<official-title>To provide for data-mining reports to Congress.</official-title>

<section section-type="section-one" id="H6E38C6D945CA4A0DA1FA4F2E452D5CDF"> <enum>1.</enum> <header>Short title</header> <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text> </section> 
<section id="H3BF58BF187294114A4515007C7B9AE45"> <enum>2.</enum> <header>Definitions</header> <text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H8BA2848F91104039A50002D9A55ECB3"> <enum>(1)</enum> <header>Data-Mining</header> <text>The term <term>data-mining</term> means a query or search or other analysis of 1 or more electronic databases, where—</text> 
<subparagraph id="HB94D6B193D494D878E95310156816B82"> <enum>(A)</enum> <text>at least 1 of the databases was obtained from or remains under the control of a non-Federal entity, or the information was acquired initially by another department or agency of the Federal Government for purposes other than intelligence or law enforcement;</text> </subparagraph> 
<subparagraph id="H21EBC030F2E546EB85F6D54257C9D73E"> <enum>(B)</enum> <text>the search does not use a specific individual’s personal identifiers to acquire information concerning that individual; and</text> </subparagraph> 
<subparagraph id="HFA80275949AD4334ACE121F34169B8C6"> <enum>(C)</enum> <text>a department or agency of the Federal Government is conducting the query or search or other analysis to find a pattern indicating terrorist or other criminal activity.</text> </subparagraph> </paragraph> 
<paragraph id="HD42488A0BA474EA295FF01B0B56CE98"> <enum>(2)</enum> <header>Database</header> <text>The term <term>database</term> does not include telephone directories, information publicly available via the Internet or available by any other means to any member of the public without payment of a fee, or databases of judicial and administrative opinions.</text> </paragraph> </section> 
<section id="H88FC24FF68124CC1942DE0E51D8443BA"> <enum>3.</enum> <header>Reports on Data-Mining activities</header> 
<subsection id="HE13F5D3847034BA696DC2905BD4DAE63"> <enum>(a)</enum> <header>Requirement for report</header> <text>The head of each department or agency of the Federal Government that is engaged in any activity to use or develop data-mining technology shall each submit a public report to Congress on all such activities of the department or agency under the jurisdiction of that official.</text> </subsection> 
<subsection id="H4B664A9D56BE4694BEA4415F48D6F66C"> <enum>(b)</enum> <header>Content of report</header> <text>A report submitted under subsection (a) shall include, for each activity to use or develop data-mining technology that is required to be covered by the report, the following information:</text> 
<paragraph id="H4ACB206B646D445C947570C484BABFFC"> <enum>(1)</enum> <text>A thorough description of the data-mining technology and the data that will be used.</text> </paragraph> 
<paragraph id="H13C85CA72F764AAC828EF2DEAFCD3935"> <enum>(2)</enum> <text>A thorough discussion of the plans for the use of such technology and the target dates for the deployment of the data-mining technology.</text> </paragraph> 
<paragraph id="HCDAF3F558F6445A29BE248039DCAABD"> <enum>(3)</enum> <text>An assessment of the likely efficacy of the data-mining technology in providing accurate and valuable information consistent with the stated plans for the use of the technology.</text> </paragraph> 
<paragraph id="H463FADC7DB104AC39786034EE4918CE0"> <enum>(4)</enum> <text>An assessment of the likely impact of the implementation of the data-mining technology on privacy and civil liberties.</text> </paragraph> 
<paragraph id="H1D0814507514468BA835ED701B008294"> <enum>(5)</enum> <text>A list and analysis of the laws and regulations that govern the information to be collected, reviewed, gathered, and analyzed with the data-mining technology and a description of any modifications of such laws that will be required to use the information in the manner proposed under such program.</text> </paragraph> 
<paragraph id="H8E62A7452E034734B747AF196B33002E"> <enum>(6)</enum> <text>A thorough discussion of the policies, procedures, and guidelines that are to be developed and applied in the use of such technology for data-mining in order to—</text> 
<subparagraph id="H0A9716207BBD47AFA9FDB9A9C2830310"> <enum>(A)</enum> <text>protect the privacy and due process rights of individuals; and</text> </subparagraph> 
<subparagraph id="H258063D3E36A4D36B6B000AF251E25C6"> <enum>(B)</enum> <text>ensure that only accurate information is collected and used.</text> </subparagraph> </paragraph> 
<paragraph id="H347C7355B94A40D5AF10A5F8DA099F83"> <enum>(7)</enum> <text>A thorough discussion of the procedures allowing individuals whose personal information will be used in the data-mining technology to be informed of the use of their personal information and what procedures are in place to allow for individuals to opt out of the technology. If no such procedures are in place, a thorough explanation as to why not.</text> </paragraph> 
<paragraph id="HA45CAC1A24EB46F2B47186412EBAB794"> <enum>(8)</enum> <text>Any necessary classified information in an annex that shall be available to the Committee on Governmental Affairs, the Committee on the Judiciary, and the Committee on Appropriations of the Senate and the Committee on Homeland Security, the Committee on the Judiciary, and the Committee on Appropriations of the House of Representatives.</text> </paragraph> </subsection> 
<subsection id="H73B92750575143C9A8F0FCF2C65221C"> <enum>(c)</enum> <header>Time for report</header> <text>Each report required under subsection (a) shall be—</text> 
<paragraph id="HC158D06263E2448195DF17F1E993EE98"> <enum>(1)</enum> <text>submitted not later than 90 days after the date of the enactment of this Act; and</text> </paragraph> 
<paragraph id="H134DE8FBDCEE4FA7B0F25A54C2B47A1"> <enum>(2)</enum> <text>updated once a year and include any new data-mining technologies.</text> </paragraph> </subsection> </section>
