<official-title>To require the Secretary of the Treasury to mint coins in commemoration of the Old Mint at San Francisco, otherwise known as the <quote>Granite Lady</quote>, and for other purposes.</official-title>

<section section-type="section-one" id="HC5121F2086684EC9BA8DBC4C6D74EE62"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="HA7247F250FF441F6BE5F45A9D973578B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress hereby finds as follows:</text> 
<paragraph id="HA0E9B99BF3884DFABB951E605ED280F2"><enum>(1)</enum><text>The Granite Lady played an important role in the history of the Nation.</text></paragraph> 
<paragraph id="H28B51BD7E02746DC9371F5FB081766CA"><enum>(2)</enum><text>The San Francisco Mint was established pursuant to an Act of Congress of July 3, 1852, to convert miners’ gold from the California gold rush into coins.</text></paragraph> 
<paragraph id="H922778BCE82D453DB3154CDE315F825C"><enum>(3)</enum><text>The San Francisco Old Mint Building was designed by architect A.B. Mullett, who also designed the United States Treasury Building and the Old Executive Office Building.</text></paragraph> 
<paragraph id="H681CF5098A8E4551BFD817DC37DE346"><enum>(4)</enum><text>The solid construction of the Granite Lady enabled it to survive the 1906 San Francisco earthquake and fire, making it the only financial institution that was able to operate immediately after the earthquake as the treasury for disaster relief funds for the city of San Francisco.</text></paragraph> 
<paragraph id="H6338D43D99CC413BA68CA4DE6CF85B23"><enum>(5)</enum><text>Coins struck at the San Francisco Old Mint are distinguished by the <quote>S</quote> mint mark.</text></paragraph> 
<paragraph id="HBEE557514E2741F0861FF2CC47EE8521"><enum>(6)</enum><text>The San Francisco Old Mint is famous for having struck many rare, legendary issues, such as the 1870-S $3 coin, which is valued today at well over $1,000,000, and the 1894-S dime which is comparatively rare.</text></paragraph> 
<paragraph id="H88DFB612B25F436692B42B697C33AE3F"><enum>(7)</enum><text>The San Francisco Old Mint Commemorative Coin will be the first commemorative coin to honor a United States mint.</text></paragraph></section> 
<section id="H0B748E3E024044B695C8DDE39A06D9C"><enum>3.</enum><header>Coin specifications</header> 
<subsection id="H5DFE1EEEF89B411EBB8EA5EF63A60000"><enum>(a)</enum><header>Denominations</header><text>Notwithstanding any other provision of law, and in commemoration of the San Francisco Old Mint, the Secretary of the Treasury (hereafter in this Act referred to as the <quote>Secretary</quote>) shall mint and issue the following coins:</text> 
<paragraph id="H90031592B4964E82AD8FD96808231120"><enum>(1)</enum><header>$5 gold coins</header><text>Not more than 100,000 $5 coins, which shall—</text> 
<subparagraph id="H63148481071349170031BD905103C924"><enum>(A)</enum><text>weigh 8.359 grams;</text></subparagraph> 
<subparagraph id="HFA72699769CF4ED2A11C307DEC86CD6F"><enum>(B)</enum><text>have a diameter of 0.850 inches; and</text></subparagraph> 
<subparagraph id="HD27BABF8B8934E318B4B27B6EB7B9FA9"><enum>(C)</enum><text>contain 90 percent gold and 10 percent alloy.</text></subparagraph></paragraph> 
<paragraph id="H74A3B32334F54F2A83009D6F5517B1E9"><enum>(2)</enum><header>$1 silver coins</header><text>Not more than 500,000 $1 coins, which shall—</text> 
<subparagraph id="HE93DA30E4008405494A66209159E3D16"><enum>(A)</enum><text>weigh 26.73 grams;</text></subparagraph> 
<subparagraph id="H8F0D7FDC060A4ED69B46EA86412C43B9"><enum>(B)</enum><text>have a diameter of 1.500 inches; and</text></subparagraph> 
<subparagraph id="HBC970D25589B46929213EE7E1EEB5675"><enum>(C)</enum><text>contain 90 percent silver and 10 percent copper.</text></subparagraph></paragraph></subsection> 
<subsection id="H9262B7F1EE5E453292C93BD9C77393A2"><enum>(b)</enum><header>Legal tender</header><text>The coins minted under this Act shall be legal tender, as provided in <external-xref legal-doc="usc" parsable-cite="usc/31/5103">section 5103</external-xref> of title 31, United States Code.</text></subsection> 
<subsection id="H35CC474438294D47BF44BEEA18FF8881"><enum>(c)</enum><header>Numismatic items</header><text>For purposes of sections <external-xref legal-doc="usc" parsable-cite="usc/31/5134">5134</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/31/5136">5136</external-xref> of title 31, United States Code, all coins minted under this Act shall be considered to be numismatic items.</text></subsection></section> 
<section id="HFDFFCBF147CB4ADB8233D3007DD43F7F"><enum>4.</enum><header>Design of coins</header> 
<subsection id="H3D6AC25B98EE452D8061F900352139E7"><enum>(a)</enum><header>Design requirements</header> 
<paragraph id="H3E1840BAFE1F4B8400FF87918FBC855C"><enum>(1)</enum><header>In general</header><text>The design of the coins minted under this Act shall be emblematic of the San Francisco Old Mint Building, its importance to California and the history of the United States, and its role in rebuilding San Francisco after the 1906 earthquake and fire.</text></paragraph> 
<paragraph id="H6EFE1665259E4A85BE0860E3ECE96500"><enum>(2)</enum><header>Designation and inscriptions</header><text>On each coin minted under this Act there shall be—</text> 
<subparagraph id="H581612A11C3B4787B6271BAEFA40ED2C"><enum>(A)</enum><text>a designation of the value of the coin;</text></subparagraph> 
<subparagraph id="H01EE45B12B2E45ABBE1EDC0023B1E1E"><enum>(B)</enum><text>an inscription of the year <quote>2007</quote>; and</text></subparagraph> 
<subparagraph id="HD64F2691E644454E811DE31ECFE01284"><enum>(C)</enum><text>inscriptions of the words <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United States of America</quote>, and <quote>E Pluribus Unum</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H2053276DAEE543B49230F5C7C666BA95"><enum>(b)</enum><header>Selection</header><text>The design for the coins minted under this Act shall be—</text> 
<paragraph id="H8B139A9B494E4050B63DDBEC6B7AE31"><enum>(1)</enum><text>selected by the Secretary, after consultation with the Commission of Fine Arts, and the Board of the San Francisco Museum and Historical Society; and</text></paragraph> 
<paragraph id="H75D126EB54F44850AB001EAD432B0013"><enum>(2)</enum><text>reviewed by the Citizens Coinage Advisory Committee.</text></paragraph></subsection></section> 
<section id="HC4D7901C8D0A4280AB12F7850179884F"><enum>5.</enum><header>Issuance of coins</header> 
<subsection id="HFA31C28BEB40484A9E19F3C9850044DD"><enum>(a)</enum><header>Quality of coins</header><text>Coins minted under this Act shall be issued in uncirculated and proof qualities.</text></subsection> 
<subsection id="H88678442644949BE9BD77B6ED3BD55D2"><enum>(b)</enum><header>Mint facility</header><text>The coins authorized under this Act shall be struck at the San Francisco Mint to the greatest extent possible.</text></subsection> 
<subsection id="H1B3F5D38046E4290A09C451FF2289B5"><enum>(c)</enum><header>Period for issuance</header><text>The Secretary may issue coins minted under this Act only during the 1-year period beginning on January 1, 2007.</text></subsection></section> 
<section id="H1A5E254EA97541DF883167D89CA972F5"><enum>6.</enum><header>Sale of coins</header> 
<subsection id="H1B7BADDB5899471CB416AC76FD4BBDEC"><enum>(a)</enum><header>Sale price</header><text>The coins issued under this Act shall be sold by the Secretary at a price equal to the sum of—</text> 
<paragraph id="H9C8A759250894A5583C1AE450531AFE5"><enum>(1)</enum><text>the face value of the coins;</text></paragraph> 
<paragraph id="H608F533A46CB4E98B0BBE9AE090819B6"><enum>(2)</enum><text>the surcharge provided in section 7(a) with respect to such coins; and</text></paragraph> 
<paragraph id="H247932C7ABB6488198A17EB29E16CFE2"><enum>(3)</enum><text>the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping).</text></paragraph></subsection> 
<subsection id="H75AF87257172429FB6EDC1F17FAAA13E"><enum>(b)</enum><header>Bulk sales</header><text>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</text></subsection> 
<subsection id="H3AECF76B57B04F909554A1D24B84A8F3"><enum>(c)</enum><header>Prepaid orders</header> 
<paragraph id="HFC9E70510D7F4AEAA5EC0044B900A781"><enum>(1)</enum><header>In general</header><text>The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of such coins.</text></paragraph> 
<paragraph id="HE746F36F1CB54EBD82C2C8F47E01DF08"><enum>(2)</enum><header>Discount</header><text>Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</text></paragraph></subsection></section> 
<section id="HF8DBF1D203464C5EBA52C2BF8B68DC15"><enum>7.</enum><header>Surcharges</header> 
<subsection id="HDAFA9EA6FAB44E83A679D61480EA6147"><enum>(a)</enum><header>In general</header><text>All sales of coins minted under this Act shall include a surcharge as follows:</text> 
<paragraph id="HE734994B543F4D79A1B3F83C119D17EC"><enum>(1)</enum><text>A surcharge of $35 per coin for the $5 coin.</text></paragraph> 
<paragraph id="HD0970457AA094EDFBD6390C1E8D576A4"><enum>(2)</enum><text>A surcharge of $10 per coin for the $1 coin.</text></paragraph></subsection> 
<subsection id="HE95B7C3B1A1A42D5BB98FF4800826BB2"><enum>(b)</enum><header>Distribution</header><text>Subject to <external-xref legal-doc="usc" parsable-cite="usc/31/5134">section 5134(f)</external-xref> of title 31, United States Code, all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary to the San Francisco Museum and Historical Society for use for the purposes of rehabilitating the Historic Old Mint in San Francisco as a city museum and an American Coin and Gold Rush Museum.</text></subsection> 
<subsection id="HB1F172C46C974945B09E00DA211B500"><enum>(c)</enum><header>Audits</header><text>The San Francisco Museum and Historical Society shall be subject to the audit requirements of <external-xref legal-doc="usc" parsable-cite="usc/31/5134">section 5134(f)(2)</external-xref> of title 31, United States Code, with regard to the amounts received by the Fund under subsection (b).</text></subsection></section>
