<section id="H4FBFCFD6467746DB957E5B222C8D89A5" section-type="section-one"><enum>1.</enum><header>Short title</header>
<subsection id="H3C5FD4E344A048ABB097FEA9606000D2"><enum></enum><text>This Act may be cited as the <quote>&short-title1;</quote>.</text> </subsection></section>
<section id="H65670379B30C40069393502424F7AEA1" section-type="subsequent-section"><enum>2.</enum><header>Assistance for hiring and retention of nurses at State veterans homes</header> 
<subsection id="H744DE7ED80C9476381918534D994FAAC"><enum>(a)</enum><header>In general</header> 
<paragraph id="H330186240B314DA4B69E8DD0C4C41151" display-inline="yes-display-inline"><enum>(1)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">Chapter 17</external-xref> of title 38, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/1743">section 1743</external-xref> the following new section:</text>

<section id="H672499FA606A4FBBA1B3EE29770055BB"><enum>1744.</enum><header>Hiring and retention of nurses: payments to assist States</header> 
<subsection id="HCCB0B843A3EA439AA484969300F23D25"><enum>(a)</enum><header>Payment program</header><text>The Secretary shall make payments to States under this section for the purpose of assisting State homes in the hiring and retention of nurses and the reduction of nursing shortages at State homes. </text></subsection> 
<subsection id="H0D77F8109B2C402FAD30365400F43DF2"><enum>(b)</enum><header>Eligible recipients</header><text>Payments to a State for a fiscal year under this section shall, subject to submission of an application, be made to any State that during that year—</text> 
<paragraph id="HF0A1C26947EA42E59C07E878676310D3"><enum>(1)</enum><text>receives per diem payments under this subchapter for that fiscal year; and</text></paragraph> 
<paragraph id="H1444AF11FC3241BC83292F4CC6D69513"><enum>(2)</enum><text>has in effect an employee incentive scholarship program or other employee incentive program at a State home designed to promote the hiring and retention of nursing staff and to reduce nursing shortages at that home.</text></paragraph></subsection> 
<subsection id="HF19119C41DF3450E97FC528DEDFD6AE"><enum>(c)</enum><header>Use of funds received</header><text>A State may use an amount received under this section only to provide funds for a program described in subsection (b)(2). Any program shall meet such criteria as the Secretary may prescribe. In prescribing such criteria, the Secretary shall take into consideration the need for flexibility and innovation.</text></subsection> 
<subsection id="H35185F41DDCC4A8BBB792580103E104B"><enum>(d)</enum><header>Limitations on amount of payment</header> 
<paragraph id="HE12042759323482FB01EBBB289D20047" display-inline="yes-display-inline"><enum>(1)</enum><text>A payment under this section may not be used to provide more than 50 percent of the costs for a fiscal year of the employee incentive scholarship or other incentive program for which the payment is made.</text></paragraph> 
<paragraph id="HE4D9056C6F324A5ABF23081B00D6168" indent="up1"><enum>(2)</enum><text>The amount of the payment to a State under this section for any fiscal year is, for each State home in that State with a program described in subsection (b)(2), the amount equal to 2 percent of the amount of payments estimated to be made to that State, for that State home, under section 1741 of this title for that fiscal year.</text></paragraph></subsection> 
<subsection id="H758A20C69DA74A6C944BB71B107FFB85" indent="up1"><enum>(e)</enum><header>Applications</header><text>A payment under this section for any fiscal year with respect to any State home may only be made based upon an application submitted by the State seeking the payment with respect to that State home. Any such application shall describe the nursing shortage at the State home and the employee incentive scholarship program or other incentive program described in subsection (c) for which the payment is sought. </text></subsection> 
<subsection id="H87F8171883554364A1CB64DA7BF20993"><enum>(f)</enum><header>Source of funds</header><text>Payments under this section shall be made from funds available for other payments under this subchapter.</text></subsection> 
<subsection id="H2E0E20A3D36E464DA500B5BB3800C3E"><enum>(g)</enum><header>Disbursement</header><text>Payments under this section to a State home shall be made as part of the disbursement of payments under section 1741 of this title with respect to that State home.</text></subsection> 
<subsection id="HCAB8265E031A45C499FCD14B086F8B00"><enum>(h)</enum><header>Use of certain receipts</header><text>The Secretary shall require as a condition of any payment under this section that, in any case in which the State home receives a refund payment made by an employee in breach of the terms of an agreement for employee assistance that used funds provided under this section, the payment shall be returned to the State home's incentive program account and credited as a non-Federal funding source.</text></subsection> 
<subsection id="H7508378057F44D40A118CB5691ADB29B"><enum>(i)</enum><header>Annual report from payment recipients</header><text>Any State home receiving a payment under this section for any fiscal year, shall, as a condition of the payment, be required to agree to provide to the Secretary a report setting forth in detail the use of funds received through the payment, including a descriptive analysis of how effective the incentive program has been on nurse staffing in the State home during that fiscal year. The report for any fiscal year shall be provided to the Secretary within 60 days of the close of the fiscal year and shall be subject to audit by the Secretary. Eligibility for a payment under this section for any later fiscal year is contingent upon the receipt by the Secretary of the annual report under this subsection for the previous year in accordance with this subsection.</text></subsection> 
<subsection id="HC895B075C8264930B12779B29161D4F3"><enum>(j)</enum><header>Regulations</header><text>The Secretary shall prescribe regulations to carry out this section. The regulations shall include the establishment of criteria for the award of payments under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H36E072215C8E44FB9CC7EA3F41B4F85B" indent="up1"><enum>(2)</enum><text>The table of sections at the beginning of such chapter is amended by inserting after section 1743 the following new item:</text>

<subsection id="H37773836FA0249C8852BB388176798F7"><enum>(b)</enum><header>Implementation</header><text>The Secretary of Veterans Affairs shall implement <external-xref legal-doc="usc" parsable-cite="usc/38/1744">section 1744</external-xref> of title 38, United States Code, as added by subsection (a), as expeditiously as possible. The Secretary shall establish such interim procedures as necessary so as to ensure that payments are made to eligible States under that section commencing not later than January 1, 2005, notwithstanding that regulations under subsection (j) of that section may not have become final.</text></subsection></section>
