<official-title>To provide that when a company makes a charitable donation of equipment, the company is generally not liable for harm later caused by that equipment, and for other purposes.</official-title>

<section id="H3FDB010F3278429695F8B7D636DD71F" section-type="section-one"><enum>1.</enum><header>Charitable donations liability reform for in-kind corporate contributions</header> 
<subsection id="H139E41D78C5F423F82938F1F2CCC28F5"><enum>(a)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="H3F765F2BAF2D4C98A873B9B1A6C23C78"><enum>(1)</enum><header>Aircraft</header><text>The term <term>aircraft</term> has the meaning provided that term in <external-xref legal-doc="usc" parsable-cite="usc/49/40102">section 40102(6)</external-xref> of title 49, United States Code.</text></paragraph> 
<paragraph id="HDE0179D9FEA94C1D000022A1523BC294"><enum>(2)</enum><header>Business entity</header><text>The term <term>business entity</term> means a firm, corporation, association, partnership, consortium, joint venture, or other form of enterprise.</text></paragraph> 
<paragraph id="H32FCC0EFDC9741A2A396AF609E697B57"><enum>(3)</enum><header>Equipment</header><text>The term <term>equipment</term> includes mechanical equipment, electronic equipment, and office equipment.</text></paragraph> 
<paragraph id="HC2C55C8B37604AB68CB044B49584AB32"><enum>(4)</enum><header>Facility</header><text>The term <term>facility</term> means any real property, including any building, improvement, or appurtenance.</text></paragraph> 
<paragraph id="H91D6AF49020742ACB7477E247E2000D3"><enum>(5)</enum><header>Gross negligence</header><text>The term <term>gross negligence</term> means voluntary and conscious conduct by a person with knowledge (at the time of the conduct) that the conduct is likely to be harmful to the health or well-being of another person.</text></paragraph> 
<paragraph id="HE25D54EC94144F2FBE2F6F19654F08FB"><enum>(6)</enum><header>Intentional misconduct</header><text>The term <term>intentional misconduct</term> means conduct by a person with knowledge (at the time of the conduct) that the conduct is harmful to the health or well-being of another person.</text></paragraph> 
<paragraph id="H4287D94F9DC64A12BBA4D28EC282F5F"><enum>(7)</enum><header>Motor vehicle</header><text>The term <term>motor vehicle</term> has the meaning provided that term in <external-xref legal-doc="usc" parsable-cite="usc/49/30102">section 30102(6)</external-xref> of title 49, United States Code.</text></paragraph> 
<paragraph id="HCD1F618AC2F240F890D87284BA384B1F"><enum>(8)</enum><header>Nonprofit organization</header><text>The term <term>nonprofit organization</term> means—</text> 
<subparagraph id="HBC4F15A2D1594FFD81E2D00933400BD"><enum>(A)</enum><text>any organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code; or</text></subparagraph> 
<subparagraph id="HB7F654B842664A3C903EB8F4E88546C7"><enum>(B)</enum><text>any not-for-profit organization organized and conducted for public benefit and operated primarily for charitable, civic, educational, religious, welfare, or health purposes.</text></subparagraph></paragraph> 
<paragraph id="H0BD09AFF1F15499DA3A06C58F4B3BBA9"><enum>(9)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the Northern Mariana Islands, any other territory or possession of the United States, or any political subdivision of any such State, territory, or possession.</text></paragraph></subsection> 
<subsection id="H5EE806D200174BDCAD36F79C55FFE797"><enum>(b)</enum><header>Liability</header> 
<paragraph id="HD357F12F03CE41B4B9E2A3C5B6FED179"><enum>(1)</enum><header>Liability of business entities that donate equipment to nonprofit organizations</header> 
<subparagraph id="H37F4E042C5394031A71B80F24C825435"><enum>(A)</enum><header>In general</header><text>Subject to subsection (c), a business entity shall not be subject to civil liability relating to any injury or death that results from the use of equipment donated by a business entity to a nonprofit organization.</text></subparagraph> 
<subparagraph id="H5935C29B9F3745689846EA9BAB35A122"><enum>(B)</enum><header>Application</header><text>This paragraph shall apply with respect to civil liability under Federal and State law.</text></subparagraph></paragraph> 
<paragraph id="H5AB555A2807043B19595E79C5CF324E6"><enum>(2)</enum><header>Liability of business entities providing use of facilities to nonprofit organizations</header> 
<subparagraph id="H0A805BF3DA8E450B8249AEE21EA74A1"><enum>(A)</enum><header>In general</header><text>Subject to subsection (c), a business entity shall not be subject to civil liability relating to any injury or death occurring at a facility of the business entity in connection with a use of such facility by a nonprofit organization, if—</text> 
<clause id="H0026C5F9E6A54E64A471C069A6C3D6D4"><enum>(i)</enum><text>the use occurs outside of the scope of business of the business entity;</text></clause> 
<clause id="H8AA385741FCE4097B1F47B5CBC28BAD4"><enum>(ii)</enum><text>such injury or death occurs during a period that such facility is used by the nonprofit organization; and</text></clause> 
<clause id="H71BEBBB614AC4C18B2F0E00D0DEBE3C"><enum>(iii)</enum><text>the business entity authorized the use of such facility by the nonprofit organization.</text></clause></subparagraph> 
<subparagraph id="H497D5970DE334278BBDA03378F112C95"><enum>(B)</enum><header>Application</header><text>This paragraph shall apply—</text> 
<clause id="H8CC1895101E84D01853324F00BDE6D9"><enum>(i)</enum><text>with respect to civil liability under Federal and State law; and</text></clause> 
<clause id="H6EFFC34975764FD9A230EF987500244F"><enum>(ii)</enum><text>regardless of whether a nonprofit organization pays for the use of a facility.</text></clause></subparagraph></paragraph> 
<paragraph id="H7EACAB824A724C95A4D107449023A700"><enum>(3)</enum><header>Liability of business entities providing use of a motor vehicle or aircraft</header> 
<subparagraph id="H74567BEB34044E8782DFAA2CB35C5767"><enum>(A)</enum><header>In general</header><text>Subject to subsection (c), a business entity shall not be subject to civil liability relating to any injury or death occurring as a result of the operation of aircraft or a motor vehicle of a business entity loaned to a nonprofit organization for use outside of the scope of business of the business entity, if—</text> 
<clause id="H2D467D96CDEE4E57979D7D08A2259C14"><enum>(i)</enum><text>such injury or death occurs during a period that such motor vehicle or aircraft is used by a nonprofit organization; and</text></clause> 
<clause id="HE90E8CAED3F14E2985601B008B1248F7"><enum>(ii)</enum><text>the business entity authorized the use by the nonprofit organization of motor vehicle or aircraft that resulted in the injury or death.</text></clause></subparagraph> 
<subparagraph id="H608B515C44724B4000E799F3ECC95700"><enum>(B)</enum><header>Application</header><text>This paragraph shall apply—</text> 
<clause id="HAB4FF3FC7E3249AFB65F8847FAD90591"><enum>(i)</enum><text>with respect to civil liability under Federal and State law; and</text></clause> 
<clause id="H822FF76A62D94FEF0060C721FDC62D4C"><enum>(ii)</enum><text>regardless of whether a nonprofit organization pays for the use of the aircraft or motor vehicle.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H903967FC3618450E8DB3DDF5D3222419"><enum>(c)</enum><header>Exceptions</header><text>Subsection (b) shall not apply to an injury or death that results from an act or omission of a business entity that constitutes gross negligence or intentional misconduct.</text></subsection> 
<subsection id="H1D7E75599B6142E386AA3EDA501872C1"><enum>(d)</enum><header>Superseding provision</header> 
<paragraph id="H3017DF5847234A65A393E46307089E26"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2) and subsection (e), this section preempts the laws of any State to the extent that such laws are inconsistent with this section, except that this section shall not preempt any State law that provides additional protection for a business entity for an injury or death described in a paragraph of subsection (b) with respect to which the conditions specified in such paragraph apply.</text></paragraph> 
<paragraph id="H51290B9B039047AD9E794C9C7B8E2292"><enum>(2)</enum><header>Limitation</header><text>Nothing in this section shall be construed to supersede any Federal or State health or safety law.</text></paragraph></subsection> 
<subsection id="H94A995B88CDC46B6A2B43824807829D0"><enum>(e)</enum><header>Election of state regarding nonapplicability</header><text>A provision of this section shall not apply to any civil action in a State court against a business entity in which all parties are citizens of the State if such State enacts a statute—</text> 
<paragraph id="HCA3A31F954C04413B994B41FFB90EC2F"><enum>(1)</enum><text>citing the authority of this section;</text></paragraph> 
<paragraph id="H58A8FDFD884E4598B3A6D2A54333356E"><enum>(2)</enum><text>declaring the election of such State that such provision shall not apply to such civil action in the State; and</text></paragraph> 
<paragraph id="H04AF52A7C0C24731ADF751048F9EBDFE"><enum>(3)</enum><text>containing no other provisions.</text></paragraph></subsection> 
<subsection id="H930C454942154253BE145D5EF657C6F3"><enum>(f)</enum><header>Effective date</header><text>This section shall apply to injuries (and deaths resulting therefrom) occurring on or after the date of the enactment of this Act.</text></subsection></section>
