<official-title>To amend title 18, United States Code, to strengthen prohibitions against animal fighting, and for other purposes.</official-title>

<section id="H8AAEAF29170B4EE28B69DCBD16B4A417" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="H86E817F014564CEA9E084B28B200E32E"><enum>2.</enum><header>Enforcement of animal fighting prohibitions</header> 
<subsection id="H803DEFF66A824652BCAC94F941B5DAE"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/3">Chapter 3</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<section id="H62426494617E45FB9B6500115F39398D"><enum>39.</enum><header>Animal fighting prohibition</header> 
<subsection id="H524D3CF3983245DD809DE794B807EF2B"><enum>(a)</enum><header>Sponsoring or exhibiting an animal in an animal fighting venture</header> 
<paragraph id="H88D0094146204323A66BE2FBAC95A239"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), it shall be unlawful for any person to knowingly sponsor or exhibit an animal in an animal fighting venture, if any animal in the venture was moved in interstate or foreign commerce.</text></paragraph> 
<paragraph id="HF2A23488983A432EBFADF787D4F50944"><enum>(2)</enum><header>Special rule for certain states</header><text>With respect to fighting ventures involving live birds in a State where it would not be in violation of the law, it shall be unlawful under this subsection for a person to sponsor or exhibit a bird in the fighting venture only if the person knew that any bird in the fighting venture was knowingly bought, sold, delivered, transported, or received in interstate or foreign commerce for the purpose of participation in the fighting venture.</text></paragraph></subsection> 
<subsection id="H8CF3D286BCF1426EA95E88001C12F515"><enum>(b)</enum><header>Buying, selling, delivering, or transporting animals for participation in animal fighting venture</header><text>It shall be unlawful for any person to knowingly sell, buy, transport, or deliver, or receive for purposes of transportation, in interstate or foreign commerce, any dog or other animal for purposes of having the dog or other animal participate in an animal fighting venture. </text></subsection> 
<subsection id="H674ABE5087914D31B1273F936F4CB652"><enum>(c)</enum><header>Use of postal service or other interstate instrumentality for promoting animal fighting venture</header><text>It shall be unlawful for any person to knowingly use the mail service of the United States Postal Service or any instrumentality of interstate commerce for commercial speech promoting an animal fighting venture except as performed outside the limits of the States of the United States.</text></subsection> 
<subsection id="H36DC0D1876344BF6A8BFCAF7AF8DE5B3"><enum>(d)</enum><header>Violation of state law</header><text>Notwithstanding subsection (c), the activities prohibited by such subsection shall be unlawful with respect to fighting ventures involving live birds only if the fight is to take place in a State where it would be in violation of the laws thereof.</text></subsection> 
<subsection id="HDDC95A889E3F4DE0A9B4C895B6FFA3D0"><enum>(e)</enum><header>Sharp instruments</header><text>It shall be unlawful for any person to knowingly sell, buy, transport, or deliver in interstate or foreign commerce a knife, a gaff, or any other sharp instrument attached, or designed or intended to be attached, to the leg of a bird for use in an animal fighting venture.</text></subsection> 
<subsection id="H207D172B0B8B4B7DACA1ED1DC3AF2555"><enum>(f)</enum><header>Penalties</header><text>Any person who violates subsection (a), (b), (c), or (e) shall be fined under this title or imprisoned for not more than 2 years, or both, for each such violation.</text></subsection> 
<subsection id="HC3C5BC54081545E9B8FBADF6008FDB61"><enum>(g)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="HCBDC00033AE5417F831B16AC7FE0A235"><enum>(1)</enum><text>the term <quote>animal fighting venture</quote> means any event which involves a fight between at least two animals and is conducted for purposes of sport, wagering, or entertainment except that the term <quote>animal fighting venture</quote> shall not be deemed to include any activity the primary purpose of which involves the use of one or more animals in hunting another animal or animals, such as waterfowl, bird, raccoon, or fox hunting; </text></paragraph> 
<paragraph id="HCFC706ABA13E4BD7AD2976A45B083CA9"><enum>(2)</enum><text>the term <quote>instrumentality of interstate commerce</quote> means any written, wire, radio, television or other form of communication in, or using a facility of, interstate commerce; </text></paragraph> 
<paragraph id="H87099A038A6945B0A68F202FC5A1CA58"><enum>(3)</enum><text>the term <quote>State</quote> means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, and any territory or possession of the United States; and</text></paragraph> 
<paragraph id="H65DC91F546004EC487C400BE1615C92B"><enum>(4)</enum><text>the term <quote>animal</quote> means any live bird, or any live dog or other mammal, except man.</text></paragraph></subsection> 
<subsection id="HB5D40BBD86284398A5D87650EC09D0E2"><enum>(h)</enum><header>Conflict with state law</header><text>The provisions of this section do not supersede or otherwise invalidate any such State, local, or municipal legislation or ordinance relating to animal fighting ventures except in case of a direct and irreconcilable conflict between any requirements thereunder and this section or any rule, regulation, or standard hereunder.</text></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H9D8A3A6E344E442FA48DD81B71FEA2C6"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/3">chapter 3</external-xref> of title 18, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/38">section 38</external-xref> the following:</text>
