<official-title>To provide for an additional temporary extension of programs under the Small Business Act and the Small Business Investment Act of 1958 through June 4, 2004, and for other purposes.</official-title>

<section id="H844D98461257430DBEEF923541DEA1C" section-type="section-one"><enum>1.</enum><header>Additional temporary extension of authorization of programs under Small Business Act and Small Business Investment Act of 1958</header><text display-inline="no-display-inline">The authorization for any program, authority, or provision, including any pilot program, that was extended through April 2, 2004, by section 1 of <external-xref legal-doc="public-law" parsable-cite="pl/108/205">Public Law 108–205</external-xref> is further extended through June 4, 2004, under the same terms and conditions. </text></section> 
<section id="HA7834A158A314AC1A85053769B56AC97"><enum>2.</enum><header>Extension of certain fee authorizations</header><text display-inline="no-display-inline">Section 503(f) of the Small Business Investment Act of 1958 (15 U.S.C. 697 (f)), as amended by section 2 of <external-xref legal-doc="public-law" parsable-cite="pl/108/205">Public Law 108–205</external-xref>, is further amended by striking <quote>May 21, 2004</quote> and inserting <quote>October 1, 2004</quote>.</text></section> 
<section id="HF9DBB809055D4EFDAE2ED57200E84716"><enum>3.</enum><header>Fiscal year 2004 purchase and guarantee authority under title III of Small Business Investment Act of 1958</header><text display-inline="no-display-inline"> Section 20 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631</external-xref> note) is amended by adding at the end the following new subsection:</text>

<subsection id="H00ECE92411B84BA38D799BB4F865272"><enum>(j)</enum><header>Fiscal year 2004 purchase and guarantee authority under title III of Small Business Investment Act of 1958</header><text>For fiscal year 2004, for the programs authorized by title III of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/681">15 U.S.C. 681 et seq.</external-xref>), the Administration is authorized to make—</text> 
<paragraph id="H2B18C391AC3848DDBB5FF1E5432F7BCA"><enum>(1)</enum><text>$4,000,000,000 in purchases of participating securities; and</text></paragraph> 
<paragraph id="H1BBA8AD99A0E466B90883C582BEC8600"><enum>(2)</enum><text>$3,000,000,000 in guarantees of debentures.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H005F96EC208D428294E9F36FA1955E9D"><enum>4.</enum><header>Combination financing</header> 
<subsection id="HA5CC1A96D5AD4BAA9174B1E1074E1B"><enum>(a)</enum><header>In general</header><text>During the period beginning on the date of the enactment of this section and ending on September 30, 2004, subsection (a) of section 7 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) shall be applied as if the paragraph set forth in subsection (b) were added at the end of that subsection (a).</text></subsection> 
<subsection id="H71B49C5515B148FF869355BF45D6A453"><enum>(b)</enum><header>Paragraph specified</header><text>The paragraph referred to in subsection (a) is as follows:</text>

<paragraph id="H0F324BA829D945EC9FBFECBA3CC3CB8F" indent="up1"><enum>(31)</enum><header>Combination financing</header> 
<subparagraph id="HB704CFD033AE4FF89BF03D48ACBC7888"><enum>(A)</enum><header>Definitions</header><text>In this paragraph—</text> 
<clause id="HBE39F49B45A3484C8EEBB500A9D7B73E"><enum>(i)</enum><text>the term <quote>combination financing</quote> means financing comprised of a loan guaranteed under this subsection and a commercial loan; and</text></clause> 
<clause id="H131A61F2EAF14E4CB41D7B527E002EBB"><enum>(ii)</enum><text>the term <quote>commercial loan</quote> means a loan which is part of a combination financing and no portion of which is guaranteed by the Federal Government.</text></clause></subparagraph> 
<subparagraph id="H36B4B60DE15F4E35A45D7C763B15BC74"><enum>(B)</enum><header>Applicability</header><text>This paragraph applies to a loan guarantee obtained by a small business concern under this subsection, if the small business concern also obtains a commercial loan. </text></subparagraph> 
<subparagraph id="HB3EEBCD422944D11B5539C2BD0F1A12B"><enum>(C)</enum><header>Commercial loan amount</header><text>In the case of any combination financing, the amount of the commercial loan which is part of such financing shall not exceed the gross amount of the loan guaranteed under this subsection which is part of such financing.</text></subparagraph> 
<subparagraph id="H549E4EB0620343E4A83FC227914F45AF"><enum>(D)</enum><header>Commercial loan provisions</header><text>The commercial loan obtained by the small business concern—</text> 
<clause id="HB6BC6058EDB84C939818DCAC296F5EE6"><enum>(i)</enum><text>may be made by the participating lender that is providing financing under this subsection or by a different lender;</text></clause> 
<clause id="HA3B49E3196E94CA7A35390E45FAABD41"><enum>(ii)</enum><text>may be secured by a senior lien; and</text></clause> 
<clause id="H6D1341C475C34FF3B66FE659A9F60287"><enum>(iii)</enum><text>may be made by a lender in the Preferred Lenders Program, if applicable.</text></clause></subparagraph> 
<subparagraph id="H650E0D65318A4DA2A1E1BB5D8EFEC04E"><enum>(E)</enum><header>Commercial loan fee</header><text>A one-time fee in an amount equal to 0.7 percent of the amount of the commercial loan shall be paid by the lender to the Administration if the commercial loan has a senior credit position to that of the loan guaranteed under this subsection. Paragraph (23)(B) shall apply to the fee established by this paragraph.</text></subparagraph> 
<subparagraph id="H56E948E6800746D2A79DAAA0AA5C00BA"><enum>(F)</enum><header>Deferred participation loan security</header><text>A loan guaranteed under this subsection may be secured by a subordinated lien.</text></subparagraph> 
<subparagraph id="H5296DFE45E684563AD8100ED1EEF1F80"><enum>(G)</enum><header>Completion of application processing</header><text>The Administrator shall complete processing of an application for combination financing under this paragraph pursuant to the program authorized by this subsection as it was operating on October 1, 2003.</text></subparagraph> 
<subparagraph id="H07C4C3EEC1DE469E9582331695210069"><enum>(H)</enum><header>Business loan eligibility</header><text>Any standards prescribed by the Administrator relating to the eligibility of small business concerns to obtain combination financing under this subsection which are in effect on the date of the enactment of this paragraph shall apply with respect to combination financings made under this paragraph. Any modifications to such standards by the Administrator after such date shall not unreasonably restrict the availability of combination financing under this paragraph relative to the availability of such financing before such modifications.</text></subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H4701F4B717FC4F7897A169992325F946"><enum>5.</enum><header>Loan guarantee fees</header> 
<subsection id="HAA6CC830784F4BA1AA7F05745B57FA75"><enum>(a)</enum><header>In general</header><text>During the period beginning on the date of the enactment of this section and ending on September 30, 2004, subparagraph (A) of paragraph (23) of subsection (a) of section 7 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(23)(A)</external-xref>) shall be applied as if that subparagraph consisted of the language set forth in subsection (b).</text></subsection> 
<subsection id="H66FBD4A041DA4ACA96ABC74B6F9028EB"><enum>(b)</enum><header>Language specified</header><text>The language referred to in subsection (a) is as follows:</text> 
<quoted-block style="OLC" id="H7735904A99034BDF837635E7E5000025" display-inline="no-display-inline"> 
<subparagraph id="HF1FAE67439424C1C9C6B9DA36F3F4334" indent="up1"><enum>(A)</enum><header>Percentage</header> 
<clause id="HA486F58250464E9A9BC5F658E1939DB2"><enum>(i)</enum><header>In general</header><text>With respect to each loan guaranteed under this subsection, the Administrator shall, in accordance with such terms and procedures as the Administrator shall establish by regulation, assess and collect an annual fee in an amount equal to 0.5 percent of the outstanding balance of the deferred participation share of the loan.</text></clause> 
<clause id="HF8C58C65170142709E3B5BCBB9CFEB2F"><enum>(ii)</enum><header>Temporary percentage</header><text>With respect to loans approved during the period beginning on the date of enactment of this clause and ending on September 30, 2004, the annual fee assessed and collected under clause (i) shall be equal to 0.36 percent of the outstanding balance of the deferred participation share of the loan.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1FA61F1F2F304FAABB09E6B400F45487"><enum>(c)</enum><header>Retention of certain fees</header> <text>Subparagraph (B) of paragraph (18) of subsection (a) of section 7 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(18)(B)</external-xref>) shall not be effective during the period beginning on the date of the enactment of this section and ending on September 30, 2004.</text></subsection></section> 
<section id="H49DCC5D6F85F4BC79F9E954C8444F6B0"><enum>6.</enum><header>Express loan provisions</header> 
<subsection id="H15B2D683CA964BBA9E3D80B67104E072"><enum>(a)</enum><header>Definitions</header><text>For the purposes of this section:</text> 
<paragraph id="H36AECD0A1FD840EFBFBB86E62E750013"><enum>(1)</enum><text>The term <quote>express lender</quote> shall mean any lender authorized by the Administrator to participate in the Express Loan Pilot Program.</text></paragraph> 
<paragraph id="HB7980072B7CB4A3C8457EEE7DA3633E1"><enum>(2)</enum><text>The term <quote>Express Loan</quote> shall mean any loan made pursuant to section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) in which a lender utilizes to the maximum extent practicable its own loan analyses, procedures, and documentation.</text></paragraph> 
<paragraph id="H4270FFCB02FB465EBEDDDD50CB17CAD2"><enum>(3)</enum><text>The term <quote>Express Loan Pilot Program</quote> shall mean the program established by the Administrator prior to the date of enactment of this section under the authority granted in section 7(a)(25)(B) of the Small Business Act (15 U.S.C. 636(a)(25(B)) with a guaranty rate not to exceed 50 percent.</text></paragraph> 
<paragraph id="H76F2D779EAEF4C7B8B0000D7BED05E9E"><enum>(4)</enum><text>The term <quote>Administrator</quote> means the Administrator of the Small Business Administration.</text></paragraph> 
<paragraph id="H142A14EA0ABA405C938F5254CAC26325"><enum>(5)</enum><text>The term <quote>small business concern</quote> has the same meaning given such term under section 3(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(a)</external-xref>). </text></paragraph></subsection> 
<subsection id="HE67209068ADA4FF0BB44DC917367189C"><enum>(b)</enum><header>Restriction to express lender</header><text>The authority to make an Express Loan shall be limited to those lenders deemed qualified to make such loans by the Administrator. Designation as an express lender for purposes of making an Express Loan shall not prohibit such lender from taking any other action authorized by the Administrator for that lender pursuant to section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>).</text></subsection> 
<subsection id="H4055C7490631463DA50366856C682B9E"><enum>(c)</enum><header>Grandfathering of existing lenders</header><text>Any express lender shall retain such designation unless the Administrator determines that the express lender has violated the law or regulations promulgated by the Administrator or modifies the requirements to be an express lender and the lender no longer satisfies those requirements.</text></subsection> 
<subsection id="H501D504C48AA416899C912922D83B22E"><enum>(d)</enum><header>Temporary expansion of express loan pilot program</header> 
<paragraph id="H3AF635D0DDA34C31A2B9F3DF375D45A8"><enum>(1)</enum><header>Authorization</header><text>As of the date of enactment of this section, the maximum loan amount in the Express Loan Pilot Program shall be increased to a maximum loan amount of $2,000,000 as set forth in section 7(a)(3)(A) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(3)(A)</external-xref>).</text></paragraph> 
<paragraph id="H45743742BBF44D0FB861E1BA98624C75"><enum>(2)</enum><header>Termination date</header><text>The authority set forth in paragraph (1) shall terminate on September 30, 2004.</text></paragraph> 
<paragraph id="HA25379B6835642508361174872F6D840"><enum>(3)</enum><header>Savings provision</header><text>Nothing in this section shall be interpreted to modify or alter the authority of the Administrator to continue to operate the Express Loan Pilot Program on or after October 1, 2004.</text></paragraph></subsection> 
<subsection id="H8CE8D94586D8442AAD5EFD8D9E3FBEAF"><enum>(e)</enum><header>Option to participate</header><text>Except as otherwise provided in this section, the Administrator shall take no regulatory, policy, or administrative action, without regard to whether such action requires notification pursuant to section 7(a)(24) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(24)</external-xref>), that has the effect of—</text> 
<paragraph id="HE12453BD5260422A88942FF727DF4D02"><enum>(1)</enum><text>requiring a lender to make an Express Loan pursuant to subsection (d);</text></paragraph> 
<paragraph id="H9F00F7FA5D0E41F493B6BA730050A5BF"><enum>(2)</enum><text>limiting or modifying any term or condition of deferred participation loans made under such section (other than Express Loans) unless the Administrator imposes the same limit or modification on Express Loans;</text></paragraph> 
<paragraph id="HD3C341E5A03E4CC9BCA63CDBB16F8485"><enum>(3)</enum><text>transferring or re-allocating staff, staff responsibilities, resources, or funding, if the result of such transfer or re-allocation would be to increase the average loan processing, approval, or disbursement time above the averages for those functions as of October 1, 2003, for loan guarantees approved under such section by employees of the Administration or through the Preferred Lenders Program; or</text></paragraph> 
<paragraph id="HD954C27F7EE442B898936D9044809618"><enum>(4)</enum><text>otherwise providing any incentive or disincentive which encourages lenders or borrowers to make or obtain loans under the Express Loan Pilot Program instead of under the general loan authority of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>).</text></paragraph></subsection> 
<subsection id="H99F38748383841FC8BE6D5CC711F2BAD"><enum>(f)</enum><header>Collection and reporting of data</header><text>For all loans in excess of $250,000 made pursuant to the authority set forth in subsection (d)(1), the Administrator shall, to the extent practicable, collect data on the purpose for each such loan. The Administrator shall report monthly to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives on the number of such loans and their purposes.</text></subsection> 
<subsection id="H9BBAFCF523974B0290E383DA0000E064"><enum>(g)</enum><header>Termination</header><text>Subsections (b), (c), (e), and (f) shall not apply after September 30, 2004.</text></subsection></section> 
<section id="H0AD97E27174A4E8D94A165A99F74FE9D"><enum>7.</enum><header>Fiscal year 2004 deferred participation standards</header><text display-inline="no-display-inline">Deferred participation loans made during the period beginning on the date of the enactment of this Act and ending on September 30, 2004, under section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) shall have the same terms and conditions (including maximum gross loan amounts and collateral requirements) as were applicable to loans made under such section on October 1, 2003, except as otherwise provided in this Act. This section shall not preclude the Administrator of the Small Business Administration from taking such action as necessary to maintain the loan program carried out under such section, subject to appropriations. </text></section> 
<section id="H0C87B35628844C228B8CAA1FE7EA28E4"><enum>8.</enum><header>Temporary increase in loan limit under business loan and investment fund and in associated guarantee fees</header> 
<subsection id="H7396FD2F28D04AA6B0573E78D669423B"><enum>(a)</enum><header>Temporary increase in amount permitted to be outstanding and committed</header><text>During the period beginning on the date of the enactment of this Act and ending on September 30, 2004, section 7(a)(3)(A) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(3)(A)</external-xref>) shall be applied as if the first dollar figure were $1,500,000.</text></subsection> 
<subsection id="H8D07A83CC25C4EC292BDA364534004DA"><enum>(b)</enum><header>Temporary guarantee fee on deferred participation share over $1,000,000</header><text>With respect to loans made during the period referred to in subsection (a) to which section 7(a)(18) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(18)</external-xref>) applies, the Administrator of the Small Business Administration shall collect an additional guarantee fee equal to 0.25 percent of the amount (if any) by which the deferred participation share of the loan exceeds $1,000,000. </text></subsection></section>
