.</text></subsection></section>
