<official-title>To amend the Marine Protection, Research, and Sanctuaries Act of 1972 to prohibit the dumping of dredged material in certain bodies of water.</official-title>

<section id="HD869BB38088D48A485089D32C406A87E" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Long Island Sound Protection Act</short-title></quote>.</text></section> 
<section id="HC6D8FBFA6DD9462DBFD95900EAED9DE7"><enum>2.</enum><header>Prohibition on dumping of dredged material</header><text display-inline="no-display-inline">Section 106 of the Marine Protection, Research, and Sanctuaries Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/33/1416">33 U.S.C. 1416</external-xref>) is amended by striking subsection (f) and inserting the following:</text>

<subsection id="H6FA39585B25842188283C847C63C82F4"><enum>(f)</enum><header>Prohibition on dumping of dredged material</header> 
<paragraph id="HB37354E81F754C78A2EDC7B3D42F8892"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="H1148A1AE668742EB8231D5AF18ADADEC"><enum>(A)</enum><header>Covered body of water</header><text>The term <term>covered body of water</term> means—</text> 
<clause id="H2F78FAB360AC45CC8D764E4E99AE595F"><enum>(i)</enum><text>Long Island Sound;</text></clause> 
<clause id="HE9124CE36F664502867F8C631989BC0"><enum>(ii)</enum><text>Fisher's Island Sound;</text></clause> 
<clause id="HFDACAE5E76154F6DB3BDBB9EB29D00BC"><enum>(iii)</enum><text>Block Island Sound; </text></clause> 
<clause id="H9046844F0B274335971C87826BBB5998"><enum>(iv)</enum><text>Peconic Bay; and</text></clause> 
<clause id="H9BA38949952E4AB181F2E8CBF8F87E8"><enum>(v)</enum><text>any harbor or tributary of a body of water described in any of clauses (i) through (iv).</text></clause></subparagraph> 
<subparagraph id="H8E316221B57448BE8F82281BFEA1F59"><enum>(B)</enum><header>Covered project</header><text>The term <term>covered project</term> means—</text> 
<clause id="HB106A90F03824862A9FF3C2B2B7DD3C6"><enum>(i)</enum><text> any Federal dredging project (or any project conducted for a Federal agency pursuant to Federal authorization);</text></clause> 
<clause id="H4F59DCA42885461EABB65229DA61311D"><enum>(ii)</enum><text> a dredging project carried out by a non-Federal entity that results in the production of more than 25,000 cubic yards of dredged material; and</text></clause> 
<clause id="H1C9A8CB43F924666933F8E3D592700B5"><enum>(iii)</enum><text>any of 2 or more dredging projects carried out by 1 or more non-Federal entities in a covered body of water, simultaneously or sequentially within a 180-day period, that result, in the aggregate, in the production of more than 25,000 cubic yards of dredged material.</text></clause></subparagraph> 
<subparagraph id="HD7F048F8BBCF41549FA41F883FB212B"><enum>(C)</enum><header>Plan</header><text>The term <term>plan</term> means the dredged material management plan required under paragraph (5).</text></subparagraph></paragraph> 
<paragraph id="H3AAC5521A7C547E9A775CAF226D3D15B"><enum>(2)</enum><header>Prohibition</header><text>No dredged material from any covered project shall be dumped, or transported for the purpose of dumping, into any covered body of water unless and until the dredged material is determined by the Administrator—</text> 
<subparagraph id="H9FA7F9CB977B4F7DA1DC74821D760259"><enum>(A)</enum><text>to have, or to cause (including through bioaccumulation), concentrations of chemical constituents that are not greater than those concentrations present in the water column, sediments, and biota of areas proximate to, but unaffected by, the proposed disposal site; and</text></subparagraph> 
<subparagraph id="HBAEC747ECFD745AE8631D52E2067464D"><enum>(B)</enum><text>to meet all requirements under this title (including the trace contaminant provision under <external-xref legal-doc="cfr" parsable-cite="cfr/40/227.6">section 227.6</external-xref> of title 40, Code of Federal Regulations (or a successor regulation), and requirements under other regulations promulgated under section 108).</text></subparagraph></paragraph> 
<paragraph id="H0E8B94CEEED1424E8321C5533EC07BD"><enum>(3)</enum><header>Designation of sites</header><text>No dredged material shall be dumped, or transported for the purpose of dumping, into any covered body of water except—</text> 
<subparagraph id="H2C4BA1524C534746B59068E5B6541029"><enum>(A)</enum><text>at a site designated by the Administrator in accordance with section 102(c); and</text></subparagraph> 
<subparagraph id="H97AE0389279C4D10009266DB8156E7B"><enum>(B)</enum><text>upon a determination by the Administrator, following approval of the plan required under paragraph (5)(F), that no feasible alternative to ocean disposal, including sediment remediation, beneficial reuse, and land-based alternatives, is available prior to the time of designation.</text></subparagraph></paragraph> 
<paragraph id="H4F1FAC2F29644AF8BDA74F745F495B6F"><enum>(4)</enum><header>Relationship to other law</header> 
<subparagraph id="HBEA51FCCF66C455D00DDBA3F81A1BFB0"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), this title applies to each covered body of water.</text></subparagraph> 
<subparagraph id="H7A3681DB4D3F40948E2BDCAC049EF16"><enum>(B)</enum><header>Exception</header><text>No waiver under section 103(d) shall be available for the dumping of dredged material in any covered body of water. </text></subparagraph></paragraph> 
<paragraph id="H8BE6ED8F2E43422183931F4B9EA2869D"><enum>(5)</enum><header>Dredged material management plan</header> 
<subparagraph id="HA3B62126CA7C46AAB44DF90701058A2"><enum>(A)</enum><header>In general</header><text>Before designation of any dredged material disposal site in a covered body of water, the Secretary and the Administrator, in consultation with the United States Fish and Wildlife Service, the National Marine Fisheries Service, the Coast Guard, and the States of Connecticut and New York, shall—</text> 
<clause id="H1A1DE7CE76FC4BCAA7539E12FA34004F"><enum>(i)</enum><text> develop a dredged material management plan for the management of all dredged sediment in the covered bodies of water; and</text></clause> 
<clause id="HD45AFB52C11F452EB5422E4085014C81"><enum>(ii)</enum><text> submit the plan to Congress and the Governors of the States of Connecticut and New York.</text></clause></subparagraph> 
<subparagraph id="HFF0E88C4AF5B42FA8EDD196E96E4EBA7"><enum>(B)</enum><header>Objectives</header><text>The objectives of the plan shall be— </text> 
<clause id="H4EB8F1E164E34050ABCEF545DCC012A1"><enum>(i)</enum><text> to identify sources, quantities, and the extent of contamination of dredged material that requires disposal; </text></clause> 
<clause id="H3520047979A24BCCAD61708139E60078"><enum>(ii)</enum><text> to determine management actions that are to be taken to reduce sediment and contaminant loading of dredged areas; </text></clause> 
<clause id="HFDC10EADC89841BBB19848DDE68D6D71"><enum>(iii)</enum><text>to thoroughly assess alternative locations, treatment technologies, and beneficial uses for dredged material;</text></clause> 
<clause id="HA546218D5A214EBDAD9D8147F250D728"><enum>(iv)</enum><text>to ensure that dumping is the disposal option of last resort for dredged material and is used only after all other options have been exhausted; </text></clause> 
<clause id="HAC7BCAEAEE0342A180C5D0AEA3601571"><enum>(v)</enum><text>to secure—</text> 
<subclause id="H0B1968A2804F47D98227E0570047D1B5"><enum>(I)</enum><text> alternative methods of disposal of dredged materials, including decontamination technologies; and</text></subclause> 
<subclause id="H07D2898B174F492CB5F81200BECBC96"><enum>(II)</enum><text> alternative uses of materials, including upland disposal, containment, beach nourishment, marsh restoration, habitat construction, and other beneficial reuses; and</text></subclause></clause> 
<clause id="H9BD219FED4EE4686822200D2A21E542D"><enum>(vi)</enum><text>to confirm the specific roles of Federal, State, and local agencies with respect to various aspects of dredged material management.</text></clause></subparagraph> 
<subparagraph id="H39326BD147B54894A56EDA582C255400"><enum>(C)</enum><header>Requirements</header><text>The plan shall include environmental, economic, and other analysis required to meet the objectives listed in subparagraph (B), including—</text> 
<clause id="HAEF668C513674DC5BE0060BF530001F2"><enum>(i)</enum><text>an analysis of strategies to reduce sediment loading of harbors and navigation areas;</text></clause> 
<clause id="HB758F85E61D746438DF6DF4E2BB08239"><enum>(ii)</enum><text>an analysis of sources of sediment contamination, including recommendations for management measures to limit or reduce those contamination sources;</text></clause> 
<clause id="HC14CB74AE8294B79880060917479A8D7"><enum>(iii)</enum><text> an analysis of options for reducing dredging needs through modification of navigation strategies;</text></clause> 
<clause id="HA7891E89DC794932AFCF9300001F6C94"><enum>(iv)</enum><text>an analysis of decontamination technologies, including subsequent alternative uses of decontaminated materials (such as upland disposal, containment, beach nourishment, marsh restoration, and habitat construction); and</text></clause> 
<clause id="HC87E9055A784409AA85B10247E7EA6A6"><enum>(v)</enum><text>a program for use of alternative methods of disposal and use of dredged material, including alternatives to dumping or dispersal in a covered body of water.</text></clause></subparagraph> 
<subparagraph id="H978ADB76B86949C0AEC317AC3934D0E3"><enum>(D)</enum><header>Public input</header><text>The Secretary and the Administrator shall—</text> 
<clause id="HBE628434292047339796710046E7B985"><enum>(i)</enum><text> during the development of the plan, hold in the States of Connecticut and New York a series of public hearings on the plan; and</text></clause> 
<clause id="H66D6EEBB2E314A74BBB3AA20D8FCA0B2"><enum>(ii)</enum><text> append to the plan a summary of the public comments received.</text></clause></subparagraph> 
<subparagraph id="HF16F97D625FC44D892824F1446AF19B3"><enum>(E)</enum><header>Support</header><text>Each of the Federal agencies referred to in subparagraph (A) shall provide such staff support and other resources as are necessary to carry out this paragraph.</text></subparagraph> 
<subparagraph id="H324126E8659543460068A8349C61EBDB"><enum>(F)</enum><header>Approval by connecticut and new york</header> 
<clause id="H91C4DAA82BD44E2FB3E0B3F587C248B2"><enum>(i)</enum><header>In general</header><text>Not later than 60 days after the date of receipt of the plan, the Governors of the States of Connecticut and New York shall notify the Secretary and the Administrator of whether the States approve or disapprove the plan.</text></clause> 
<clause id="HA4EAD9C9F4C54A429B95C8AAF0193641"><enum>(ii)</enum><header>Dumping of dredged material</header><text>No dredged material from a covered project may be dumped, or transported for the purpose of dumping, in any covered body of water unless the dredged material—</text> 
<subclause id="H556EDEC688D449498D81D4BFAF46D028"><enum>(I)</enum><text>conforms to a plan that has been approved by the Governors of the States of Connecticut and New York; and</text></subclause> 
<subclause id="HFFC63E40AE814C5AA0CB55C2A896B748"><enum>(II)</enum><text> is to be dumped in a dredged material disposal site designated by the Administrator under this title.</text></subclause></clause> 
<clause id="HF23447E9E0144075BC5C9D0051EA45F8"><enum>(iii)</enum><header>Finality</header><text>No dredged material disposal plan shall become final until the plan has been approved by the States of Connecticut and New York under clause (i).</text></clause> 
<clause id="H6D66330D73AE40AD96EE395203CE10E2"><enum>(iv)</enum><header>Previously designated sites</header><text>No dredged material disposal site in any covered body of water that was designated before the date of enactment of this clause shall be used for dumping of dredged material from a covered project until the plan has been approved by the States of Connecticut and New York under clause (i).</text></clause></subparagraph> 
<subparagraph id="HDE4319D21DE048C2A124A5044730B170"><enum>(G)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this paragraph $5,000,000 for each of fiscal years 2005 and 2006.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
