<official-title>To amend title 38, United States Code, to codify certain additional diseases as establishing a presumption of service-connection when occurring in veterans exposed to ionizing radiation during active military, naval, or air service, and for other purposes.</official-title>

<section id="HCE7EAD6053DF48138C29AD2A0D9B214" section-type="section-one"><enum>1.</enum><header>Codification of administrative actions relating to presumptions of service connection for veterans exposed to ionizing radiation</header> 
<subsection id="HA80C4D14276E43C591BA7F14323195FF"><enum>(a)</enum><header>Covered diseases</header><text>Subsection (c)(2) of <external-xref legal-doc="usc" parsable-cite="usc/38/1112">section 1112</external-xref> of title 38, United States Code, is amended by adding at the end the following new subparagraphs:</text>

<subsection id="H7BEB67798ECE442D8C150022F4E6FD41"><enum>(b)</enum><header>Covered radiation-risk activities</header><text>Subsection (c)(3)(B) of such section is amended by adding at the end the following new clause:</text>

<clause id="H84178214F2F84DBEB4CFB82948878800" indent="up2"><enum>(iv)</enum><text>Service in a capacity which, if performed as an employee of the Department of Energy, would qualify the individual for inclusion as a member of the Special Exposure Cohort under section 3621(14) of the Energy Employees Occupational Illness Compensation Program Act of 2000 (42 U.S.C. 7384<italic>l</italic>(14)).</text></clause> <after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE5B527FB9D114A66009DB380CEE218C"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect as of March 26, 2002. </text></subsection></section> 
<section id="H190760ACDB7C412B9E045878B000F5A5"><enum>2.</enum><header>Offset of veterans’ disability compensation and dependency and indemnity compensation from awards under Radiation Exposure Compensation program</header> 
<subsection id="H7D6D8C2718264900939B5CA656DCCF30"><enum>(a)</enum><header>Offset in lieu of forfeiture from disability compensation</header><text>Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/38/1112">section 1112</external-xref> of title 38, United States Code, is amended by adding at the end the following new paragraph:</text>

<paragraph id="HFFBD2120A4494B869B866725D5E14942" indent="up1"><enum>(4)</enum><text>A radiation-exposed veteran who receives a payment under the provisions of the Radiation Exposure Compensation Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) shall not be deprived, by reason of the receipt of that payment, of receipt of compensation to which that veteran is entitled by reason of paragraph (1), but there shall be deducted from payment of such compensation the amount of the payment under that Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H898680E52E6346F79B04DDA5E4769F5"><enum>(b)</enum><header>Offset in lieu of forfeiture from dependency and indemnity compensation</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/1310">Section 1310</external-xref> of title 38, United States Code, is amended by adding at the end the following new paragraph:</text>

<subsection id="H9ED7823E9BCC488F00F37BB4A6C5199E" indent="up1"><enum>(c)</enum><text>A person who receives a payment under the provisions of the Radiation Exposure Compensation Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/2210">42 U.S.C. 2210</external-xref> note) shall not be deprived, by reason of the receipt of that payment, of receipt of dependency and indemnity compensation to which that person is otherwise entitled, but there shall be deducted from payment of such dependency and indemnity compensation the amount of the payment under that Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC101917132834B3CA9983100BCAC9014"><enum>(c)</enum><header>Effective date</header><text>Paragraph (4) of <external-xref legal-doc="usc" parsable-cite="usc/38/1112">section 1112(c)</external-xref> of title 38, United States Code, as added by subsection (a), shall take effect with respect to compensation payments for months beginning after March 26, 2002. Subsection (c) of section 1310 of such title, as added by subsection (b), shall take effect with respect to dependency and indemnity compensation payments for months beginning after March 26, 2002.</text> </subsection></section>
