<section section-type="section-one" id="H5324333F9A13452C85951C49BE4896D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="H55B224303D21431B9949F5C4FD1DECC8"><enum>2.</enum><header>Establishment of college financial assistance program for District of Columbia National Guard</header> 
<subsection id="HBDDDFB4E59B94B85AF4081607CCB5BD2"><enum>(a)</enum><header>Program authorized</header> 
<paragraph display-inline="yes-display-inline" id="H87998FC205E74C048BBABCDC91AB00AD"><enum>(1)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/1611">Chapter 1611</external-xref> of title 10, United States Code, is amended by adding at the end the following new section:</text>

<section id="HF2D17ED7444B4919A1F029E54D01F0D5"><enum>16402.</enum><header>District of Columbia National Guard: college financial assistance program</header> 
<subsection id="H5FE7688012AD4AA0ABFC36969FFD9171"><enum>(a)</enum><header>Authority</header><text>The Secretary concerned may provide financial assistance to an eligible member of the National Guard of the District of Columbia for expenses of the member while the member is enrolled in an approved institution of higher education in a degree, certificate, or other program (including a program of study abroad approved for credit by the institution of higher education) leading to a recognized educational credential at the institution of higher education.</text></subsection> 
<subsection id="HF6B3AF88AADB45A2AE3B394890A041DF"><enum>(b)</enum><header>Eligibility</header><text>To be eligible for financial assistance under this section, a member of the National Guard of the District of Columbia must—</text> 
<paragraph id="HCB0114EB059642BB9307F514617C3C1"><enum>(1)</enum><text>be a member of the National Guard of the District of Columbia for not less than the 12 consecutive months preceding the commencement of the tuition assistance;</text></paragraph> 
<paragraph id="H524842C4A80B406BA91E71D8AF88BA16"><enum>(2)</enum><text>be enrolled or accepted for enrollment in a program of education referred to in subsection (a) at an institution of higher education; and</text></paragraph> 
<paragraph id="HC8015592237A4C19BDAA24148E0018BE"><enum>(3)</enum><text>if already enrolled, maintain satisfactory progress in the course of study the member is pursuing in accordance with section 484(c) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1091">20 U.S.C. 1091(c)</external-xref>).</text></paragraph></subsection> 
<subsection id="H450C6A1504294309834B689C86BA8DF8"><enum>(c)</enum><header>Covered expenses</header><text>Expenses for which financial assistance may be provided under this section are—</text> 
<paragraph id="HBCAD183B316645D5A258E32FF7626944"><enum>(1)</enum><text>tuition and fees charged by an approved institution of higher education involved;</text></paragraph> 
<paragraph id="H35FDC5CE8F444B74A352E69E0000D854"><enum>(2)</enum><text>the cost of books; and</text></paragraph> 
<paragraph id="HD3923BB4E7B34524AF94033E30358696"><enum>(3)</enum><text>laboratory expenses.</text></paragraph></subsection> 
<subsection id="H669B1F5921D04C1F91A00B6061F3F9B"><enum>(d)</enum><header>Amount</header> 
<paragraph display-inline="yes-display-inline" id="HF8BA7964DC0D44E8B953C58CC1007290"><enum>(1)</enum><text>The amount of financial assistance provided to a member of the National Guard of the District of Columbia under this section shall be prescribed by the Secretary concerned, but may not exceed $2,500 for any academic year. The Secretary concerned shall prorate assistance under this section for members who pursue a program of education on less than a full-time basis.</text></paragraph> 
<paragraph indent="up1" id="HA6B85A41F0DB4831AA4D4F87CED7912D"><enum>(2)</enum><text>A member may not receive more than $12,500 under this section.</text></paragraph></subsection> 
<subsection id="H9C8E8D0FA44246A1BA23A591D0771462"><enum>(e)</enum><header>Construction</header><text>Nothing in this section shall be construed to require an institution of higher education to alter the institution’s admissions policies or standards in any manner to enable a member of the National Guard of the District of Columbia to enroll in the institution.</text></subsection> 
<subsection id="H5DF3E7D7A6384854BC78933CEBE7569D"><enum>(f)</enum><header>Gifts</header><text>The Secretary concerned may accept, use, and dispose of donations of services or property for purposes of carrying out this section.</text></subsection> 
<subsection id="H74BAAC9CE1BC4DC1BEE53601053215E8"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H9552EF46F07E427A861FA876001DD280"><enum>(1)</enum><text>The term <term>approved institution of higher education</term> means an institution of higher education (as defined in section 101 of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)) that—</text> 
<subparagraph id="H00FFD81C595C40FF83F2045E44F21309"><enum>(A)</enum><text>is eligible to participate in the student financial assistance programs under title IV of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1070">20 U.S.C. 1070 et seq.</external-xref>); and</text></subparagraph> 
<subparagraph id="H37D74289B47C41A1B00049DF00567EDC"><enum>(B)</enum><text>has entered into an agreement with the Secretary concerned containing such conditions as the Secretary may specify, including a requirement that the institution use the funds made available under this section to supplement and not supplant assistance that otherwise would be provided to eligible students from the District of Columbia National Guard.</text></subparagraph></paragraph> 
<paragraph id="H62DE8BC7C46446F58887FA2DC3C92395"><enum>(2)</enum><header>Secretary concerned</header><text>The term ‘Secretary concerned’ means—</text> 
<subparagraph id="H44A5386785F346408273BB3858527D4C"><enum>(A)</enum><text>the Secretary of the Army, in the case of the Army National Guard of the District of Columbia; and</text></subparagraph> 
<subparagraph id="H7038566CDD5F4E13BA00B57F3B636334"><enum>(B)</enum><text>the Secretary of the Air Force, in the case of the Air National Guard of the District of Columbia.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph indent="up1" id="H1885BD48A0D1472B8376D796CE3029E1"><enum>(2)</enum><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>

<subsection id="H2B20384101464750A0EFAD662F00AC82"><enum>(b)</enum><header>Application of amendment</header><text>Financial assistance may be provided under <external-xref legal-doc="usc" parsable-cite="usc/10/16402">section 16402</external-xref> of title 10, United States Code, as added by subsection (a), to eligible members of the National Guard of the District of Columbia described in such section for periods of instruction that begin on or after January 1, 2004.</text></subsection></section>
