<official-title>To provide a clear and unambiguous structure for the jurisdictional and regulatory treatment for the offering or provision of voice-over-Internet-protocol applications, and for other purposes.</official-title>

<section section-type="section-one" id="H36965B417E9D4241B44397DA492152AB"><enum>1.</enum><header>Short title; purpose</header> 
<subsection id="HC209961C360A4BCDAA51F9E41EBC29C4"><enum>(a)</enum><header>Short title</header><text>This Act may be referred to as the <quote><short-title>&short-title1;</short-title></quote>.</text></subsection> 
<subsection id="H8702D6E494874E6BB5D2005644DD9C0"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to prevent the imposition of harmful obligations or a patchwork of multiple and discriminatory regulations on the providers of applications that utilize the Internet protocol or any successor protocol to offer 2-way or multidirectional voice communications.</text></subsection></section> 
<section id="H6F6DA1A74B924F118F3B5BD9DDBC00A5"><enum>2.</enum><header>Assertion of Federal jurisdiction</header> 
<subsection id="H72BCE8DE3F43470FB8F4C340335322A4"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, responsibility and authority to regulate the offering or provision of a voice-over-Internet-protocol application is reserved solely to the Federal Government.</text></subsection> 
<subsection id="HBA3F8D3FE2C3425087FDE2F46DE6D8D"><enum>(b)</enum><header>Prohibition of State regulation</header><text>No State or political subdivision thereof may enact or enforce any law, rule, regulation, standard, or other provision having the force or effect of law that regulates, or has the effect of regulating, the offering or provision of a VoIP application.</text></subsection> 
<subsection id="H6720C46946FC4058BCE594018C519EB"><enum>(c)</enum><header>Prohibition of delegation to States</header><text>Any responsibility or authority to regulate the offering or provision of a VoIP application that, pursuant to subsection (a), is reserved by the Federal Government may not be delegated, by any Federal agency or officer, to any State or political subdivision thereof.</text></subsection></section> 
<section id="H4A16CB988AC54A78A2ACE753043CC400"><enum>3.</enum><header>Preemption of broad FCC authority</header><text display-inline="no-display-inline">Except as specifically provided in this Act and notwithstanding any other provision of law, the Commission shall not impose any rule or regulation on, or otherwise regulate, the offering or provision of a VoIP application.</text></section> 
<section id="HB3BE3552170F4C309D966165F5F42201"><enum>4.</enum><header>FCC authority regarding connected VoIP applications</header> 
<subsection id="H057D1680A11A4E599025E2AA13E010B3"><enum>(a)</enum><header>Interprovider compensation</header> 
<paragraph id="HE79ACF05038C48A3A0C2E2C39C009B1D"><enum>(1)</enum><header>Rulemaking</header><text>Within 180 days after the date of the enactment of this Act, the Commission shall complete a proceeding to establish a set of rules and standards to provide for appropriate arrangements to compensate providers of facilities and equipment used to transmit communications employing a connected VoIP application. </text></paragraph> 
<paragraph id="H7021338234D64D4782CAB853AE16626C"><enum>(2)</enum><header>Factors</header><text>In the proceeding the Commission shall—</text> 
<subparagraph id="H96DEB2BD09234A6EAF40E913A69F949E"><enum>(A)</enum><text>provide for an appropriate transition period to allow providers of such facilities and equipment and providers of connected VoIP applications to comply with any rules and standards established; and</text></subparagraph> 
<subparagraph id="HA836692304EA410186217CE971063585"><enum>(B)</enum><text>consider the unique nature and circumstances relating to the use of such facilities and equipment in varying geographic markets and rural areas.</text></subparagraph> </paragraph> </subsection> 
<subsection id="H445C72C558414662A332E91BCB237167"><enum>(b)</enum><header>Universal service</header><text>Within 180 days after the date of the enactment of this Act, the Commission shall complete a proceeding to provide a contribution mechanism applicable to connected VoIP applications, which may include a collection methodology based on the assignment of telephone numbers to end users, other methodologies, or any combination thereof. In the proceeding, the Commission shall seek to ensure the preservation, enhancement, and long-term sustainability of universal service by maximizing participation in the support of universal service among the greatest number of providers of connected VoIP applications.</text> </subsection> 
<subsection id="HBF79D062168842A0B0838B97EB0543BF"><enum>(c)</enum><header>Law enforcement access</header> 
<paragraph id="H87A2A7128D18438A8C180538F13BD4B1"><enum>(1)</enum><header>Requirements regarding assistance capabilities</header><text>Effective as provided in paragraph (3)(D), each provider of a connected VoIP application shall ensure that its equipment, facilities, or services are capable of—</text> 
<subparagraph id="HE8535F8AF70A4ECFAB157D4E59A26F5D"><enum>(A)</enum><text>enabling the government to intercept communications transmitted using such application and to access call-identifying information regarding communications so transmitted, and</text></subparagraph> 
<subparagraph id="HB403AB44CB3D4B66A8A6B9B6CADFF55"><enum>(B)</enum><text>delivering such intercepted communications and call-identifying information to the government,</text></subparagraph><continuation-text continuation-text-level="paragraph">for the same purposes, to a similar extent, and subject to similar limitations and protections (including protections regarding privacy and security and protections ensuring access only pursuant to lawful authorization) that, under sections 103 and 105 of the Communications Assistance for Law Enforcement Act, are required of the capabilities of the equipment, facilities, or services of a telecommunications carrier.</continuation-text></paragraph> 
<paragraph id="HE0B2AA7614A140F1848B40275626B760"><enum>(2)</enum><header>Determination regarding feasibility</header><text>Not later than 180 days after the date of the enactment of this Act, and not later than every 180 days thereafter, the Commission shall conduct a proceeding to determine whether it is technologically feasible and reasonable to commence applicability of the assistance capability requirements established under paragraph (1).</text></paragraph> 
<paragraph id="H0CDD815B108B49BA81E113AA77DEF4D2"><enum>(3)</enum><header>Effect of determination</header><text>If the Commission, pursuant to a proceeding under paragraph (2), determines that it is technologically feasible and reasonable to commence applicability of the assistance capability requirements established under paragraph (1)—</text> 
<subparagraph id="H18BE4EEB7694425B8227D04D8300D5B8"><enum>(A)</enum><text>the requirement under paragraph (2) to conduct further semi-annual proceedings shall not apply after such determination;</text></subparagraph> 
<subparagraph id="HE82EDD27B6574C39A9AD57D41900A7B3"><enum>(B)</enum><text>not later than 180 days after such determination, the Commission shall establish rules, technical requirements, and standards that—</text> 
<clause id="HFADD6596C5B94DAC91FB9FEE44BE3F1F"><enum>(i)</enum><text>implement the requirements under paragraph (1);</text></clause> 
<clause id="HEA5F6DD7F14E4DD08B81441C04264DB8"><enum>(ii)</enum><text>protect the privacy and security of communications not authorized to be intercepted;</text></clause> 
<clause id="HE81FE21349A645EF85B0BEF313009EA8"><enum>(iii)</enum><text>minimize the cost of such compliance on customers or subscribers;</text></clause> 
<clause id="H4FFD6C46BACD4A77B4D18CC67904AFC5"><enum>(iv)</enum><text> serve the policy of the United States to encourage the provision of new technologies and services to the public; and</text></clause> 
<clause id="H0E2A3FFFB33E4C6400943219F7F32799"><enum>(v)</enum><text>provide a reasonable time and conditions for compliance with and the transition to any new standard;</text></clause></subparagraph> 
<subparagraph id="HE548F04E851D49869175AD48A549DD7E"><enum>(C)</enum><text>in establishing such rules, technical requirement, and standards, the Commission consult with providers of connected VoIP applications, manufacturers of equipment used by such applications, other appropriate parties providing services used in such applications, the Attorney General of the United States, and State and local law enforcement agencies; and</text></subparagraph> 
<subparagraph id="H33116E743E8B4A05A5F511715DCF773D"><enum>(D)</enum><text>the requirement under paragraph (1) shall take effect upon the expiration of the 180-day period beginning upon such determination.</text></subparagraph></paragraph> </subsection> </section> 
<section id="HFAC04D61C7C14E05BF00AE72BC285146"><enum>5.</enum><header>Voluntary industry consensus process regarding other connected VoIP obligations</header> 
<subsection id="H1C58261E966142D1889099E293448D52"><enum>(a)</enum><header>Voluntary process</header><text>The Commission shall appoint an appropriate representative industry organization or organizations which shall, within 180 days after the date of the enactment of this Act, develop, as applicable, consensus guidelines, protocols, or performance requirements pertaining to the offering or provision of connected VoIP applications for—</text> 
<paragraph id="HE3DD942A62A1422493D8F507E732A045"><enum>(1)</enum><text>providing comparable capabilities to 911 and enhanced 911 services;</text></paragraph> 
<paragraph id="H63EB422A5AC049B4AD38D4244C453000"><enum>(2)</enum><text>improving use by the disabled community;</text></paragraph> 
<paragraph id="H0C5ACA3989074AA59BFF301CFA5707DE"><enum>(3)</enum><text>improving reliability of voice over Internet protocol applications; and</text></paragraph> 
<paragraph id="HAA7451C6F10549D8B4593DB9E95BD49C"><enum>(4)</enum><text>ensuring appropriate security for the application and voice communications.</text></paragraph></subsection> 
<subsection id="HAF53D385532A4F69BA4F14B800FF3D10"><enum>(b)</enum><header>Information to customers</header><text>A provider of a connected VoIP application that does not provide for its customers services that are comparable to 911 service and enhanced 911 service shall provide a clear and conspicuous notice of the failure to provide such services to each customer prior to the offering of the application to that customer.</text></subsection> 
<subsection id="HE255437F16F746429434E0E859D5BF43"><enum>(c)</enum><header>Technical support</header><text>The Commission shall provide technical support, as appropriate, to the organization selected pursuant to subsection (a).</text></subsection></section> 
<section id="HC4A40CB2D24F4280B0535B9F86AA1BC"><enum>6.</enum><header>Commission review</header> <text display-inline="no-display-inline">Beginning in 2005, the Commission shall provide a report to the Congress not less than biennially indicating any regulatory obligations that it recommends be enacted on the offering or provision of a VoIP application, including nondiscriminatory treatment for processing or treatment of digital packets.</text></section> 
<section id="HF1C86D0CE536400FBDD07ECC39A884E8"><enum>7.</enum><header>No state or local taxation of VoIP applications</header> 
<subsection id="H9CC2BF9017DE4FABB2E4942E62E9F1AE"><enum>(a)</enum><header>In general</header><text>No State or political subdivision shall impose any tax, fee, surcharge, or other charge for the purpose of generating revenues for governmental purposes on the offering or provision of a VoIP application.</text></subsection> 
<subsection id="HBD4F5001D38842169B5851AC909FE25"><enum>(b)</enum><header>Exemption</header><text>Subsection (a) shall not apply to a fee imposed for a specific privilege, service, or benefit conferred.</text></subsection> </section> 
<section id="H25D4E7305D5B4AE09B4499765CFD1953"><enum>8.</enum><header>No impact on transmission facilities</header><text display-inline="no-display-inline">Nothing in this Act shall affect the authority of the Commission or any State commission to regulate the transmission facilities used to transmit a voice communication of a VoIP application. This section may not be construed to authorize the Commission or any State to regulate the offering or provision of a VoIP application by regulating such transmission facilities. </text></section> 
<section id="HB683BFA13B5B4B91BC10463398EE4A2"><enum>9.</enum><header>Ftc authority</header> 
<subsection id="H3680BCC07E65447995CEEC863E4B6079"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (b), nothing in this Act shall be constructed to affect the authority of the Federal Trade Commission to prevent unfair or deceptive acts or practices.</text></subsection> 
<subsection id="HCB1E5131C6344AE98CE74C84CFBCEC7"><enum>(b)</enum><header>Regulations excluded</header><text>Subsection (a) does not authorize the Federal Trade Commission to issue any regulations to implement this Act.</text></subsection></section> 
<section id="HD64C16A2CA2044AABDABFC861CBD931F"><enum>10.</enum><header>Definitions</header> 
<subsection id="HF7EC3883E0644917BB29FC8243A500E7"><enum>(a)</enum><header>In general</header><text>For purposes of this Act:</text> 
<paragraph id="H2D01EC75E6EE46EEAE128600334762BD"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph> 
<paragraph id="H7CE8C8228D914967A0002352B3887013"><enum>(2)</enum><header>Connected voip application</header><text>The term <term>connected VoIP application</term> means a VoIP application that is capable of receiving voice communications from or sending voice communications to the public switched telephone network, or both.</text> </paragraph> 
<paragraph id="HC2F288C9AA76425A91EB13EC3C5D3B14"><enum>(3)</enum><header>Customer</header><text>The term <term>customer</term> includes a consumer of goods or services whether for a fee, in exchange for an explicit benefit, or provided for free.</text></paragraph> 
<paragraph id="HFFF2410BC93D4AE999955C1D87F6DAE9"><enum>(4)</enum><header>Regulate</header><text>The term <term>regulate</term> includes taking any governmental action that restricts, prohibits, limits, or burdens, or imposes any obstacle, obligation, or duty, or interferes with, an application.</text></paragraph> 
<paragraph id="HAE1B0D8519594CA7AF20BCC415000034"><enum>(5)</enum><header>Universal service</header><text>The term ‘‘universal service’’ has the meaning given such term by section 254(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/47/254">47 U.S.C. 254(c)</external-xref>).</text></paragraph> 
<paragraph id="H17C4146BA8CA4019A000BF651843FDC8"><enum>(6)</enum><header>Voice-over-Internet-protocol application; voip application</header> 
<subparagraph id="HFB7B878D01024DCC998442EA77F189DA"><enum>(A)</enum><header>In general</header><text>The terms <term>Voice-over-Internet-protocol application</term> and <term>VoIP application</term> mean the use of software, hardware, or network equipment for real-time 2-way or multidirectional voice communications over the public Internet or a private network utilizing Internet protocol, or any successor protocol, in whole or part, to connect users notwithstanding—</text> 
<clause id="H00CDEDCDFE604923B375615C00D5F7E5"><enum>(i)</enum><text>the underlying transmission technology used to transmit the communications;</text></clause> 
<clause id="H82A232C913824A7B8F73EC7EB470384D"><enum>(ii)</enum><text>whether the packetizing and depacketizing of the communications occurs at the customer premise or network level; or</text></clause> 
<clause id="H88B4D2EC4606424FBEC9AC3F3100B46B"><enum>(iii)</enum><text>the software, hardware, or network equipment used to connect users.</text></clause></subparagraph> 
<subparagraph id="HFB647F39CBD94C8882D2F51B28993593"><enum>(B)</enum><header>Exclusion</header><text>The term does not include an application that is used for voice communications that both originate and terminate on the public switched telephone network.</text></subparagraph></paragraph> </subsection> 
<subsection id="H3A4A26E127454E15A16306414C98DB79"><enum>(b)</enum><header>Common terminology</header><text>Except as otherwise provided in subsection (a), terms used in this Act shall have the meaning provided under section 3 of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name>.</text></subsection></section>
