<section id="H77A3D7FA0A104E79A313FF828BF989BB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wool Suit and Textile Trade Extension Act of 2004</short-title></quote>.</text></section> 
<section id="H5F39A6656AB941DCB49E011DE68B00D2" section-type="subsequent-section"><enum>2.</enum><header>Extension and modification of duty suspension on wool products, wool research fund, wool duty refunds</header> 
<subsection id="H83F8DDCCBBE34401ACA1515939DF733"><enum>(a)</enum><header>Extension of temporary duty reductions</header> 
<paragraph id="H6C40012E6B5A462998F135E3BA78E6BF"><enum>(1)</enum><header>Heading 9902.51.11</header><text>Heading 9902.51.11 of the Harmonized Tariff Schedule of the United States is amended—</text> 
<subparagraph id="HFE4BFD12E9044841AE20B6216FE18BF0"><enum>(A)</enum><text>by striking <quote>2005</quote> and inserting <quote>2010</quote>; and</text></subparagraph> 
<subparagraph id="HFF276CB720814C57ADBEAA147036736"><enum>(B)</enum><text>by striking <quote>17.5%</quote> and inserting <quote>10%</quote>.</text></subparagraph></paragraph>

<paragraph id="HA5F0B8B4390143A9B5EF00725B91002E"><enum>(1)</enum><header>Note 15</header><text>U.S. Note 15 to subchapter II of chapter 99 of the Harmonized Tariff Schedule of the United States is amended—</text> 
<subparagraph id="H9D8CCD33588046878999CC200097EDCE"><enum>(A)</enum><text>by striking <quote>and</quote> after <quote>2002,</quote>; and</text></subparagraph> 
<subparagraph id="HCE16218397074A4F88B709378820EAE7"><enum>(B)</enum><text>by striking <quote>year 2003</quote> and all that follows through the end period and inserting the following: <quote>years 2003 and 2004, and 5,500,000 square meter equivalents in calendar year 2005 and each calendar year thereafter for the benefit of persons who cut and sew men’s and boys’ worsted wool suits and suit-like jackets and trousers in the United States, allocated as required by section 501(e)(1) of the Trade and Development Act of 2000.</quote>.</text></subparagraph></paragraph>

<paragraph id="HBA7A1C7B70F24ABB86938F00FBC8303F"><enum>(b)</enum><text>2,000,000 square meter equivalents in calendar year 2005 and each calendar year thereafter for the benefit of manufacturers who weave worsted wool fabric in the United States suitable for use in men’s and boys’ suits, allocated as required by section 501(e)(2) of the Trade and Development Act of 2000.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H6649E283AB0143A2B6A690C97312DD15"><enum>(3)</enum><header>Conforming amendments</header> 
<subparagraph id="H9C84672A78CD4C7AA2EF02E8B30133C8"><enum>(A)</enum><header>Sunset staged reduction requirement</header><text>Section 501(a)(2) of the Trade and Development Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/200">Public Law 106–200</external-xref>; 114 Stat. 299) is amended by inserting before the period <quote>for goods entered, or withdrawn from warehouse for consumption, before January 1, 2005</quote>.</text></subparagraph> 
<subparagraph id="H6AD678A8AB0642FAAF9D42ADE4388DB"><enum>(B)</enum><header>Allocation of tariff rate quotas</header><text>Section 501(e) of the Trade and Development Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/200">Public Law 106–200</external-xref>; 114 Stat. 300) is amended—</text> 
<clause id="HF516907CD543498AA7EC46BB967C08E2"><enum>(i)</enum><text>by striking <quote>In implementing</quote> and inserting <quote>(1) In implementing</quote>; </text> </clause>

<clause id="H34D39AC07DD84815B5A24683BAD17E82"><enum>(iii)</enum><text>by adding at the end the following:</text>

<paragraph id="HB8B9BBE4997345A5BBC3EBD31EB5EAB"><enum>(2)</enum><text>In implementing the limitation on the quantity of worsted wool fabrics under heading 9902.51.12 of the Harmonized Tariff Schedule of the United States, as required by U.S. Note 16(b) of subchapter II of chapter 99 of such Schedule, for the entry, or withdrawal from warehouse for consumption, the Secretary of Commerce shall adopt regulations to allocate fairly such quantity to manufacturers who weave worsted wool fabric in the United States suitable for use in men’s and boys’ suits and who apply for an allocation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph> 
<subparagraph id="H71A22667B12948C5AC8400E45032C00"><enum>(C)</enum><header>Sunset authority to modify limitation on quantity</header><text>Section 504(b) of the Trade and Development Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/200">Public Law 106–200</external-xref>; 114 Stat. 301) is repealed, effective January 1, 2005.</text></subparagraph></paragraph></subsection> 
<subsection id="H73F36B3835D441A89F4D15DFC22BC8A"><enum>(c)</enum><header>Extension of duty refunds and wool research trust fund</header> 
<paragraph id="HE7D7B327751149879E312E74FE65BDF"><enum>(1)</enum><header>In general</header><text>The United States Customs Service shall pay to each manufacturer that receives a payment during calendar year 2005 under section 505 of the Trade and Development Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/200">Public Law 106–200</external-xref>; 114 Stat. 303), as amended by section 5101 of the Trade Act of 2002 (116 Stat. 1041), and that provides an affidavit, no later than March 1 of the year of the payment, that it remains a manufacturer in the United States as of January 1 of the year of the payment, 5 additional payments, each payment equal to the payment received for calendar year 2005 as follows:</text> 
<subparagraph id="HC64DBD2EDA1D49A39450361C9585F278"><enum>(A)</enum><text>The first payment to be made after January 1, 2006, but on or before April 15, 2006.</text></subparagraph> 
<subparagraph id="H946836F8E6484B95997C8CDC25002FEF"><enum>(B)</enum><text>The second, third, fourth, and fifth payments to be made after January 1, but on or before April 15, of each of the following four calendar years.</text></subparagraph></paragraph> 
<paragraph id="H49998D99BF254F1CB0C1FEA6E02987EF"><enum>(2)</enum><header>Successor-in-interest</header><text>Any manufacturer that becomes a successor-in-interest to a claimant of a payment under section 505 of the Trade and Development Act of 2000, as amended by section 5101 of the Trade Act of 2002, because of—</text> 
<subparagraph id="H60A184EA14AE49DE9F5E8E83B5F441C"><enum>(A)</enum><text>an assignment of the claim,</text></subparagraph> 
<subparagraph id="HEB4EF05FC52B423CB1A36DD44F92EF34"><enum>(B)</enum><text>an assignment of the original claimant’s right to manufacture under the same trade name,</text></subparagraph> 
<subparagraph id="HDC7081570E4E469F992D7F6D007189C"><enum>(C)</enum><text>a reorganization,</text></subparagraph><continuation-text continuation-text-level="paragraph">or otherwise, shall be eligible to claim the payment as if the successor manufacturer were the original claimant, without regard to <external-xref legal-doc="usc" parsable-cite="usc/31/3727">section 3727</external-xref> of title 31, United States Code. Such right to claim payment as a successor shall be effective as if the right were included in section 505 of the Trade and Development Act of 2000.</continuation-text></paragraph> 
<paragraph id="H6891211F9AFB49A2B739F06C15339583"><enum>(3)</enum><header>Extension of wool research, development, and promotion trust fund</header><text>Section 506(f) of the Trade and Development Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/200">Public Law 106–200</external-xref>; 114 Stat. 303), as amended by section 5102(c)(2) of the Trade Act of 2002 (116 Stat. 1047), is amended by striking <quote>2006</quote> and inserting <quote>2011</quote>.</text></paragraph> 
<paragraph id="HC0663E822C744CF4BADCBFCBF04BD498"><enum>(4)</enum><header>Commerce authority to promote domestic employment</header><text></text> 
<subparagraph id="H60FB381095FD4C7F90371B9D3700112B"><enum>(A)</enum><header>Grants to manufacturers of worsted wool fabrics</header><text>The Secretary of Commerce shall provide to—</text> 
<clause id="H9E04C6C2A1034AC4A400F63FB4A211B7"><enum>(i)</enum><text>persons who were, during calendar years 1999, 2000, and 2001, manufacturers of worsted wool fabric of the kind described in heading 9902.51.12 of the Harmonized Tariff Schedule of the United States, and</text></clause> 
<clause id="HB6C2667F53124CA192002C1D06E46179"><enum>(ii)</enum><text>persons who were, during such calendar years, manufacturers of worsted wool fabric of the kind described in heading 9902.51.11 of the Harmonized Tariff Schedule of the United States, </text></clause><continuation-text continuation-text-level="subparagraph">grants in each of calendar years 2005 through 2010 in the amounts determined under subparagraph (B).</continuation-text></subparagraph> 
<subparagraph id="HCA96C29356DE492C92350802F2156739"><enum>(B)</enum><header>Amounts</header><text></text> 
<clause id="HBCC2A46A9C124EF7A62B60F1CD049085" display-inline="yes-display-inline"><enum>(i)</enum><text>The total amount of grants to manufacturers under subparagraph (A)(i) shall be $2,666,000 each calendar year, allocated among such manufacturers on the basis of the percentage of each manufacturer’s production of the fabric described in heading 9902.51.12 of the Harmonized Tariff Schedule of the United States for calendar years 1999, 2000, and 2001, compared to the production of such fabric by all such manufacturers who qualify under subparagraph (A)(i) for such grants.</text></clause> 
<clause id="HD7131430FEA7491E87EA00F8B57B9C3C" indent="up1"><enum>(ii)</enum><text>The total amount of grants to manufacturers under subparagraph (A)(ii) shall be $2,666,000 each calendar year, allocated among such manufacturers on the basis of the percentage of each manufacturer’s production of the fabric described in heading 9902.51.11 of the Harmonized Tariff Schedule of the United States for calendar years 1999, 2000, and 2001, compared to the production of such fabric by all manufacturers who qualify under subparagraph (A)(ii) for such grants.</text></clause> 
<clause id="HDBB08FAE8C574139B899739B24B8CC3" indent="up1"><enum>(iii)</enum><text>Any grant awarded by the Secretary under this paragraph shall be final and not subject to appeal or protest.</text></clause></subparagraph></paragraph> 
<paragraph id="H194E2A2DBD69475CB2C205DB074B985B"><enum>(5)</enum><header>Authorization</header><text>There are authorized to be appropriated and are hereby appropriated out of amounts in the general fund of the Treasury not otherwise appropriated such sums as are necessary to carry out this subsection.</text></paragraph> </subsection> 
<subsection id="H3C0064004BDE49E089E0D0CEE428A964"><enum>(d)</enum><header>Effective date for duty reduction</header><text>The amendment made by subsection (a)(1)(B) shall apply to goods entered, or withdrawn from warehouse for consumption, on or after January 1, 2005.</text></subsection></section> 
<section id="H43F01C1AB4E84504A781C129660097C8"><enum>3.</enum><header>Labeling of wool products to facilitate compliance and protect consumers</header> 
<subsection id="H3735D8F390BC4F7BB6478811002F0087"><enum>(a)</enum><header>In general</header><text>Section 4 of the Wool Products Labeling Act of 1939 (<external-xref legal-doc="usc" parsable-cite="usc/15/68b">15 U.S.C. 68b(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HC9E76FFED99B4D44A3C5A1A8818DE168"><enum>(5)</enum><text>In the case of a wool product stamped, tagged, labeled, or otherwise identified as—</text> 
<subparagraph id="HDE280DB6AE0746CA829D3D9124B73BF2"><enum>(A)</enum><text><quote>Super 80’s</quote> or <quote>80’s</quote>, if the average fiber diameter thereof does not average 19.5 microns or finer;</text></subparagraph> 
<subparagraph id="H3586481A2A7A4E99AD55D563BFD6B845"><enum>(B)</enum><text><quote>Super 90’s</quote> or <quote>90’s</quote>, if the average fiber diameter thereof does not average 19.0 microns or finer;</text></subparagraph> 
<subparagraph id="H3730351AE16649EC97A42E80974EEB95"><enum>(C)</enum><text><quote>Super 100’s</quote> or <quote>100’s</quote>, if the average fiber diameter thereof does not average 18.5 microns or finer;</text></subparagraph> 
<subparagraph id="HF77D84B88BCF4CE196AA83004EDDD27D"><enum>(D)</enum><text><quote>Super 110’s</quote> or <quote>110’s</quote>, if the average diameter of wool fiber thereof does not average 18.0 microns or finer;</text></subparagraph> 
<subparagraph id="HDE1B7D5712874D9883606B063BF22EDB"><enum>(E)</enum><text><quote>Super 120’s</quote> or <quote>120’s</quote>, if the average diameter of wool fiber thereof does not average 17.5 microns or finer;</text></subparagraph> 
<subparagraph id="H9BDA6F9EF6F345150002362CE275C67C"><enum>(F)</enum><text><quote>Super 130’s</quote> or <quote>130’s</quote>, if the average diameter of wool fiber thereof does not average 17.0 microns or finer;</text></subparagraph> 
<subparagraph id="H305B35D7BCCC4F83BAD3D664C13F67EB"><enum>(G)</enum><text><quote>Super 140’s</quote> or <quote>140’s</quote>, if the average diameter of wool fiber thereof does not average 16.5 microns or finer;</text></subparagraph> 
<subparagraph id="H7B71EEA7DF874314ACF747B940E2CC0"><enum>(H)</enum><text><quote>Super 150’s</quote> or <quote>150’s</quote>, if the average diameter of wool fiber thereof does not average 16.0 microns or finer;</text></subparagraph> 
<subparagraph id="H818751211A764347AC4E79B32D4E9707"><enum>(I)</enum><text><quote>Super 160’s</quote> or <quote>160’s</quote>, if the average diameter of wool fiber thereof does not average 15.5 microns or finer;</text></subparagraph> 
<subparagraph id="H85A986227BD6416C9639C9C73CAE0719"><enum>(J)</enum><text><quote>Super 170’s</quote> or <quote>170’s</quote>, if the average diameter of wool fiber thereof does not average 15.0 microns or finer;</text></subparagraph> 
<subparagraph id="H38B73EE7CB58431190A556321529621"><enum>(K)</enum><text><quote>Super 180’s</quote> or <quote>180’s</quote>, if the average diameter of wool fiber thereof does not average 14.5 microns or finer;</text></subparagraph> 
<subparagraph id="HC7B3479349D742D6BEBB333C15627D7B"><enum>(L)</enum><text><quote>Super 190’s</quote> or <quote>190’s</quote>, if the average diameter of wool fiber thereof does not average 14.0 microns or finer;</text></subparagraph> 
<subparagraph id="H27FCAC59E3954832B1008BF85EC5A7F9"><enum>(M)</enum><text><quote>Super 200’s</quote> or <quote>200’s</quote>, if the average diameter of wool fiber thereof does not average 13.5 microns or finer; and</text></subparagraph> 
<subparagraph id="H4D075668F46E4AF2A9025EBD00D6A955"><enum>(N)</enum><text><quote>Super 210’s</quote> or <quote>210’s</quote>, if the average diameter of wool fiber thereof does not average 13.0 microns or finer.</text></subparagraph><continuation-text continuation-text-level="paragraph">In each such case, the average fiber diameter may be subject to a variation of 0.25 microns, and may be subject to such other standards or deviations therefrom as adopted by regulation by the Commission.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H92911BFEAAD54A16A986DBCA3DCC8B2"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to wool products manufactured on or after January 1, 2005.</text></subsection></section>
