<section id="HE7B6AA114B1F4DEA9BC300D95F476555" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="H43C6973B3397458F8822B3F145301BFD" section-type="subsequent-section"><enum>2.</enum><header>Reauthorization of Paul D. Coverdell Drug-Free Workplace Program</header> 
<subsection id="H0BAD89C86B4740BAA590C9547C00FC48"><enum>(a)</enum><header>In general</header><text>Paragraph (1) of section 27(g) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/654">15 U.S.C. 654(g)</external-xref>) is amended by striking <quote>2001 through 2003</quote> and inserting <quote>2004 through 2006</quote>.</text></subsection> 
<subsection id="HE1265CB02EAF4B6895FDE6EEFC16AE31"><enum>(b)</enum><header>Additional grants for programs carried out in cooperation with small business development centers</header> 
<paragraph id="H1937183148E64BD8B5EAE41691CB9576"><enum>(1)</enum><header>In general</header><text>Subsection (b) of section 27 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/654">15 U.S.C. 654</external-xref>) is amended—</text> 
<subparagraph id="H589597FE7C924B2EA3D554277F3CDC65"><enum>(A)</enum><text>by striking <quote>There is established</quote> and inserting the following: </text>

<paragraph id="HE702F74DA3D2432EB100FFC5FD457E06"><enum>(2)</enum><header>Additional grants for programs carried out in cooperation with small business development centers</header><text>The Administrator may make an additional grant to, or enter into a cooperative agreement or contract with, any grantee under paragraph (1) for the purpose of providing, in cooperation with one or more small business development centers, technical assistance to small business concerns seeking to establish a drug-free workplace program.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HCC6458BA0266436C86577F0915A2B178"><enum>(2)</enum><header>Authorization</header><text>Subsection (g) of section 27 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/654">15 U.S.C. 654</external-xref>) is amended—</text> 
<subparagraph id="H6718E391CB6A47E7A5A8D265BD575696"><enum>(A)</enum><text>by redesignating paragraph (2) as paragraph (3);</text></subparagraph> 
<subparagraph id="H6727D107C7D84441AB2F30E1311FB1C0"><enum>(B)</enum><text>by inserting after paragraph (1) the following new paragraph:</text>

<paragraph id="H65E20730E40E49EB94261FB0B81257EA"><enum>(2)</enum><header>Additional authorization</header><text>There is authorized to be appropriated to carry out this subsection, $1,500,000 for each of fiscal years 2004 through 2006. Amounts made available under this paragraph shall remain available until expended.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H795167421C2D4F479D8F022B60278FBF"><enum>(C)</enum><text>in paragraph (1)—</text> 
<clause id="H86DFEAB806EA4EC1B853E624C2C5CAE5"><enum>(i)</enum><text>by inserting <quote>(other than subsection (b)(2))</quote> after <quote>this section</quote>; and</text></clause> 
<clause id="H1CB61B5E35FC498ABAF061AF4FED9497"><enum>(ii)</enum><text>by striking <quote>this subsection</quote> and inserting <quote>this paragraph</quote>. </text></clause></subparagraph></paragraph></subsection> 
<subsection id="H9C1E74584DEA44B1B3A600DD3D915D05"><enum>(c)</enum><header>2-year grants</header><text>Subsection (b) of section 27 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/654">15 U.S.C. 654</external-xref>), as amended by subsection (b), is further amended by adding at the end the following new paragraph:</text>

<paragraph id="H76F1887C902C4D43A4E8BBF71BA8C6DC"><enum>(3)</enum><header>2-year grants</header><text>Each grant made under this subsection shall be for a period of 2 years, subject to an annual performance review by the Administrator.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HBE17B9F0ED61430189F1EC23E8A6A544"><enum>(d)</enum><header>Eligibility of drug-free communities coalitions</header><text>Subparagraph (D) of section 27(a)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/654">15 U.S.C. 654(a)(2)</external-xref>) is amended to read as follows:</text>

<subparagraph id="HB05F98E46B7B45C6BAD7678F1B2EF59E"><enum>(D)</enum> 
<clause id="H53116424045E42B1BE03C5F76E00B17D" display-inline="yes-display-inline"><enum>(i)</enum><text>the purpose of which is—</text> 
<subclause id="HD517B12C23364D7F93342E36077DD6AA" indent="up1"><enum>(I)</enum><text>to develop comprehensive drug-free workplace programs or to supply drug-free workplace services; or</text></subclause> 
<subclause id="H3194341B68DE46169181C1ECFEC278E8" indent="up1"><enum>(II)</enum><text>to provide other forms of assistance and services to small business concerns; or</text></subclause></clause> 
<clause id="H268DE74F72804B39BFD5CA75B917ACB6" indent="up1"><enum>(ii)</enum><text>that is eligible to receive a grant under chapter 2 of the National Narcotics Leadership Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/21/1521">21 U.S.C. 1521 et seq.</external-xref>).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H59C8815589F14E459CB04E635EDAD46E"><enum>(e)</enum><header>Evaluation and coordination</header><text>Section 27 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/654">15 U.S.C. 654</external-xref>) is amended—</text> 
<paragraph id="H2A191347883449DEA85514D9F9B26595"><enum>(1)</enum><text>by striking subsection (d);</text></paragraph> 
<paragraph id="H265522FB1A2946129862C1B66E5088AC"><enum>(2)</enum><text>by redesignating subsections (e), (f), and (g) as subsections (f), (g), and (h), respectively; and</text></paragraph> 
<paragraph id="H816E308106454D0088E5C51D7632D9B2"><enum>(3)</enum><text>by inserting after subsection (c) the following new subsections:</text>

<subsection id="H622F7A5E01BB441B8B62122D26389EBE"><enum>(d)</enum><header>Technical assistance</header><text>The Administrator, after consultation with the Director of the Center for Substance Abuse and Prevention, shall provide technical assistance and information to each eligible intermediary receiving a grant under subsection (b) regarding the most effective practices in establishing and carrying out drug-free workplace programs.</text></subsection> 
<subsection id="H3E3BC2A5B395498DB8891287F41719C6"><enum>(e)</enum><header>Evaluation of program</header> 
<paragraph id="H597344898AFC4C92AEB9F8304C6410EF"><enum>(1)</enum><header>Data collection system</header><text>Each eligible intermediary receiving a grant under this section shall establish a system to collect and analyze information regarding the effectiveness of drug-free workplace programs established with assistance provided under this section through the intermediary, including information regarding any increase or decrease among employees in drug use, awareness of the adverse consequences of drug use, and absenteeism, injury, and disciplinary problems related to drug use. Such system shall conform to such requirements as the Administrator, after consultation with the Director of the Center for Substance Abuse and Prevention, may prescribe. Not more than 5 percent of the amount of each grant made under subsection (b) shall be used by the eligible intermediary to carry out this paragraph.</text></paragraph> 
<paragraph id="HC8E88C7F62D6492CA0675802EA76635C"><enum>(2)</enum><header>Method of evaluation</header><text>The Administrator, after consultation with the Director of the Center for Substance Abuse and Prevention, shall provide technical assistance and guidance to each eligible intermediary receiving a grant under subsection (b) regarding the collection and analysis of information to evaluate the effectiveness of drug-free workplace programs established with assistance provided under this section, including the information referred to in paragraph (1). Such assistance shall include the identification of additional information suitable for measuring the benefits of drug-free workplace programs to the small business concern and to the concern’s employees and the identification of methods suitable for analyzing such information.</text></paragraph> 
<paragraph id="H188A10F2FF0A4E12AFB95B3C4D53A6"><enum>(3)</enum><header>Study and report</header><text>Not later than 18 months after the date of the enactment of the Drug-Free Workplace Program Reauthorization Act of 2004, the Administrator, in consultation with the Secretary of Labor, the Secretary of Health and Human Services, and the Director of National Drug Control Policy, shall—</text> 
<subparagraph id="H3ABCEC06D7664CA496D36E13054B2D58"><enum>(A)</enum><text>compile and analyze the information collected under this subsection;</text></subparagraph> 
<subparagraph id="HE9B1967AB0484EA6BDF397003658A4C5"><enum>(B)</enum><text>identify trends in such information;</text></subparagraph> 
<subparagraph id="H617BBC15B5B04DD7AB02E108BE009E36"><enum>(C)</enum><text>evaluate the effectiveness of the drug-free workplace programs established with assistance provided under this section; and</text></subparagraph> 
<subparagraph id="HB3EEF5C210714A04990044B2E851712C"><enum>(D)</enum><text>submit to the Congress a report that describes the results of the analysis conducted under subparagraph (A), the trends identified under subparagraph (B), and the results of the evaluation conducted under subparagraph (C).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H40C4E1292B9C4195A2007287E5F946AC"><enum>(f)</enum><header>Small business development centers</header> 
<paragraph id="HC2D97A5B32F74FCAA1762848B76C391D"><enum>(1)</enum><header>In general</header><text>Subparagraph (T) of section 21(c)(3) of the Small Business Act (15 U.S.C 648(c)(3)) is amended by striking <quote>October 1, 2003</quote> and inserting <quote>October 1, 2006</quote>. </text> </paragraph> 
<paragraph id="H5AF8AAA66C7E40A092074DCDCBD6D081"><enum>(2)</enum><header>Limitation</header><text>Paragraph (3) of section 27(h) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/654">15 U.S.C. 654(g)</external-xref>), as redesignated under subsection (b)(2) and (d), is amended—</text> 
<subparagraph id="HCE5261BF5B5E4B1195776779FD7652FD"><enum>(A)</enum><text>by striking <quote>$1,000,000</quote> and inserting <quote>$500,000</quote>; and </text></subparagraph> 
<subparagraph id="HD7B8748627374D4F90E434EC19AA0050"><enum>(B)</enum><text>by inserting <quote>for fiscal years 2004 through 2006</quote> after <quote>under this subsection</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H0264820FA19845738CC5487FB74BF0A4"><enum>(g)</enum><header>Administrative costs</header><text>Subsection (h) of section 27 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/654">15 U.S.C. 654</external-xref>), as so redesignated, is amended by adding at the end the following new paragraph:</text>

<paragraph id="H97D0E6E4635A4EC2818B41209CD1AA5F"><enum>(4)</enum><header>Administrative costs</header><text>Of the total amount made available under this subsection for any fiscal year, not more than 5 percent of such amount shall be used for administrative costs (determined without regard to the administrative costs of eligible intermediaries).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
