<legis-type>A BILL</legis-type> 
<official-title>To amend the Fair Labor Standards Act of 1938 to clarify the exemption from the minimum wage and overtime compensation requirements of that Act for certain construction engineering and design professionals.</official-title>

<section id="H9564CB6E16B542D7814858F1DD4C73FC" section-type="section-one"><enum>1.</enum><header>Fair Labor Standards Act of 1938</header><text display-inline="no-display-inline"> Section 13(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)</external-xref>) is amended—</text> 
<paragraph id="H4B39383B7F7842FEA1DBF067E4CB4CD2"><enum>(1)</enum><text>in paragraph (17), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="HA7F91BA2ED884B69B19064745E65FA90"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="HDA44A8B661FC4C05BC7FAA495323811C"><enum>(18)</enum><text>any employee providing professional consulting services recognized by a 4-year degree or greater, professional licensure, professional certification, or at least 8 years of similar work experience, if—</text> 
<subparagraph id="HFC2709D3394E46B08FC1C8C3A63F7B25"><enum>(A)</enum><text>the duties of the employee include—</text> 
<clause id="HD9CEE45E5400439A966ECFAB40ECFC9"><enum>(i)</enum><text>interpretation and adherence to design documents and applicable construction codes;</text></clause> 
<clause id="H94BA2001B2E64DFD008321DE864193BD"><enum>(ii)</enum><text>supervision during a project;</text></clause> 
<clause id="H5ED117E8586B4A90A2D9C52F9C6989C"><enum>(iii)</enum><text>interpretation of contract requirements through analysis of specifications and drawings;</text></clause> 
<clause id="H1D616AAFCC2A41AAAA6DE908962C374F"><enum>(iv)</enum><text>the application of a variety of testing and inspection techniques;</text></clause> 
<clause id="HF38F53A7603C4E97872D408C160053C9"><enum>(v)</enum><text>implementation of research methods;</text></clause> 
<clause id="H24B52E042A9D437A97CF179962B6C147"><enum>(vi)</enum><text>supervision of the inspection of materials and workmanship; or</text></clause> 
<clause id="H2977AAC9040C44B385A3704B774E965E"><enum>(vii)</enum><text>the interpretation of engineering principles and national, State, and local construction code requirements or of established codes (such as the Uniform Building Code) set by nationally recognized standard-setting organizations (such as the International Conference of Building Officials); and</text></clause></subparagraph> 
<subparagraph id="HC4423058F2194448AB251289EB5742E6"><enum>(B)</enum><text>the services of the employee relate to the preliminary or conceptual design and development, design, bidding, construction, or postconstruction evaluation phases of engineering, architecture, landscape architecture, land and hydrographic surveying, land use planning, natural, environmental, and earth sciences, or construction technology.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
