<official-title>To amend title 49, United States Code, to establish the Pipeline Safety Administration in the Department of Transportation.</official-title>

<section id="HC4D140E3BE144E4AAC7755E7F5E0B9C1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="HCFBBCA25386349DD9FF55DCB96E7C7EB"><enum>2.</enum><header>Pipeline Safety Administration</header> 
<subsection id="HE8A511F4FF984FB5BCCC03F819F75F4F"><enum>(a)</enum><header>In General</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/1">Chapter 1</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<section id="H27056ABBD2C441F980596300A91C85C9"><enum>116.</enum><header>Pipeline Safety Administration</header> 
<subsection id="HDB74C10D46B6443B937480BD4E177017"><enum>(a)</enum><header>In general</header><text>The Pipeline Safety Administration shall be an administration in the Department of Transportation.</text></subsection> 
<subsection id="H8038AB5DBD6B49F4B97C00C5F5B98B9B"><enum>(b)</enum><header>Administrator</header><text>The head of the Administration shall be the Administrator who shall be appointed by the President, by and with the advice and consent of the Senate. The Administrator shall report directly to the Secretary of Transportation.</text></subsection> 
<subsection id="HF1562C7C5EA64E9B8258D41F64B396E6"><enum>(c)</enum><header>Deputy Administrator</header><text>The Administration shall have a Deputy Administrator who shall be appointed by the Secretary of Transportation. The Deputy Administrator shall carry out duties and powers prescribed by the Administrator.</text></subsection> 
<subsection id="H6900735AAC574756AFA595239FC0ECA5"><enum>(d)</enum><header>Responsibilities of Administrator</header><text>The Administrator shall carry out the duties and powers vested in the Secretary under chapter 601 and additional duties and powers related to pipeline safety prescribed by the Secretary.</text></subsection> 
<subsection id="H9EF23894A4594F51AF606B115358872E"><enum>(e)</enum><header>Limitation on Statutory Construction</header><text>Nothing in this section shall affect any delegation of authority, regulation, order, approval, exemption, waiver, contract, or other administrative act of the Secretary with respect to laws administered through the Research and Special Programs Administration as of the day before the date of enactment of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF2151637455A449B8914BB933FBDF700"><enum>(b)</enum><header>Conforming Amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/1">chapter 1</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<subsection id="H95BECF7B0B984A78B247DC1300D51BD4"><enum>(c)</enum><header>Duties of research and special programs administration</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/112">Section 112(d)</external-xref> of title 49, United States Code, is amended by striking paragraph (2) and redesignating paragraphs (3) and (4) as paragraphs (2) and (3), respectively.</text></subsection> 
<subsection id="H33B913BAEC5B46F79CA66596622473DF"><enum>(d)</enum><header>Executive schedule</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/5313">Section 5313</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>

<subsection id="H8176967748F74A84AB81EC879FD5286F"><enum>(e)</enum><header>Transition</header><text>The Secretary of Transportation shall provide for the transfer of duties and powers under the amendments made by this Act.</text></subsection></section>
