<official-title>To require the Secretary of the Treasury to mint coins celebrating the recovery and restoration of the American bald eagle, the national symbol of the United States, to America’s lands, waterways, and skies and the great importance of the designation of the American bald eagle as an <quote>endangered</quote> species under the Endangered Species Act of 1973, and for other purposes.</official-title>

<section id="HBFE12867A9C14DBEB4A914E700495C00" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>American Bald Eagle Recovery and National Emblem Commemorative Coin Act</quote></text></section> 
<section id="H1050F58730E84CF2954E70F95DB589C2"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text> 
<paragraph id="HCB4CD4AFCDDE429894ABA48677D51D26"><enum>(1)</enum><text>The bald eagle was designated as the national emblem of the United States on June 20, 1782, by our country’s Founding Fathers at the Second Continental Congress.</text></paragraph> 
<paragraph id="HE4CEF5C2C3934C6596594BAAEF9151A9"><enum>(2)</enum><text>The bald eagle is the greatest visible symbol of the spirit of freedom and democracy in the world.</text></paragraph> 
<paragraph id="H82E711A4470F48A2A85FB70876C72422"><enum>(3)</enum><text>The bald eagle species is unique to North America and represents the American values and attributes of freedom, courage, strength, spirit, loyalty, justice, equality, democracy, quality, and excellence.</text></paragraph> 
<paragraph id="H44F60B400D8D45C4BF6B5639BCE39139"><enum>(4)</enum><text>The bald eagle is the central image used in the Great Seal of the United States and the seal of many branches and departments of the United States Government, including the President and the Vice President of the United States, the United States Congress, the Department of Defense, the Department of the Treasury, the Department of Justice, the Department of State, the Department of Commerce, the Department of Homeland Security, and the United States Postal Service.</text></paragraph> 
<paragraph id="H6386341E547446FDA2650839EBF9ECF5"><enum>(5)</enum><text>The bald eagle’s image and symbolism have played a profound role in establishing and honoring American beliefs and traditions.</text></paragraph> 
<paragraph id="HF71341675B9D4F99B5F74B877E1E5962"><enum>(6)</enum><text>The bald eagle’s image and symbolism have influenced American art, music, history, literature, commerce, and culture since the founding of our Nation.</text></paragraph> 
<paragraph id="H217DDEFC08CE40C1B377AF2DDDF87D8B"><enum>(7)</enum><text>The bald eagle species was once threatened with possible extinction in the lower 48 States but is now making a gradual, encouraging recovery within America’s lands, waterways, and skies.</text></paragraph> 
<paragraph id="H69C6AE3A8443484CA60904E120A937C6"><enum>(8)</enum><text>The bald eagle was federally classified as an <quote>endangered</quote> species in 1973 under the Endangered Species Act of 1973, and, in 1995, was removed from the <quote>endangered</quote> species list and upgraded to the less imperiled <quote>threatened</quote> status under such Act.</text></paragraph> 
<paragraph id="HDED8A5E099E44493AA19B2BBCCB35077"><enum>(9)</enum><text>The administration is likely to officially delist the bald eagle from both the <quote>endangered</quote> and <quote>threatened</quote> species lists under the Endangered Species Act of 1973 by no later than 2008.</text></paragraph> 
<paragraph id="H8C376A926EEF4133A12092DD692732C9"><enum>(10)</enum><text>The initial recovery of the bald eagle population in the United States was accomplished by the vigilant efforts of numerous caring agencies, corporations, organizations, and citizens.</text></paragraph> 
<paragraph id="H88BD7B0E3552433D9D296D135951D303"><enum>(11)</enum><text>The continued caring and concern of the American people and the further restoration and protection of the bald eagle and its habitat is necessary to guarantee the full recovery and survival of this precious national treasure for future generations.</text></paragraph> 
<paragraph id="HB62673BFA4DE4AE7B90556942458AC02"><enum>(12)</enum><text>Since the Endangered Species Act of 1973 requires that delisted species be administratively monitored for a 5-year period, the bald eagle nests in 49 States will require continual monitoring after the bald eagle is removed from the protection of such Act; and such efforts will require substantial funding to the Federal and State agencies and private organizations that will conduct such monitoring. </text></paragraph> 
<paragraph id="HB152014C7AAF47488523E733985868A6"><enum>(13)</enum><text>Due to Federal and State budget cutting and balancing trends, funding for on-going bald eagle care, restoration, monitoring, protection, and enhancement programs has diminished annually.</text></paragraph> 
<paragraph id="H0EADA33F5F304B928CE6E1CC36999D63"><enum>(14)</enum><text>In anticipation of the nationwide observance of the official removal, by 2008, of the bald eagle from the <quote>threatened</quote> species list under the Endangered Species Act of 1973, and the 35th anniversary, in 2008, of the Endangered Species Act of 1973 and the designation of the bald eagle as an <quote>endangered</quote> species under such Act, Congress wishes to offer the opportunity for all persons to voluntarily participate in raising funds for future bald eagle recovery, monitoring, and preservation efforts and to contribute to a special American Eagle Fund endowment managed by the not-for-profit American Eagle Foundation of Tennessee in the United States, in cooperation with fund management experts.</text></paragraph> 
<paragraph id="H9CACFE360BFA4396AAB36084667DF873"><enum>(15)</enum><text>It is appropriate for Congress to authorize coins—</text> 
<subparagraph id="H67CA7858A2B14490A9E7C1D861961B1B"><enum>(A)</enum><text>celebrating the recovery and restoration of the bald eagle, the living symbol of freedom in the United States, to America’s lands, waterways, and skies;</text></subparagraph> 
<subparagraph id="H81B29AF7540F4008A9667FFFE99098E0"><enum>(B)</enum><text>commemorating the removal of the bald eagle from the <quote>endangered</quote> and <quote>threatened</quote> species lists under the Endangered Species Act of 1973; and</text></subparagraph> 
<subparagraph id="HDF058EEE77D548A4B2B1BD07613CB740"><enum>(C)</enum><text>commemorating the 35th anniversary of the enactment of the Endangered Species Act of 1973 and the designation of the bald eagle as an <quote>endangered</quote> species under such Act.</text></subparagraph></paragraph></section> 
<section id="H647777275978433D95FF206D5E84D6D4"><enum>3.</enum><header>Coin specifications</header> 
<subsection id="H799067F46CCF463C9D818D9113401C8B"><enum>(a)</enum><header>Denominations</header><text>In celebration of the recovery of the bald eagle, the national living symbol of freedom, to America’s lands, waterways, and skies and in commemoration of the 35th anniversary of the enactment of the Endangered Species Act of 1973 and the placement of the bald eagle on the endangered species list under such Act, the Secretary of the Treasury (hereafter in this Act referred to as the <quote>Secretary</quote>) shall mint and issue the following coins:</text> 
<paragraph id="H9536B346B1D542F3AD19066E863422FE"><enum>(1)</enum><header>$5 gold coins</header><text>Not more than 100,000 $5 coins, which shall—</text> 
<subparagraph id="HF5659C24A4E242F3A0021BA3B393645C"><enum>(A)</enum><text>weigh 8.359 grams;</text></subparagraph> 
<subparagraph id="HF856D7F732F948468D167DEE423DA600"><enum>(B)</enum><text>have a diameter of 0.850 inches; and</text></subparagraph> 
<subparagraph id="H31E4792E8A00429CAA426E021B2C3033"><enum>(C)</enum><text>contain 90 percent gold and 10 percent alloy.</text></subparagraph></paragraph> 
<paragraph id="HE7FD100CD9324CE7B6B1EDD26FB13300"><enum>(2)</enum><header>$1 silver coins</header><text>Not more than 500,000 $1 coins, which shall—</text> 
<subparagraph id="H854B724ED2FE4DF3BD00EF98C9C4B5E"><enum>(A)</enum><text>weigh 26.73 grams;</text></subparagraph> 
<subparagraph id="H83C5528D557C4B6EB280A2F15FF16BF0"><enum>(B)</enum><text>have a diameter of 1.500 inches; and</text></subparagraph> 
<subparagraph id="HE5DCF5BD3B54412EBBFA9C9BB300D06C"><enum>(C)</enum><text>contain 90 percent silver and 10 percent copper.</text></subparagraph></paragraph> 
<paragraph id="HC46F34C50D8047508BB655E4D9677726"><enum>(3)</enum><header>Half dollar clad coins</header><text>Not more than 750,000 half dollar coins which shall—</text> 
<subparagraph id="H0579A984D1304F41BA77AD381D23B644"><enum>(A)</enum><text>weigh 11.34 grams;</text></subparagraph> 
<subparagraph id="H3117513E3F0A4DDA9EFD7568E83B2D00"><enum>(B)</enum><text>have a diameter of 1.205 inches; and</text></subparagraph> 
<subparagraph id="H9700F33D806A478AA70300B615BCA5AF"><enum>(C)</enum><text>be minted to the specifications for half dollar coins contained in <external-xref legal-doc="usc" parsable-cite="usc/31/5112">section 5112(b)</external-xref> of title 31, United States Code.</text></subparagraph></paragraph></subsection> 
<subsection id="H142D615C95614758A986A16226ACA1E"><enum>(b)</enum><header>Legal tender</header><text>The coins minted under this Act shall be legal tender, as provided in <external-xref legal-doc="usc" parsable-cite="usc/31/5103">section 5103</external-xref> of title 31, United States Code.</text></subsection> 
<subsection id="H30A97092FC0A4F8488837079DE9F346D"><enum>(c)</enum><header>Numismatic items</header><text>For purposes of sections <external-xref legal-doc="usc" parsable-cite="usc/31/5134">5134</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/31/5136">5136</external-xref> of title 31, United States Code, all coins minted under this Act shall be considered to be numismatic items.</text></subsection></section> 
<section id="HD10D926990C948C88161372C33A154BB"><enum>4.</enum><header>Design of coins</header> 
<subsection id="HDEFD91E8BC0945099007298716C500CA"><enum>(a)</enum><header>Design requirements</header> 
<paragraph id="H215DD339724744B5A92B58B4C57499C2"><enum>(1)</enum><header>In general</header><text>The design of the coins minted under this Act shall be emblematic of the bald eagle and its history, natural biology, and national symbolism.</text></paragraph> 
<paragraph id="HCA3DE8D6A1014B13928213F321CE3844"><enum>(2)</enum><header>Designation and inscriptions</header><text>On each coin minted under this Act there shall be—</text> 
<subparagraph id="HCE396297B01C49DDA436619DDBD4451E"><enum>(A)</enum><text>a designation of the value of the coin;</text></subparagraph> 
<subparagraph id="HB2487784F587496EAA7B17CDEE45CB2"><enum>(B)</enum><text>an inscription of the year <quote>2008</quote>; and</text></subparagraph> 
<subparagraph id="H7EA284B467874C38ABEACAD743FC0012"><enum>(C)</enum><text>inscriptions of the words <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United States of America</quote>, and <quote>E Pluribus Unum</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H59BC21085C664912941F08E059B8A271"><enum>(b)</enum><header>Selection</header><text>The design for the coins minted under this Act shall be—</text> 
<paragraph id="H29CEEDFDDD3D40C6ADC64DED5778D100"><enum>(1)</enum><text>selected by the Secretary after consultation with the Commission of Fine Arts, and the American Eagle Foundation of Tennessee in the United States; and</text></paragraph> 
<paragraph id="H64F1762F442945EBADC64F00D031CCF3"><enum>(2)</enum><text>reviewed by the Citizens Coinage Advisory Committee.</text></paragraph></subsection></section> 
<section id="H50AD2C60DD2449CFB7F53E853DB85DD"><enum>5.</enum><header>Issuance of coins</header> 
<subsection id="H1BDB2EE3BACD4B8F937C252FE2B540DD"><enum>(a)</enum><header>Quality of coins</header><text>Coins minted under this Act shall be issued in uncirculated and proof qualities.</text></subsection> 
<subsection id="H43427922124E448496183E6377EB33F3"><enum>(b)</enum><header>Mint facility</header><text>Only 1 facility of the United States Mint may be used to strike any particular quality of the coins minted under this Act.</text></subsection> 
<subsection id="H9F06B374B9084AE19C12DF3D47C9DF4"><enum>(c)</enum><header>Period for issuance</header><text>The Secretary may issue coins minted under this Act only during the 1-year period beginning on January 1, 2008.</text></subsection></section> 
<section id="H9F3CCAD470624228865E12C251C00B"><enum>6.</enum><header>Sale of coins</header> 
<subsection id="H48BE39BD1A994CAE884BD24BBFA5D2B"><enum>(a)</enum><header>Sale price</header><text>The coins issued under this Act shall be sold by the Secretary at a price equal to the sum of—</text> 
<paragraph id="H078AFFB6CA0F4404918450F5002435A3"><enum>(1)</enum><text>the face value of the coins;</text></paragraph> 
<paragraph id="HE83560F2077F47E1B64200FDD542C13D"><enum>(2)</enum><text>the surcharge provided in section 7(a) with respect to such coins; and</text></paragraph> 
<paragraph id="H609F6DE71B36404BB546854B27A26ED7"><enum>(3)</enum><text>the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping).</text></paragraph></subsection> 
<subsection id="H0FA4B1A2F303423F869025DB97E7BC7E"><enum>(b)</enum><header>Bulk sales</header><text>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</text></subsection> 
<subsection id="H3F584F422B6047B9A534E972B4AF1AB"><enum>(c)</enum><header>Prepaid orders</header> 
<paragraph id="HD4653EA39A8D4EABA7CC2B95ACA96B"><enum>(1)</enum><header>In general</header><text>The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of such coins.</text></paragraph> 
<paragraph id="H115757DC29C941FA836572DB8CF86B00"><enum>(2)</enum><header>Discount</header><text>Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</text></paragraph></subsection></section> 
<section id="H6B201534DB43459BABE8A4B328B4111B"><enum>7.</enum><header>Surcharges</header> 
<subsection id="H3D24A14EBBAD469FA9F3A8E78600D216"><enum>(a)</enum><header>In general</header><text>All sales of coins minted under this Act shall include a surcharge as follows:</text> 
<paragraph id="H2D5F17D1F7824EAF005844E6875D888F"><enum>(1)</enum><text>A surcharge of $35 per coin for the $5 coin.</text></paragraph> 
<paragraph id="H3C951D28DEBB4390816F91A7CB1F13C7"><enum>(2)</enum><text>A surcharge of $10 per coin for the $1 coin.</text></paragraph> 
<paragraph id="H87F41D06A9124155BC31F1CBB5696D2E"><enum>(3)</enum><text>A surcharge of $3 per coin for the half dollar coin.</text></paragraph></subsection> 
<subsection id="H90E4C87DA1224227B0F02EB16817863E"><enum>(b)</enum><header>Distribution</header><text>Subject to <external-xref legal-doc="usc" parsable-cite="usc/31/5134">section 5134(f)</external-xref> of title 31, United States Code, all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary to the American Eagle Foundation of Tennessee in the United States for use solely for the following purposes:</text> 
<paragraph id="HEBEADE40CAA147F9A078C46CF000BC58"><enum>(1)</enum><text>To establish an interest-bearing endowment called the American Eagle Fund as a permanent source of support for the care, monitoring, maintenance, and recovery of the bald eagle and its habitat in the United States, including the following:</text> 
<subparagraph id="HD08925C6020E4D70974E84051D84CBDD"><enum>(A)</enum><text>Public education activities and events.</text></subparagraph> 
<subparagraph id="H63C10461FF47442DA18D52733E76A314"><enum>(B)</enum><text>Habitat purchases and cooperative land agreements.</text></subparagraph> 
<subparagraph id="H213742CC1A344F1AB7E805D53700B292"><enum>(C)</enum><text>Raptor rehabilitation and captive breeding and hacking.</text></subparagraph> 
<subparagraph id="H1DBF172D280D44ECA1270226BF26302D"><enum>(D)</enum><text>Behavior and migration research and wintering migration counts.</text></subparagraph> 
<subparagraph id="HD0D9582983154CD8BC03D8F196B8204B"><enum>(E)</enum><text>Facilitate the enforcement of laws protecting the bald eagle.</text></subparagraph> 
<subparagraph id="H11610C167C90492591083129E99045F6"><enum>(F)</enum><text>Nest-watch monitoring and eaglet banding.</text></subparagraph> 
<subparagraph id="H6960FD95BAB040C2B38F33AC7100B47D"><enum>(G)</enum><text>Public viewing areas and visitor centers.</text></subparagraph></paragraph> 
<paragraph id="HB3E8CE83495C457DA6F58B47961401CB"><enum>(2)</enum><text>To make annual grants, in an amount not to exceed 10 percent of the annual income of the American Eagle Fund, to Federal, State, and private eagle restoration, protection, and enhancement projects within the 5 bald eagle recovery regions established by the United States Fish and Wildlife Service, in accordance with recommendations made by an advisory committee of recognized eagle experts which the Foundation shall establish.</text></paragraph> 
<paragraph id="H1DE31382B2C84D5600ECEF75333E99EC"><enum>(3)</enum><text>To administer the American Eagle Fund, including contracting for necessary services, in an annual amount not to exceed the lesser of—</text> 
<subparagraph id="H6220D0D1844E4DEF84B89121105C486F"><enum>(A)</enum><text>10 percent of the annual income of the American Eagle Fund; or</text></subparagraph> 
<subparagraph id="HC76044A949DF4D1F932CAA0172A6B6CC"><enum>(B)</enum><text>$250,000.</text></subparagraph></paragraph> 
<paragraph id="H96E1B8EA621A4C4CBFD1135BD4348F7F"><enum>(4)</enum><text>To provide financial support for capital projects related to the restoration and protection of bald eagles in Tennessee and in the United States, in general.</text></paragraph> 
<paragraph id="H17A6AC8E34F14EA9A0E0B4FF480013DD"><enum>(5)</enum><text>To provide financial support for the continuation and expansion of the efforts of the American Eagle Foundation of Tennessee in the United States to educate the American people nationally about the livelihood, symbolism, and protection of the bald eagle, the national symbol of the United States, through the dissemination of information regarding bald eagles and their habitat at special events and through the media (including newspapers, magazines, radio, television, the Internet, and billboards).</text></paragraph></subsection> 
<subsection id="H2D096A72A42C46248600BFB35B795600"><enum>(c)</enum><header>Audits</header><text>The American Eagle Foundation of Tennessee in the United States and the American Eagle Fund shall be subject to the audit requirements of <external-xref legal-doc="usc" parsable-cite="usc/31/5134">section 5134(f)(2)</external-xref> of title 31, United States Code, with regard to the amounts received by the Foundation or the Fund under subsection (b).</text></subsection></section>
