<official-title>To amend the Small Business Act to permit business concerns that are owned by venture capital operating companies or pension plans to participate in the Small Business Innovation Research Program.</official-title>

<section id="H3FBAF6DF28AD4C7DBAA583147C00D0DB" section-type="section-one"><enum>1.</enum><header>SBIR awards to business concerns owned by venture capital operating companies or employee benefit or pension plans</header> 
<subsection id="H0EE04CC65DC0433F89B7F3F9B46E342D"><enum>(a)</enum><header>In general</header><text>Section 9(f) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(f)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H1D2FD4B1327C43A0B600C089A3F914FD"><enum>(4)</enum><header>Eligibility</header><text>A business concern shall not be prevented from participating in the Small Business Innovation Research Program solely because such business concern is owned in part by—</text> 
<subparagraph id="H997F476EDB1445658466F90000EE7B5E"><enum>(A)</enum><text>a venture capital operating company that is managed and controlled by 1 or more United States citizens or permanent resident aliens; or</text></subparagraph> 
<subparagraph id="H1F85E4005F2E4DFB86F75B51D64CA006"><enum>(B)</enum><text>an employee benefit or pension plan.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA1641FB62D614D458967D212FF9C16B2"><enum>(b)</enum><header>Rulemaking authority</header><text>Not later than 180 days after the date of the enactment of this Act, the Administrator of the Small Business Administration shall issue regulations to—</text> 
<paragraph id="H7954DB807DA145049B844FDBF16690D2"><enum>(1)</enum><text>carry out the amendment made by subsection (a);</text></paragraph> 
<paragraph id="H54D6F185C6F34607B1766340CB8D0061"><enum>(2)</enum><text>ensure that a Small Business Innovation Research award is not given to a business concern that is majority owned by—</text> 
<subparagraph id="HB8E0C9F3686142DAA2EDD6028BF36DD7"><enum>(A)</enum><text>another business concern that is ineligible to participate in the Small Business Innovation Research Program; or</text></subparagraph> 
<subparagraph id="H38A9CDEE340E41F5B0CB54749E2C2880"><enum>(B)</enum><text>a venture capital operating company or an employee benefit or pension plan that is the alter ego, instrumentality, or identity of another business concern that is ineligible to participate in the Small Business Innovation Research Program.</text></subparagraph></paragraph></subsection></section>
