<official-title>To increase the amount of student loans that may be forgiven for highly qualified teachers in mathematics, science, and special education and for reading specialists.</official-title>

<section id="H4BBB135BF86B465CB7E6DC496F00EF48" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <short-title></short-title><quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="H2BB811857D9D4687960620FA32D3FD29"> <enum>2.</enum> <header>Increased qualified loan amounts</header> 
<subsection id="HEC34E3A7063A46DA88F8747D367D2F79"> <enum>(a)</enum> <header>FFEL loans</header> <text>Section 428J(c) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-10">20 U.S.C. 1078–10(c)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H3B0DE1E379BC465CA54C6D14A0DD06D"> <enum>(3)</enum> <header>Increased amounts for teachers in mathematics, science, or special education</header> 
<subparagraph id="H7D69DCFC8A5346159BE13668EDC533FA"> <enum>(A)</enum> <header>Service qualifying for increased amounts</header> <text>Notwithstanding the amount specified in paragraph (1), the aggregate amount that the Secretary shall repay under this section shall not be more than $17,500 in the case of—</text> 
<clause id="HBD80DAE2FBD843DEAC436CBAA96C31E"> <enum>(i)</enum> <text>a secondary school teacher—</text> 
<subclause id="H196D22B9C24B45E7AA7BAAAFA27486D4"> <enum>(I)</enum> <text>who meets the requirements of subsection (b), subject to <internal-xref idref="H0A528ADF6B2744B7B06DC92C457B49DC" legis-path="q:(3)(D)">subparagraph (D) of this paragraph</internal-xref>; and</text> </subclause> 
<subclause id="H419DC600C2854329B5805534425B739F"> <enum>(II)</enum> <text>whose qualifying employment for purposes of such subsection has been teaching mathematics or science on a full-time basis;</text> </subclause> </clause> 
<clause id="H034AD822E3694C09B428ADA8FF53708D"> <enum>(ii)</enum> <text>an elementary or secondary school teacher—</text> 
<subclause id="H4ED7D2EB0E8B4FABBFE415384FCC49FD"> <enum>(I)</enum> <text>who meets the requirements of subsection (b), subject to <internal-xref idref="H0A528ADF6B2744B7B06DC92C457B49DC" legis-path="q:(3)(D)">subparagraph (D) of this paragraph</internal-xref>; </text> </subclause> 
<subclause id="HF233C53234BE4D2F94C2BE87F8B9065"> <enum>(II)</enum> <text>whose qualifying employment for purposes of such subsection has been as a special education teacher whose primary responsibility is to provide special education to children with disabilities (as those terms are defined in section 602 of the Individuals with Disabilities Act); and</text> </subclause> 
<subclause id="HD853EFF893274695B5CF85200925E04E"> <enum>(III)</enum> <text>who, as certified by the chief administrative officer of the public or nonprofit private elementary or secondary school in which the borrower is employed, is teaching children with disabilities that correspond with the borrower’s special education training and has demonstrated knowledge and teaching skills in the content areas of the elementary or secondary school curriculum that the borrower is teaching; and</text> </subclause> </clause> 
<clause id="H991B068F453D42C8B800A13C606C3CB7"> <enum>(iii)</enum> <text>an elementary or secondary school teacher who primarily teaches reading and—</text> 
<subclause id="H4D55F11A82D041228CDD036359B2A297"> <enum>(I)</enum> <text>who meets the requirements of subsection (b), subject to <internal-xref idref="H0A528ADF6B2744B7B06DC92C457B49DC" legis-path="q:(3)(D)">subparagraph (D) of this paragraph</internal-xref>; </text> </subclause> 
<subclause id="HB1D20BD709EE486EA0CB032FA6F77CB9"> <enum>(II)</enum> <text>who has obtained a separate reading instruction credential from the State in which the teacher is employed; and</text> </subclause> 
<subclause id="H0121A700C7424256ABC3BB5E617F35C"> <enum>(III)</enum> <text>who is certified by the chief administrative officer of the public or nonprofit private elementary or secondary school in which the borrower is employed to teach reading—</text> 
<item id="H7C3E0BC35E7F49B89BA89D39AA5CB692"> <enum>(aa)</enum> <text>as being proficient in teaching the essential components of reading instruction as defined in section 1208 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name>; and</text> </item> 
<item id="H05079DD317354ED0882E253500BBC6F6"> <enum>(bb)</enum> <text>as having such credential.</text> </item> </subclause> </clause> </subparagraph> 
<subparagraph id="H1CFD1BC9CF534F4BBF7D76FB2531693F"> <enum>(B)</enum> <header>Accelerated payment</header> <text>Notwithstanding the requirements of subsection (b)(1) and paragraph (1) of this subsection that 5 consecutive complete years of service have been completed prior to the receipt of loan forgiveness, in the case of service described in <internal-xref idref="H7D69DCFC8A5346159BE13668EDC533FA" legis-path="q:(3)(A)">subparagraph (A) of this paragraph</internal-xref>, the Secretary shall repay a portion of a borrower’s loan obligation outstanding at the commencement of the qualifying service under this subsection, not to exceed a total of $17,500, in the following increments:</text> 
<clause id="H7C566A1DB70B46A79E84D07325AF3B2B"> <enum>(i)</enum> <text>up to $1,750, or 10 percent of such outstanding loan obligation, whichever is less, at the completion of the second year of such service;</text> </clause> 
<clause id="H07D14F6AB0974FC88D04D62A6620800"> <enum>(ii)</enum> <text>up to $2,625, or 15 percent of such outstanding loan obligation, whichever is less, at the completion of the third year of such service;</text> </clause> 
<clause id="HF26FDE4363AC45CC93160000C14F8100"> <enum>(iii)</enum> <text>up to $4,375, or 25 percent of such outstanding loan obligation, whichever is less, at the completion of the fourth year of such service; and</text> </clause> 
<clause id="HAFA95CE36DCB41A483510021DD957F2"> <enum>(iv)</enum> <text>up to $8,750, or 50 percent of such outstanding loan obligation, whichever is less, at the completion of the fifth year of such service.</text> </clause> </subparagraph> 
<subparagraph id="HAD6A763C60824479B56F003091A39314"> <enum>(C)</enum> <header>Promise to complete service required for accelerated payment</header> <text>Any borrower who receives accelerated payment under this paragraph shall enter into an agreement to continue in the qualifying service for not less than 5 consecutive complete school years, or, upon a failure to complete such 5 years, to repay the United States, in accordance with regulations prescribed by the Secretary, the amount of the loans repaid by the Secretary under this paragraph, together with interest thereon and, to the extent required in such regulations, the reasonable costs of collection. Such regulations may provide for waiver by the Secretary of such repayment obligations upon proof of economic hardship as specified in such regulations.</text> </subparagraph> 
<subparagraph id="H0A528ADF6B2744B7B06DC92C457B49DC"> <enum>(D)</enum> <header>Higher poverty enrollment required</header> <text>In order to qualify for an increased repayment amount under this paragraph, section 465(a)(2)(A) shall, for purposes of subsection (b)(1)(A) of this section, be applied by substituting <quote>40 percent of the total enrollment</quote> for <quote>30 percent of the total enrollment</quote>.</text> </subparagraph> </paragraph> <after-quoted-block>.</after-quoted-block> </quoted-block> </subsection> 
<subsection id="H656D1C927D2B48159687D02046345B3B"> <enum>(b)</enum> <header>Direct loans</header> <text>Section 460(c) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1087j">20 U.S.C. 1087j(c)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HE7CC192D6AA34E04B22141BE838958D1"> <enum>(3)</enum> <header>Increased amounts for teachers in mathematics, science, or special education</header> 
<subparagraph id="H2B4C014A80D6490A82258BAB59AFAE4C"> <enum>(A)</enum> <header>Service qualifying for increased amounts</header> <text>Notwithstanding the amount specified in paragraph (1), the aggregate amount that the Secretary shall repay under this section shall not be more than $17,500 in the case of—</text>

<subclause id="HF4E0E4ACC3E5469B86C104568F649788"> <enum>(II)</enum> <text>whose qualifying employment for purposes of such subsection has been teaching mathematics or science on a full-time basis;</text> </subclause> </clause> 
<clause id="HA1EAF6B4789E42B8963F52B34F8CCC7D"> <enum>(ii)</enum> <text>an elementray or secondary school teacher—</text> 
<subclause id="H4BB3E51E158547F887BA3E35D506D4EC"> <enum>(I)</enum> <text>who meets the requirements of subsection (b)(1), subject to <internal-xref idref="H464BCD05636A4E5DA558EFDEFE965BCD" legis-path="q:(3)(D)">subparagraph (D) of this paragraph</internal-xref>; </text> </subclause> 
<subclause id="H78998F8798024AF493C84CC2BF115983"> <enum>(II)</enum> <text>whose qualifying employment for purposes of such subsection has been as a special education teacher whose primary responsibility is to provide special education to children with disabilities (as those terms are defined in section 602 of the Individuals with Disabilities Act); and</text> </subclause> 
<subclause id="H81412D0367A946FE98FD980362F884B7"> <enum>(III)</enum> <text>who, as certified by the chief administrative officer of the public or nonprofit private elementary or secondary school in which the borrower is employed, is teaching children with disabilities that correspond with the borrower’s special education training and has demonstrated knowledge and teaching skills in the content areas of the elementary or secondary school curriculum that the borrower is teaching; and</text> </subclause> </clause> 
<clause id="H1A091E86F3FD4894A2A82E00DEECDBAE"> <enum>(iii)</enum> <text>an elementary or secondary school teacher who primarily teaches reading and—</text> 
<subclause id="H2F9288A9B6DB4137BA67612EC600F681"> <enum>(I)</enum> <text>who meets the requirements of subsection (b), subject to <internal-xref idref="H464BCD05636A4E5DA558EFDEFE965BCD" legis-path="q:(3)(D)">subparagraph (D) of this paragraph</internal-xref>; </text> </subclause> 
<subclause id="H7B20E64925C3412BAC35591B924DA600"> <enum>(II)</enum> <text>who has obtained a separate reading instruction credential from the State in which the teacher is employed; and</text> </subclause> 
<subclause id="H6E59C4C82EF14A47BAE63320AAB69C34"> <enum>(III)</enum> <text>who is certified by the chief administrative officer of the public or nonprofit private elementary or secondary school in which the borrower is employed to teach reading—</text> 
<item id="H71F5598DC070417E00122DCF106BF653"> <enum>(aa)</enum> <text>as being proficient in teaching the essential components of reading instruction as defined in section 1208 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name>; and</text> </item> 
<item id="H44A14A1A612241FAB84B9500F138E61"> <enum>(bb)</enum> <text>as having such credential.</text> </item> </subclause> </clause> </subparagraph> 
<subparagraph id="HF5215D87613D441B9E05E656BB1EF6DF"> <enum>(B)</enum> <header>Accelerated payment</header> <text>Notwithstanding the requirements of subsection (b)(1)(A) and paragraph (1) of this subsection that 5 consecutive complete years of service have been completed prior to the receipt of loan forgiveness, in the case of service described in <internal-xref idref="H2B4C014A80D6490A82258BAB59AFAE4C" legis-path="q:(3)(A)">subparagraph (A) of this paragraph</internal-xref>, the Secretary shall repay a portion of a borrower’s loan obligation outstanding at the commencement of the qualifying service under this subsection, not to exceed a total of $17,500, in the following increments:</text> 
<clause id="H451EF45FCE0342A7B2EBCD4A1A1C8E"> <enum>(i)</enum> <text>up to $1,750, or 10 percent of such outstanding loan obligation, whichever is less, at the completion of the second year of such service;</text> </clause> 
<clause id="H99096B4CC77142A48BF4C5EC933C1061"> <enum>(ii)</enum> <text>up to $2,625, or 15 percent of such outstanding loan obligation, whichever is less, at the completion of the third year of such service;</text> </clause> 
<clause id="H1DC030ADCFCB4D16A3B37972653363DA"> <enum>(iii)</enum> <text>up to $4,375, or 25 percent of such outstanding loan obligation, whichever is less, at the completion of the fourth year of such service; and</text> </clause> 
<clause id="HAB6321B718ED413390608935F63F402C"> <enum>(iv)</enum> <text>up to $8,750, or 50 percent of such outstanding loan obligation, whichever is less, at the completion of the fifth year of such service.</text> </clause> </subparagraph> 
<subparagraph id="H29B6323425C347F495DEF2AC75CE89B8"> <enum>(C)</enum> <header>Promise to complete service required for accelerated payment</header> <text>Any borrower who receives accelerated payment under this paragraph shall enter into an agreement to continue in the qualifying service for not less than 5 consecutive complete school years, or, upon a failure to complete such 5 years, to repay the United States, in accordance with regulations prescribed by the Secretary, the amount of the loans repaid by the Secretary under this paragraph, together with interest thereon and, to the extent required in such regulations, the reasonable costs of collection. <subsection id="H146DF07C96BA4CBE8C87E54B240D8EE"> <enum>(a)</enum> <header>Amendments</header> 
<paragraph id="HC3C1CAFB47C1435600D3C3BB5EE0099"> <enum>(1)</enum> <header>FFEL loans</header> <text>Section 428J(b)(1) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-10">20 U.S.C. 1078–10(b)(1)</external-xref>) is amended—</text> 
<subparagraph id="HB8507EC0A55F409780B6833CB9367652"> <enum>(A)</enum> <text>by inserting <quote>and</quote> after the semicolon at the end of subparagraph (A); and</text> </subparagraph> 
<subparagraph id="HC115CF37ECB04568A02913B937002989"> <enum>(B)</enum> <text>by striking subparagraphs (B) and (C) and inserting the following:</text>

<subparagraph id="H5118C0B594404FCB8FFD5CC1BC94C0DE"> <enum>(B)</enum> <text>if employed as an elementary or secondary school teacher, is highly qualified as defined in section 9101(23) of the Elementary Secondary Education Act of 1965; and</text> </subparagraph> <after-quoted-block>.</after-quoted-block> </quoted-block> </subparagraph> </paragraph> 
<paragraph id="HB078A4D89FC146C49C649000D69357C9"> <enum>(2)</enum> <header>Direct loans</header> <text>Section 460(b)(1)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1087j">20 U.S.C. 1087j(b)(1)(A)</external-xref>) is amended—</text> 
<subparagraph id="HEE923E1589D0480DAFF3CC7594857F63"> <enum>(A)</enum> <text>by inserting <quote>and</quote> after the semicolon at the end of clause (i); and</text> </subparagraph> 
<subparagraph id="H36EBA34BE3A144788285E6C69801F8FF"> <enum>(B)</enum> <text>by striking clauses (ii) and (iii) and inserting the following:</text>

<subsection id="H36D1B966CA8749518DD3C69902C8CB50"> <enum>(b)</enum> <header>Transition rule</header> 
<paragraph id="H6E5A1ED18601415186A714AA37C0097"> <enum>(1)</enum> <header>Rule</header> <text>The amendments made by subsection (a) of this section to sections 428J(b)(1) and 460(b)(1)(A) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> shall not be applied to disqualify any individual who, before the date of enactment of this Act, commenced service that met and continues to meet the requirements of such sections as in effect before such date of enactment.</text> </paragraph> 
<paragraph id="H6764D07248B04861A22578D4D58DA035"> <enum>(2)</enum> <header>Rule not applicable to increased qualified loan amounts</header> <text>Paragraph (1) of this subsection shall not apply for purposes of obtaining increased qualified loan amounts under sections 428J(b)(3) and 460(b)(3) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> as added by section 2 of this Act.</text> </paragraph> </subsection> </section> 
<section id="H695738A61FBB45769B9D0779777469D4"> <enum>4.</enum> <header>Information on benefits to rural school districts</header> <text display-inline="no-display-inline">The Secretary shall—</text> 
<paragraph id="HDE2E51DFD5714DDEBFA84BBA4B611505"> <enum>(1)</enum> <text>notify local educational agencies eligible to participate in the Small Rural Achievement Program authorized under subpart 1 of part B of title VI of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> of the benefits available under the amendments made by this Act; and</text> </paragraph> 
<paragraph id="H3AA2FB7CE039429EBC3CD9F90027A9E1"> <enum>(2)</enum> <text>encourage such agencies to notify their teachers of such benefits.</text> </paragraph> </section>
