<official-title>To provide for the suspension from Federal procurement and nonprocurement activities of persons that have not paid a fine resulting from a violation of the Occupational Safety and Health Act of 1970 that causes the death of an employee.</official-title>

<section id="HB40A200F14E64C729B399789D81B1121" section-type="section-one"><enum>1.</enum><header>Federal Contracts Suspension for Unpaid Fines Resulting from Violations of OSHA that Cause Death of an Employee</header> 
<subsection id="H103B5A34A5DB4906BA2BF5DDF2116CC"><enum>(a)</enum><header>Suspension</header><text>Section 17(e) of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/666">29 U.S.C. 666(e)</external-xref>) is amended—</text> 
<paragraph id="HD562B25A75F24E2891B8B5CBECDA655"><enum>(1)</enum><text>by striking <quote>(e)</quote> and inserting <quote>(e)(1)</quote>; and</text></paragraph> 
<paragraph id="HFE94FBFA09964395821E1F3C09A0D8C"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H2B957E2EE3734F80BFB4241FDBFD6499" indent="up1"><enum>(2)</enum> 
<subparagraph id="HA51D7323C1E74C59A69769AFB23C812C" display-inline="yes-display-inline" indent="up1"><enum>(A)</enum><text>The Secretary shall suspend a person from procurement activities and nonprocurement activities upon a finding by the Secretary that the person has not paid a fine imposed for a violation of paragraph (1). Such suspension shall continue until a finding by the Secretary that the fine is paid.</text> </subparagraph> 
<subparagraph id="HF89E00A5B75B4CC1AC882DD0699B36C9" display-inline="no-display-inline" indent="up1"><enum>(B)</enum><text>In this paragraph:</text> 
<clause id="H2FE9F90F520C493EA3C5F9A25543A340"><enum>(i)</enum><text>The term <quote>suspend</quote> means to disqualify, pursuant to established administrative procedures, from Government contracting and subcontracting, or from participation in nonprocurement activities.</text></clause> 
<clause id="H1DDF8E2299E0498BB442F1938BB29299"><enum>(ii)</enum><text>The term <quote>procurement activities</quote> means all acquisition programs and activities of the Federal Government, as defined in the Federal Acquisition Regulation.</text></clause> 
<clause id="H8F24086B9754442EB753B5B8C3347C7F"><enum>(iii)</enum><text>The term <quote>nonprocurement activities</quote> means all programs and activities involving Federal financial and nonfinancial assistance and benefits, as covered by Executive Order No. 12549 and the Office of Management and Budget guidelines implementing that order.</text> </clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H89555ACCBC844901B4A2006DAF0314F5"><enum>(b)</enum><header>Regulations</header><text>The Federal Acquisition Regulation and the guidelines implementing Executive Order No. 12549 shall be revised to include provisions to carry out the amendments made by subsection (a). </text></subsection></section>
