<official-title>To prohibit discrimination on the basis of certain factors with respect to any aspect of a surety bond transaction.</official-title>

<section section-type="section-one" id="H8C4911294E854D570037479F0609F5FF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="H80C0D0FA6BEF42DCB430E2A07D40646D"><enum>2.</enum><header>Equal surety bond opportunity requirements</header> 
<subsection id="HC820A0F614F346BDA6793084B8F09128"><enum>(a)</enum><header>Activities constituting discrimination</header><text>It shall be unlawful for any surety to discriminate against any applicant, with respect to any aspect of a surety bond transaction—</text> 
<paragraph id="H24A3D06967CB45378195077C89D63E54"><enum>(1)</enum><text>on the basis of race, color, religion, national origin, sex, marital status, sexual orientation, disability, or age (if the applicant has the capacity to contract);</text></paragraph> 
<paragraph id="H3846EF839ED2457B98F0C4284BB086E1"><enum>(2)</enum><text>because the applicant has in good faith exercised any right under this Act;</text></paragraph> 
<paragraph id="H70F4981998F248E3B4D050B1FF71012D"><enum>(3)</enum><text>because the applicant previously obtained a bond through an individual or personal surety; or</text></paragraph> 
<paragraph id="H7D9756C8C1114E2CA1DBE8873DC6AE8F"><enum>(4)</enum><text>because the applicant previously obtained a bond through—</text> 
<subparagraph id="HF815B828FED6425E8911F2E9489B1665"><enum>(A)</enum><text>any bonding assistance program expressly authorized by law;</text></subparagraph> 
<subparagraph id="H9D4A5990A15647B4A7ACA21BAEC07BF"><enum>(B)</enum><text>any bonding assistance program administered by a nonprofit organization for its members or an economically disadvantaged class of persons; or</text></subparagraph> 
<subparagraph id="HF7E9F8E3385B48F99700EFDABDE94DB9"><enum>(C)</enum><text>any special purpose bonding program offered by a profit-making organization to meet special needs.</text></subparagraph></paragraph></subsection> 
<subsection id="H030C12F7373541A3BEAD7B47FB6BCCCD"><enum>(b)</enum><header>Activities not constituting discrimination</header><text>It shall not constitute discrimination for purposes of this Act for a surety—</text> 
<paragraph id="H4C85862C3F0343519F6672B750A65B9E"><enum>(1)</enum><text>to make an inquiry of marital status if such inquiry is for the purpose of ascertaining the surety’s rights and remedies applicable to the granting of a bond and not to discriminate in a determination of bondability;</text></paragraph> 
<paragraph id="HF731A347783D4261A33EB7FFC4C25800"><enum>(2)</enum><text>to make an inquiry of the applicant’s age if such inquiry is for the purpose of determining the amount and probable continuance of bondability; or</text></paragraph> 
<paragraph id="H14A1CA0B35C842E90069AF93C2C4A3BB"><enum>(3)</enum><text>to make an inquiry as to where the applicant has previously obtained a bond, in order to determine bonding history, or other pertinent element of bondability, except that an applicant may not be assigned a negative factor or value because the applicant previously obtained a bond through—</text> 
<subparagraph id="H3F507BF79EDA4973AB135200EC72D66"><enum>(A)</enum><text>an individual or personal surety;</text></subparagraph> 
<subparagraph id="H0835CA3D9EC04C1EA5699284ED00D5D2"><enum>(B)</enum><text>a bonding assistance program expressly authorized by law;</text></subparagraph> 
<subparagraph id="H1E5CCA3AB12E46BB86A7B1B232C653D5"><enum>(C)</enum><text>any bonding program administered by a nonprofit organization for its members or an economically disadvantaged class of persons; or</text></subparagraph> 
<subparagraph id="H6D3804015EF44110BAE788F1549B43AD"><enum>(D)</enum><text>any special purpose bonding program offered by a profit-making organization to meet special needs.</text></subparagraph></paragraph></subsection> 
<subsection id="H811413ED76984B18A2DCAC68835F00B5"><enum>(c)</enum><header>Additional activities not constituting discrimination</header><text>It is not a violation of this Act for a surety to refuse to issue a bond pursuant to—</text> 
<paragraph id="H0BBAA6863AF64C12B4440098BF7A9F"><enum>(1)</enum><text>any bonding assistance program authorized by law for an economically disadvantaged class of persons;</text></paragraph> 
<paragraph id="H9FDE80E4298D4F0AA0B1C7EC1FD4D4D"><enum>(2)</enum><text>any bonding assistance program administered by a nonprofit organization for its members or an economically disadvantaged class of persons; or</text></paragraph> 
<paragraph id="H5ED994930EA04AE88F00097E44C2D791"><enum>(3)</enum><text>any special purpose bonding program offered by a profit-making organization to meet special needs;</text></paragraph><continuation-text continuation-text-level="subsection">if such refusal is required by or made pursuant to such program.</continuation-text></subsection> 
<subsection id="H00F19BE2763445A69B275EC5EEF4674"><enum>(d)</enum><header>Reasons for adverse action; procedure applicable; definition</header> 
<paragraph id="H83C03EFDBD5E45A59067E1FAC0AAF0C4"><enum>(1)</enum><header>Notice required</header> 
<subparagraph id="HE106E5B8849D4DF6A455F95D92A3E3E6"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), any surety approved under <external-xref legal-doc="usc" parsable-cite="usc/31/9304">section 9304</external-xref> of title 31, United States Code, shall notify an applicant of the surety’s action on a completed application before the end of the 10-day period beginning on the date the application is filed with the surety.</text></subparagraph> 
<subparagraph id="H622DDA77F866487D939F94D114283E37"><enum>(B)</enum><header>Extension</header><text>The 10-day period referred to in subparagraph (A) may be extended an additional 10 days if the surety has not issued a bond to the applicant during the 1-year period ending on the date the application is filed with the surety.</text></subparagraph></paragraph> 
<paragraph id="H62A8119D312A47ADA8803929FD7F1CC3"><enum>(2)</enum><header>Statement of reasons</header> 
<subparagraph id="H8011069DCBF24DC4BA3F4306266100F"><enum>(A)</enum><header>In general</header><text>Each applicant against whom adverse action is taken shall be entitled to a statement of reasons for such action from the surety.</text></subparagraph> 
<subparagraph id="HC933557B32344B748B90F4FAFD480076"><enum>(B)</enum><header>Acceptable forms of statement</header><text>A surety satisfies the requirement established under subparagraph (A) by—</text> 
<clause id="HE4A169299D5C4AA18F1BCF2667EEB319"><enum>(i)</enum><text>providing a statement of reasons in writing as a matter of course to applicants against whom adverse action is taken; or</text></clause> 
<clause id="H04D604024C484F45B74DE9EBA9A4055F"><enum>(ii)</enum><text>giving written notification of adverse action which discloses—</text> 
<subclause id="HE42DB944D6FF4EDC96AF6E45A805AD4F"><enum>(I)</enum><text>the applicant’s right to a statement of reasons within 30 days after receipt by the surety of a request made within 60 days after such notification; and</text></subclause> 
<subclause id="HDDC4B6451A9C4491A600DC3F55C81DDD"><enum>(II)</enum><text>the identity of the person or office from which such statement may be obtained.</text></subclause></clause></subparagraph> 
<subparagraph id="H29E8D066EADA491ABFA961D92B7B46D"><enum>(C)</enum><header>Oral statement permitted</header><text>Such statement may be given orally if the written notification advises the applicant of the applicant’s right to have the statement of reasons confirmed in writing on written request.</text></subparagraph></paragraph> 
<paragraph id="H756CFF16DA0645A08D588B19DC75F732"><enum>(3)</enum><header>Specificity of reasons</header><text>A statement of reasons meets the requirements of this Act only if it contains specific reasons for the adverse action taken.</text></paragraph> 
<paragraph id="HB379D4A00C79478F98CB8681066C7793"><enum>(4)</enum><header>Applicability in case of 3d party applications</header><text>In the case of a request to a surety by a third party to issue a bond directly or indirectly to an applicant, the notification and statement of reasons required by this section may be made directly by such surety, or indirectly through the third party, if the identity of the surety is disclosed to the applicant.</text></paragraph> 
<paragraph id="H5AE9C7355CFD40298BD1B88C6FD49D81"><enum>(5)</enum><header>Applicability in case of sureties which accept few applications</header><text>The requirements of paragraph (2), (3), or (4) may be satisfied by oral statements or notifications in the case of any surety who did not act on more than 100 applications during the calendar year in which the adverse action is taken.</text></paragraph></subsection> 
<subsection id="HD2546455563B4D2E8EBFE7F0CA2E32FD"><enum>(e)</enum><header>Adverse action defined</header><text>For purposes of this Act, the term <term>adverse action</term>—</text> 
<paragraph id="H1404C136FA6F43FCAB933850494E74EE"><enum>(1)</enum><text>means a denial of a bond, a change in the terms of an existing bonding arrangement, or a refusal to issue a bond in the amount or on substantially the terms requested; and</text></paragraph> 
<paragraph id="H9C9671C320E14DD00037DE2CB2B5F3F8"><enum>(2)</enum><text>does not include any refusal to issue an additional bond under an existing bonding arrangement where the applicant is in default, or where such additional bond would exceed a previously established bonding limit.</text></paragraph></subsection></section> 
<section id="H9336CC3740F944AABE6FB778E7250232"><enum>3.</enum><header>Civil liability</header> 
<subsection id="H188AF5D8B72F4B588933A08F72000026"><enum>(a)</enum><header>Damages</header><text>Any surety who fails to comply with section 2(a) shall be liable to the aggrieved applicant for—</text> 
<paragraph id="H220525C47E7B4E91A249EF299E4FA4E"><enum>(1)</enum><text>any actual damage sustained by such applicant (individually or as a member of a class); and</text></paragraph> 
<paragraph id="H200B3CC138384E2797DBB7F3FCD65913"><enum>(2)</enum><text>in the case of any successful action under this section, the costs of the action, together with reasonable attorney’s fees as determined by the court.</text></paragraph></subsection> 
<subsection id="H1F0E20D2171B4F6CAC8E9CDA8DE6396"><enum>(b)</enum><header>Equitable relief</header><text>Upon application by an aggrieved applicant, a court of competent jurisdiction may enjoin a surety from violating the requirements of this Act or grant such other equitable relief as the court determines to be appropriate to enforce such requirements.</text></subsection> 
<subsection id="H4BB4CC98ED524458A9A1095748D426F2"><enum>(c)</enum><header>Jurisdiction</header><text>Any action under this section may be brought in any United States district court, or in any other court of competent jurisdiction, within 1 year after the date of the occurrence of the violation involved.</text></subsection></section> 
<section id="H5B16FA2E8F884951B6745DFD271D371F"><enum>4.</enum><header>Administrative enforcement</header> 
<subsection id="H4D68963AC9E64BBCB042801EA4E241BA"><enum>(a)</enum><header>In general</header><text>A company may not be approved as a surety by the Secretary of the Treasury under <external-xref legal-doc="usc" parsable-cite="usc/31/9304">section 9304</external-xref> of title 31, United States Code, or provide any surety bond pursuant to such section unless such company maintains full compliance with the requirements of this Act.</text></subsection> 
<subsection id="HBB428A51AA814120A719D080E78008E"><enum>(b)</enum><header>Requirements relating to enforceability of Act</header> 
<paragraph id="H7FCA2031470A42BAAB6155088ED66116"><enum>(1)</enum><header>Signed statement of compliance with application</header><text><external-xref legal-doc="usc" parsable-cite="usc/31/9305">Section 9305(a)</external-xref> of title 31, United States Code, is amended—</text> 
<subparagraph id="HE6FAA63844D14371BDE536DE741D00A4"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (1);</text></subparagraph> 
<subparagraph id="HF7669E5425644E51944685EE008D671F"><enum>(B)</enum><text>by striking the period at the end of paragraph (2) and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="H5ABA702272E04EBCBC109FBD2D003DF7"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="HD7A03E16843E4C60925454E9F9515088"> 
<paragraph id="H687F183695A545709D9356CFE1E4D459"><enum>(3)</enum><text>a statement of compliance with the &short-title1; which is signed under penalty of perjury by the president and the secretary of the corporation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HEE7F99FA52774D06A176B234F38B85B"><enum>(2)</enum><header>Compliance as a condition for approval of application</header><text><external-xref legal-doc="usc" parsable-cite="usc/31/9305">Section 9305(b)</external-xref> of title 31, United States Code, is amended—</text> 
<subparagraph id="HF37E3D838A814C47832CC3BCEFEC3B1"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (2);</text></subparagraph> 
<subparagraph id="H14ECCFD752F6422099D371D200D1FA0"><enum>(B)</enum><text>by striking the period at the end of paragraph (3) and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="HDDBFAE57D2E84B4DAA9EFCDC506C34DD"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H5A39661128EC4733B7D019B0825CB752"><enum>(4)</enum><text>the corporation is in full compliance with the &short-title1;.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H68BA074EC2B743909BD81430FDF2251F"><enum>(3)</enum><header>Signed statement of compliance with quarterly reports</header><text><external-xref legal-doc="usc" parsable-cite="usc/31/9305">Section 9305(c)</external-xref> of title 31, United States Code, is amended by inserting <quote>and a statement of compliance with the &short-title1;</quote> before the period.</text></paragraph> 
<paragraph id="HDF9D25B9EED545C2A4CED41559DF69BF"><enum>(4)</enum><header>Enforcement authority of Secretary of the Treasury</header><text><external-xref legal-doc="usc" parsable-cite="usc/31/9305">Section 9305(d)</external-xref> of title 31, United States Code, is amended—</text> 
<subparagraph id="H993FCC71CB4E46DBB079762CA34EE360"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>or the provisions of the &short-title1;</quote> before the semicolon;</text></subparagraph> 
<subparagraph id="H1901D67CF1174840928C65A64E63FAF2"><enum>(B)</enum><text>by striking <quote>and</quote> at the end of paragraph (2);</text></subparagraph> 
<subparagraph id="H32674B1DB4524CC6A56FDE89C92B5A4"><enum>(C)</enum><text>by striking the period at the end of paragraph (3) and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="H87705F9152364C7EBF6CE9FEBC3E797D"><enum>(D)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="H86310EA6AFF8466D8CF7D8B73BD212A"> 
<paragraph id="H39A57FD552844536A1893876D4906D3E"><enum>(4)</enum><text>may, after the end of the 1-year period beginning on the effective date of any revocation under paragraph (1) of the authority of a surety corporation for noncompliance with the &short-title1;, reauthorize such corporation to provide surety bonds under section 9304.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H1BEC0CAA6192496C96FF772F2C4CEF8"><enum>(5)</enum><header>Revocation for failure to pay certain judgments</header><text><external-xref legal-doc="usc" parsable-cite="usc/31/9305">Section 9305(e)</external-xref> of title 31, United States Code, is amended—</text> 
<subparagraph id="HB5FB5B9FEE8A42E39C301BD8BCEDD5FF"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (1);</text></subparagraph> 
<subparagraph id="H2F707B40DCED46B8A2263CA4352FE24C"><enum>(B)</enum><text>by redesignating paragraph (2) as paragraph (3); and</text></subparagraph> 
<subparagraph id="HC9AA74359BFF46D38E3E0075D2DA4475"><enum>(C)</enum><text>by inserting after paragraph (1) the following new paragraph:</text> 
<quoted-block id="HCBC39559CFC34F6AB6B6D8FE98E3587C"> 
<paragraph id="HD81DEDE581DF43D887BEB9DCDDA9B007"><enum>(2)</enum><text>the corporation does not pay a final judgment or order against the corporation for noncompliance with the &short-title1; or fails to comply with any order under section 3(c) of such Act;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="H73F8143A62F1433D91D58342002B97F8"><enum>(c)</enum><header>Technical and conforming amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/31/9304">Section 9304(a)(3)</external-xref> of title 31, United States Code, is amended by inserting <quote>and section 4(a) of the &short-title1;</quote> before the period.</text></subsection> 
<subsection id="HB6AEAC98BACC4ED8895962BA9F642221"><enum>(d)</enum><header>Regulations</header> 
<paragraph id="HA65DAB12AD2B4E70ADB2120DC6E1B80"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall prescribe such regulations as may be necessary to carry out the purposes of this Act.</text></paragraph> 
<paragraph id="H4D2D19391FD64BF7B7F44CB216EA9B54"><enum>(2)</enum><header>Initial regulations</header><text>The initial regulations prescribed pursuant to paragraph (1) shall take effect at the earliest practicable date after the date of the enactment of this Act and not later than the end of the 1-year period beginning on such date of enactment.</text></paragraph></subsection></section> 
<section id="H876858E5FB5942CB92D2B19BE1EADEDF"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">Sections 2(d) and 4(a) shall take effect on the earlier of—</text> 
<paragraph id="HB686988A6F214AE48F3B4590EE50A00"><enum>(1)</enum><text>the effective date of the initial regulations prescribed pursuant to section 4(d); or</text></paragraph> 
<paragraph id="H95A38F28B1064BB19DF3A510AF6BEAB0"><enum>(2)</enum><text>the end of the 1-year period beginning on the date of the enactment of this Act.</text></paragraph></section>
