<official-title>To require designation of a senior official within the Office of Management and Budget as the Chief Privacy Officer, and for other purposes.</official-title>

<section id="H0CBD125E34CB495B850734AF00364F9B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote> or the <quote>SHIELD Privacy Act</quote>.</text></section> 
<section id="H7D547051BE5F46DFAF1CF090F823E9E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> 
<paragraph id="HF1B80832C9A841E68017E400DB6CA5D"><enum>(1)</enum><text>The protection of our Nation’s civil liberties and privacy is fundamental to the American way of life.</text></paragraph> 
<paragraph id="H80D9C695F2374124B1C7D15F31A188A9"><enum>(2)</enum><text>Strengthening our homeland security ensures that our way of life and the rights protected by the Constitution remain intact.</text></paragraph> 
<paragraph id="H49BD0DFFE73F4657B392751B9757615D"><enum>(3)</enum><text>In developing homeland security initiatives, our Government must take care to protect fundamental constitutional rights and strive to minimize unnecessary impositions on the freedoms and privileges enjoyed in the United States.</text> </paragraph> 
<paragraph id="H0281972818AD432BA782F28BC83898A1"><enum>(4)</enum><text>As governments develop and employ new technologies and gather information from the private sector for homeland security efforts, they must ensure that our society’s constitutional guarantees relating to privacy, due process, and civil liberties are protected.</text></paragraph></section> 
<section id="HBC32F774EAFB4914B2A080944F488B01"><enum>3.</enum><header>Chief Privacy Officer</header> 
<subsection id="H3E9F9282DDF04308BE6287A9028E73DE"><enum>(a)</enum><header>Designation</header><text>The President shall designate a senior official within the Office of Management and Budget as the Chief Privacy Officer, who shall have primary responsibility for privacy policy throughout the Federal Government.</text></subsection> 
<subsection id="H7D9092F7860D4F88B4A8607C2FEDC3AB"><enum>(b)</enum><header>Specific responsibilities</header><text>The responsibilities of the Chief Privacy Officer shall include the following:</text> 
<paragraph id="H96B616172F474BED9D214405722347A0"><enum>(1)</enum><text>Assuring that the technologies procured and use of technologies by the Federal Government sustain, and do not erode, privacy protections relating to the use, collection, and disclosure of personally identifiable information.</text></paragraph> 
<paragraph id="HB446447465444519AC5F9C02F6E5B818"><enum>(2)</enum><text>Assuring that personally identifiable information contained in systems of records (as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/5/552a">section 552a</external-xref> of title 5, United States Code, popularly known as the <quote>Privacy Act of 1974</quote>) is handled in full compliance with fair information practices required under that section.</text> </paragraph> 
<paragraph id="H8445B6D91C96417ABFC1464F7CBB2000"><enum>(3)</enum><text>Evaluating legislative and regulatory proposals involving collection, use, and disclosure of personally identifiable information by the Federal Government.</text></paragraph> 
<paragraph id="H5CA330901A984D2C9E8700B791AA519"><enum>(4)</enum><text>Exercising responsibility currently vested in the Director of the Office of Management and Budget with respect to privacy impact assessment rules, regulations, and oversight under section 208 of the E–Gov Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/44/3501">44 U.S.C. 3501</external-xref> note).</text></paragraph> 
<paragraph id="H580FB30F9A7B41E9B51CAF9D5EC8169D"><enum>(5)</enum><text>Preparing an annual report to the Congress containing an agency-by-agency analysis of Federal activities that affect privacy, including complaints of privacy violations, implementation of <external-xref legal-doc="usc" parsable-cite="usc/5/552a">section 552a</external-xref> of title 5, United States Code, internal controls, and other matters.</text> </paragraph></subsection> 
<subsection id="H37AFE9B9F4264C2FBD064C32217CC9F"><enum>(c)</enum><header>Agency information</header><text>The head of each Federal agency shall provide to the Chief Privacy Officer such information as the Chief Privacy Officer considers necessary for the completion of the annual reports under subsection (b)(5).</text></subsection> 
<subsection id="H3F752CE42F624C9AAF16DCDF8D3C44E0"><enum>(d)</enum><header>Report by Secretary of Homeland Security</header><text>Section 222(5) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/142">6 U.S.C. 142(5)</external-xref>) is amended by striking <quote>Congress</quote> and inserting <quote>the chief Privacy Officer of the Office of Management and Budget</quote>. </text> </subsection></section> 
<section id="HEB42211D17F448ACB804CBD52D4C8DBC"><enum>4.</enum><header>Privacy policy of departments and independent agencies</header> 
<subsection id="H1207E940DB10468E9D7279F290AF92C6"><enum>(a)</enum><header>Officials responsible for privacy policy</header><text>The head of each department and each independent agency in the executive branch shall appoint a senior official of the department or independent agency, respectively, to assure primary responsibility for privacy policy, including the following:</text> 
<paragraph id="H9FE7BA6E13BC4FC298A6C68E87472382"><enum>(1)</enum><text>Assuring that technologies procured and use of technologies sustain, and do not erode, privacy protections relating to the use, collection, and disclosure of personally identifiable information.</text></paragraph> 
<paragraph id="H58EC517959E843B599EAEB6B373E55E"><enum>(2)</enum><text>Assuring that personally identifiable information contained in systems of records (as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/5/552a">section 552a</external-xref> of title 5, United States Code, popularly known as the <quote>Privacy Act of 1974</quote>) is handled in full compliance with fair information practices required under that section.</text></paragraph> 
<paragraph id="H2F3FD9D4D2224A1280FA84C2BF5E61F8"><enum>(3)</enum><text>Evaluating legislative and regulatory proposals involving collection, use, and disclosure of personally identifiable information by the Federal Government.</text></paragraph> 
<paragraph id="HBE76A7913A484848AD923C5646E3EFD7"><enum>(4)</enum><text>Conducting privacy impact assessments under subsection (b).</text></paragraph> 
<paragraph id="H2B35831957F847BA004BD2F675075842"><enum>(5)</enum><text>Ensuring that the department or agency protects personally identifiable information and information systems from unauthorized access, use, disclosure, disruption, modification, or destruction in order to provide—</text> 
<subparagraph id="HF844AAAFC2424391BBFB4B7CE7B487DE"><enum>(A)</enum><text>integrity, by—</text> 
<clause id="HECD872232C31428FA21043133D3750E2"><enum>(i)</enum><text>guarding against improper information modification or destruction; and</text></clause> 
<clause id="HB6C3C8A5C819453B9D44FFD32C9EA104"><enum>(ii)</enum><text>ensuring information nonrepudiation and authenticity;</text></clause></subparagraph> 
<subparagraph id="H91DC2FC5204F454EB2F0BFCD31A5BC29"><enum>(B)</enum><text>confidentiality, by preserving authorized restrictions on access and disclosure, including means for protecting personal privacy and proprietary information;</text></subparagraph> 
<subparagraph id="HB3681DC8ED3842DBA66017BD005DF9D4"><enum>(C)</enum><text>availability, by ensuring timely and reliable access to and use of that information; and</text></subparagraph> 
<subparagraph id="H238659854D3C4FBA9E369B6523EF0018"><enum>(D)</enum><text>authentication, by utilizing digital credentials to assure the identity of users and validate their access.</text></subparagraph></paragraph> 
<paragraph id="H936114CC672B4255893927DEE3882CE3"><enum>(6)</enum><text>Submitting an annual report to the Director of the Office of Management and Budget on activities of their agencies that affect privacy, including complaints of privacy violations, implementation of <external-xref legal-doc="usc" parsable-cite="usc/5/552a">section 552a</external-xref> of title 5, United States Code, internal controls, and other matters.</text></paragraph></subsection> 
<subsection id="H18BE35480B5C4CF4834C23CD069DBFC2"><enum>(b)</enum><header>Privacy impact assessments</header><text></text> 
<paragraph id="HE6E953EB83094570B55C8FFE61072C63"><enum>(1)</enum><header>Requirement</header><text>The official appointed under subsection (a) for a department or independent agency shall—</text> 
<subparagraph id="HBE3419697C8B4F45A942B58405B5D211"><enum>(A)</enum><text>assess the impact on privacy of each proposed action of the Department or agency that will require collecting, using, or accessing personally identifiable information from 10 or more persons; and </text> </subparagraph> 
<subparagraph id="H2D65ADC6A40143E0001665A5005DB9F"><enum>(B)</enum><text>make the results of such assessments publicly available through the World Wide Web site of the Department.</text></subparagraph></paragraph> 
<paragraph id="H0BFDC357AFAC49DF91B5DA8C71066DC"><enum>(2)</enum><header>Matters considered</header><text>Each assessment under this subsection regarding a proposed action shall consider the following:</text> 
<subparagraph id="H6BC69927EF734246BFEE674F7F7A239"><enum>(A)</enum><text>The type of any personally identifiable information to be collected, used, or accessed by the Department.</text></subparagraph> 
<subparagraph id="HCC7F3E4EABDE43E390CB389E507244DD"><enum>(B)</enum><text>Why such information will be collected, used, or accessed.</text></subparagraph> 
<subparagraph id="H7188C5921D2C496CB64B41A4B2A57380"><enum>(C)</enum><text>The intended use of such information.</text></subparagraph> 
<subparagraph id="HBEA552C685D84C8FAD328DE15200E3B8"><enum>(D)</enum><text>The persons with whom such information will be shared.</text></subparagraph> 
<subparagraph id="HE0DC040EEA2644F500A80B82CB438F2"><enum>(E)</enum><text>What notice or consent will be provided to individuals regarding such information to be collected or accessed, and how that information will be shared.</text></subparagraph> 
<subparagraph id="H9F166DEE8F7B4E90BC4EE7C1C49E1B84"><enum>(F)</enum><text>How such information will be secured.</text></subparagraph> 
<subparagraph id="H1B7DC83876B14F138590D9BB8009935"><enum>(G)</enum><text>Whether a system of records will be created for purposes of <external-xref legal-doc="usc" parsable-cite="usc/5/552a">section 552a</external-xref> of title 5, United States Code.</text></subparagraph> 
<subparagraph id="HB302B146AFF144CDAA141004564679D9"><enum>(H)</enum><text>The method by which, extent to which, and rate at which such collected information will be destroyed or returned.</text></subparagraph></paragraph></subsection> </section> 
<section id="H60CA8BB1A8704AFB9307C8DF3ED32B18"><enum>5.</enum><header>Commission on Privacy, Freedom, and Homeland Security</header> 
<subsection id="HE6249398933E442D8EEEAB13F466C500"><enum>(a)</enum><header>Establishment</header><text>There is established a commission to be known as the <quote>Commission on Privacy, Freedom, and Homeland Security</quote>.</text></subsection> 
<subsection id="HE1E571C9C4BC4799B34239EA44CB6992"><enum>(b)</enum><header>Duties of commission</header> 
<paragraph id="HB53C6B69B9CC4BBC965D1B14D875CF58"><enum>(1)</enum><header>In general</header><text>The Commission shall conduct a comprehensive legal and factual study relating to United States efforts to further homeland security in a manner that protects privacy, civil liberties, and individual freedoms.</text></paragraph> 
<paragraph id="HEFEA0F0E9C35445FA16641537448E73D"><enum>(2)</enum><header>Matters to be studied</header><text>The matters studied by the Commission under paragraph (1) shall at a minimum include the following:</text> 
<subparagraph id="H159F61D5AF094E1983E463741BF95523"><enum>(A)</enum><text>A review of whether Federal agencies are properly assessing the privacy implications of new homeland security technologies before implementing and deploying such technologies.</text></subparagraph> 
<subparagraph id="H7F5099CD2A2340DB942060002E5DD6BC"><enum>(B)</enum><text>The impact of existing Federal and State privacy statutes and regulations, legislation pending before the Congress, and privacy protection efforts undertaken by the Federal Government, State governments, foreign governments, and international governing bodies on homeland security.</text></subparagraph> 
<subparagraph id="HA8B36EE17F014A6F961031AE98DA39E9"><enum>(C)</enum><text>The impact of Federal legislation enacted since September 11, 2001, or pending before the Congress, on civil liberties.</text></subparagraph> 
<subparagraph id="H0E5B9D34EEFD4F4ABFB31C5B006FA200"><enum>(D)</enum><text>The likely effectiveness of existing technologies for analyzing public and private sources of data and information to identify terrorists and prevent terrorist acts.</text></subparagraph> </paragraph> </subsection> 
<subsection id="HEAFFA28E81F34C758E6470FDA4512347"><enum>(c)</enum><header>Field hearings</header> 
<paragraph id="H4FB63A87A76F47A68F34A585F459D09C"><enum>(1)</enum><header>In general</header><text>The Commission shall conduct at least 2 field hearings in each of the 5 geographical regions of the United States.</text></paragraph> 
<paragraph id="HC0727F7D07DA49B989FBE5EDD557BCA7"><enum>(2)</enum><header>Determination of regions</header><text>For purposes of this subsection, the Commission may determine the boundaries of the 5 geographical regions of the United States.</text></paragraph></subsection> 
<subsection id="HDF499A042DC740D8B56612A2A071107B"><enum>(d)</enum><header>Report</header> 
<paragraph id="H28A2DF58B8E24333B09537AEF9B8FDE0"><enum>(1)</enum><header>In general</header><text>No later than 24 months after the date on which the Commission first meets, the Commission shall submit to the President and the Congress a comprehensive report of the Commission’s findings, recommendations, and conclusions. Such report shall include a summary of the report submitted to the Commission by the National Research Council under subsection (g)(9), and a summary of any other material relied on by the Commission in the preparation of its report.</text></paragraph> 
<paragraph id="H0E4BB6C86D03428F9419F7FB98E46B8"><enum>(2)</enum><header>Recommendations</header><text>The report under paragraph (1) shall include recommendations regarding the following:</text> 
<subparagraph id="HCC9958E9AE7845188D8531003F7817B9"><enum>(A)</enum><text>Steps Federal agencies should take when considering new homeland security technologies to ensure that privacy implications are adequately considered before such technologies are implemented.</text></subparagraph> 
<subparagraph id="H118B135AFAC8458B00D89221BE2B057C"><enum>(B)</enum><text> Whether additional legislation is necessary to reform or augment current laws and regulations relating to privacy and homeland security, including specific reform proposals and an analysis of the financial costs of any proposed changes.</text></subparagraph> 
<subparagraph id="H57797FAB94A543A580AFC2CB583C7608"><enum>(C)</enum><text> Safeguards and protection that should be in place when the Federal Government uses an individual’s personally identifiable information obtained from a commercial database or a list for counterterrorism and homeland security purposes.</text></subparagraph></paragraph> 
<paragraph id="H0B9B353789D94E4DA8E65F829EE17311"><enum>(3)</enum><header>Additional report</header><text>The Commission shall submit to the Congress and the President, with the report under paragraph (1), any additional report of dissenting opinions or minority views by any member of the Commission.</text></paragraph> 
<paragraph id="H7342CB66BB914AB6AE6E1990936C4F9B"><enum>(4)</enum><header>Interim report</header><text>The Commission may submit to the Congress and the President interim reports approved by a majority of the members of the Commission.</text></paragraph></subsection> 
<subsection id="H0A48586416DD410DAFB2DCFDFDA543C2"><enum>(e)</enum><header>Structure of Commission</header> 
<paragraph id="HB2DD3EB2C17E48BDA874EA50E3822B36"><enum>(1)</enum><header>Member and appointment</header><text>The Commission shall be composed of 10 members appointed as follows:</text> 
<subparagraph id="H3A7F5646E3724E8E9EC81DE622F02EF3"><enum>(A)</enum><text>1 member appointed by the President, who shall be the chairperson of the Commission.</text></subparagraph> 
<subparagraph id="H661CECF8F4164E909957504E69E0DB30"><enum>(B)</enum><text>1 member appointed jointly by the minority leader of the House of Representatives and the minority leader of the Senate, who shall be the vice chairperson of the Commission.</text></subparagraph> 
<subparagraph id="H071E9616154F4E20A5B195014F5BF538"><enum>(C)</enum><text>2 members appointed by the majority leader of the House of Representatives.</text></subparagraph> 
<subparagraph id="H583BA0DE260F463D8901710972247E4B"><enum>(D)</enum><text>2 members appointed by the minority leader of the House of Representatives.</text></subparagraph> 
<subparagraph id="H4E8CA4D12D334A2C87B5E90680493515"><enum>(E)</enum><text>2 members appointed by the majority leader of the Senate.</text></subparagraph> 
<subparagraph id="H7B11E2EE2B434CB3B9E4604F985294C4"><enum>(F)</enum><text>2 members appointed by the minority leader of the Senate.</text> </subparagraph></paragraph> 
<paragraph id="H9A5AA0A7165746A9A823CEF234DAA4"><enum>(2)</enum><header>Qualifications of members</header><text>The appointing authorities under subsection (1) shall seek to ensure that the membership of the Commission has a diversity of views and experiences on the matters to be studied by the Commission, including views and knowledge of law, civil rights and liberties, privacy matters, homeland security, information technology, security, database integration, and law enforcement.</text></paragraph> 
<paragraph id="H4B8CB244949E41689349204390EF049B"><enum>(3)</enum><header>Date of appointment</header><text>The appointment of the members of the Commission shall be made not later than 30 days after the date of the enactment of this Act.</text></paragraph> 
<paragraph id="HD66C1D1096144FDBB7A413C48BCEB3C"><enum>(4)</enum><header>Terms</header><text>Each member of the Commission shall be appointed for the life of the Commission.</text></paragraph> 
<paragraph id="H0C60E46E50C7496F8CB673483785B7B5"><enum>(5)</enum><header>Vacancies</header><text>Any vacancy in the Commission shall be filled in the same manner in which the original appointment was made.</text></paragraph> 
<paragraph id="H9C051AB4022C4BECBA7E777F6C21044F"><enum>(6)</enum><header>Compensation; travel expenses</header><text>Members of the Commission shall serve without pay, but shall receive travel expenses, including per diem in lieu of subsistence, in accordance with sections <external-xref legal-doc="usc" parsable-cite="usc/5/5702">5702</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/5/5703">5703</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="H66AF03A681F1494FA13F33449B51E576"><enum>(7)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum for purposes of conducting business, except that 2 members of the Commission shall constitute a quorum for purposes of conducting a hearing.</text></paragraph> 
<paragraph id="H884E9F2256E445D5BFA020A48858F5D8"><enum>(8)</enum><header>Meetings</header><text></text> 
<subparagraph id="H879614572EE94F2299C255169DFE93F"><enum>(A)</enum><header>In general</header><text>The Commission shall meet at the call of the Chairperson or a majority of its members. </text></subparagraph> 
<subparagraph id="H1FE43B53E45E4444923F8B5B488CDAE5"><enum>(B)</enum><header>Initial meeting</header><text>Not later than 45 days after the date of the enactment of this Act, the Commission shall hold its initial meeting.</text></subparagraph></paragraph></subsection> 
<subsection id="H13795816C9E74BAD8010C366DC2176CA"><enum>(f)</enum><header>Director; Staff; Experts and Consultants</header><text></text> 
<paragraph id="H178DCC3833D7433899D6692769A9437C"><enum>(1)</enum><header>Director</header><text></text> 
<subparagraph id="HB829F512566B4EFF8F87CF188C412D04"><enum>(A)</enum><header>Appointment</header><text>Not later than 60 days after the date of the enactment of this Act, the Commission shall appoint a Director, without regard to the provisions of title 5, United States Code, governing appointments to the competitive service. </text></subparagraph> 
<subparagraph id="HC667D1EEDFB64A45ACBEC81EE3A46225"><enum>(B)</enum><header>Pay</header><text>The Director shall be paid at the rate payable for level III of the Executive Schedule established under section 5314 of such title.</text></subparagraph></paragraph> 
<paragraph id="H73C0A24ED4BA4D30AB2E985B44C8700"><enum>(2)</enum><header>Staff</header><text></text> 
<subparagraph id="HC34779270B7E4C4EB478DF478065E798"><enum>(A)</enum><header>Appointment</header><text>The Director may appoint such staff as the Director determines appropriate, without regard to the provisions of title 5, United States Code, governing appointments in the competitive service.</text></subparagraph> 
<subparagraph id="HD02F461EB8A54361B5D1C80055009464"><enum>(B)</enum><header>Pay</header><text>The staff of the Commission shall be paid in accordance with the provisions of chapter 51 and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, relating to classification and General Schedule pay rates, but at rates not in excess of the maximum rate for grade GS–15 of the General Schedule under section 5332 of that title.</text></subparagraph></paragraph> 
<paragraph id="H64F9F48A02B24FEAA9A0AA0448EAE44D"><enum>(3)</enum><header>Experts and consultants</header><text>The Director may procure temporary and intermittent services under <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109(b)</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="HED2440711D544D7385FEE0DD1DE8DB68"><enum>(4)</enum><header>Detailees</header><text></text> 
<subparagraph id="H09736CF40488455C88B7216DFC0059B6"><enum>(A)</enum><header>In general</header><text>Upon request of the Director, the head of any Federal department or agency may detail, on a reimbursable basis, any of the personnel of that department or agency to the Commission to assist it in carrying out this Act. </text></subparagraph> 
<subparagraph id="HA1D51CA017BD49B2AAE5F8C547F10093"><enum>(B)</enum><header>Notice</header><text>Before making a request under this paragraph, the Director shall give notice of the request to each member of the Commission.</text></subparagraph></paragraph></subsection> 
<subsection id="HEAD6E74D611E43C6BB9E79E0C5DD4C9"><enum>(g)</enum><header>Powers of Commission</header> 
<paragraph id="H1911A7E6A8A7458091B8243943AE37D0"><enum>(1)</enum><header>Hearings and sessions</header><text>The Commission may, for the purpose of carrying out this Act, hold hearings, sit and act at times and places, take testimony, and receive evidence to carry out its duties under subsection (b). The Commission may administer oaths or affirmations to witnesses appearing before it.</text></paragraph> 
<paragraph id="HF0465CD353DE403F847F8B65743F31C0"><enum>(2)</enum><header>Powers of members and agents</header><text>Any member or agent of the Commission may, if authorized by the Commission, take any action which the Commission is authorized to take by this section.</text></paragraph> 
<paragraph id="H21BA5E1022D54AD7A970398E12A3688C"><enum>(3)</enum><header>Obtaining official information</header> 
<subparagraph id="H7914912FBF6E4FCDB8FCB5D1B8009E8C"><enum>(A)</enum><header>Requirement to furnish</header><text>Except as provided in subparagraph (B), if the Commission submits a request to a Federal department or agency for information necessary to enable the Commission to carry out this Act, the head of that department or agency shall furnish that information to the Commission.</text></subparagraph> 
<subparagraph id="H68901B3CE835495C8FB8C3CED1EF74C"><enum>(B)</enum><header>Exception for national security</header><text>If the head of a Federal department or agency determines that it is necessary to withhold requested information from disclosure to protect the national security interests of the United States, the department or agency head shall not furnish that information to the Commission.</text></subparagraph></paragraph> 
<paragraph id="H089004C767C9406D9818485300F62959"><enum>(4)</enum><header>Mails</header><text>The Commission may use the United States mails in the same manner and under the same conditions as other departments and agencies of the United States.</text></paragraph> 
<paragraph id="H1655E07D267A4523003BCEAF1ECD9DE9"><enum>(5)</enum><header>Administrative support services</header><text>Upon the request of the Director, the Administrator of General Services shall provide to the Commission, on a reimbursable basis, the administrative support services necessary for the Commission to carry out this section.</text></paragraph> 
<paragraph id="HDB978FEA3ACF431DB1D00B440BE35F2"><enum>(6)</enum><header>Gifts and donations</header><text>The Commission may accept, use, and dispose of gifts or donations of services or property to carry out this Act, but only to the extent or in the amounts provided in advance in appropriation Acts.</text></paragraph> 
<paragraph id="HD7EA5615DB184A74A6426F824E19C935"><enum>(7)</enum><header>Contracts</header><text>The Commission may contract with and compensate persons and government agencies for supplies and services, without regard to section 3709 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/41/5">41 U.S.C. 5</external-xref>).</text></paragraph> 
<paragraph id="HC51E77807D364E83813F85BEB21399FB"><enum>(8)</enum><header>Subpoena power</header> 
<subparagraph id="H04522F825ADD4372A5238EB4A98E6FD"><enum>(A)</enum><header>In general</header><text>If a Federal department or agency or any other person fails to supply information requested by the Commission, the Commission may require by subpoena the production of the information. The Commission shall transmit to the Attorney General a written notice at least 10 days in advance of the issuance of any such subpoena. A subpoena under this paragraph may require the production of materials from any place within the United States.</text></subparagraph> 
<subparagraph id="H3E978239DF8C4EEEBC7D748B1EFFBFF2"><enum>(B)</enum><header>Interrogatories</header><text>The Commission may, with respect only to information necessary to understand any materials obtained through a subpoena under paragraph (A), issue a subpoena requiring the person producing such materials to answer, either through a sworn deposition or through written answers provided under oath (at the election of the person upon whom the subpoena is served), interrogatories from the Commission regarding such information. A complete recording or transcription shall be made of any deposition made under this paragraph.</text></subparagraph> 
<subparagraph id="H05847F8132F842E39F831B16AB96B2B8"><enum>(C)</enum><header>Certification</header><text>Each person who submits materials or information to the Commission pursuant to a subpoena issued under subparagraph (A) or (B) shall certify to the Commission the authenticity and completeness of all materials or information submitted.</text></subparagraph> 
<subparagraph id="H17877D7E20164B74AA00A8431915A7C5"><enum>(D)</enum><header>Treatment of subpoenas</header><text>Any subpoena issued by the Commission under subparagraph (A) or (B) shall comply with requirements for subpoenas issued by a United States district court under the Federal Rules of Civil Procedure.</text></subparagraph> 
<subparagraph id="H929ABF3C5D554991801955EAD3B0C164"><enum>(E)</enum><header>Failure to obey a subpoena</header><text>If a person refuses to obey a subpoena issued by the Commission under subparagraph (A) or (B), the Commission may apply to a United States district court for an order requiring that person to comply with such subpoena. The application may be made within the judicial district in which that person is found, resides, or transacts business. Any failure to obey the order of the court may be punished by the court as civil contempt.</text></subparagraph> </paragraph> 
<paragraph id="H755411306AF4430B88BE8FFBF1D284AC"><enum>(9)</enum><header>Arrangements with National Research Council</header><text></text> 
<subparagraph id="H7DDBD7C4EAE04F7486CF68B68B3FAC1B"><enum>(A)</enum><header>In general</header><text>In carrying out its duties under subsection (b), the Commission shall arrange with the National Research Council of the National Academy of Sciences for assistance in conducting the studies required by the Commission under subsection (b)(2), including performance of the analysis required under subsection (b)(2)(C).</text></subparagraph> 
<subparagraph id="H0B40F9CCF26942BFB3FCFCF04630E9"><enum>(B)</enum><header>Report</header><text>The arrangements entered into under (A) shall require that the National Research Council submit a report to the Commission detailing the results of its efforts no later than 15 months after the date on which the Commission first meets.</text></subparagraph> 
<subparagraph id="HC39909F2474E475C83328586BE30A4ED"><enum>(C)</enum><header>Use of funds</header><text>Of amounts appropriated to carry out this section, up to $750,000 shall be available to the Commission to carry out this paragraph.</text></subparagraph> </paragraph></subsection> 
<subsection id="H6B8E1224069842CFA19E04B351254FA2"><enum>(h)</enum><header>Budget Act compliance</header><text>Any new contract authority authorized by this section shall be effective only to the extent or in the amounts provided in advance in appropriation Acts.</text></subsection> 
<subsection id="H7C42080FC8B446FBAD4841A015D28500"><enum>(i)</enum><header>Privacy protections</header> 
<paragraph id="H9D5FF31A150442559230BAD6B42DBBAD"><enum>(1)</enum><header>Destruction or return of information required</header><text>Upon the conclusion of the matter or need for which individually identifiable information was disclosed to the Commission, the Commission shall either destroy the individually identifiable information or return it to the person or entity from which it was obtained, unless the individual that is the subject of the individually identifiable information has authorized its disclosure.</text></paragraph> 
<paragraph id="HE8295B3258374DE4ABAB29AC4186BA8D"><enum>(2)</enum><header>Disclosure of information prohibited</header><text>Any individual employed by an individual, entity, or organization under contract to the Commission shall be considered an employee of the Commission for the purposes of <external-xref legal-doc="usc" parsable-cite="usc/18/1905">section 1905</external-xref> of title 18, United States Code.</text></paragraph> 
<paragraph id="H55C5469851334441A700B213F2700061"><enum>(3)</enum><header>Proprietary business information and financial information</header><text>The Commission shall protect from improper use, and may not disclose to any person, proprietary business information and proprietary financial information that may be viewed or obtained by the Commission in the course of carrying out its duties under this section.</text></paragraph> 
<paragraph id="H396F57283180437D94575460AFE555EB"><enum>(4)</enum><header>Individually identifiable information defined</header><text>For the purposes of this section, the term <term>individually identifiable information</term> means any information, whether oral or recorded in any form or medium, that identifies an individual, or with respect to which there is a reasonable basis to believe that the information can be used to identify an individual.</text></paragraph></subsection> 
<subsection id="H63AA938E99B8480888DBD3F3E84C7636"><enum>(j)</enum><header>Termination of Commission</header><text>The Commission shall terminate 30 days after submitting a report under subsection (d)(1).</text></subsection> 
<subsection id="HD778408B7C0C4B18B3CD47C865DD6BA0"><enum>(k)</enum><header>Authorization of appropriations</header><text></text> 
<paragraph id="H56408E8D31DB4AC481D55C08B2EEBF5F"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Commission $4,750,000 to carry out this Act. </text></paragraph> 
<paragraph id="HCD4F046EDD5E4502B52F676C89577900"><enum>(2)</enum><header>Availability</header><text>Any sums appropriated pursuant to the authorization in subsection (a) shall remain available until expended.</text></paragraph></subsection> </section>
