<official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10, United States Code (the Uniform Code of Military Justice), to bring military sexual assault crimes into parallel with Federal sexual assault crimes.</official-title>

<section id="H7B7769363B9F4C7A84ADF144226E59B0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text> </section> 
<section id="H1B71CF3C855444EDB2F335966607E9C3"><enum>2.</enum><header>Military sexual abuse</header> 
<subsection id="HC68F2090CF494D1DAC9B1704FE8381E4"><enum>(a)</enum><header>Sexual abuse</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/920">Section 920</external-xref> of title 10, United States Code (article 120 of the Uniform Code of Military Justice), is amended to read as follows:</text>

<section id="HED23CE2DD3E741458DFBB4038400F615"><enum>920. Art. 120. Sexual abuse</enum> 
<subsection id="H85EDCA204C0E4760B69D8DA314E87352"><enum>(a)</enum><text>Any person subject to this chapter who knowingly causes another person to engage in a sexual act—</text> 
<paragraph id="HDB91909477F3434DA56635B006C147E"><enum>(1)</enum><text>by using force against that other person; or</text></paragraph> 
<paragraph id="HD6D7F11418BB446F951D005D51990134"><enum>(2)</enum><text>by threatening or placing that other person in fear that any person will be subjected to death, serious bodily injury, or kidnapping;</text></paragraph><continuation-text continuation-text-level="subsection">is guilty of aggravated sexual abuse and shall be punished as a court-martial may direct.</continuation-text></subsection> 
<subsection id="H0601B26EE807468398A0B9F8B0A03BDE"><enum>(b)</enum><text>Any person subject to this chapter who knowingly—</text> 
<paragraph id="H105D515D737A42B2BBB1C7227D0759D7"><enum>(1)</enum><text>renders another person unconscious and thereby engages in a sexual act with that other person; or</text></paragraph> 
<paragraph id="HAE322BDFDB15439499EB6B9E76650900"><enum>(2)</enum><text>administers to another person by force or threat of force, or without the knowledge or permission of that other person, a drug, intoxicant, or other similar substance and thereby—</text> 
<subparagraph id="H432C4B4D20324A8F9B0046BA41003900"><enum>(A)</enum><text>substantially impairs the ability of that other person to appraise or control conduct; and</text></subparagraph> 
<subparagraph id="H3BC956A6C26F49BEB871E89585D99D51"><enum>(B)</enum><text>engages in a sexual act with that other person;</text></subparagraph></paragraph><continuation-text continuation-text-level="subsection">is guilty of aggravated sexual abuse and shall be punished as a court-martial may direct.</continuation-text></subsection> 
<subsection id="HD8B285A206A44AA4B083548477A3D8A5"><enum>(c)</enum><text>Any person subject to this chapter who knowingly engages in a sexual act with another person who has not attained the age of twelve years is guilty of aggravated sexual abuse of a child and shall be punished as a court-martial may direct. In a prosecution under this subsection, it need not be proven that the accused knew that the other person engaging in the sexual act had not attained the age of twelve years.</text></subsection> 
<subsection id="H8FAEC388787744A8B6489CDC469D2773"><enum>(d)</enum><text>Any person subject to this chapter who knowingly—</text> 
<paragraph id="HC5E0C5E9E0E6449C84BCB510EF550943"><enum>(1)</enum><text>causes another person to engage in a sexual act by threatening or placing that other person in fear (other than by threatening or placing that other person in fear that any person will be subjected to death, serious bodily injury, or kidnapping); or</text></paragraph> 
<paragraph id="H8706841EEFA449DDBE863735AB417C7F"><enum>(2)</enum><text>engages in a sexual act with another person if that other person is—</text> 
<subparagraph id="H8FBCC37649194678BC23BF94EB6BD8E9"><enum>(A)</enum><text>incapable of appraising the nature of the conduct; or</text></subparagraph> 
<subparagraph id="H66A1900C21F5469FAC36B5B79EC6A2D6"><enum>(B)</enum><text>physically incapable of declining participation in, or communicating unwillingness to engage in, that sexual act;</text></subparagraph></paragraph><continuation-text continuation-text-level="subsection">is guilty of sexual abuse and shall be punished as a court-martial may direct.</continuation-text></subsection> 
<subsection id="HEC48C8FE80A6484A9164A5095B8D25C"><enum>(e)</enum> 
<paragraph id="HFB3F24781DF3401000900945CE1157B7" display-inline="yes-display-inline"><enum>(1)</enum><text>Any person subject to this chapter who knowingly engages in a sexual act with another person who—</text> 
<subparagraph id="H5BAC62810C28434B9FC0EF4F81117E19" indent="up1"><enum>(A)</enum><text>has attained the age of twelve years but has not attained the age of sixteen years;</text></subparagraph> 
<subparagraph id="H9363EA6C7B2C4BED00EDC9B87D2E9F1F" indent="up1"><enum>(B)</enum><text>is at least four years younger than the person so engaging; and</text></subparagraph> 
<subparagraph id="H45DBE60FAD45496C9803FA4CA9F0F683" indent="up1"><enum>(C)</enum><text>is not that person’s spouse;</text></subparagraph> <continuation-text continuation-text-level="subsection">is guilty of sexual abuse of a minor and shall be punished as a court-martial may direct.</continuation-text></paragraph> 
<paragraph id="H62ADD3C38E8F47CC95185938CD850019" indent="up1"><enum>(2)</enum><text>In a prosecution under this subsection, it need not be proven that the accused knew the age of the other person engaging in the sexual act or that the requisite age difference existed between the persons so engaging.</text></paragraph> 
<paragraph id="HF972E977FAF04C53BF6F0618A21BA370" indent="up1"><enum>(3)</enum><text>In a prosecution under this subsection, it is an affirmative defense that the accused reasonably believed that the other person had attained the age of sixteen years. The accused has the burden of proving a defense under this paragraph by a preponderance of the evidence.</text></paragraph></subsection> 
<subsection id="H86CA3A693A514DA892555166FFDD744D"><enum>(f)</enum><text>Any person subject to this chapter who knowingly engages in a sexual act with another person who is—</text> 
<paragraph id="HC43245F3B50449989B12D39F3E9B5FCD"><enum>(1)</enum><text>in official detention or confinement; and</text></paragraph> 
<paragraph id="H85E6AF059C3C416CABB4EC7675B28C67"><enum>(2)</enum><text>under the custodial, supervisory, or disciplinary authority of the person so engaging; and</text></paragraph> 
<paragraph id="H97B4A1D73A9A4BECAF003F607E31D395"><enum>(3)</enum><text>is not that person's spouse;</text></paragraph><continuation-text continuation-text-level="subsection">is guilty of sexual abuse of a ward and shall be punished as a court-martial may direct.</continuation-text></subsection> 
<subsection id="HD8EBCF06E4344246A0A40239003ED2E8"><enum>(g)</enum><text>In this section, the term <term>sexual act</term> means—</text> 
<paragraph id="H0A8E6654E27442CFAA21006F273F5800"><enum>(1)</enum><text>contact between the penis and the vulva or the penis and the anus, and for purposes of this subparagraph contact involving the penis occurs upon penetration, however slight;</text></paragraph> 
<paragraph id="HD7BD83FC1E4F43D7A2E5E32180BC8109"><enum>(2)</enum><text>contact between the mouth and the penis, the mouth and the vulva, or the mouth and the anus;</text></paragraph> 
<paragraph id="HD685134661E94186B5D1163955945EB8"><enum>(3)</enum><text>the penetration, however slight, of the anal or genital opening of another by a hand or finger or by any object, with an intent to abuse, humiliate, harass, degrade, or arouse or gratify the sexual desire of any person; or</text></paragraph> 
<paragraph id="HE045CA354DC84B93A8EDEF4572A169BD"><enum>(4)</enum><text>the intentional touching, not through the clothing, of the genitalia of another person who has not attained the age of sixteen years with an intent to abuse, humiliate, harass, degrade, or arouse or gratify the sexual desire of any person.</text></paragraph></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB2A41E2E20EE45B1A74C9CE637945F00"><enum>(b)</enum><header>Conforming amendments</header><text></text> 
<paragraph id="HDF14B065D0554BE5B87E00372999C743"><enum>(1)</enum><header>Murder</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/918">Section 918(4)</external-xref> of title 10, United States Code (article 118 of the Uniform Code of Military Justice), is amended by striking <quote>sodomy, rape,</quote> and inserting <quote>aggravated sexual abuse, aggravated sexual abuse of a child,</quote>.</text></paragraph> 
<paragraph id="H684C516E27C34DA1AA49029C9069AE78"><enum>(2)</enum><header>Sodomy</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/925">Section 925</external-xref> of title 10, United States Code (article 125 of the Uniform Code of Military Justice), is repealed.</text></paragraph></subsection> 
<subsection id="H746FA51824294F87BECAECD1BCE76FF6"><enum>(c)</enum><header>Clerical amendments</header> <text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10, United States Code, is amended—</text> 
<paragraph id="H1A08380B5C8A4144B72D27F9E128CBFD"><enum>(1)</enum><text>by striking the item relating to section 925; and</text></paragraph> 
<paragraph id="HDC6F01E47D7041AF9DD7651567A7567F"><enum>(2)</enum><text>by striking the item relating to section 920 and inserting the following new item:</text>

<subsection id="H97F6932D74C64E89B05C47E6889BD055"><enum>(d)</enum><header>Effective Date</header><text>The amendments made by this section shall apply with respect to offenses committed after the date of the enactment of this Act.</text></subsection> </section>
