<official-title>To amend title 5, United States Code, to provide for a corporate responsibility investment option under the Thrift Savings Plan.</official-title>

<section section-type="section-one" id="H47526AEC82BC40889907AAF3D7BF09AC"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="H5B0728B9CCBE48D891EB6C005C90E94C"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HDB633357257140DFB18C67D57D7127D0"><enum>(1)</enum><text>The Department of Labor has asserted that socially responsible investments meet the fiduciary standards set in the Employee Retirement Income Security Act.</text></paragraph> 
<paragraph id="HF1118FD01FA244F580288DD512008837"><enum>(2)</enum><text>84 percent of mutual fund investors would be more likely to invest in a fund if one of its principles was to invest in companies that engage in ethical business practices in terms of operations and reporting.</text></paragraph> 
<paragraph id="HE6D8A0B828424D008BBD40009CB6658E"><enum>(3)</enum><text>71 percent of investors agree that companies that operate with higher levels of integrity carry less investment risk, and 67 percent of investors believe that these companies deliver better investment returns.</text></paragraph></section> 
<section id="H99A59D32694943AFB0D4BFC84DAF3DC2"><enum>3.</enum><header>Corporate Responsibility Stock Index Fund</header> 
<subsection id="H7D072170245541C382EBA0A99B9B87BF"><enum>(a)</enum><header>Definition</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8438">Section 8438(a)</external-xref> of title 5, United States Code, is amended—</text> 
<paragraph id="HA67EC98048214C9EA5005DAE76C4E66"><enum>(1)</enum><text>in paragraph (9), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H8BF27B49405B4C4DB0B88683CDF907C6"><enum>(2)</enum><text>in paragraph (10), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H1BD4F7B095884FD088967BC6E9AEF58"><enum>(3)</enum><text>by adding at the end the following:</text>

<subsection id="H2CC61DECEE464A4B9090E405D27C938E"><enum>(b)</enum><header>Establishment</header> 
<paragraph id="HEA2AD3668AC4464298B0B4AA6BAFF1ED"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8438">Section 8438(b)(1)</external-xref> of title 5, United States Code, is amended—</text> 
<subparagraph id="H4A9FB8614ABF471DBC5003B4A1E0596B"><enum>(A)</enum><text>in subparagraph (D), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="HD25931439C2A43F7986358077B503166"><enum>(B)</enum><text>in subparagraph (E), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="H5024D8DE7C0D4FD1AE9F15C126BCC674"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph id="H734FBA7200404FCB99860000B21CD918"><enum>(2)</enum><header>Fund requirements</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8438">Section 8438(b)</external-xref> of title 5, United States Code, is amended by adding at the end the following:</text>

<paragraph indent="up1" id="HE7DD0D88CE2E4A2E84421CB50003DCBA"><enum>(5)</enum> 
<subparagraph display-inline="yes-display-inline" id="HBD8BA6000D454B12A1FF58F7A38FBAA1"><enum>(A)</enum><text>The Board shall select an index which is a commonly recognized, passively managed index comprised of domestic stocks that have been analyzed based on criteria consistent with the purposes of this paragraph. Such criteria may include corporate governance, environmental practices, workplace relations and benefits, product safety and impact, international operations and human rights, involvement with repressive regimes, and community relations. The index’s financial track record must be comparable to that of the other options available under the Thrift Savings Plan.</text></subparagraph> 
<subparagraph indent="up1" id="H4D5F95A3416D4AFF8CD8647C6DCDBB00"><enum>(B)</enum><text>The Corporate Responsibility Stock Index Fund shall be invested in a portfolio designed to replicate the performance of the index in subparagraph (A). The portfolio shall be designed such that, to the extent practicable, the percentage of the Corporate Responsibility Stock Index Fund that is invested in each stock is the same as the percentage determined by dividing the aggregate market value of all shares of that stock by the aggregate market value of all shares of all stocks included in such index.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H5F4B00E3A000413C934578074075A544"><enum>(c)</enum><header>Acknowledgment of risk</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8439">Section 8439(d)</external-xref> of title 5, United States Code, is amended—</text> 
<paragraph id="H2B6877577E7B4DDC87C54334659CE616"><enum>(1)</enum><text>by striking <quote>or the Small Capitalization Stock Index Investment Fund,</quote> and inserting <quote>the Small Capitalization Stock Index Investment Fund, or the Corporate Responsibility Stock Index Fund,</quote>; and</text></paragraph> 
<paragraph id="H1A0BDCA235344F9AB9E811CA99C9C3AC"><enum>(2)</enum><text>by striking <quote>and (10),</quote> and inserting <quote>(10), and (11),</quote>.</text></paragraph></subsection></section> 
<section id="H2E5118607CF143C582DAAD2CA26F5FD3"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The fund required under this Act shall be made available beginning with the earliest election period (under <external-xref legal-doc="usc" parsable-cite="usc/5/8432">section 8432(b)</external-xref> of title 5, United States Code) practicable, as determined by the Executive Director of the Thrift Savings Fund in regulations.</text></section>
