<official-title>To provide for the conveyance of certain public land in Clark County, Nevada, for use as a heliport.</official-title>

<section section-type="section-one" id="HD4EFAB6E0B4C4B48B5E2DDEF162B9DE"><enum>1.</enum><header>Conveyance of property to clark County, Nevada</header> 
<subsection id="H3DFAA1F295CA4603B3205DFC5B2C565"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> 
<paragraph id="H361EF804306941AEA181C2ADF03ED38E"><enum>(1)</enum><text>the Las Vegas Valley in the State of Nevada is the fastest growing community in the United States;</text></paragraph> 
<paragraph id="H87812175E49C459AAAA4D8976EEED991"><enum>(2)</enum><text>helicopter tour operations are conflicting with the needs of long-established residential communities in the Valley; and</text></paragraph> 
<paragraph id="HDC378C46D23B475AB0215E59D87E0EE"><enum>(3)</enum><text>the designation of a public heliport in the Valley that would reduce conflicts between helicopter tour operators and residential communities is in the public interest.</text></paragraph></subsection> 
<subsection id="HBD4D4E506DA447F98FBFFB1DBE1780A9"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to provide a suitable location for the establishment of a commercial service heliport facility to serve the Las Vegas Valley in the State of Nevada while minimizing and mitigating the impact of air tours on the Sloan Canyon National Conservation Area and North McCullough Mountains Wilderness.</text></subsection> 
<subsection id="HF1BDD6B4D0F64082A34851E81592EA82"><enum>(c)</enum><header>Definitions</header><text>In this Act:</text> 
<paragraph id="H74D90B7AB3184B24BCF15DF9DC73005C"><enum>(1)</enum><header>Conservation Area</header><text>The term <term>Conservation Area</term> means the Sloan Canyon National Conservation Area established by section 604(a) of the Clark County Conservation of Public Land and Natural Resources Act of 2002 (116 Stat. 2010).</text></paragraph> 
<paragraph id="H72C3943075D8401DAF02970072142FFD"><enum>(2)</enum><header>County</header><text>The term <term>County</term> means Clark County, Nevada.</text></paragraph> 
<paragraph id="HA7AFCC907FFA474C9B6714C7486691B2"><enum>(3)</enum><header>Helicopter tour</header> 
<subparagraph id="H03670BB53A324293B802064D2E5BF600"><enum>(A)</enum><header>In general</header><text>The term <term>helicopter tour</term> means a commercial helicopter tour operated for profit.</text></subparagraph> 
<subparagraph id="H2C602AAC10D549A0968D2048ACBBDB96"><enum>(B)</enum><header>Exclusion</header><text>The term <term>helicopter tour</term> does not include a helicopter tour that is carried out to assist a Federal, State, or local agency.</text></subparagraph></paragraph> 
<paragraph id="H62A5CF4ED93441239311ED191FD906E"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="H572E896188764BF800D05DDFE815006B"><enum>(5)</enum><header>Wilderness</header><text>The term <term>Wilderness</term> means the North McCullough Mountains Wilderness established by section 202(a)(13) of the Clark County Conservation of Public Land and Natural Resources Act of 2002 (116 Stat. 2000).</text></paragraph></subsection> 
<subsection id="HEE309927D611493A82F318D6D1D07B00"><enum>(d)</enum><header>Conveyance</header><text>As soon as practicable after the date of enactment of this Act, the Secretary shall convey to the County, subject to valid existing rights, for no consideration, all right, title, and interest of the United States in and to the parcel of land described in subsection (e).</text></subsection> 
<subsection id="H61ADD37F5A5847E08CEDA3AE5E00712B"><enum>(e)</enum><header>Description of land</header><text>The parcel of land to be conveyed under subsection (d) is the parcel of approximately 229 acres of land depicted as tract A on the map entitled <quote>Clark County Public Heliport Facility</quote> and dated May 3, 2004.</text></subsection> 
<subsection id="H762FF543B8C744F58C661C33AD875E8"><enum>(f)</enum><header>Use of land</header> 
<paragraph id="H1057BF12B90A432BA972B6008C423B44"><enum>(1)</enum><header>In general</header><text>The parcel of land conveyed under subsection (d)—</text> 
<subparagraph id="H0CF6ECA05F4C4EFB82065951C7BABCB0"><enum>(A)</enum><text>shall be used by the County for the operation of a heliport facility under the conditions stated in paragraphs (2) and (3); and</text></subparagraph> 
<subparagraph id="H991E5C84C0AF417484AF7B805B8DE4A1"><enum>(B)</enum><text>shall not be disposed of by the County.</text></subparagraph></paragraph> 
<paragraph id="HAA3E709756E54B3480F07600AAA2E3C1"><enum>(2)</enum><header>Imposition of fees</header> 
<subparagraph id="H43C6315679FA4F9E90E9E6B29D980039"><enum>(A)</enum><header>In general</header><text>Any operator of a helicopter tour originating from or concluding at the parcel of land described in subsection (e) shall pay to the Clark County Department of Aviation a $3 conservation fee for each passenger on the helicopter tour if any portion of the helicopter tour occurs over the Conservation Area.</text></subparagraph> 
<subparagraph id="H8F4892C09D9F4F3D91A42F67FFF235C5"><enum>(B)</enum><header>Disposition of funds</header><text>Any amounts collected under subparagraph (A) shall be deposited in a special account in the Treasury of the United States, which shall be available to the Secretary, without further appropriation, for the management of cultural, wildlife, and wilderness resources on public land in the State of Nevada.</text></subparagraph></paragraph> 
<paragraph id="HE84C7DB621024415008086ADB5EBB222"><enum>(3)</enum><header>Flight path</header><text>Except for safety reasons, any helicopter tour originating or concluding at the parcel of land described in subsection (e) that flies over the Conservation Area shall not fly—</text> 
<subparagraph id="H8F611AFD41BC4C6A84A94E29FCB6321"><enum>(A)</enum><text>over any area in the Conservation Area except the area that is between 3 and 5 miles north of the latitude of the southernmost boundary of the Conservation Area;</text></subparagraph> 
<subparagraph id="H51D3607F90344C1AB142F601B4D45C82"><enum>(B)</enum><text>lower than 1,000 feet over the eastern segments of the boundary of the Conservation Area; or</text></subparagraph> 
<subparagraph id="H35DBE597A2B847B0BFB0B1B35223AB68"><enum>(C)</enum><text>lower than 500 feet over the western segments of the boundary of the Conservation Area.</text></subparagraph></paragraph> 
<paragraph id="H6D015470F4DD4C39B817C81E20678C00"><enum>(4)</enum><header>Reversion</header><text>If the County ceases to use any of the land described in subsection (d) for the purpose described in paragraph (1)(A) and under the conditions stated in paragraphs (2) and (3)—</text> 
<subparagraph id="H260C81E02983449DA17E32AC2CD7F17"><enum>(A)</enum><text>title to the parcel shall revert to the United States, at the option of the United States; and</text></subparagraph> 
<subparagraph id="H892D6F9263444F1F00A60077A856ADE2"><enum>(B)</enum><text>the County shall be responsible for any reclamation necessary to revert the parcel to the United States.</text></subparagraph></paragraph></subsection> 
<subsection id="H1BB3E1406EE6437BA6E7009188AAC325"><enum>(g)</enum><header>Administrative costs</header><text>The Secretary shall require, as a condition of the conveyance under subsection (d), that the County pay the administrative costs of the conveyance, including survey costs and any other costs associated with the transfer of title.</text></subsection></section>
