<official-title>To require the Commodity Credit Corporation to support the development of a domestic casein and milk protein concentrate industry, and for other purposes.</official-title>

<section id="H4EF80B03AB074CEB835EAD00D23BFB37" section-type="section-one"><enum>1.</enum><header>United States Dairy Proteins Incentive Program</header> 
<subsection id="H762DD214C13B4980A98C02A64983E9F"><enum>(a)</enum><header>Establishment and Purpose</header><text>The Commodity Credit Corporation shall establish and operate a program under section 5 of the Commodity Credit Corporation Charter Act (<external-xref legal-doc="usc" parsable-cite="usc/15/714c">15 U.S.C. 714c</external-xref>) to support the development of a casein and milk protein concentrate industry in the 48 contiguous States.</text></subsection> 
<subsection id="H4B745C7CCD6F4A60A1ED55F83F3F4F8F"><enum>(b)</enum><header>Program Described</header><text>Under the program, the Corporation shall make payments, on a bid basis, to an entity that produces and markets dairy proteins produced from liquid skim milk. The Secretary of Agriculture shall have sole discretion to accept or reject bids under such criteria as the Secretary considers appropriate. </text></subsection> 
<subsection id="HAFE712D7CB6349D68728F85B64D6EC91"><enum>(c)</enum><header>Rules and Regulations</header><text>The program shall be operated under such rules and regulations issued by the Secretary as the Secretary considers necessary to ensure, among other things, that—</text> 
<paragraph id="HB2695C9DBDA047A8916D456B5F9BA84F"><enum>(1)</enum><text>receipt of a payment is contingent upon the end use of the dairy proteins produced;</text></paragraph> 
<paragraph id="HB578FD681D9F436186493871A87B64D5"><enum>(2)</enum><text>no applicant receives a payment if the contract submitted for review would result in the undercutting of domestic prices for milk, nonfat dry milk, or dairy proteins; and</text></paragraph> 
<paragraph id="H8FCA1E72E8B845DB984091F4E895A040"><enum>(3)</enum><text>the sale of the dairy proteins represents a new use of the domestically produced dairy proteins. </text></paragraph></subsection> 
<subsection id="H782E337760614831A1CCDF7FF49E01D7"><enum>(d)</enum><header>Cheese Products Exception</header><text>The sale of dairy proteins for use in the production of standardized cheeses, as determined by the Secretary, shall not be eligible to receive payments under the program. </text></subsection> 
<subsection id="HF818A35D34B54345859557701C018D56"><enum>(e)</enum><header>Payment Rate</header><text>Payments made under the program shall be made at a rate or rates established or approved by the Secretary. Any such rate shall be published in the Federal Register or publicly announced through other appropriate means, and shall be at a level or levels that will encourage the development of a dairy proteins industry in the 48 contiguous States. </text> </subsection> 
<subsection id="H2E7EA3F8A64A40BFB3CD58B79C25A88E"><enum>(f)</enum><header>Implementation of Program</header><text>The Secretary shall develop regulations and implement the program not later than 180 days after the date of the enactment of this section.</text></subsection> 
<subsection id="H56E7B42B84AD4D8699C218B6169897A0"><enum>(g)</enum><header>Treaty Obligations</header><text>The Secretary shall carry out the program in a manner consistent with the obligations of the United States as a member of the World Trade Organization.</text></subsection> 
<subsection id="H115BCF5F11294D3187E1E77DB62DBF65"><enum>(h)</enum><header>Dairy Protein Definition</header><text>In this section, the term <quote>dairy proteins</quote> means whey, whey protein concentrate, casein, or milk protein concentrate.</text></subsection></section>
