<official-title>To amend the Uniform Services Employment and Reemployment Rights Act of 1994 to require employers to post a notice of the rights and duties that apply under that Act.</official-title>

<section section-type="section-one" id="H7EAB75E5429E44D3A015CB655273B30" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Patriotic Employer Act of 2004</short-title></quote>.</text></section>
<section id="H228C6CA572434C2893702BC64553B100"><enum>2.</enum><header>Requirement for employers to post notice of rights and duties under USERRA</header>
<subsection id="HCAC4051065C248ACB52F7FBC9E1251DD"><enum>(a)</enum><header>Notice</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/43">Chapter 43</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text>

<section id="HE300485746884AD9991CF174B895B60"><enum>4334.</enum><header>Notice of rights and duties</header>
<subsection id="H860D8B68CA6A4C4D885EBF07DFC010BF"><enum>(a)</enum><header>Requirement to post notice</header><text>Each employer shall post in a conspicuous place in the place of employment for persons entitled to rights and benefits under this chapter a notice of the rights, benefits, and obligations of such persons and such employers under this chapter.</text></subsection>
<subsection id="H50E518120E7445898D9500BE902AD80"><enum>(b)</enum><header>Content of notice</header><text>The Secretary shall provide to employers the text of the notice to be provided under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HD505F86CBE2F4F2B009E6929863C0000"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>

<subsection id="H3961F58416CC40BFA979C7FF49B047DA"><enum>(c)</enum><header>Implementation</header>
<paragraph display-inline="yes-display-inline" id="H3A1FD5E684324753BBCA9D4932BD54D"><enum>(1)</enum><text>Not later than the date that is 90 days after the date of the enactment of this Act, the Secretary of Labor shall make available to employers the notice required under <external-xref legal-doc="usc" parsable-cite="usc/38/4334">section 4334</external-xref> of title 38, United States Code, as added by subsection (a).</text></paragraph>
<paragraph indent="up1" id="H542F4368F9324705B4E02D6264DB3361"><enum>(2)</enum><text>The amendments made by this section shall apply to employers under chapter 43 of such title on and after the first date referred to in paragraph (1).</text></paragraph></subsection></section>
