<legis-type>A BILL</legis-type> 
<official-title>To encourage the establishment of both long-term and short-term programs to address the threat of man-portable air defense systems (MANPADS) to commercial aviation.</official-title>

<section id="H1125B55BC4564E5AB0ED1779D600BAC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="H99F64F07F4DD4644B5F5CB69876F404F"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H57469B87B40F40749CA7F15372004C24"><enum>(1)</enum><text> MANPADS constitute a threat to military and civilian aircraft.</text></paragraph> 
<paragraph id="H8CED144641D34E9989607426E77D2010"><enum>(2)</enum><text>The threat posed by MANPADS requires the development of both short-term and long-term plans.</text></paragraph> 
<paragraph id="HAA20E645563042C99B7F8815E437924E"><enum>(3)</enum><text>The threat posed by MANPADS requires an international as well as domestic response.</text></paragraph> 
<paragraph id="H2F048E57605643B78CC5882D07051D"><enum>(4)</enum><text>There should be an international effort to address the issues of MANPADS proliferation and defense.</text></paragraph> 
<paragraph id="H8AFACA3DB118476B95B8BC73B4055BB9"><enum>(5)</enum><text>The Government is pursuing and should continue to pursue diplomatic efforts to prevent the proliferation of MANPADS.</text></paragraph> </section> 
<section id="H3704ED4EE4304C6CA2F6434F15540022"><enum>3.</enum><header>International cooperative efforts</header> 
<subsection id="HE8A0118581E14CE68E247BD061632892"><enum>(a) </enum><header>To limit availability and transfer of MANPADS</header><text>The President is encouraged to pursue further strong international diplomatic and cooperative efforts, including bilateral and multilateral treaties, in the appropriate forum to limit the availability, transfer, and proliferation of MANPADS worldwide.</text></subsection> 
<subsection id="HBC7F769A38FF418F9E4790186DA39E59"><enum>(b)</enum><header>To achieve destruction of MANPADS</header><text>The President should continue to pursue further strong international diplomatic and cooperative efforts, including bilateral and multilateral treaties, in the appropriate forum to assure the destruction of excess, obsolete, and illicit stocks of MANPADS worldwide.</text></subsection> 
<subsection id="H6E94CE0D1A8F422583A693AD209B567B"><enum>(c)</enum><header>Reporting and briefing requirements</header><text>Not later than 180 days after the date of enactment of this Act, the President shall transmit to the appropriate congressional committees a report that contains a detailed description of the status of diplomatic efforts under subsections (a) and (b). Annually thereafter until completion of such diplomatic efforts, the Secretary of State shall brief the appropriate congressional committees on the status of such diplomatic efforts.</text></subsection> </section> 
<section id="HBE89E35AEF554D4C99EFF0AB19712861"><enum>4.</enum><header>FAA airworthiness certification of missile defense systems for commercial aircraft</header> 
<subsection id="HAD631C76A6104B1A9091FED1F4220070"><enum>(a)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall establish a process for conducting airworthiness and safety certification of missile defense systems for commercial aircraft.</text></subsection> 
<subsection id="H0E167B2D797F4A9ABCCB8B386500BDAA"><enum>(b)</enum><header>Certification acceptance</header><text>Under the process, the Administrator shall accept the certification of the Department of Homeland Security that a missile defense system is effective and does not pose a danger when used to defend commercial aircraft against MANPADS.</text></subsection> 
<subsection id="H12AD3CF215524E06A02DDDB9E6703F9"><enum>(c)</enum><header>Expeditious certification</header><text>Under the process, the Administrator shall expedite the airworthiness and safety certification of missile defense systems for commercial aircraft.</text></subsection> 
<subsection id="H0144E4CE0D6947B1854FD8348BCF19C4"><enum>(d)</enum><header>Reports</header><text>Not later than 180 days after the initiation of certification procedures for missile defense systems for commercial aircraft, and every 6 months thereafter until complete, the Federal Aviation Administration shall transmit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report that contains a detailed description of the status of airworthiness and safety certification.</text></subsection></section> 
<section id="H39AEB30C3AB4436FB0A6AF1819E262AF"><enum>5.</enum><header>Programs to reduce MANPADS</header> 
<subsection id="H8DCF76088BC5464EBDD480046936F6A4"><enum>(a)</enum><header>In general</header><text>The President is encouraged to pursue strong programs to reduce the number of MANPADS worldwide so that fewer MANPADS will be available for trade, proliferation, and sale.</text> </subsection> 
<subsection id="HAA3B51033320414BB04F5900493F1451"><enum>(b)</enum><header>Reporting and briefing requirements</header><text>Not later than 180 days after the date of enactment of this Act, the President shall transmit to the appropriate congressional committees a report that contains a detailed description of the status of the programs being pursued under subsection (a). Annually thereafter until the programs are no longer needed, the Secretary of State shall brief the appropriate congressional committees on the status of programs.</text></subsection> 
<subsection id="HF45B40D0D2CB4AE6B44F3B21E18DE686"><enum>(c)</enum><header>Funding</header><text>There is authorized to be appropriated such sums as may be necessary to carry out this section.</text></subsection></section> 
<section id="HA3635F9FB6C54A39939CBD47D4B499D7"><enum>6.</enum><header>MANPADS Vulnerability Assessments Report</header> 
<subsection id="H3229BA68ED494505A200D324EA1D616B"><enum>(a)</enum><header>In general</header><text>Not later than one year after the date of enactment of this Act, the Secretary of Homeland Security shall transmit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report describing the Department of Homeland Security’s plans to secure airports and the aircraft arriving and departing from airports against MANPADS attacks.</text></subsection> 
<subsection id="H3CAE2B7F035745B282719784A658DA40"><enum>(b)</enum><header>Matters to be addressed</header><text>The Secretary’s report shall address, at a minimum, the following:</text> 
<paragraph id="HB8B5CB03EAF7426AAFC0749581CCA600"><enum>(1)</enum><text>The status of the Department’s efforts to conduct MANPADS vulnerability assessments at United States airports at which the Department is conducting assessments. </text></paragraph> 
<paragraph id="HAA1A5952172F4E5795D05D436F1FCBDE"><enum>(2)</enum><text>How intelligence is shared between the United States intelligence agencies and Federal, State, and local law enforcement to address the MANPADS threat and potential ways to improve such intelligence sharing.</text></paragraph> 
<paragraph id="H58773DF2C06848309600F867B0C0142C"><enum>(3)</enum><text>Contingency plans that the Department has developed in the event that it receives intelligence indicating a high threat of MANPADS attack on aircraft at or near United States airports.</text></paragraph> 
<paragraph id="HA32E1869C08C41439D69DD9709B948E6"><enum>(4)</enum><text>The feasibility and effectiveness of implementing public education and neighborhood watch programs in areas surrounding United States airports in cases in which intelligence reports indicate there is a high risk of MANPADS attacks on aircraft. </text></paragraph> 
<paragraph id="H4A19E0D7CAF241E0ADF9BBF883EA0003"><enum>(5)</enum><text>Any other issues that the Secretary deems relevant.</text></paragraph></subsection> 
<subsection id="HCD2C06EE3F164B9D8143D135ABD956A1"><enum>(c)</enum><header>Format</header><text>The report required by this section may be submitted in a classified format.</text></subsection></section> 
<section id="H1B31EC5731DA4F5B9CCA57E6327D7E12"><enum>7.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions apply:</text> 
<paragraph display-inline="no-display-inline" id="HDB541CABBB8146E58E99A2003500758D"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means—</text> 
<subparagraph id="HA07E82DA7BAA4F50936D105F55D83B7D"><enum>(A)</enum><text>the Committee on Armed Services, the Committee on International Relations, and the Committee on Transportation and Infrastructure of the House of Representatives; and</text></subparagraph> 
<subparagraph id="HF00D86F0DA6F4F9C963C826EEE001D2F"><enum>(B)</enum><text>the Committee on Armed Services, the Committee on Foreign Relations, and the Committee on Commerce, Science, and Transportation of the Senate.</text></subparagraph></paragraph> 
<paragraph id="H5838B01B2D154BF68010DA76A3000011"><enum>(2)</enum><header>MANPADS</header><text>The term <quote>MANPADS</quote> means man-portable air defense systems, which are shoulder-fired, surface-to-air missile systems that can be carried and transported by a person.</text></paragraph></section>
