<legis-type>A BILL</legis-type> 
<official-title>To amend the National Labor Relations Act to ensure the right of employees to a secret-ballot election conducted by the National Labor Relations Board.</official-title>

<section id="H822661F8E37F46EDBED58BC85144E8C0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secret Ballot Protection Act of 2004</short-title></quote>.</text></section> 
<section id="H53D88222E7CA440888C11DC445B8AF7D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph display-inline="no-display-inline" id="H326AE77494624B3681BB53C536DEBF95"><enum>(1)</enum><text>the right of employees under the National Labor Relations Act to choose whether to be represented by a labor organization by way of secret ballot election conducted by the National Labor Relations Board is among the most important protections afforded under Federal labor law;</text></paragraph> 
<paragraph id="H3DDC38427A9142918917247F6EDB33FC"><enum>(2)</enum><text>the right of employees to choose by secret ballot is the only method that ensures a choice free of coercion, intimidation, irregularity, or illegality; and</text></paragraph> 
<paragraph id="HE97555B9A893487485E95C2F5780ED"><enum>(3)</enum><text>the recognition of a labor organization by using a private agreement, rather than a secret ballot election overseen by the National Labor Relations Board, threatens the freedom of employees to choose whether to be represented by a labor organization, and severely limits the ability of the National Labor Relations Board to ensure the protection of workers.</text></paragraph></section> 
<section id="HA1AC90307C1A47169D80A90284C22F1F"><enum>3.</enum><header>National Labor Relations Act</header> 
<subsection id="H296DDCBC69B44BA096BBFE8B0068F9D8"><enum>(a)</enum><header>Recognition of representative</header> 
<paragraph id="HB60216EB801C4BFA8B08088CC6554B91"><enum>(1)</enum><header>In general</header><text>Section 8(a)(2) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/158">29 U.S.C. 158(a)(2)</external-xref>) is amended by inserting before the colon the following: <quote>or to recognize or bargain collectively with a labor organization that has not been selected by a majority of such employees in a secret ballot election conducted by the National Labor Relations Board in accordance with section 9</quote>.</text></paragraph> 
<paragraph id="HFBAF207873744E74A8FA3B02FEE3325C"><enum>(2)</enum><header>Application</header><text>The amendment made by subsection (a) shall not apply to collective bargaining relationships in which a labor organization with majority support was lawfully recognized before the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="HF1F3406633AC410BAF8BFE05BFA9D105"><enum>(b)</enum><header>Election required</header> 
<paragraph id="H8B7FE2004395448CA893A85073A576AC"><enum>(1)</enum><header>In general</header><text>Section 8(b) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/158">29 U.S.C. 158(b)</external-xref>), as amended by subsection (c) of this section, is amended—</text> 
<subparagraph id="H946DD22CC8154F6CB50106D387B78DE"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (6);</text></subparagraph> 
<subparagraph id="H667F33229765442F8C535B00CA3DE171"><enum>(B)</enum><text>by striking the period at the end of paragraph (7) and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="H9564B3F7C4594AE2B93FA6808270BE9C"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph id="HC161D35C1D56405CB9BFC1D94C0B34F"><enum>(8)</enum><text>to cause or attempt to cause an employer to recognize or bargain collectively with a representative of a labor organization that has not been selected by a majority of such employees in a secret ballot election conducted by the National Labor Relations Board in accordance with section 9.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H282C70A41B804B86B791B2249CFEC011"><enum>(2)</enum><header>Application</header><text>The amendment made by paragraph (1) shall not apply to collective bargaining relationships that were recognized before the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="HF2603DE310A74D6DB500F36C70DE43F6"><enum>(c)</enum><header>Secret Ballot Election</header><text>Section 9(a) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/159">29 U.S.C. 159(a)</external-xref>), is amended—</text> 
<paragraph id="H2B51777E465D45AC8C65B3E38F7D31C1"><enum>(1)</enum><text>by inserting <quote> (1) </quote>after <quote>(a)</quote>;</text></paragraph> 
<paragraph id="HB0D52C0C214A4624B26C3B1E5F69DA72"><enum>(2)</enum><text> by inserting after <quote>designated or selected</quote> the following: <quote>by a secret ballot election conducted by the National Labor Relations Board in accordance with this section</quote>; and</text></paragraph> 
<paragraph id="H934007434A9943AB98452CDFBA45B93D"><enum>(3)</enum><text>by adding at the end the following:</text>

<paragraph id="H5BD705FC42954413BC750286BC59D28F"><enum>(2) </enum><text>The secret ballot election requirement of paragraph (1) shall not apply to collective bargaining relationships that were recognized before the date of the enactment of this Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H7560506637E245E4BBC0BB65B0EA5FA6"><enum>4.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 6 months after the date of the enactment of this Act the National Labor Relations Board shall review and revise all regulations promulgated before such date to implement the amendments made in this Act to the National Labor Relations Act.</text> </section>
