2.Congress finds the following:
(1)The United States is engaged in a Global War on Terrorism, in which threats to the security of the United States often originate in weak or failing countries.
(2)The National Security Strategy of the United States states that “the United States and countries cooperating with us must not allow the terrorists to develop new home bases”.
(3)It is in the interests of the United States to develop a comprehensive framework to monitor weak or failing countries and prepare to deal effectively with these countries before they become imminent threats to the people of the United States.
(4)The Department of State is uniquely equipped to communicate with other United States agencies and international organizations to plan for pre-conflict stabilization operations and post-conflict reconstruction operations in weak or failing countries, both as an alternative to military intervention and as a successor to military conflict, if such conflict becomes unavoidable.
(5)Since the end of World War II, the United States has participated in reconstruction and democracy-building efforts in Germany, Japan, Somalia, Haiti, Bosnia and Herzegovina, Kosovo, Afghanistan, and Iraq, and the knowledge and experience of United States agencies, in cooperation with international organizations, was critical to successfully providing security and humanitarian relief and establishing the rule of law in these countries and regions.
(6)The ability of the Department of Defense, the Department of State, the National Security Council, and various international organizations to coordinate and cooperate effectively to deal with emerging threats is essential for enhancing the ability of the United States and its allies to win the Global War on Terrorism
(7)A 2003 report from the RAND Corporation states post-conflict stabilization and reconstruction with the objective of promoting a transition to democracy appear to be the inescapable responsibility of the world’s only superpower. Therefore . . . the United States ought to make the smaller long-term investments in its own institutional capacity to conduct such operations

<section id="H78E7575D1BD2463599559843BA53CB60"><enum>101.</enum><header>Office of Overseas Contingencies and Stabilization and Undersecretary of State for Overseas Contingencies and Stabilization</header>
<subsection id="HE95D581308414BAF962B00813FD3278"><enum>(a)</enum><header>Establishment</header><text>The State Department Basic Authorities Act of 1956 is amended by adding after section 58 (<external-xref legal-doc="usc" parsable-cite="usc/22/2730">22 U.S.C. 2730</external-xref>) the following new section:</text>

<section id="HC71D0B7FE5414E1D8555E01F3500F568"><enum>59.</enum><header>Overseas contingencies and stabilization</header>
<subsection id="HE9D3F76204644185BDCC83015E2E624"><enum>(a)</enum><header>Office of Overseas Contingencies and Stabilization</header>
<paragraph id="H07E6340201114F759DA593158E7DF852"><enum>(1)</enum><header>Establishment of Office</header><text>The Secretary shall establish within the Department of State an Office of Overseas Contingencies and Stabilization.</text></paragraph>
<paragraph id="H8238C3B65A014912BD8DA500D552DCC"><enum>(2)</enum><header>Purpose of Office</header><text>The Office shall have primary responsibility for planning and administering non-military aspects of overseas contingency operations, including pre-conflict stabilization operations and post-conflict reconstruction operations, in countries categorized pursuant to section 60 as countries of impending risk or countries of immediate risk.</text></paragraph>
<paragraph id="H8F09CE086B854E07B7C194A37257F9C3"><enum>(3)</enum><header>Head of Office</header><text>The head of the Office shall be the Undersecretary for Overseas Contingencies and Stabilization. The President shall appoint the Undersecretary, by and with the advice and consent of the Senate.</text></paragraph></subsection>
<subsection id="HCA73977ADE94458495E0384CAA5363E"><enum>(b)</enum><header>Organization of Office</header>
<paragraph id="H65A61E13457644329B93BE00CF003304"><enum>(1)</enum><header>Three bureaus</header><text>The Office shall be organized into three bureaus, as follows:</text>
<subparagraph id="HC6D74D54DA30433D8EA617BDB4891794"><enum>(A)</enum><text>The Bureau of Contingency Planning.</text></subparagraph>
<subparagraph id="H62D171FCA88B4C3DA072E16CAE700F1"><enum>(B)</enum><text>The Bureau of Contingency Training.</text></subparagraph>
<subparagraph id="H8F38694180F844848EE500A2FE606B9"><enum>(C)</enum><text>The Bureau of Contingency Coordination.</text></subparagraph></paragraph>
<paragraph id="HF6C59E67A94144F1AAAA4B42771D523B"><enum>(2)</enum><header>Head of bureaus</header><text>The head of each bureau shall be an Assistant Secretary. The President shall appoint the Assistant Secretaries, by and with the advice and consent of the Senate.</text></paragraph></subsection>
<subsection id="H2D3676A6E10E4E6F9068D08B91C4476B"><enum>(c)</enum><header>Bureau of Contingency Planning</header><text>The Bureau of Contingency Planning shall be responsible for—</text>
<paragraph id="H15DADC4FD00B42DAB7CFB125DB31B6D4"><enum>(1)</enum><text>coordinating with the intelligence community, as defined in section 3(4) of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/401a">50 U.S.C. 401a(4)</external-xref>), in the identification of countries as weak or failing under section 60;</text></paragraph>
<paragraph id="HDF22F482770A4FFCA579EC535F702000"><enum>(2)</enum><text>monitoring political and economic developments in such countries;</text> </paragraph>
<paragraph id="H74A21C8AB28842B18C7EA9F252647051"><enum>(3)</enum><text>preparing pre-conflict stabilization operations to address the dangers specified in section 60(a)(1) associated with such countries; and</text></paragraph>
<paragraph id="HD17AD0DD72C94F629989C7DD3E41A327"><enum>(4)</enum><text>preparing post-conflict reconstruction operations, including operations relating to civil and political affairs, for countries in which the United States participates or may participate in a pre-conflict stabilization operation or a post-conflict reconstruction operation.</text></paragraph></subsection>
<subsection id="H3C69261E3A7D4DB5961486CBECF54BDD"><enum>(d)</enum><header>Bureau of Contingency Training</header><text>The Bureau of Contingency Training shall be responsible for—</text>
<paragraph id="HC0F763621D27410F8EE0D899518D2D25"><enum>(1)</enum><text>training members of the Federal Government for overseas pre-conflict stabilization operations and post-conflict reconstruction operations in weak or failing countries identified under section 60;</text></paragraph>
<paragraph id="HA42B03F7E7C24DD983C5FCF3762F35C8"><enum>(2)</enum><text>administering the International Contingency Training Center established under subsection (f); and</text></paragraph>
<paragraph id="H4703AEC2536941EB937EA5A90033EA8F"><enum>(3)</enum><text>administering the Civilian Overseas Contingency Force established under section (g) and maintaining the International Contingency Personnel Database established under subsection (h).</text></paragraph></subsection>
<subsection id="H9D5B5B52705F4B2CAE80DF7FA0643341"><enum>(e)</enum><header>Bureau of Contingency Coordination</header><text>The Bureau of Contingency Coordination shall serve as the permanent liaison between the Office and—</text>
<paragraph id="H256E83A79AF94DADB1D26651949BF493"><enum>(1)</enum><text>the Department of Defense and other relevant departments;</text></paragraph>
<paragraph id="H03188790AE7D4E5793C600456ED62B38"><enum>(2)</enum><text>the Central Intelligence Agency and other relevant elements of the intelligence community;</text></paragraph>
<paragraph id="H300D1EB2B5D844B1A11628AAF2280055"><enum>(3)</enum><text>the United Nations and the North Atlantic Treaty Organization and other relevant international governmental organizations; and</text></paragraph>
<paragraph id="HA4CF7E31DB8445FC93FF11ECF694596C"><enum>(4)</enum><text>relevant non-governmental organizations.</text></paragraph></subsection>
<subsection id="H81AA7FC506A848639B00252CE03E3766"><enum>(f)</enum><header>International Contingency Training Center</header>
<paragraph id="HC15701CF56614D7FA9F4003E00006495"><enum>(1)</enum><header>Establishment</header><text>The Undersecretary shall establish within the Bureau of Contingency Training an International Contingency Training Center.</text></paragraph>
<paragraph id="H325F675F98D64F4FB74818F4C8A622CA"><enum>(2)</enum><header>Duties</header><text>The Center shall be responsible for—</text>
<subparagraph id="H85C62A3C21704934AB9C08000057C8B5"><enum>(A)</enum><text>conducting inter-agency training, including training related to inter-agency decision-making, operational planning, and execution simulations, for mid-level Government officials and managers to prepare these officials and managers to address complex overseas contingencies, including pre-conflict stabilization operations and post-conflict reconstruction operations;</text></subparagraph>
<subparagraph id="H11894FB491834CE6A1AEC6B4001D78BF"><enum>(B)</enum><text>conducting advanced training related to pre-conflict stabilization operations and post-conflict reconstruction operations for members of the Civilian Overseas Contingency Force;</text></subparagraph>
<subparagraph id="HAE2B6A448871417700ABF800008300E1"><enum>(C)</enum><text>conducting pre-deployment training related to pre-conflict stabilization operations and post-conflict reconstruction operations for civilians and military-civil affairs personnel;</text></subparagraph>
<subparagraph id="H92AF3F482E9947BC9353EAA1CC42462"><enum>(D)</enum><text>conducting exercises related to pre-conflict stabilization operations and post-conflict reconstruction operations for United States and international experts; </text></subparagraph>
<subparagraph id="H9F3EBF3E39B140458C17939D6FEE1C93"><enum>(E)</enum><text>developing a uniform set of operating procedures for pre-conflict stabilization operations and post-conflict reconstruction operations; and</text></subparagraph>
<subparagraph id="H78F64216BEAA4D10A72132F5396D43D3"><enum>(F)</enum><text>conducting on-going evaluations and after-action reviews of pre-conflict stabilization operations and post-conflict reconstruction operations.</text></subparagraph></paragraph>
<paragraph id="HB0316FEC6C2943AC8F1737E6E6A8F4B3"><enum>(3)</enum><header>Location</header>
<subparagraph id="H142F68F9DE1346FD8BB226F61726B4AD"><enum>(A)</enum><header>Determination by Undersecretary</header><text>The Center shall be located at a site the Undersecretary determines to be appropriate to allow the Center to properly carry out the duties specified in paragraph (2).</text></subparagraph>
<subparagraph id="H85C9E9ABB72743B9AD6766BCEB75688D"><enum>(B)</enum><header>Military and other facilities</header><text>In making the determination under subparagraph (A), the Undersecretary shall consider military installations and other existing Government facilities that satisfy the needs of the Center.</text></subparagraph>
<subparagraph id="H22DC637B3B7B4352B2AEAEC239195E03"><enum>(C)</enum><header>Report</header><text>Not later than one year from the date of the enactment of the &short-title1;, the Undersecretary shall submit to the appropriate congressional committees a report recommending a site for the location of the Center.</text></subparagraph></paragraph>
<paragraph id="H1643CBC1D7B94510B6E374635B04CECB"><enum>(4)</enum><header>Support</header><text>The Assistant Secretary for Contingency Training shall provide the Center with such staff and resources as the Assistant Secretary considers necessary and appropriate to allow the Center to properly carry out the duties specified in paragraph (2).</text></paragraph></subsection>
<subsection id="H5BCD9F5B924544878D6998E2EF0089BF"><enum>(g)</enum><header>Civilian Overseas Contingency Force</header>
<paragraph id="H420CC53B333046FC95ADBC380062A9AF"><enum>(1)</enum><header>Establishment and purpose</header><text>The Undersecretary shall establish within the Bureau of Contingency Training a Civilian Overseas Contingency Force intended to provide a ready source of volunteers who can provide in-country assistance in support of pre-conflict stabilization operations and post-conflict reconstruction operations carried out by the Office in countries categorized pursuant to section 60 as countries of impending risk or countries of immediate risk.</text></paragraph>
<paragraph id="HEA6F46FDA3F744D9005BE0EF91B3DC8E"><enum>(2)</enum><header>Authority</header>
<subparagraph id="HED43C9B8A97F4CCA9C007B6908E5AD3E"><enum>(A)</enum><header>Country of impending risk</header><text>The President, acting through the Undersecretary, may authorize the deployment of members of the Force to a country of impending risk if the President determines that such deployment is likely to—</text>
<clause id="H607BA8F865C142E6B0196D00E16E9CFC"><enum>(i)</enum><text>prevent the country from satisfying any of the criteria specified in section 60(a)(1), if the country does not satisfy any of the criteria at the time of the appointment of a Special Coordinator under section 60(g) for the country; or</text></clause>
<clause id="H4F0DAAAB38B348BBA106D4938FFCB03"><enum>(ii)</enum><text>assist the country to end its satisfaction of any of the criteria and reduce the likelihood that the country will be considered a national security priority by the President, if the country satisfies any of the criteria at the time of the appointment</text></clause></subparagraph>
<subparagraph id="H3CAAAD08525B4C6BB2283F88C0D17563"><enum>(B)</enum><header>Country of immediate risk</header><text>The President, acting through the Undersecretary, may authorize the deployment of members of the Force to a country of immediate risk if the President determines that such deployment is likely to—</text>
<clause id="H8C33DE6CB6784D0990F59B4BF255CBD2"><enum>(i)</enum><text>assist the country to end its satisfaction of any of the criteria specified in section 60(a)(1); and</text></clause>
<clause id="HCAC48A1227CC4B66817B89B900EC4000"><enum>(ii)</enum><text>allow the President to remove the country from the list of countries the President considers to be a national security priority.</text></clause></subparagraph></paragraph>
<paragraph id="H4B02857EC2FC45B78EB976ED7BE300BF"><enum>(3)</enum><header>Composition</header>
<subparagraph id="HE3D661141D264AE0B8352D405EB9362B"><enum>(A)</enum><header>Volunteers</header><text>The Force shall be composed of volunteers selected by the Undersecretary, and may include—</text>
<clause id="H84BBAC2EA9AD4BEF91FFE0D31910E824"><enum>(i)</enum><text>individuals who are Federal employees or former employees of the executive, legislative, or judicial branches;</text></clause>
<clause id="HE539604637394A81A301005DFB4610B4"><enum>(ii)</enum><text>individuals who are retired or former members of the uniformed services;</text></clause>
<clause id="HD1A162DF34264BB0979FE16808E0C0FE"><enum>(iii)</enum><text>individuals from the United States or foreign academic community;</text></clause>
<clause id="HD677F91919CF4216B3BD7DC1874D31F"><enum>(iv)</enum><text>individuals from United States or foreign non-governmental organizations; and</text></clause>
<clause id="H72842D00F7A24968A8B18C4428D94D12"><enum>(v)</enum><text>such other individuals from the United States or foreign countries as the Undersecretary considers necessary and appropriate to satisfy the needs of the Force under this subsection.</text></clause></subparagraph>
<subparagraph id="HCC325538BA8E4D5888135000BA5659BA"><enum>(B)</enum><header>Relevant expertise or experience required</header><text>Volunteers selected under subparagraph (A) shall possess expertise in or experience related to pre-conflict stabilization operations and post-conflict reconstruction operations, including individuals who possess expertise or experience as—</text>
<clause id="H66E86611A23046A6A0E9E05CB7298D00"><enum>(i)</enum><text>members of the judiciary;</text></clause>
<clause id="HE9694123648D4666A92CD3655DB2C500"><enum>(ii)</enum><text>members of a police force;</text></clause>
<clause id="HDCB1616FA914404000E3A1D09F395D9"><enum>(iii)</enum><text>health workers;</text></clause>
<clause id="HEA0D611610DA4484AC2DCA5003249DC3"><enum>(iv)</enum><text>penal officers;</text></clause>
<clause id="H9B81709F00A844CF8D002D624095E22"><enum>(v)</enum><text>civil planners or administrators;</text></clause>
<clause id="H30128D72CDD14B2B901DBA08EB4376F6"><enum>(vi)</enum><text>attorneys;</text></clause>
<clause id="HDD6BBCA2902E4D3DB9E4ACE94FC0CB03"><enum>(vii)</enum><text>constitutional experts;</text></clause>
<clause id="H443BC959BECA46C691DFC8C389585767"><enum>(viii)</enum><text>civil engineers;</text></clause>
<clause id="H2E73D01D010D45BEBC32DF13D6A380FE"><enum>(ix)</enum><text>construction workers; or</text></clause>
<clause id="H3A9D0830EC4A4095BC2951176BB0F0EC"><enum>(x)</enum><text>members of the financial services sector.</text></clause></subparagraph> </paragraph>
<paragraph id="H1C953A5496064E98B8EE6262FE4041"><enum>(4)</enum><header>Advanced training</header><text>The Assistant Secretary for Contingency Training shall utilize the International Contingency Training Center to provide members of the Force with such advanced training in pre-conflict stabilization operations and post-conflict reconstruction operations as the Assistant Secretary considers necessary and appropriate to maintain the operational readiness of the Force.</text></paragraph>
<paragraph id="H1C32406C2B5D4DC1BEB2914FB7C1D72"><enum>(5)</enum><header>Limitation on deployment</header>
<subparagraph id="H49F6D871D93B42FF822756C700E35C13"><enum>(A)</enum><header>Limitation</header><text>A member of the Force may not be deployed to one or more countries of impending risk or countries of immediate risk for more than 365 days during any two-year period, as calculated from the date of the initial deployment of the member to any such country, unless the member consents to a longer deployment.</text></subparagraph>
<subparagraph id="H52445B735D7D4661A1AF321EB4A1A78F"><enum>(B)</enum><header>Treatment of advanced training</header><text>Training provided to a member of the Force under paragraph (4) shall not be counted for purposes of applying the limitation on deployment described in subparagraph (A).</text></subparagraph></paragraph>
<paragraph id="H17283343FFF444C2A8CE032B2CB5E100"><enum>(6)</enum><header>Compensation</header><text>Although members of the Force are volunteers, the Undersecretary shall compensate members of the Force during periods of training and deployment in accordance with—</text>
<subparagraph id="HC79E444753DE4268A6A6754C57AC5C03"><enum>(A)</enum><text>the appropriate salary class for the Foreign Service, as set forth in sections 402 and 403 of the Foreign Service Act of 1980 (22 U.S.C. 3962 and 3963); or</text></subparagraph>
<subparagraph id="HDE181E2A355E4D0687D492887DBDB3C4"><enum>(B)</enum><text>the relevant authority under sections <external-xref legal-doc="usc" parsable-cite="usc/5/3101">3101</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/5/3392">3392</external-xref> of title 5, United States Code.</text></subparagraph></paragraph>
<paragraph id="HD8B8A43398214239B1412E044F476B6E"><enum>(7)</enum><header>Extension of certain Foreign Service benefits</header><text>The Undersecretary may extend to any member of the Force who is deployed in support of a pre-conflict stabilization operation or a post-conflict reconstruction operation the benefits or privileges set forth in sections 412, 413, 704, and 901 of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/3972">22 U.S.C. 3972</external-xref>, 3973, 4024, and 4081) to the same extent and in the same manner that such benefits and privileges are extended to members of the Foreign Service.</text></paragraph>
<paragraph id="H1A3BAF90BF4B41B2B0CB8E9CACEF90AE"><enum>(8)</enum><header>Employment and reemployment rights</header><text>Members of the Force shall be treated as members of the uniformed services, as defined in <external-xref legal-doc="usc" parsable-cite="usc/38/4303">section 4303(16)</external-xref> of title 38, United States Code, for purposes of employment and reemployment rights under subchapters I and II of chapter 43 of such title.</text></paragraph>
<paragraph id="H28F0E5F5004243ADB9ABB9377D24A090"><enum>(9)</enum><header>Non-Force personnel</header>
<subparagraph id="HB4CFE5A3BAA34867A0F07E04DBDBC4CC"><enum>(A)</enum><header>Contracting authority</header><text>The Undersecretary may procure the services of individuals or organizations by contract to assist the Office in any pre-conflict stabilization operation or post-conflict reconstruction operation in which the Office may be involved. Individuals performing services related to such assistance shall not by virtue of such performance be considered employees of the United States for purposes of any law administered by the Office of Personnel Management (except that the Undersecretary may determine the applicability to such individuals of any law administered by the Undersecretary concerning such performance by such individuals).</text></subparagraph>
<subparagraph id="HDE0150AB4E6A4CDEB6882952C07D80D8"><enum>(B)</enum><header>Experts and consultants</header><text>In the event of a pre-conflict stabilization operation or a post-conflict reconstruction operation in which the Office is involved, and to the extent necessary to obtain without undue delay necessary services considered by the Undersecretary to be relevant to the success of such operation, the Undersecretary may procure the services of experts and consultants under <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109</external-xref> of title 5, United States Code.</text></subparagraph>
<subparagraph id="HCDB7BE4465C644BE921D007CFA00A607"><enum>(C)</enum><header>Authority to accept and assign details</header><text>The Undersecretary may accept details or assignments of employees of the executive, legislative, or judicial branches, members of the uniformed services, and employees of State or local governments on a reimbursable or nonreimbursable basis in order to satisfy the needs of the Office. The assignment of an employee of a State or local government under this subsection shall be consistent with subchapter VI of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code.</text></subparagraph>
<subparagraph id="H1DE48951D6F44A739F80D36DD6BCE8F"><enum>(D)</enum><header>Acceptance of unpaid volunteer services</header><text>In the event of a pre-conflict stabilization operation or a post-conflict reconstruction operation in which the Office is involved, the Undersecretary may accept the services of certain individuals to assist the Office in the administration of such operations without regard to <external-xref legal-doc="usc" parsable-cite="usc/31/1342">section 1342</external-xref> of title 31, United States Code. Individuals providing such services shall be uncompensated.</text> </subparagraph></paragraph>
<paragraph id="HFF7318E804CA4032B58F1B491E00EC9C"><enum>(10)</enum><header>Supervision and treatment of Force and non-Force personnel</header>
<subparagraph id="HE62CB562B81943869B8D3034313400DB"><enum>(A)</enum><header>Supervision</header><text>The Undersecretary shall—</text>
<clause id="H4D9CB1FC728D491E93BBFDBD6B4F7588"><enum>(i)</enum><text>ensure that members of the Force and non-Force personnel under paragraph (9) are notified of the scope of the services accepted pursuant to such paragraph;</text></clause>
<clause id="H9557D77AE0D94B73B6A8DA9CBE4DECF3"><enum>(ii)</enum><text>supervise the non-Force personnel to the same extent as Federal employees performing similar services; and</text></clause>
<clause id="H5FC0599F7EF4480C00EF96B293B0D18C"><enum>(iii)</enum><text>ensure that a non-Force individual has appropriate credentials or is otherwise qualified to perform in the capacity for which the services of such individual are accepted.</text></clause></subparagraph>
<subparagraph id="HECBFB6D551F644E48D0258EB741EFC23"><enum>(B)</enum><header>Applicability of provisions relating to Federal employees</header><text>Members of the Force or non-Force personnel under paragraph (9) who are not Federal employees shall not be considered as Federal employees by reason of the performance of services, except for the purposes of the following provisions of the United States Code:</text>
<clause id="H17832DD434204EFA873BA1C15DAA7313"><enum>(i)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/81">Chapter 81</external-xref> of title 5, relating to compensation for work-related injuries.</text></clause>
<clause id="H47757650548D4C83BFBC5681FD12E1A0"><enum>(ii)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">Chapter 171</external-xref> of title 28, relating to tort claims.</text></clause>

<paragraph id="HE39A6B6366004756A72CF374518EC6C1"><enum>(11)</enum><header>Database of civilian volunteers and other individuals</header><text>The Undersecretary shall establish within the Bureau a database of members of the Force and such other non-Force individuals with relevant experience or expertise related to pre-conflict stabilization operations and post-conflict reconstruction operations as the Undersecretary determines necessary and appropriate to satisfy the needs of the Force under this subsection.</text> </paragraph> </subsection> </section> <after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HD90E0B088F4343418D178CDB4001801"><enum>(b)</enum><header>Number of Undersecretaries and Assistant Secretaries</header>
<paragraph id="H734FF6C9E8CC4C4681D4E965BE6C7315"><enum>(1)</enum><header>State Department Basic Authorities Act of 1956</header><text>Section 1 of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2651a">22 U.S.C. 2651a</external-xref>) is amended—</text>

<section id="HF9387337572C4AA0A3963F89AD42509E"><enum>102.</enum><header>Identification of weak or failing countries and categorization of country according to level of risk</header> <text display-inline="no-display-inline">The State Department Basic Authorities Act of 1956 is further amended by adding after section 59, as added by section 101, the following new section:</text>

<section id="H7122C305712948DF9D3668FCBCB2ECE"><enum>60.</enum><header>Identification of weak or failing countries and categorization of country according to level of risk</header>
<subsection id="H035CA52EA54F4DEA9C37A87248284DD2"><enum>(a)</enum><header>Weak or failing country</header>
<paragraph id="HA8C46033B14441B88072C8BAD0C47C00"><enum>(1)</enum><header>Identification</header><text>The Undersecretary for Overseas Contingencies and Stabilization shall identify a country as a weak or failing country if the Undersecretary determines that the country endangers or is likely to endanger—</text>
<subparagraph id="H938359DF3803490C83E67EE397A35900"><enum>(A)</enum><text>the population of such country;</text></subparagraph>
<subparagraph id="H08E2E5853B1943C780AE49F8EEB7B9D"><enum>(B)</enum><text>the security or stability of neighboring countries;</text></subparagraph>
<subparagraph id="H6F4EA4B741CE4C14B378CC96F5DBF6C5"><enum>(C)</enum><text>United States national security;</text></subparagraph>
<subparagraph id="H8132BDA7347F4915B494AEE800E42728"><enum>(D)</enum><text>success in the Global War on Terrorism; or</text></subparagraph>
<subparagraph id="H5497A58BAC6D4342A63FDD41A3005762"><enum>(E)</enum><text>United States or international efforts towards the non-proliferation of weapons of mass destruction.</text></subparagraph></paragraph>
<paragraph id="H804DB952A480412DA3E3888B032FCFF1"><enum>(2)</enum><header>Definition</header><text>For purposes of this section, the term <quote>weak or failing country</quote> means a country identified by the Undersecretary under paragraph (1).</text></paragraph> </subsection>
<subsection id="HD6B7A1A070F54D299FF302868BB8ECBA"><enum>(b)</enum><header>Categorization</header>
<paragraph id="HBF83DCED1F7348AEAFFAE09B60672EBD"><enum>(1)</enum><header>Increasing levels of risk</header><text>The Undersecretary shall categorize a weak or failing country into one of three risk categories, each of which corresponds to an increasing level of risk relative to the preceding category, as follows:</text>
<subparagraph id="H3B6F63B900944061846EF371BEFB845B"><enum>(A)</enum><text>Country of risk.</text></subparagraph>
<subparagraph id="H6AAB27042EC64FB199E3DD56CA91B88D"><enum>(B)</enum><text>Country of impending risk.</text></subparagraph>
<subparagraph id="HFE2ECBE4214B498BAFCD4241114BAC8F"><enum>(C)</enum><text>Country of immediate risk.</text></subparagraph></paragraph>
<paragraph id="H1D237172CC6D4B58B7AC290593E5783D"><enum>(2)</enum><header>Country of risk</header><text>The Undersecretary shall categorize a weak or failing country as a country of risk if the Undersecretary determines that the country is likely to satisfy one or more of the criteria specified in subsection (a)(1) within two to five years after the date of the categorization.</text></paragraph>
<paragraph id="H1697A606269545A5AFBA4700CE6B09E6"><enum>(3)</enum><header>Country of impending risk</header><text>The Undersecretary shall categorize a weak or failing country as a country of impending risk if the Undersecretary determines that the country—</text>
<subparagraph id="H97389E207EA24478B67724EEC411D46D"><enum>(A)</enum><text>is likely to satisfy one or more of the criteria specified in subsection (a)(1) within two years after the date of the categorization; or</text></subparagraph>
<subparagraph id="HAC4FCC630EE1449F86C8469C8788DB4C"><enum>(B)</enum><text>satisfies one or more of the criteria at the time of the categorization, but the President, after consultation with the National Security Council, does not consider the country to be a national security priority.</text></subparagraph></paragraph>
<paragraph id="HC92DA1FE19394550872DCD5E7F05E0BF"><enum>(4)</enum><header>Country of immediate risk</header><text>The Undersecretary shall categorize a weak or failing country as a country of immediate risk if—</text>
<subparagraph id="HF25B3E4FBFDD4C318C9200C8A2A56C34"><enum>(A)</enum><text>the Undersecretary determines that the country satisfies one or more of the criteria specified in subsection (a)(1) at the time of the categorization; and</text></subparagraph>
<subparagraph id="H82BD93B3EAD84990B5E9ABB467E0470"><enum>(B)</enum><text>the President, after consultation with the National Security Council, considers the country to be a national security priority.</text></subparagraph></paragraph>
<paragraph id="HB4821235227D47F4838356E93FC6CFA"><enum>(5)</enum><header>Prompt notice of certain categorizations</header><text>Not later than 30 days after the initial categorization of a weak or failing country as a country of impending risk or a country of immediate risk, the Undersecretary shall notify the President and the appropriate congressional committees of the categorization.</text></paragraph> </subsection>
<subsection id="HC984D56CB5194A9CA88F9FECD393A180"><enum>(c)</enum><header>Basis for categorization</header>
<paragraph id="HCF65C08CA87B4EB096275B455C0066CE"><enum>(1)</enum><header>Review</header><text>The Assistant Secretary for Contingency Planning shall conduct—</text>
<subparagraph id="H2E5B3C646E0F4B2789DA30FAEC2D6C59"><enum>(A)</enum><text>an annual review of each weak or failing country categorized as a country of risk;</text></subparagraph>
<subparagraph id="HC5CD7D049950485DABC547003F49ABF1"><enum>(B)</enum><text>a biannual review of each weak or failing country categorized as a country of impending risk; and</text></subparagraph>
<subparagraph id="H39D9989EF96E4DE1A2FBD6FDB14BA012"><enum>(C)</enum><text>a quarterly review of each weak or failing country categorized as a country of immediate risk.</text></subparagraph></paragraph>
<paragraph id="H33A8D3CA90094E409620FF779BEAC68B"><enum>(2)</enum><header>Report</header><text>Not later than 30 days after the completion of each review under paragraph (1), the Undersecretary shall submit to the appropriate congressional committees a report containing the results of the review and such other information as the Undersecretary considers appropriate to support the categorization of the weak or failing country under subsection (b).</text></paragraph> </subsection>
<subsection id="HA6F5744B787E47BFAEBA934F6C758770"><enum>(d)</enum><header>Additional monitoring</header>
<paragraph id="H521327E1B0AC4293B3A5C19F90C6202B"><enum>(1)</enum><header>Political and economic developments</header><text>The Assistant Secretary for Contingency Planning shall monitor political and economic developments in each weak or failing country categorized as a country of risk, a country of impending risk, or a country of immediate risk.</text></paragraph>
<paragraph id="H6D3D39CE68CF4ADD8DB408D8BE879D3"><enum>(2)</enum><header>Focus of attention</header><text>With respect to a weak or failing country categorized as a country of impending risk or a country of immediate risk, the Assistant Secretary shall pay particular attention to political and economic developments that are likely to necessitate—</text>
<subparagraph id="H34122F5695AF41689494C045A1C1D75F"><enum>(A)</enum><text>an adjustment in plans for pre-conflict stabilization operations and post-conflict reconstruction operations for the country under subsection (f); or</text></subparagraph>
<subparagraph id="H3AC952D42E194CF0A6D383D954722EE3"><enum>(B)</enum><text>an adjustment in the level of risk of the country under subsection (b).</text></subparagraph></paragraph> </subsection>
<subsection id="H54A920B66403458200F0FDA28EC1A31"><enum>(e)</enum><header>Review of foreign assistance and diplomatic efforts</header>
<paragraph id="HE95E81A286E740CA858184A9D8C2A447"><enum>(1)</enum><header>Initial review required</header><text>Not later than 30 days after the initial categorization of a weak or failing country as a country of risk, country of impending risk, or a country of immediate risk, the Assistant Secretary for Contingency Planning shall conduct a review of the amount of foreign assistance provided to the country and any diplomatic efforts undertaken with regard to the country.</text></paragraph>
<paragraph id="H4B3B4B781C32489CA24E68A4602BDC1D"><enum>(2)</enum><header>Periodic updates</header><text>The Assistant Secretary shall update each review conducted under paragraph (1)—</text>
<subparagraph id="HC7667E71AE8C47E4A76CD5E45DEF017"><enum>(A)</enum><text>not less than once every two years for each weak or failing country that is categorized as a country of risk for two or more consecutive years;</text></subparagraph>
<subparagraph id="H0354546FF732421D8FE4D9C9B91E062C"><enum>(B)</enum><text>not less than once every year for each weak or failing country that is categorized as a country of impending risk for two or more consecutive years; and</text></subparagraph>
<subparagraph id="H504B10F19A4F430BBABE1C00A460FC92"><enum>(C)</enum><text>not less than once every six months for each weak or failing country that is categorized as a country of immediate risk.</text></subparagraph></paragraph>
<paragraph id="HADED5AFFF7404652001845DBB0E1D100"><enum>(3)</enum><header>Follow-up report</header><text>Not later than 30 days after completing each review conducted or updated under this subsection regarding a weak or failing country categorized as a country of risk, a country of impending risk, or a country of immediate risk, and based on the review, the Undersecretary shall submit to the appropriate congressional committees a report containing such recommendations for further action regarding the country, including relating to foreign assistance and diplomatic efforts, as the Undersecretary considers appropriate to—</text>
<subparagraph id="H8102319B0F96477497D09F576E29E5D8"><enum>(A)</enum><text>reduce the likelihood that the country will ever satisfy any of the criteria specified in subsection (a)(1), if the country does not satisfy any of the criteria at the time of the submission of the report;</text></subparagraph>
<subparagraph id="H1D8EE259C0E246FD9E9E66E006005B20"><enum>(B)</enum><text>assist the country to end its satisfaction of any of the criteria and reduce the likelihood that the country will be considered a national security priority by the President or allow the President to remove the country from the list of countries the President considers to be a national security priority, if the country satisfies any of the criteria at the time of the submission of the report; and</text></subparagraph>
<subparagraph id="H95B043C5DDD14062B1B65FB00CDF35D"><enum>(C)</enum><text>allow the Undersecretary to reduce or remove the categorization of the country under subsection (b) and remove the identification of the country as a weak or failing country.</text></subparagraph></paragraph></subsection>
<subsection id="H68D3F215E06F48A89B81F4C0CB1178B1"><enum>(f)</enum><header>Plans for pre-conflict stabilization operations and post-conflict reconstruction operations</header><text>The Assistant Secretary for Contingency Planning shall require the preparation of plans for pre-conflict stabilization operations and post-conflict reconstruction operations for each weak or failing country categorized as a country of impending risk or a country of immediate risk.</text></subsection>
<subsection id="H69CFE35DD9D046CA905B4479A4A0B8B6"><enum>(g)</enum><header>Special Coordinator for countries of impending risk</header>
<paragraph id="H1C11634C0A134AB582D18DC03BEA2BD9"><enum>(1)</enum><header>Appointment</header><text>Not later than 15 days after the categorization of a weak or failing country as a country of impending risk, the President shall appoint an acting Special Coordinator for each such country.</text></paragraph>
<paragraph id="HF18CE4D59E5141B0A9D71916FD760885"><enum>(2)</enum><header>Formalization</header><text>As soon as practicable after the appointment of an acting Special Coordinator under paragraph (1), the President shall request that the acting Special Coordinator be formally appointed as a Special Coordinator. The Special Coordinator shall be appointed by and with the advice and consent of the Senate, and shall have the rank and status of Ambassador-at-Large.</text></paragraph>
<paragraph id="HE0C6AD4586624559BAEFE1523FD521E"><enum>(3)</enum><header>Duties</header><text>The Special Coordinator for a country shall serve as the lead executive branch official responsible for coordinating pre-conflict stabilization operations and post-conflict reconstruction operations with regard to the country, intended to—</text>
<subparagraph id="HCAB8C3CAD31E45C7AFCB6D3D7D9820CD"><enum>(A)</enum><text>prevent the country from satisfying any of the criteria specified in subsection (a)(1), if the country does not satisfy any of the criteria at the time of the appointment; or</text></subparagraph>
<subparagraph id="HF9F6F5BCC59E4E6EB9DDD8183300378D"><enum>(B)</enum><text>assist the country to end its satisfaction of any of the criteria and reduce the likelihood that the country will be considered a national security priority by the President, if the country satisfies any of the criteria at the time of the appointment.</text></subparagraph></paragraph>
<paragraph id="H3241E360ED804BFBB660274E69E8E042"><enum>(4)</enum><header>Qualifications</header><text>A person appointed as a Special Coordinator shall—</text>
<subparagraph id="HE80F959A6EB744DDA9EB8F9B003B8869"><enum>(A)</enum><text>be a senior member of the Foreign Service who possesses expertise with respect to the country categorized as a country of impending risk; or</text></subparagraph>
<subparagraph id="HFF9083888AF24F7B99E7DDAA48B84DE0"><enum>(B)</enum><text>be a member of the Office of Overseas Contingencies and Stabilization with expertise in the operations and administration of the Office.</text></subparagraph></paragraph>
<paragraph id="H828589E1B02E4756AA393DF363447FC6"><enum>(5)</enum><header>Waiver</header><text>The President may waive the qualification requirements under paragraph (4) if the President determines that the waiver is in the national security interests of the United States.</text></paragraph>
<paragraph id="H6FBDFA3D24F741998D760164AF1D371F"><enum>(6)</enum><header>Support</header><text>The Undersecretary shall provide each Special Coordinator with such staff and resources as the Undersecretary considers necessary and appropriate to allow the Special Coordinator to properly carry out the duties specified in paragraph (3).</text></paragraph></subsection>
<subsection id="HD4535973728A407CA7EFAD403147BC84"><enum>(h)</enum><header>Director of Operations for countries of immediate risk and related countries</header>
<paragraph id="H41D390FDB2534A619C144605A402A500"><enum>(1)</enum><header>Appointment</header><text>Not later than 15 days after the categorization of a weak or failing country as a country of immediate risk, the President shall appoint an acting Director of Operations for each such country.</text></paragraph>
<paragraph id="H3B0CCAF1680C4F6D8108F0A746E3E2EE"><enum>(2)</enum><header>Formalization</header><text>As soon as practicable after the appointment of an acting Director of Operations under paragraph (1), the President shall request that the acting Director of Operations be formally appointed as a Director of Operations. The Director of Operations shall be appointed by and with the advice and consent of the Senate, and shall have the rank and status of Ambassador-at-Large.</text></paragraph>
<paragraph id="H5F0F8434E75E47E19F05A634FCB30901"><enum>(3)</enum><header>Appointment of emergency acting Director of Operations</header>
<subparagraph id="H6C536C28F714444DA0326ECD308C807"><enum>(A)</enum><header>Emergency appointment for related countries</header><text>The Undersecretary shall appoint an emergency acting Director of Operations for a country or a weak or failing country not categorized as a country of immediate risk if—</text>
<clause id="HA6CCE92AB05B49F294CC278DA89C7896"><enum>(i)</enum><text>the United States undertakes a military or non-military intervention operation in the country; or</text></clause>
<clause id="H978680836C244428BC5B65EFD7150077"><enum>(ii)</enum><text>the Undersecretary determines that a military or non-military intervention operation is imminent.</text></clause></subparagraph>
<subparagraph id="H0C0EE2F6A9234B9A9599F6B8D52009E"><enum>(B)</enum><header>Time for emergency appointment</header><text>The Undersecretary shall appoint the emergency acting Director of Operations for a country or such weak or failing country—</text>
<clause id="H52DAB2F2F41443AB94F238859864248B"><enum>(i)</enum><text>as soon as practicable after the initiation of a military or non-military intervention operation in the country; or</text></clause>
<clause id="H37854B1578704C3C9FC1CC1974EF72F1"><enum>(ii)</enum><text>in the case of a determination under subparagraph (A)(ii), as soon as practicable after making the determination, but not later than the first day after the initiation of such intervention operation.</text> </clause></subparagraph>
<subparagraph id="H66D8BC30017941C688D1567463A525FA"><enum>(C)</enum><header>Notification to Congress</header><text>Not later than seven days after the appointment of an emergency acting Director of Operations under paragraph (3), the Undersecretary shall notify the appropriate congressional committees of the designation.</text></subparagraph>
<subparagraph id="H79B303B3CB9345B9A03D35404F63809B"><enum>(D)</enum><header>Formalization</header><text>As soon as practicable after the appointment of an emergency acting Director of Operations under paragraph (3), the President shall request that the emergency acting Director of Operations be formally appointed as a Director of Operations.</text></subparagraph> </paragraph>
<paragraph id="H2DA0B3D332284D5BA617676C1F4DA82E"><enum>(4)</enum><header>Duties</header><text>The Director of Operations for a country shall serve as the lead executive branch official responsible for coordinating pre-conflict stabilization operations and post-conflict reconstruction operations with regard to the country, intended to—</text>
<subparagraph id="H10C6B12EC78B43B598C46148A92CBB9F"><enum>(A)</enum><text>assist the country to end its satisfaction of any of the criteria specified in subsection (a)(1); and</text></subparagraph>
<subparagraph id="H8CCD9D6E34A44AD198F26667A6369C00"><enum>(B)</enum><text>allow the President to remove the country from the list of countries the President considers to be a national security priority.</text></subparagraph></paragraph>
<paragraph id="H8342BEACBB0343599925E058F1188BE"><enum>(5)</enum><header>Regular appearance before Congress</header><text>To the maximum extent practicable, the Director of Operations shall appear regularly before the appropriate congressional committees to provide updates regarding pre-conflict stabilization operations or post-conflict reconstruction operations, intended to—</text>
<subparagraph id="HC17E6C0CA99243BEA19DA0ED62514B46"><enum>(A)</enum><text>assist the country to end its satisfaction of any of the criteria specified in subsection (a)(1); and</text></subparagraph>
<subparagraph id="H9F60F93BB68741C1A84CC4C537FB6F32"><enum>(B)</enum><text>allow the President to remove the country from the list of countries the President considers to be a national security priority.</text></subparagraph></paragraph>
<paragraph id="HFE58A194735348A494D868EB9EEFB831"><enum>(6)</enum><header>Qualifications</header><text>A person appointed as a Director of Operations shall—</text>
<subparagraph id="HA5B7ED7C08A945A693143841B7DEA112"><enum>(A)</enum><text>be a senior or former member of the Foreign Service who possesses expertise with respect to the country; or</text></subparagraph>
<subparagraph id="H3BECE233488C40DB9DE51C4914C83239"><enum>(B)</enum><text>be a senior or former member of the Senior Executive Service who possesses expertise with respect to the country.</text></subparagraph></paragraph>
<paragraph id="HD866C7125F764F4E9213F4DD91CB89D6"><enum>(7)</enum><header>Waiver</header><text>The President may waive the qualification requirements under paragraph (6) if the President determines that the waiver is in the national security interests of the United States.</text></paragraph>
<paragraph id="HE6C2DAED3E57411995ED9926B242C3F8"><enum>(8)</enum><header>Support</header><text>The Undersecretary shall provide each Director of Operations with such staff and resources as the Undersecretary considers necessary and appropriate to allow the Director of Operations to properly carry out the duties specified in paragraph (4).</text></paragraph> </subsection>
<subsection id="H3571155010DD4377A0920914E385E6BC"><enum>(i)</enum><header>Transitional countries</header>
<paragraph id="H4511E5662BAD4AEC9D34401506BB6F69"><enum>(1)</enum><header>Increase in level of risk</header><text>The Special Coordinator for a country of impending risk shall assume the title of Director of Operations for that country if that country is subsequently categorized as a country of immediate risk.</text></paragraph>
<paragraph id="H539325F1C86A4568AF30672E52B63D04"><enum>(2)</enum><header>Decrease in level of risk</header>
<subparagraph id="HF9716C170D474CB9B31710DA90F40963"><enum>(A)</enum><header>Country of immediate risk to country of impending risk</header><text>The Director of Operations for a country of immediate risk shall assume the title of Special Coordinator for that country if that country is subsequently categorized as a country of impending risk.</text></subparagraph>
<subparagraph id="H6121E5BD2BAA4A6D951678584447881E"><enum>(B)</enum><header>Country of immediate or impending risk to country of risk or non-categorized country</header><text>The Director of Operations for a country of immediate risk or a Special Coordinator for a country of impending risk may retain such title if—</text>
<clause id="H35EC7244AB734BA3AEB9C893B4BFD8B"><enum>(i)</enum><text>that country is subsequently categorized as a country of risk or that country is subsequently removed from risk categorization; and</text></clause>
<clause id="HA807A9C95B6A4819BFA2D6C32BB8294C"><enum>(ii)</enum><text>the President determines that retention of the Director of Operations or Special Coordinator is in the national security interests of the United States.</text></clause></subparagraph></paragraph></subsection>
<subsection id="H2197E45122B44559B78EBA22C52390E9"><enum>(j)</enum><header>Resignation and replacement</header><text>If a Special Coordinator or a Director of Operations resigns, the President shall, not later than 15 days from the date of such resignation, appoint a replacement acting Special Coordinator or replacement acting Director of Operations in accordance with subsections (g) or (h), as the case may be.</text> </subsection>
<subsection id="HE021F9868B344053A02BC0558003A2C1"><enum>(k)</enum><header>Emergency assistance</header><text>Pursuant to section 452 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>), the Undersecretary shall use emergency financial assistance furnished from the Department of State Emergency Stabilization Operations Support Fund to carry out pre-conflict stabilization operations in countries of impending risk or countries of immediate risk.</text></subsection>
<subsection id="HD779FE92D1E34CBAA4B0D040E9009E00"><enum>(l)</enum><header>Classified information</header>

<section id="H5F5676573A804A46907309647500E522"><enum>103.</enum><header>Emergency Stabilization Operations Support Fund</header> <text display-inline="no-display-inline">The Foreign Assistance Act of 1961 is amended by adding after section 451 (<external-xref legal-doc="usc" parsable-cite="usc/22/2261">22 U.S.C. 2261</external-xref>) the following new section:</text>

<section id="HB3DAD89CF1634D868D5971318B689799"><enum>452.</enum><header>Emergency Stabilization Operations Support Fund</header>
<subsection id="H84E960B4CB484C1995FA63829C63D21D"><enum>(a)</enum><header>Establishment and funding</header><text>There is established in the Treasury an account to be known as the <quote>Department of State Emergency Stabilization Operations Support Fund</quote> (in this section referred to as the <quote>Fund</quote>). The Fund shall consist of amounts appropriated to the Fund. Amounts in the Fund are available without further appropriation and until expended to carry out this section.</text></subsection>
<subsection id="HF14C8D6F68BE4A33BC29D2CA81AA002E"><enum>(b)</enum><header>Emergency assistance and coordination</header><text>The President, acting through the Undersecretary of State for Overseas Contingencies and Stabilization, is authorized to use amounts in the Fund to furnish emergency financial assistance to the Office of Overseas Contingencies and Stabilization of the Department of State, for use with respect to a country categorized under section 60 of the State Department Basic Authorities Act of 1956 as a country of impending risk or a country of immediate risk.</text></subsection>
<subsection id="H7480B665DBFE4137AB3299ED293906CC"><enum>(c)</enum><header>Use of emergency assistance for pre-conflict stabilization operations</header>
<paragraph id="H14D84BDBFA9A432683253F74001BA7B1"><enum>(1)</enum><header>Country of impending risk</header><text>The Special Coordinator for a country of impending risk, appointed pursuant to section 60(g) of the State Department Basic Authorities Act of 1956, shall use the emergency financial assistance furnished under subsection (b) to carry out pre-conflict stabilization operations with respect to a country of impending risk, intended to—</text>
<subparagraph id="H00E43EA55D124530AF4DF8D505BFD1F8"><enum>(A)</enum><text>prevent the country from satisfying any of the criteria specified in section 60(a)(1) of the State Department Basic Authorities Act of 1956, if the country does not satisfy any of the criteria at the time of the appointment of the Special Coordinator for the country; or</text></subparagraph>
<subparagraph id="HC17B6972C9FA4ADDB200BA8D9D458432"><enum>(B)</enum><text>assist the country to end its satisfaction of any of the criteria and reduce the likelihood that the country will be considered a national security priority by the President, if the country satisfies any of the criteria at the time of the appointment.</text></subparagraph></paragraph>
<paragraph id="HD3F3274B16CC4B03BE1F64E675DA4BBE"><enum>(2)</enum><header>Country of immediate risk</header><text>The Director of Operations for a country of immediate risk, appointed pursuant to section 60(h) of the State Department Basic Authorities Act of 1956, shall use the emergency financial assistance furnished under subsection (b) to carry out pre-conflict stabilization operations with respect to a country of immediate risk, intended to—</text>
<subparagraph id="H4F25A81722394B91B727EFD00CBF1B0"><enum>(A)</enum><text>assist the country to end its satisfaction of any of the criteria specified in section 60(a)(1) of the State Department Basic Authorities Act of 1956; and</text></subparagraph>
<subparagraph id="H79FFAFB898FE4ABC85D859164CBD19E2"><enum>(B)</enum><text>allow the President to remove the country from the list of countries the President considers to be a national security priority.</text></subparagraph></paragraph></subsection>
<subsection id="H081C48B80EFC4DCC8494853669D28FF2"><enum>(d)</enum><header>Report</header><text>The President shall submit to the Committee on International Relations of the House of Representatives and the Committee on Foreign Relations of the Senate an annual report covering the previous year and containing—</text>
<paragraph id="H5215FA4D139A41ABBD00FEBE173B86B8"><enum>(1)</enum><text>an identification of the countries of impending risk and the countries of immediate risk for which amounts from the Fund have been expended;</text></paragraph>
<paragraph id="H8A8CD0E210B143819DF85E7E35375462"><enum>(2)</enum><text>a specification of the amounts of emergency financial assistance so expended;</text></paragraph>
<paragraph id="H053C24A989634BC38CF98BFF5E760088"><enum>(3)</enum><text>an explanation of how or in what manner the emergency financial assistance was used;</text></paragraph>
<paragraph id="H4AB8E510EEA345F18644DF17B3641F73"><enum>(4)</enum><text>an evaluation of the effectiveness of the emergency financial assistance in helping the Office of Overseas Contingencies and Stabilization carry out the stabilization operations specified in subsection (c) with respect to countries of impending risk and countries of immediate risk; and</text></paragraph>
<paragraph id="HC0CB6A7068B3473AB8EE96D5C4D55F12"><enum>(5)</enum><text>such other information as the President considers necessary and appropriate.</text></paragraph></subsection>
<subsection id="H8079AFEB328A43220084F1B2D4E1FE1"><enum>(e)</enum><header>Limitation on use of emergency assistance</header><text>Emergency financial assistance made furnished under this section may not be used for post-conflict reconstruction operations in any country.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>

<section id="H31D7480A9871468DB2F6A278B2F2D9A5"><enum>201.</enum><header>Regional joint interagency task forces for post-conflict reconstruction operations</header>
<subsection id="H57090EBCA1C94677813F7735F189E713"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/6">Chapter 6</external-xref> of title 10, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/164">section 164</external-xref> the following new section:</text>

<section id="HB9AD53C989384F488D26AA9569BE3F72"><enum>164a.</enum><header>Joint interagency task forces for post-conflict reconstruction operations</header>
<subsection id="H05FB3E8D4A2F4F56BA8827EC9FC4539B"><enum>(a)</enum><header>Establishment</header><text></text>
<paragraph id="HD27A5CB837464C95A4F318F77960A531" display-inline="yes-display-inline"><enum>(1)</enum><text>Whenever the commander of a regional combatant command, at the direction of the President or Secretary of Defense, begins planning for a contingency operation that has been or may be directed by the President or Secretary of Defense, the commander shall establish, within the staff of the combatant command, a joint interagency task force to prepare for any post-conflict reconstruction operations that may result from that contingency operation.</text></paragraph>
<paragraph id="HAC806C67FF6D4064A6B11DE07F671511" indent="up1"><enum>(2)</enum><text>Subject to the direction of the President and Secretary of Defense, and except as otherwise specified by the commander of the command, the head of any task force established under paragraph (1) shall be the deputy commander of the combatant command. If the deputy commander is not the head of the task force, the head of the task force shall be a general or flag officer on active duty who is assigned to the combatant command.</text></paragraph></subsection>
<subsection id="H109857FAAD9A44F9A86E88B86DF6FBBD"><enum>(b)</enum><header>Functions</header><text>A task force established under this section with respect to a contingency operation shall assist the combatant commander in planning, before, during, and after the combatant command is involved in combat operations, for post-conflict reconstruction operations in order to facilitate as smooth a transition as possible from the conflict phase to the post-conflict reconstruction phase of the operation.</text></subsection>
<subsection id="HF3D8A387FE684F88AFE44B73857C40A6"><enum>(c)</enum><header>Agency representatives</header><text></text>
<paragraph id="HC6F244E01527481DB454AFAC4F6CBE4D" display-inline="yes-display-inline"><enum>(1)</enum><text>Whenever the commander of a combatant command establishes a task force under this section, the commander, subject to such procedures as may be established by the Secretary of Defense, shall request the heads of the departments and agencies specified in paragraph (2) to assign an appropriate representative or representatives to the task force. Upon receiving such a request, the head of a department or agency shall promptly assign a representative or representatives to the task force.</text></paragraph>
<paragraph id="H2415DE7E19E7411497A84FB1739777D" indent="up1"><enum>(2)</enum><text>Paragraph (1) applies to the following:</text>
<subparagraph id="H8E004D26AA364AC0893724B3813766DB"><enum>(A)</enum><text>The Department of State, including the Office of Overseas Contingencies and Stabilization.</text></subparagraph>
<subparagraph id="H0F1AB4D655DB4E2EB02DEC4E8F3DB4E6"><enum>(B)</enum><text>The Department of Commerce.</text></subparagraph>
<subparagraph id="HB6F7D52816D647F4AF4535844E436F32"><enum>(C)</enum><text>The Department of the Treasury.</text></subparagraph>
<subparagraph id="HA6F49E1B6A9547B9BE09E5FF64253600"><enum>(D)</enum><text>The Federal Bureau of Investigation.</text></subparagraph>
<subparagraph id="HA1C2A4AC0D1547C8A304B5674395A827"><enum>(E)</enum><text>The Central Intelligence Agency.</text></subparagraph>

<enum>III</enum><header>National Security Council Reform</header>
<section id="H6738C42ED8C84A19B089B9005BA1C7A4"><enum>301.</enum><header>Joint Task Force for Stabilization, Reconstruction, and Contingency Operations Coordination</header>
<subsection id="H81AFD1D910AE49C28CF4E343053CFAA7"><enum>(a)</enum><header>Establishment</header><text>There is established in the Executive Office of the President a task force to be known as the <quote>Joint Task Force for Stabilization, Reconstruction, and Contingency Operations Coordination</quote> (in this section referred to as the <quote>Joint Task Force</quote>). The Joint Task Force shall be headed by the Assistant to the President for National Security Affairs or a designee of the Assistant.</text></subsection>
<subsection id="H0DFFB31D30EA47F2A16363FAF104E88"><enum>(b)</enum><header>Mission</header><text>The mission of the Joint Task Force is to ensure proper and complete coordination between Federal agencies before, during, and after instances in which the United States participates in—</text>
<paragraph id="H8921D33477CA4DA1AAED00F45DBF51A2"><enum>(1)</enum><text>pre-conflict stabilization operations in a foreign country;</text></paragraph>
<paragraph id="H076C081A399A4A93A341EB95A9330278"><enum>(2)</enum><text>contingency operations, as defined in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(13)</external-xref> of title 10, United States Code, in a foreign country; and</text></paragraph>
<paragraph id="H78239B6A189D46C7BC91D9D1AD81BCBA"><enum>(3)</enum><text>post-conflict reconstruction operations, in a foreign country.</text> </paragraph> </subsection>
<subsection id="H72BBF4402FC44451885DD107D984985"><enum>(c)</enum><header>Organization</header><text>The Joint Task Force shall be comprised of the following:</text>
<paragraph id="HE09EF12D67734279A003557E086E8F5C"><enum>(1)</enum><header>Director or Acting Director of Operations</header><text>Each Director or Acting Director of Operations, appointed under section 60 of the State Department Basic Authorities Act of 1956, as added by section 102.</text> </paragraph>
<paragraph id="H087D1492CA6444A0898708E04CD0F0DD"><enum>(2)</enum><header>Deputy commander of the combatant command</header><text>A deputy commander of the combatant command of the joint interagency task force for post-conflict reconstruction operations, established under <external-xref legal-doc="usc" parsable-cite="usc/10/164a">section 164a</external-xref> of title 10, United States Code, as added by section 201, for each country in which such operations are conducted.</text></paragraph>
<paragraph id="HD9BCA233400742FF9DB3241D1DE229FF"><enum>(3)</enum><header>Additional officials</header><text>Such additional officials of the executive branch as the Assistant to the President for National Security Affairs or a designee of the Assistant determines to be appropriate.</text></paragraph></subsection>
<subsection id="H250CD13ABE1547C4A6937118A1EAB362"><enum>(d)</enum><header>Meetings</header>
<paragraph id="H403E8F9D2B2242378274D7E2AF90642E"><enum>(1)</enum><header>In general</header><text>The Joint Task Force shall meet as such times and in such places as the Assistant to the President for National Security Affairs or a designee of the Assistant directs.</text></paragraph>
<paragraph id="H59F04A6ACBC04EA7977CE71C3649DCDE"><enum>(2)</enum><header>Mandatory meetings</header><text>In the case of a pre-conflict stabilization operation, a contingency operation, or a post-conflict reconstruction operation, the Joint Task Force shall meet as soon as practicable after the initiation of such operation.</text></paragraph></subsection> </section>
<enum>IV</enum><header>Miscellaneous Provisions</header>
<section id="HD782173767194780B7DD79585CEE24AA"><enum>401.</enum><header>Rules of construction</header>
<subsection id="H89DAF3426C6944559566D9A2C1D560E6"><enum>(a)</enum><header>National security strategy</header><text>Nothing in this Act shall be construed to encourage or discourage an increase or decrease in foreign interventions or military or non-military operations by the United States, or to endorse any particular national security strategy or policy.</text></subsection>
<subsection id="HF4F420BB467B4023A8FBD0354D2F2C00"><enum>(b)</enum><header>Authority of the President</header><text>Nothing in this Act shall be construed to limit the authority of the President to undertake any military or non-military operation that the President considers necessary to protect the national security interests of the United States.</text></subsection></section>
<section id="HCC6A4BC70FB74CED940908DFD336DC2"><enum>402.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
<paragraph id="H404A33092C8D475A98AF4B2C4500A174"><enum>(1)</enum><text>funds appropriated to carry out the amendments made by this Act should be offset, to the greatest extent practicable, by reductions in redundant or duplicative functions and foreign assistance programs of the Department of State; and</text></paragraph>
<paragraph id="H32FFE6DD30F04871BA00C8C6F0C602A5"><enum>(2)</enum><text>increased staff levels required by the amendments made by this Act should be offset, to the greatest extent practicable, by—</text>
<subparagraph id="H8808EAE4C33042869EB8D26BB2F3BE3"><enum>(A)</enum><text>the transfer of staff within the Department of State; and</text></subparagraph>
<subparagraph id="HBAD7FA07EFB44D02B58603F26266D08B"><enum>(B)</enum><text>the elimination of redundant functions of the Department of State that arise as a result of the amendments made by this Act.</text></subparagraph></paragraph></section>
