<official-title>To amend the Military Construction Authorization Act for Fiscal Year 2002 to modify the terms and scope of a land exchange involving Fort Lewis, Washington, authorized between the Secretary of the Army and the Nisqually Tribe and affecting the interests of the Bonneville Power Administration.</official-title>

<section id="H729A9F990AEC48F1AB778993FE7DD4EC" section-type="section-one"><enum>1.</enum><header> Modification of land exchange and consolidation, Fort Lewis, Washington</header> 
<subsection id="HD76DA5533B884E2E008486694F7DCFF3"><enum>(a)</enum><header>Property to be transferred to Secretary of the Interior in trust</header><text>Subsection (a)(1) of section 2837 of the Military Construction Authorization Act for Fiscal Year 2002 (division B of <external-xref legal-doc="public-law" parsable-cite="pl/107/107">Public Law 107–107</external-xref>; 115 Stat. 1315) is amended—</text> 
<paragraph id="H3CB5C13B562B4E34A2B4EBCCD3626619"><enum>(1)</enum><text>by striking <quote>may convey to</quote> and inserting <quote>may transfer to the Secretary of the Interior, in trust for</quote>; and</text></paragraph> 
<paragraph id="H93EA8721C44C4D6A8D00152FE900397D"><enum>(2)</enum><text>by striking <quote>Washington, in</quote> and all that follows through the period and inserting <quote>Washington. The Secretary of the Army may make the transfer under the preceding sentence, and the Secretary of the Interior may accept the property transferred in trust for the Nisqually Tribe under the preceding sentence, only in conjunction with the conveyance described in subsection (b)(2).</quote>.</text></paragraph></subsection> 
<subsection id="H316A6A80FCCC4B60B95B9EF64E17BB2B"><enum>(b)</enum><header>Increase in acreage to be transferred</header><text>Such subsection is further amended by striking <quote>138 acres</quote> and inserting <quote>168 acres</quote>.</text></subsection> 
<subsection id="HB2EF8BA28AE143AAB8FF5DB5EF5080A6"><enum>(c)</enum><header>Qualification on property to be transferred</header><text>Subsection (a)(2) of such section is amended—</text> 
<paragraph id="HB9CF5234C24545BEBA976C744D1E4501"><enum>(1)</enum><text>by striking <quote>conveyance</quote> and inserting <quote>transfer</quote>; and</text></paragraph> 
<paragraph id="HE422D52349844B389B39CB10533B97F5"><enum>(2)</enum><text>by striking <quote>or the right of way described in subsection (c)</quote> and inserting <quote>located on the real property transferred under that paragraph</quote>.</text></paragraph></subsection> 
<subsection id="H5E6FA9AF9C3E493F94816DD3C087F6FE"><enum>(d)</enum><header>Consideration</header><text>Subsection (b) of such section is amended—</text> 
<paragraph id="HFD9CE4ED96ED4E6A842F41869E7397FC"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>conveyance</quote> and inserting <quote>transfer</quote>; and</text></paragraph> 
<paragraph id="H39AF9EBB5DBF4752905B1D0768F029F6"><enum>(2)</enum><text>in paragraph (2), by striking <quote>fee title over the acquired property to the Secretary</quote> and inserting <quote>to the United States fee title to the property acquired under paragraph (1), free from all liens, encumbrances or other interests other than those, if any, acceptable to the Secretary of the Army</quote>.</text></paragraph></subsection> 
<subsection id="H93E150EE4B534290B4EEE0B5DDD0D61F"><enum>(e)</enum><header>Treatment of existing permit rights; grant of easement</header><text>Such section is further amended—</text> 
<paragraph id="HF4E51FE5D4F54770BD293D328E00C249"><enum>(1)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; and</text></paragraph> 
<paragraph id="HC08700398C864A05A8D96170A44300DB"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsection:</text>

<subsection id="H9902BFBADA954C9180BD796C462851B5"><enum>(d)</enum><header>Treatment of existing permit rights; grant of easement</header> 
<paragraph display-inline="yes-display-inline" id="HB48FCED4DB7042858219A5DD866093C0"><enum>(1)</enum><text>The transfer under subsection (a) recognizes and preserves to the Bonneville Power Administration, in perpetuity and without the right of revocation except as provided in paragraph (2), rights in existence at the time of the conveyance under the permit dated February 4, 1949, as amended January 4, 1952, between the Department of the Army and the Bonneville Power Administration with respect to any portion of the property transferred under subsection (a) upon which the Bonneville Power Administration retains transmission facilities. The rights recognized and preserved include the right to upgrade those transmission facilities.</text></paragraph> 
<paragraph indent="up1" id="HF01837FEF3E74288A000002C20C84BDA"><enum>(2)</enum><text>The permit rights recognized and preserved under paragraph (1) shall terminate only upon the Bonneville Power Administration’s relocation of the transmission facilities referred to in paragraph (1), and then only with respect to that portion of those transmission facilities that are relocated.</text></paragraph> 
<paragraph indent="up1" id="H62D1BE7479A04E9096363DFAA3939547"><enum>(3)</enum><text>The Secretary of the Interior, as trustee for the Nisqually Tribe, shall grant to the Bonneville Power Administration, without consideration and subject to the same rights recognized and preserved in paragraph (1), such additional easements across the property transferred under subsection (a) as the Bonneville Power Administration considers necessary to accommodate the relocation or reconnection of Bonneville Power Administration transmission facilities from property owned by the Tribe and held by the Secretary of the Interior in trust for the Tribe.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HDFBDD539854541A29702D70048B190E9"><enum>(f)</enum><header>Conforming amendments</header> 
<paragraph display-inline="yes-display-inline" id="H1E9A05B7081E4757ADB16C0066F5EFD0"><enum>(1)</enum><text>Subsection (c) of such section is amended by inserting <quote>of the Army</quote> after <quote>Secretary</quote>.</text></paragraph> 
<paragraph indent="up1" id="H2973BA5213D141FCBBDD6DD10CF44F"><enum>(2)</enum><text>Subsection (e) of such section (as redesignated by subsection (e)(1)) is amended—</text> 
<subparagraph id="H23782D39413E4B77AEC359012C8BFCF4"><enum>(A)</enum><text>by striking <quote>conveyed</quote> and inserting <quote>transferred</quote>;</text></subparagraph> 
<subparagraph id="H71F4D384CCED4926BD23001D0663F8CA"><enum>(B)</enum><text>by inserting <quote>of the Army</quote> after <quote>Secretary</quote>; and</text></subparagraph> 
<subparagraph id="HA6D69441FA5145C4BE00E66348E7A220"><enum>(C)</enum><text>by striking <quote>the recipient of the property being surveyed</quote> and inserting <quote>the Tribe, in the case of the transfer under subsection (a), and the Secretary of the Army, in the case of the acquisition under subsection (b)</quote>.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H713A24AC29954C1096A8C62D44FCBE40"><enum>(3)</enum><text>Subsection (f) of such section (as redesignated by subsection (e)(1)) is amended—</text> 
<subparagraph id="H4DA7E9F17C17497392ACD8705E17AE32"><enum>(A)</enum><text>by inserting <quote>of the Army</quote> after <quote>Secretary</quote> both places it appears; and</text></subparagraph> 
<subparagraph id="H0E1998130C0344EB872274BAE83DC986"><enum>(B)</enum><text>by striking <quote>conveyances under this section</quote> and inserting <quote>transfer under subsection (a) and conveyances under subsections (b)(2) and (c)</quote>.</text></subparagraph></paragraph></subsection></section>
