<official-title>To increase the penalties for terrorism against mass transportation and railroads and provide law enforcement with the tools to combat and prevent attacks on mass transportation and railroads.</official-title>

<section section-type="section-one" id="H9F533CA73A724503904C31563B8D0795"> <enum>1.</enum> <header>Short title</header> <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text> </section> 
<section id="H5789A6E11B284B35AD6794FBF18EC49"> <enum>2.</enum> <header>Attacks against mass transportation systems and railroad carriers</header> 
<subsection id="H81EAF4D7995C4FCEAA24C8D9A585D5F"> <enum>(a)</enum> <header>In general</header> <text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/97">Chapter 97</external-xref> of title 18, United States Code, is amended by striking sections 1992 and 1993 and inserting the following:</text>

<section id="HED7D60F7003E4B818D8F74F4AF4AF3B"> <enum>1992.</enum> <header>Terrorist attacks and other acts of violence against mass transportation systems on land, on water, or through the air, and against railroad carriers</header> 
<subsection id="H262F099579094BF7909D8609C805353F"> <enum>(a)</enum> <header>General prohibitions</header> <text>Whoever willfully—</text> 
<paragraph id="HAC95DB70C74F4D5C8CF98EACEEF2A33D"> <enum>(1)</enum> <text>wrecks, derails, sets fire to, or disables a mass transportation vehicle or ferry, or a train, locomotive, tender, motor unit, freight or passenger car, or other on-track equipment used, operated, or employed by a railroad carrier;</text> </paragraph> 
<paragraph id="HF44DA76A534146AEB675CB67D08DBE7"> <enum>(2)</enum> <text>places or causes to be placed any biological agent or toxin, destructive substance, or destructive device in, upon, or near a mass transportation vehicle or ferry, or a train, locomotive, tender, motor unit, freight or passenger car, or other on-track equipment used, operated, or employed by a railroad carrier, without previously obtaining the permission of the mass transportation provider or railroad carrier, and with intent to endanger the safety of any passenger or employee of such a provider or carrier, or with a reckless disregard for the safety of human life;</text> </paragraph> 
<paragraph id="H5325672C674C4E7491C7F1007667DB90"> <enum>(3)</enum> <text>sets fire to, undermines, makes unworkable, unusable, or hazardous to work on or use, or places or causes to be placed any biological agent or toxin, destructive substance, or destructive device in, upon, or near any—</text> 
<subparagraph id="H6556C913FED0407100D6B9DF5C68D721"> <enum>(A)</enum> <text>garage, terminal, structure, track, electromagnetic guideway, supply, or facility used in the operation of, or in support of the operation of, a mass transportation vehicle or ferry, without previously obtaining the permission of the mass transportation provider, and with intent to, or knowing or having reason to know such activity would likely, derail, disable, or wreck a mass transportation vehicle or ferry used, operated, or employed by a mass transportation provider; or</text> </subparagraph> 
<subparagraph id="HDBBC84BF46144DE28BB761BBE3B13A"> <enum>(B)</enum> <text>tunnel, bridge, viaduct, trestle, track, electromagnetic guideway, signal, station, depot, warehouse, terminal, or any other way, structure, property, or appurtenance used in the operation of, or in support of the operation of, a railroad carrier, without previously obtaining the permission of the railroad carrier, and with intent to, or knowing or having reason to know such activity would likely, derail, disable, or wreck a train, locomotive, tender, motor unit, freight or passenger car, or other on-track equipment used, operated, or employed by a railroad carrier;</text> </subparagraph> </paragraph> 
<paragraph id="H1469362447DC42558171862DBD7FB5C1"> <enum>(4)</enum> <text>removes an appurtenance from, damages, or otherwise impairs the operation of a mass transportation signal or dispatching system or railroad signal system, including a train control system, centralized dispatching system, or highway-railroad grade crossing warning signal, without authorization from the mass transportation provider or railroad carrier;</text> </paragraph> 
<paragraph id="HD2CE00B9939946A0A6B19441A7DDB6"> <enum>(5)</enum> <text>interferes with, disables, or incapacitates any dispatcher, driver, captain, locomotive engineer, railroad conductor, or other person while the person is employed in dispatching, operating, or maintaining a mass transportation vehicle or ferry, or a train, locomotive, tender, motor unit, freight or passenger car, or other on-track equipment, with intent to endanger the safety of any passenger or employee of a mass transportation provider or railroad carrier, or with a reckless disregard for the safety of human life;</text> </paragraph> 
<paragraph id="HFD885C2B179E4FA2A010B51183E67450"> <enum>(6)</enum> <text>commits an act, including the use of a dangerous weapon, with the intent to cause death or serious bodily injury to an employee or passenger of a mass transportation provider or railroad carrier, or any other person while any of the foregoing is on the property of a mass transportation provider or railroad carrier;</text> </paragraph> 
<paragraph id="HF19D99DDBDD249C38328113D1BDED17C"> <enum>(7)</enum> <text>conveys or causes to be conveyed false information, knowing the information to be false, concerning an attempt or alleged attempt that was made, is being made, or is to be made, to do any act which would be a crime prohibited by this subsection;</text> </paragraph> 
<paragraph id="HD3DF159EC1024F10BD55B700F1B1BF92"> <enum>(8)</enum> <text>causes the release of a hazardous material or a biological agent or toxin on the property of a mass transportation provider or railroad carrier, with the intent to endanger the safety of any person or with a reckless disregard for the safety of human life; or</text> </paragraph> 
<paragraph id="HAA730E0512A448C9A9004117CDF65464"> <enum>(9)</enum> <text>attempts, threatens, or conspires to do any of the acts described in paragraphs (1) through (8), shall be fined under this title or imprisoned not more than 20 years, or both, if the act is committed, or, in the case of an attempt, threat, or conspiracy to do an act enumerated in paragraphs (1) through (8), it would be committed, on, against, or affecting a mass transportation provider or railroad carrier engaged in or affecting interstate or foreign commerce, or if that person travels or communicates across a State line in order to commit an act enumerated in paragraphs (1) through (9), or transports materials across a State line in aid of the commission of an act enumerated in paragraphs (1) through (9).</text> </paragraph> </subsection> 
<subsection id="HBADF926B1BE845B7AF45C5DCA1DD64E"> <enum>(b)</enum> <header>Aggravated offense</header> <text>Whoever commits an offense under subsection (a) of this section in a circumstance in which—</text> 
<paragraph id="H45D3E15A7EE041CA84BD9DAEC2D22045"> <enum>(1)</enum> <text>the mass transportation vehicle or ferry, or train, locomotive, tender, motor unit, freight or passenger car, or other on-track equipment, was carrying a passenger at the time of the offense;</text> </paragraph> 
<paragraph id="H511A8465E4F642CB9C63B686DBD43EEF"> <enum>(2)</enum> <text>the mass transportation vehicle or ferry, or train, locomotive, tender, motor unit, freight or passenger car, or other on-track equipment, was carrying high-level radioactive waste or spent nuclear fuel at the time of the offense;</text> </paragraph> 
<paragraph id="H4C649E2F5822440DB560F2CCE30224CE"> <enum>(3)</enum> <text>the mass transportation vehicle or ferry, or train, locomotive, tender, motor unit, freight or passenger car, or other on-track equipment, was carrying a hazardous material listed in table 1 of <external-xref legal-doc="cfr" parsable-cite="cfr/49/172.504">section 172.504</external-xref> of title 49, Code of Federal Regulations, at the time of the offense; or</text> </paragraph> 
<paragraph id="H83E5E1F6E5F24DC8BAE2CED2BB52B000"> <enum>(4)</enum> <text>the offense has resulted in the death of any person, shall be guilty of an aggravated form of the offense and shall be fined under this title or imprisoned for any term of years or life, or both; and, in the case of a violation described in paragraph (2), the term of imprisonment shall be not less than 30 years; and, in the case of a violation described in paragraph (4), shall be subject to the death penalty or to imprisonment for life.</text> </paragraph> </subsection> 
<subsection id="H5606570D6BD849F3828CFBAEFCC7005B"> <enum>(c)</enum> <header>Conspiracy</header> <text>A person who conspires to commit any offense under this section shall be subject to the same penalties (other than the penalty of death) as the penalties prescribed for the offense, the commission of which was the object of the conspiracy.</text> </subsection> 
<subsection id="H9C25312CE17D4EEAA6E3E3696018ECCD"> <enum>(d)</enum> <header>Nonapplicability</header> <text>Provisions of subsections (a) and (c) of this section do not apply to the act of an entity with respect to a destructive substance or destructive device that is also classified as a hazardous material in commerce if the act—</text> 
<paragraph id="H3A6ED8E5B1694F168294D7F9E5D08E37"> <enum>(1)</enum> <text>complies with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/51">chapter 51</external-xref> of title 49 and regulations, exemptions, approvals, and orders issued under that chapter; or</text> </paragraph> 
<paragraph id="H43AC727373BF4E8681EB71B14309C5A8"> <enum>(2)</enum> <text>constitutes a violation of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/51">chapter 51</external-xref> of title 49 or a regulation or order issued under that chapter, but not a criminal violation of that chapter, regulation, or order.</text> </paragraph> </subsection> 
<subsection id="H4D6662715E3D421C92D4028B2DD7EFA8"> <enum>(e)</enum> <header>Definitions</header> <text>In this section—</text> 
<paragraph id="HD831A717BDA34D9DB840B9B21800095F"> <enum>(1)</enum> <text>the term <term>biological agent</term> has the meaning given to that term in section 178(1) of this title;</text> </paragraph> 
<paragraph id="HDDC371FC61B6428F9F46445245FC0597"> <enum>(2)</enum> <text>the term <term>dangerous weapon</term> means a weapon, device, instrument, material, or substance, animate or inanimate, that is used for, or is readily capable of, causing death or serious bodily injury, including a pocket knife with a blade of less than 2<fraction>1/2</fraction> inches in length and a box cutter;</text> </paragraph> 
<paragraph id="H654D7B823F8A4C7992D9E293F5345CC3"> <enum>(3)</enum> <text>the term <term>destructive device</term> has the meaning given to that term in section 921(a)(4) of this title;</text> </paragraph> 
<paragraph id="HB0F76AB41F8C44B0B2759FCDF1ECD63"> <enum>(4)</enum> <text>the term <term>destructive substance</term> means an explosive substance, flammable material, infernal machine, or other chemical, mechanical, or radioactive device or material, or matter of a combustible, contaminative, corrosive, or explosive nature, except that the term <term>radioactive device</term> does not include any radioactive device or material used solely for medical, industrial, research, or other peaceful purposes;</text> </paragraph> 
<paragraph id="H70874633124C43FB9868F1E81C004286"> <enum>(5)</enum> <text>the term <term>hazardous material</term> has the meaning given to that term in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/51">chapter 51</external-xref> of title 49;</text> </paragraph> 
<paragraph id="HCA40A0C5E48D41B58541005B7088E324"> <enum>(6)</enum> <text>the term <term>high-level radioactive waste</term> has the meaning given to that term in section 2(12) of the <act-name parsable-cite="NWPA">Nuclear Waste Policy Act of 1982</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101(12)</external-xref>);</text> </paragraph> 
<paragraph id="HDF6DDD994ECC4E1D971EF3F5CF59FD6"> <enum>(7)</enum> <text>the term <term>mass transportation</term> has the meaning given to that term in <external-xref legal-doc="usc" parsable-cite="usc/49/5302">section 5302(a)(7)</external-xref> of title 49, United States Code, except that the term shall include school bus, charter, and sightseeing transportation;</text> </paragraph> 
<paragraph id="H3D053777F22043F49B451E1CF5FD3925"> <enum>(8)</enum> <text>the term <term>on-track equipment</term> means a carriage or other contrivance that runs on rails or electromagnetic guideways;</text> </paragraph> 
<paragraph id="H858660C921384288ACA2807935F847EC"> <enum>(9)</enum> <text>the term <term>railroad</term> has the meaning given to that term in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/201">chapter 201</external-xref> of title 49;</text> </paragraph> 
<paragraph id="H3797D7A3810841428DC7DB93E4BD38CB"> <enum>(10)</enum> <text>the term <term>railroad carrier</term> has the meaning given to that term in <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/201">chapter 201</external-xref> of title 49;</text> </paragraph> 
<paragraph id="H18A0F304FE8A4ED8A05FEAAD8846B3D"> <enum>(11)</enum> <text>the term <term>serious bodily injury</term> has the meaning given to that term in section 1365 of this title;</text> </paragraph> 
<paragraph id="H1673B7AC18B74721A564CA3C1CFB5EB4"> <enum>(12)</enum> <text>the term <term>spent nuclear fuel</term> has the meaning given to that term in section 2(23) of the <act-name parsable-cite="NWPA">Nuclear Waste Policy Act of 1982</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101(23)</external-xref>);</text> </paragraph> 
<paragraph id="H94902D2EDEB2416DB6B76E1FB710358"> <enum>(13)</enum> <text>the term <term>State</term> has the meaning given to that term in section 2266 of this title;</text> </paragraph> 
<paragraph id="HD0E2B2EDD686443B885B7EDE74CC8D76"> <enum>(14)</enum> <text>the term <term>toxin</term> has the meaning given to that term in section 178(2) of this title; and</text> </paragraph> 
<paragraph id="HFB884FE4F09F49ADBFCA72A8C0CD8B64"> <enum>(15)</enum> <text>the term <term>vehicle</term> means any carriage or other contrivance used, or capable of being used, as a means of transportation on land, on water, or through the air.</text> </paragraph> </subsection> </section> <after-quoted-block>.</after-quoted-block> </quoted-block> </subsection>

<paragraph id="H7BA67AA3F1FA4A219C90586175DEDB44"> <enum>(1)</enum> <header>Chapter</header> <text>The chapter analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/97">chapter 97</external-xref> of title 18, United States Code, is amended—</text>

<subsection id="HCECB0551CDA24AF8AD258880FF8009FD"> <enum>(a)</enum> <header>Authorization for interruption</header> <text><external-xref legal-doc="usc" parsable-cite="usc/18/2516">Section 2516</external-xref> of title 18, United States Code, is amended—</text>

<subsection id="H2F918EE8B3754CFD89715E9B9EBC58B6"> <enum>(d)</enum> <header>Definitions</header> <text><external-xref legal-doc="usc" parsable-cite="usc/18/3127">Section 3127(2)(A)</external-xref> of title 18, United States Code, is amended to read as follows:</text>

<subparagraph id="H91E31A436EE540CB97C083F1ED416C39"> <enum>(A)</enum> <text>any district court of the United States (including a magistrate judge of such a court) or any United States court of appeals that—</text> 
<clause id="HE898DF95ABC8461A9B81CCAA7B428954"> <enum>(i)</enum> <text>has jurisdiction over the offense being investigated;</text> </clause> 
<clause id="HE54E881C4F35435E9EDAA89218CF0B8"> <enum>(ii)</enum> <text>is in or for a district in which the provider of wire or electronic communication service is located; or</text> </clause>

<subsection id="HE45725B83D654E2EBCC5A64400E13FA4"> <enum>(e)</enum> <header>Acts of terrorism</header> <text><external-xref legal-doc="usc" parsable-cite="usc/18/2332b">Section 2332b(g)(5)(A)</external-xref> of title 18, United States Code, is amended to read as follows:</text>

<subparagraph id="H629CFCAFB18743CC98A6486E27D3E2D"> <enum>(A)</enum> <text>appears by its nature or context to be intended—</text> 
<clause id="H026ED5708C664B938E1223FE0768CBF0"> <enum>(i)</enum> <text>to intimidate or coerce a civilian population;</text> </clause> 
<clause id="H3A67553D65EA46A79800B2661CA888AA"> <enum>(ii)</enum> <text>to influence the policy of a government by intimidation or coercion; or</text> </clause>
