<legis-type>A BILL</legis-type> 
<official-title>To amend title 49, United States Code, to make certain conforming changes to provisions governing the registration of aircraft and the recordation of instruments in order to implement the Convention on International Interests in Mobile Equipment and the Protocol to the Convention on International Interests in Mobile Equipment on Matters Specific to Aircraft Equipment, known as the <quote>Cape Town Treaty</quote>.</official-title>

<section id="H8DB60B25941942C2A5FB2284D1F7E9DC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="H298EE4789E8346859CDAFB58D16970A5"><enum>2.</enum><header>Findings and purpose</header> 
<subsection id="H58B99854C1024C6D003F8953F349A18B"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="HA6EFC5B41F5D4D119C562400A3252B44"><enum>(1)</enum><text>The Cape Town Treaty (as defined in <external-xref legal-doc="usc" parsable-cite="usc/49/44114">section 44114</external-xref> of title 49, United States Code) extends modern commercial laws for the sale, finance, and lease of aircraft and aircraft engines to the international arena in a manner consistent with United States law and practice.</text></paragraph> 
<paragraph id="HC0BEF2A00BF049BB987B87C3F1294A2"><enum>(2)</enum><text>The Cape Town Treaty provides for internationally established and recognized financing and leasing rights that will provide greater security and commercial predictability in connection with the financing and leasing of highly mobile assets, such as aircraft and aircraft engines.</text></paragraph> 
<paragraph id="H3F012781D74C49F682508474CB80839D"><enum>(3)</enum><text>The legal and financing framework of the Cape Town Treaty will provide substantial economic benefits to the aviation and aerospace sectors, including the promotion of exports, and will facilitate the acquisition of newer, safer aircraft around the world.</text></paragraph> 
<paragraph id="H80029937EA804EECAEDF741BAF65C900"><enum>(4)</enum><text>Only technical changes to United States law and regulations are required since the asset-based financing and leasing concepts embodied in the Cape Town Treaty are already reflected in the United States in the Uniform Commercial Code.</text></paragraph> 
<paragraph id="H5C7C61E23435491E99CE5703B58FADBE"><enum>(5)</enum><text>The new electronic registry system established under the Cape Town Treaty will work in tandem with current aircraft document recordation systems of the Federal Aviation Administration, which have served United States industry well. </text></paragraph> 
<paragraph id="HD145FFF9E01B4899B3F508F53100AF45"><enum>(6)</enum><text>The United States Government was a leader in the development of the Cape Town Treaty. </text></paragraph></subsection> 
<subsection id="H89CD9E9B8C6C4B59BF9159D7F3323F8F"><enum>(b)</enum><header>Purpose</header><text>Accordingly, the purpose of this Act is to provide for the implementation of the Cape Town Treaty in the United States by making certain technical amendments to the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/441">chapter 441</external-xref> of title 49, United States Code, directing the Federal Aviation Administration to complete the necessary rulemaking processes as expeditiously as possible, and clarifying the applicability of the Treaty during the rulemaking process.</text></subsection></section> 
<section id="H84078D724F5345DA8354D88C9B5F1309"><enum>3.</enum><header>Recordation of security instruments</header> 
<subsection id="H594416B702FD4EE48614D040835E47B"><enum>(a)</enum><header>Establishment of system</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/44107">Section 44107(a)</external-xref> of title 49, United States Code, is amended—</text> 
<paragraph id="HBF829E3EAE574C34B26B02159D220767"><enum>(1)</enum><text>in paragraph (2)(A) by striking <quote>750</quote> and inserting <quote>550</quote>;</text></paragraph> 
<paragraph id="H1032D61995C9430B9F5B29C500BCCB1"><enum>(2)</enum><text>by striking <quote>and</quote> at the end of paragraph (2)(D);</text></paragraph> 
<paragraph id="H566A167972754484AD2855EE273DC7F"><enum>(3)</enum><text> by redesignating paragraph (3) as paragraph (4);</text></paragraph> 
<paragraph id="H0C323709A6A443F298A1A85421146FF1"><enum>(4)</enum><text>by inserting after paragraph (2) the following:</text>

<paragraph id="H287BE7F4E0254C60865D63767EC7DFFF"><enum>(3)</enum><text>notice of prospective assignments and prospective international interests in, and prospective sales of, aircraft or aircraft engines under the Cape Town Treaty; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H6842EBE8D79349D2B8ED315CEE9C9C01"><enum>(5)</enum><text>in paragraph (4) (as so redesignated) by striking <quote>clause (1) or (2) of this subsection</quote> and inserting <quote>paragraph (1) or (2) and releases, cancellations, discharges, and satisfactions related to the prospective assignment, interest, or sale for which a notice is recorded under paragraph (3)</quote>.</text></paragraph></subsection> 
<subsection id="H1342B8D2FE2C4C57B247D9B571FBED23"><enum>(b)</enum><header>International registry</header><text>Section 44107 of such title is amended by adding at the end the following:</text>

<subsection id="HB4EA0196D107414D82E3A1DB1602588B"><enum>(e)</enum><header>International registry</header> 
<paragraph id="HB05F39B345E34CFC83FCA8D20047987D" display-inline="no-display-inline"><enum>(1)</enum><header>Designation of United States Entry Point</header><text>As permitted under the Cape Town Treaty, the Federal Aviation Administration Civil Aviation Registry is designated as the United States Entry Point to the International Registry relating to—</text> 
<subparagraph id="H7F875AEE1CDC47C3A9280955478500D9"><enum>(A)</enum><text>civil aircraft of the United States;</text></subparagraph> 
<subparagraph id="HC1906AACA2124D30B71000F35CAE53E4"><enum>(B)</enum><text>an aircraft for which a United States identification number has been assigned but only with regard to a notice recorded under subsection (a)(3); and</text></subparagraph> 
<subparagraph id="H1ED0F8573B2A4A3BA91749A9174D10AF"><enum>(C)</enum><text>aircraft engines.</text></subparagraph></paragraph> 
<paragraph id="H580A8D160B5C4D29AAA8643DF97781C8"><enum>(2)</enum><header>Authorization for registration of aircraft</header><text>A registration with the International Registry relating to an aircraft described in paragraph (1) (other than subparagraph (C)) is valid only if (A) the person seeking the registration first files documents eligible for recording under subsection (a) and relating to the registration with the United States Entry Point, and (B) the United States Entry Point authorizes the registration.</text></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> 
<section id="H670302FEA95A4244846F23CCBEED097"><enum>4.</enum><header>Regulations</header> 
<subsection id="HC70FEDB274B14EB9BA918EEACC979B1"><enum>(a)</enum><header>In general</header><text>The Administrator of the Federal Aviation Administration shall issue regulations necessary to carry out this Act, including any amendments made by this Act.</text></subsection> 
<subsection id="H105BB7940A524FCAB3A40100A5ECBAE3"><enum>(b)</enum><header>Contents of regulations</header><text>Regulations to be issued under this Act shall specify, at a minimum, the requirements for—</text> 
<paragraph id="H68EC3F2D03ED4AD6A4FBE40AFFE1376"><enum>(1)</enum><text>the registration of aircraft previously registered in a country in which the Cape Town Treaty is in effect;</text></paragraph> 
<paragraph id="H1229CCACDA6A4BB0BFBACBE3F7744572"><enum>(2)</enum><text>the cancellation of registration of a civil aircraft of the United States based on a request made in accordance with the Cape Town Treaty; and</text></paragraph> 
<paragraph id="H29D3481D75CE4D728E02917B2354B02F"><enum>(3)</enum><text>the filing of documents eligible for recording under section <external-xref legal-doc="usc" parsable-cite="usc/49/44107">44107(a)(1)</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/49/44107">44107(a)(2)</external-xref> of title 49, United States Code, within a specified time period in order to maintain the validity of such prospective interests.</text></paragraph></subsection> 
<subsection id="HDB2841B319A94486A293DD486198EF98"><enum>(c)</enum><header>Expedited rulemaking process</header><text></text> 
<paragraph id="H5553F005D85843B98F114257C9A2FFF6"><enum>(1)</enum><header>Interim final rule</header><text></text> 
<subparagraph id="HC7586C24936E4C6C936B146009CEDA2"><enum>(A)</enum><header>Publication</header><text>The Administrator shall issue regulations under this section by publishing an interim final rule by the 60th day following the date of enactment of this Act.</text></subparagraph> 
<subparagraph id="HEB9E9A1025A34949B7DFBCAF8BD85435"><enum>(B)</enum><header>Public comment</header><text>The Administrator shall seek public comment on the interim final rule.</text></subparagraph> 
<subparagraph id="H6E715053A2EA4952B6AE13FF24B5A1DE"><enum>(C)</enum><header>Effective date</header><text>The interim final rule shall be effective on the date the Cape Town Treaty enters into force with respect to the United States.</text></subparagraph> 
<subparagraph id="H0FAD6F1835FD43B4A28B05AD6300DDE0"><enum>(D)</enum><header>Economic analysis</header><text>The Administrator shall not be required to prepare an economic analysis of the cost and benefits of the interim final rule.</text></subparagraph></paragraph> 
<paragraph id="HEB58A6DC8656441D00A4F5A8F35C32B"><enum>(2)</enum><header>Final rule</header><text>The Administrator shall issue a final rule under this section by December 31, 2004.</text></paragraph></subsection> 
<subsection id="H603479078BB74D82A700F6FEE9FCB94"><enum>(d)</enum><header>Applicability of treaty</header><text>Notwithstanding parts 47.37(a)(3)(ii) and 47.47(a)(2) of title 14, Code of Federal Regulations, Articles IX(5) and XIII of the Cape Town Treaty shall apply to the matters described in subsection (b) until the earlier of the effective date of the interim final rule under this section or December 31, 2004.</text></subsection></section> 
<section id="H0C61E8981346411AB5ABC2A275ECA997"><enum>5.</enum><header> Limitation on validity of conveyances, leases, and security instruments</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/44108">Section 44108(c)(2)</external-xref> of title 49, United States Code, is amended by striking the period at the end and inserting <quote>or the Cape Town Treaty, as applicable.</quote>.</text></section>

<subsection id="H64F03A80C73048ECADF84E86C118F8A"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/441">Chapter 441</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<section id="HBF310565A68044C892841EC04E9D131F"><enum>44114. </enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter, the following definitions apply:</text> 
<paragraph id="H086F5D7854D744FA8CAAAF6C2CA46E2"><enum>(1)</enum><header>Cape Town Treaty</header><text>The term <term>Cape Town Treaty</term> means the Convention on International Interests in Mobile Equipment, as modified by the Protocol to the Convention on International Interests in Mobile Equipment on Matters Specific to Aircraft Equipment, signed at Rome on May 9, 2003.</text></paragraph> 
<paragraph id="HBC0902E0500747B484BE1F74D29EAD81"><enum>(2)</enum><header>United States Entry Point</header><text>The term <term>United States Entry Point</term> means the Federal Aviation Administration Civil Aircraft Registry.</text></paragraph> 
<paragraph id="H07E848645645459A816FE9B108132C30"><enum>(3)</enum><header>International registry</header><text>The term <term>International Registry</term> means the registry established under the Cape Town Treaty.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H6DC225C4DDD34754896D3E278584C300"><enum>(b)</enum><header>Conforming amendment</header><text>The analysis for such chapter is amended by adding at the end the following:</text>

<section id="H86892B493F4B4618B99994816D20C148"><enum>7.</enum><header>Effective date and preservation of prior rights</header><text display-inline="no-display-inline">This Act, including any amendments made by this Act, shall take effect on the date the Cape Town Treaty (as defined in <external-xref legal-doc="usc" parsable-cite="usc/49/44114">section 44114</external-xref> of title 49, United States Code) enters into force with respect to the United States and shall not apply to any registration or recordation that was made before such effective date under chapter 441 of such title or any legal rights relating to such registration or recordation.</text></section>
