<official-title>To amend the Migratory Bird Treaty Act to exclude non-native migratory bird species from the application of that Act, and for other purposes.</official-title>

<section id="H02EBD5FAA3434B719FE4DC9DF86DC83C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="HA6EBF73BCEC043DBB71BACF00A44B54"><enum>2.</enum><header>Exclusion of non-native species from application of certain prohibitions under Migratory Bird Treaty Act</header><text display-inline="no-display-inline">Section 2 of the Migratory Bird Treaty Act (<external-xref legal-doc="usc" parsable-cite="usc/16/703">16 U.S.C. 703</external-xref>) is amended—</text> 
<paragraph id="H8F2BF9D4BB304CFFB84EAEE71087AFE0"><enum>(1)</enum><text> in the first sentence by striking <quote>That unless and except as permitted</quote> and inserting the following: <quote>(a)<header-in-text level="paragraph"> In General</header-in-text>.—Unless and except as permitted</quote>; and</text></paragraph> 
<paragraph id="H61A0253AC2BC4B21AA3F4700DCFA79CA"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="HD3654CF2326544A4B5A6B7D00815388"><enum>(b)</enum><header>Limitation on application to introduced species</header> 
<paragraph id="H6D6E55E0C2554563AB09D492EC18FD11"><enum>(1)</enum><header>In general</header><text>This section applies only to migratory bird species that are native to the United States and whose occurrence in the United States is entirely the result of natural biological or ecological conditions.</text></paragraph> 
<paragraph id="HE47CB9A548124867B25CC87E5943CB1"><enum>(2)</enum><header>Treatment of introduced species</header><text>For purposes of paragraph (1)—</text> 
<subparagraph id="H831D2BB71A8B480DA56C64CB2073F789"><enum>(A)</enum><text>a bird species shall not be treated as native to the United States if it occurs in the United States solely as a result of intentional or unintentional human-assisted introduction; and</text></subparagraph> 
<subparagraph id="H24797835A85A43ADB331DE83E2EC3B9"><enum>(B)</enum><text>a migratory bird species shall be treated as native to the United States if—</text> 
<clause id="HEADE51F8530E4E15A33EE487DF84DE85"><enum>(i)</enum><text>it was native to the United States and extant in 1918;</text></clause> 
<clause id="H54B72D2D069D41F3A4AF81D8EAD6C6B6"><enum>(ii)</enum><text>it was extirpated after 1918 throughout its range in the United States; and</text></clause> 
<clause id="HA23C12006E9740A6876ED560A66D8313"><enum>(iii)</enum><text>after such extirpation, it was reintroduced in the United States as a part of a program carried out by a Federal agency.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
