<official-title>To amend the Omnibus Crime Control and Safe Streets Act of 1968 to allow the Attorney General to award grants under a homeland security overtime program to reimburse law enforcement agencies for past overtime expenditures and to require the Attorney General to waive the matching funds requirement for such grants.</official-title>

<section id="H7D7A16F080BC49E88BD3B241E87EA6A6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Homeland Security Overtime Reimbursement Act</quote>.</text></section> 
<section id="HE0836A2579BC49C094EE76D236868583"><enum>2.</enum><header>Reimbursement of law enforcement agencies for past overtime expenditures under the Homeland Security Overtime Program</header> 
<subsection id="HA8C8D0C736E24278B6A1CE51FEA1378"><enum>(a)</enum><header>In general</header><text>Section 1701 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796dd">42 U.S.C. 3796dd</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H5380CE74E4D747389410943E202C7E87"><enum>(l)</enum><header>Special rules for homeland security overtime programs</header><text></text> 
<paragraph id="H5F476481FA434A1D92C1F68CBDA9063"><enum>(1)</enum><header>Reimbursement for past overtime expenditures</header><text>Notwithstanding section 1704(a), a recipient of a grant under a homeland security overtime program may use grant funds to pay for homeland security overtime expenditures incurred at any time during the fiscal year preceding the fiscal year in which the grant is made.</text></paragraph> 
<paragraph id="H89765C324D364DE3A08B2DC90299F83D"><enum>(2)</enum><header>Waiver of matching funds</header><text>The Attorney General shall waive the requirement under subsection (i) of a non-Federal contribution for any grant or portion of a grant under a homeland security overtime program to the extent that the grant is used to pay for expenditures described in paragraph (1).</text></paragraph> 
<paragraph id="H225D009E4504438DA80068B147004549"><enum>(3)</enum><header>Treatment of Puerto Rico</header><text>Puerto Rico shall be considered both a unit of local government and a State for the purposes of any homeland security overtime program.</text></paragraph> 
<paragraph id="HEDF707543DC74A4BA8A99E0080938154"><enum>(4)</enum><header>Homeland security overtime program</header><text>The term <quote>homeland security overtime program</quote> means a program for which a grant is made under subsection (a) to fund overtime expenditures to law enforcement agencies for training and increased patrols related to homeland security concerns.</text></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H09B34D8BA5594B108919DBDFFAEDDDA4"><enum>(b)</enum><header>Conforming amendments</header><text>Part Q of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796dd">42 U.S.C. 3796dd et seq.</external-xref>) is amended—</text> 
<paragraph id="HC59684831C7F401AA2420030690013D5" display-inline="no-display-inline"><enum>(1)</enum><text>in section 1704(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/3799dd-3">42 U.S.C. 3799dd–3(a)</external-xref>), by striking <quote>Funds made</quote> and inserting <quote>Except as provided in section 1701(l)(1), funds made</quote>; and</text></paragraph> 
<paragraph id="H34567516FE8340E2BAF29853D9FC06D0"><enum>(2)</enum><text>in section 1701(i) (<external-xref legal-doc="usc" parsable-cite="usc/42/3799dd">42 U.S.C. 3799dd(i)</external-xref>), by striking <quote>The portion</quote> and inserting <quote>Except as provided in subsection (l)(2), the portion</quote>.</text></paragraph></subsection></section> 
<section id="H0137F242B31945E6843814C01C824E2E"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply to grants made under section 1701(a) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/9799dd">42 U.S.C. 9799dd(a)</external-xref>) for which applications are submitted after the date of the enactment of this Act.</text> </section>
