<section id="HEA89E457EC014D7891F3A91D660010CD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Manufacturing Advisory Council Establishment Act of 2004</quote>.</text></section> 
<section id="H24DEDCE74CEF42969FCF88A25822D3E4"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph display-inline="no-display-inline" id="H075486EBF0684A18A100ED3824AA0077"><enum>(1)</enum><text>Manufacturing is a critical component of the economy of the United States.</text></paragraph> 
<paragraph id="H51A4B03A0E394BA0A300E0ED827FB439"><enum>(2)</enum><text>A strong manufacturing sector is important to maintaining a desirable standard of living for all United States citizens. </text></paragraph> 
<paragraph id="H6E1EC9733D0D440EBB6464BD81003BB2"><enum>(3)</enum><text>United States manufacturers can compete globally as long as they are not subjected to anti-competitive trade practices. </text></paragraph> 
<paragraph id="H21A21C20413146ABBD7E59AA99C026FB"><enum>(4)</enum><text>The United States manufacturing industry is presently facing many challenges, both domestic and international. </text></paragraph> 
<paragraph id="HF45A8595AEC64C03AEAFFA678FA0273"><enum>(5)</enum><text>The President would benefit from regular, informed advice from a variety of sources within the Unites States manufacturing sector, including representatives of small and mid-sized businesses, on policies that affect manufacturing.</text></paragraph></section> 
<section id="H62803B1C6DEC47E9A328A2ADAF32A89C"><enum>3.</enum><header>Establishment</header><text display-inline="no-display-inline">There is established a council to be known as the <quote>President’s Council of Advisors on Manufacturing</quote>.</text></section> 
<section id="H12BE7DA83EE544579E61456B6DB7D0F2"><enum>4.</enum><header>Duties</header><text display-inline="no-display-inline">The duties of the Council shall be—</text> 
<paragraph id="HA47D1F76ADA7436BA9EDADF35151091"><enum>(1)</enum><text>to advise the President on policy matters affecting the domestic manufacturing sector;</text></paragraph> 
<paragraph id="HA292A57658F14DBAA34B436D1FA934AD"><enum>(2)</enum><text>to assist in the development of policies that will—</text> 
<subparagraph id="HBA98157DBBF6450F8538134EA200C34"><enum>(A)</enum><text>reduce production costs within the manufacturing sector,</text></subparagraph> 
<subparagraph id="H7EF616F6B1784778AA28EB118DFF4156"><enum>(B)</enum><text>promote the competitiveness of products manufactured in the United States in international markets,</text></subparagraph> 
<subparagraph id="H7FCE998F0F584F42B4B3194C50535159"><enum>(C)</enum><text>encourage innovation, investment, and productivity in the manufacturing sector, and</text></subparagraph> 
<subparagraph id="H19F088535E6E4F0EB1AF1661A262173"><enum>(D)</enum><text>ensure an adequate supply of skilled workers in the manufacturing sector; and</text></subparagraph></paragraph> 
<paragraph id="HB28FF7F569B9414892DBC0F4B0A3FF46"><enum>(3)</enum><text>to assist the Secretary of Commerce in securing private sector involvement for Department of Commerce activities.</text> </paragraph></section> 
<section id="H295FE8875EB84567B4F8279B6805EE2E"><enum>5.</enum><header>Membership</header> 
<subsection id="HCB5A382F6DA8483AA32D4035978800E0"><enum>(a)</enum><header>Number and appointment</header><text>The Council shall be composed of 25 members appointed by the President as follows:</text> 
<paragraph id="H0CE1899C48B64C5DA55F4F66A36B7098"><enum>(1)</enum><text>1 member shall be an officer or employee of the Federal Government.</text></paragraph> 
<paragraph id="H8A837B65B82B4DF6B966F200068F9900"><enum>(2)</enum><text>24 members shall be individuals who—</text> 
<subparagraph id="HF4ACCD4DB3EC4C8D852EBD5DE3940900"><enum>(A)</enum><text>are not officers or employees of the Federal Government;</text></subparagraph> 
<subparagraph id="H132A97B5EB9B46BCB55C46A9517C3855"><enum>(B)</enum><text>have expertise in manufacturing; and</text></subparagraph> 
<subparagraph id="H56C2F58F17A14386ABAE772334BB05D3"><enum>(C)</enum><text>represent businesses of various sizes and industries within the manufacturing sector.</text></subparagraph></paragraph></subsection> 
<subsection id="H9F47AD57A66D4232B500523BDB980157"><enum>(b)</enum><header>Continuation of membership</header><text>If a member was appointed to the Council as an officer or employee of the Federal Government and the member ceases to be an officer or employee of the Federal Government, or was appointed to the Council because the member was not an officer or employee of the Federal Government and later becomes an officer or employee of the Federal Government, that member may continue as a member for not longer than the 90-day period beginning on the date that the member ceases to be an officer or employee of the Federal Government, or becomes such an officer or employee, as the case may be. </text></subsection> 
<subsection id="H922483CB88DF40A5A9A3C2ECF5475FE7"><enum>(c)</enum><header>Terms</header><text></text> 
<paragraph id="H191FB99FC49645E7B1A18BAB15F79737"><enum>(1)</enum><header>In general</header><text>Each member shall be appointed for a term of 2 years, except as provided in paragraphs (2) and (3).</text></paragraph> 
<paragraph id="HCA8E2C97E7A943E489A48E05002D79A5"><enum>(2)</enum><header>Terms of initial appointees</header><text>As designated by the President at the time of appointment, of the members first appointed—</text> 
<subparagraph id="H7D62DE620F8348C9A219A96BE16BDED4"><enum>(A)</enum><text>8 shall be appointed for terms of 4 years;</text></subparagraph> 
<subparagraph id="HD8EF2E0F537C4982A03DD7B61000E14B"><enum>(B)</enum><text>8 shall be appointed for terms of 3 years;</text></subparagraph> 
<subparagraph id="HF040565A35444270BF8F53B7D9B2A463"><enum>(C)</enum><text>8 shall be appointed for terms of 2 years; and</text></subparagraph> 
<subparagraph id="H1CDAF07718D14AA4AA6FD018AB76686D"><enum>(D)</enum><text>the member appointed under subsection (a)(1) shall be appointed for a term of 2 years.</text></subparagraph></paragraph> 
<paragraph id="HF4E0BFCFF6BF4D2CA01708A6EEDEE986"><enum>(3)</enum><header>Vacancies</header><text>Any member appointed to fill a vacancy occurring before the expiration of the term for which the member’s predecessor was appointed shall be appointed only for the remainder of that term. A member may serve after the expiration of that member’s term until a successor has taken office.</text></paragraph></subsection> 
<subsection id="H587431755BC544D1992DB680B5C653A5"><enum>(d)</enum><header>Deadline for appointment</header><text>The appointments of the members of the Council shall be made no later than 90 days after the date of the enactment of this Act.</text></subsection> 
<subsection id="H22A3040811C64C40A1A45015EC9DBD43"><enum>(e)</enum><header>Co-chairs</header><text>The co-chairs of the Council shall be the member appointed under subsection (a)(1) and one member appointed under subsection (a)(2) who is designated by the President at the time of appointment.</text></subsection> 
<subsection id="HC20FF56B62444DA28F04A608BA2545B"><enum>(f)</enum><header>Meetings</header><text></text> 
<paragraph id="HCEF76654F73D41CD972BB4E73C3600D7"><enum>(1)</enum><header>First meeting</header><text>The Council shall hold its first meeting on a date designated by the co-chairs which is not later than 30 days after the date on which all members have been appointed.</text></paragraph> 
<paragraph id="H9B33627F5F9B47BBB949DCC17170E131"><enum>(2)</enum><header>Subsequent meetings</header><text>After the first meeting, the Council shall meet at least semi-annually upon the call of the co-chairs.</text></paragraph></subsection> 
<subsection id="HC474795C0A634CEF001416C6D1B18CEC"><enum>(g)</enum><header>No compensation for service</header><text>The members shall serve on the Council without compensation.</text></subsection> 
<subsection id="HDBFA80488CF14C0D832950EBAF2BFC13"><enum>(h)</enum><header>Travel expenses</header><text>Each member shall receive travel expenses, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></subsection> </section> 
<section id="H2220F26068614326BAE580E5954FAC8"><enum>6.</enum><header>Powers of the Council</header> 
<subsection id="H9A50F9C647864D869F3CBB9B239111D9"><enum>(a)</enum><header>Information and advice</header><text>As the Council finds appropriate, the Council may seek information and advice from persons who are not members of the Council.</text></subsection> 
<subsection id="HC2437FFD0BA34A28B000E76D1B979104"><enum>(b)</enum><header>Obtaining official data</header><text>The Council may secure directly from any agency of the United States information necessary to enable it to carry out this Act. Upon the request of either co-chair, the head of that department or agency shall furnish that information to the Council.</text></subsection> 
<subsection id="H08113B6AD9B04DDB83EC5DF67C42B0D"><enum>(c)</enum><header>Mails</header><text>The Council may use the United States mails in the same manner and under the same conditions as other departments and agencies of the United States.</text></subsection></section> 
<section id="H92C35FC76ABD4DF5B12EB0F272D9347F"><enum>7.</enum><header>Administration</header> 
<subsection id="HE1E441409332481C80856D00F4006009"><enum>(a)</enum><header>Expenses</header><text>Any expenses incurred by the Council shall be paid from the funds available to the Assistant Secretary of Commerce responsible for manufacturing and services, as determined by the Secretary of Commerce.</text></subsection> 
<subsection id="H468CCD85C2AE40ECB793740088265F84"><enum>(b)</enum><header>Administrative services</header><text>The Assistant Secretary of Commerce responsible for manufacturing and services, as determined by the Secretary of Commerce, shall provide any administrative support services required by the Council.</text></subsection></section> 
<section id="H9B58D5755AEB471EA9F4DB80D69138E8"><enum>8.</enum><header>No termination</header><text display-inline="no-display-inline">Section 14(a)(2)(B) of the Federal Advisory Committee Act (5 U.S.C. App.; relating to the termination of advisory committees) shall not apply to the Council.</text></section>
