<official-title>To amend the Balanced Budget and Emergency Deficit Control Act of 1985 and the Congressional Budget Act of 1974 to extend the discretionary spending caps and the pay-as-you-go requirement, and for other purposes.</official-title>

<section id="H560A757221494B9A9776FA32D5919CB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text> </section> 
<section id="HC9056441180F444D8CCCE94AA34CD43"><enum>2.</enum><header>Extension of the discretionary spending caps</header> 
<subsection id="H55940123B6304CBC85DC4DF7C00900C9"><enum>(a)</enum><header>In general</header><text>Section 251(c) of the Balanced Budget and Emergency Deficit Control Act of 1985 is amended—</text> 
<paragraph id="HEC6D4F519F404A5DABE8A0DE8918965"><enum>(1)</enum><text>in paragraph (2), by inserting a dash after <quote>2005</quote>, by redesignating the remaining matter as subparagraph (B) and moving it two ems to the right, and by inserting before such redesignated matter the following: </text> 
<quoted-block style="OLC" id="HCF6CF468EEBA49E4B531EE05E482B741" display-inline="no-display-inline"> 
<subparagraph id="HFE3A5213E0C6474F968BC4225FC6B662"><enum>(A)</enum><text>for the discretionary category: $822,903,000,000 in new budget authority and $902,920,000,000 in outlays; and</text> </subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HD261A106185F4C629E7521CCB31D5EE"><enum>(2)</enum><text> in paragraph (3), by inserting a dash after <quote>2006</quote>, by redesignating the remaining matter as subparagraph (B) and moving it two ems to the right, and by inserting before such redesignated matter the following: </text>

<paragraph id="H0743874EA0B14ECB9EDA1C7B4CBEC464"><enum>(4) </enum><text>with respect to fiscal year 2007 for the discretionary category: $870,003,000,000 in new budget authority and $900,651,000,000 in outlays; and</text></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEBCED9729B2A412200D8F17D2C16CD"><enum>(b)</enum><header>Expiration</header><text>Section 275 of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900</external-xref> note) is amended by striking subsection (b).</text></subsection></section> 
<section id="H5A53437182744FC7A13CBE68B2AD6088"><enum>3.</enum><header>Extension of pay-as-you-go requirement</header> 
<subsection id="HCF01D6C6944D4B91909973DF006EB1E6"><enum>(a)</enum><header>Purpose</header><text>Section 252(a) of the Balanced Budget and Emergency Deficit Control Act of 1985 is amended by striking <quote>2002</quote> and inserting <quote>2009</quote>.</text></subsection> 
<subsection id="H3078EFB7C20243F4B1007F617550554F"><enum>(b)</enum><header>Sequestration</header><text>Section 252(b)(1) of the Balanced Budget and Emergency Deficit Control Act of 1985 is amended by striking <quote>2002</quote> and inserting <quote>2009</quote>.</text></subsection></section> 
<section id="HF2E2F96D7B494CDC836D7C4865A5CEC3"><enum>4.</enum><header>Automatic budget enforcement for measures considered on the floor</header> 
<subsection id="H6D939AB64254439EAF6E7EE208B818AD"><enum>(a)</enum><header>In general</header><text>Title III of the Congressional Budget Act of 1974 is amended by adding at the end the following new section:</text>

<section id="H9E05AF5D945540740005D0009C58A26B"><enum>316. </enum><header>Budget evasion points of order</header> 
<subsection id="HB1F2A558E67C4780BD68DE00385DCCA8" display-inline="yes-display-inline"><enum>(a)</enum><header>Discretionary spending caps</header><text>It shall not be in order in the House of Representatives or the Senate to consider any bill or resolution (or amendment, motion, or conference report on that bill or resolution) that waives or suspends the enforcement of section 251 of the Balanced Budget and Emergency Deficit Control Act of 1985 or otherwise would alter the spending limits set forth in that section.</text></subsection> 
<subsection id="H09AE89F3641D4307B92B8FD636624033" indent="up1"><enum>(b)</enum><header>Pay-As-You-Go</header><text>It shall not be in order in the House of Representatives or the Senate to consider any bill or resolution (or amendment, motion, or conference report on that bill or resolution) that waives or suspends the enforcement of section 252 of the Balanced Budget and Emergency Deficit Control Act of 1985 or otherwise would alter the balances of the pay-as-you-go scorecard pursuant to that section.</text></subsection> 
<subsection id="HCC9B78D4F77844A99D71DFDC763D24A3" indent="up1"><enum>(c)</enum><header>Directed scoring</header><text>It shall not be in order in the House of Representatives or the Senate to consider any bill or resolution (or amendment, motion, or conference report on that bill or resolution) that directs the scorekeeping of any bill or resolution.</text></subsection> 
<subsection id="HF00DAF981D1A4117817F89E4153BF2F2" indent="up1"><enum>(d)</enum><header>Far-Outyears</header><text>It shall not be in order in the House of Representatives or the Senate to consider any bill or resolution (or amendment, motion, or conference report on that bill or resolution) that contains a provision providing new budget authority or which reduces revenues which first takes effect after the first five fiscal years covered in the most recently adopted concurrent resolution on the budget and would have the effect of reducing the surplus or increasing the deficit in any fiscal year.</text></subsection> 
<subsection id="H1AEC83AC81AC4FB190EDA573D004EE" indent="up1"><enum>(e)</enum><header> Enforcement in the house of representatives</header> 
<paragraph id="HBE4C9B53E302471CBB1DBAAA7EA36651" display-inline="yes-display-inline"><enum>(1)</enum><text>It shall not be in order in the House of Representatives to consider a rule or order that waives the application of this section.</text></paragraph> 
<paragraph id="H5F7B98F1A9BB40A9B5007C292054C370" indent="up1"><enum>(2)</enum><text></text> 
<subparagraph id="HCC3F4ECE48D44E08B3F53DFE93F952FB" display-inline="yes-display-inline"><enum>(A)</enum><text>This subsection shall apply only to the House of Representatives.</text></subparagraph> 
<subparagraph id="H848B90294E6D4041AEC0CA219F2113E" indent="up1"><enum>(B)</enum><text>In order to be cognizable by the Chair, a point of order under this section must specify the precise language on which it is premised.</text></subparagraph> 
<subparagraph id="H1B166864F48F4108869725008EBC5BC3" indent="up1"><enum>(C)</enum><text>As disposition of points of order under this section, the Chair shall put the question of consideration with respect to the proposition that is the subject of the points of order.</text></subparagraph> 
<subparagraph id="HACB9579142D54FC4A1BEC2A6E02EA13B" indent="up1"><enum>(D)</enum><text>A question of consideration under this section shall be debatable for 10 minutes by each Member initiating a point of order and for 10 minutes by an opponent on each point of order, but shall otherwise be decided without intervening motion except one that the House adjourn or that the Committee of the Whole rise, as the case may be.</text></subparagraph> 
<subparagraph id="HC4EDC221E4104F19A995B13912A71207" indent="up1"><enum>(E)</enum><text>The disposition of the question of consideration under this subsection with respect to a bill or joint resolution shall be considered also to determine the question of consideration under this subsection with respect to an amendment made in order as original text.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD14F99FAC32F4D4FBB7C249C22F1E83C"><enum>(b)</enum><header>Waiver and Appeal in the Senate</header><text>Section 904 of the Congressional Budget Act of 1974 is amended—</text> 
<paragraph id="H271C9FFE612441E58B73C3368100B351"><enum>(1)</enum><text>in subsection (c)(1), by inserting <quote>316,</quote> after <quote>313,</quote>; and</text></paragraph> 
<paragraph id="H4FDDFF5DA2194551BAF786003372FEB9"><enum>(2)</enum><text>in subsection (d)(2), by inserting <quote>316,</quote> after <quote>313,</quote>.</text></paragraph></subsection> 
<subsection id="H6B2DBE23ABA7468AB3265BA4A9C06D1"><enum>(c)</enum><header>Table of contents</header><text>The table of contents for the Congressional Budget Act of 1974 is amended by inserting after the item for section 315 the following:</text>

<paragraph id="H58FE920F08854BC9B8D2831682C67E44"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>and</quote> after the semicolon;</text></paragraph> 
<paragraph id="HE6900635D83D4C5D97CB3E2FE4287709"><enum>(2)</enum><text>in subparagraph (C), by striking the period and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HF233B72985AB404CA8F0FB30108B0522"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>

<section id="HF574E35F117D46569951933642F500A4"><enum>6.</enum><header>Accountability in emergency spending</header> 
<subsection id="H12F5D8E4CFE84277B3577183DD5D8883"><enum>(a)</enum><header>OMB emergency criteria</header><text>Section 3 of the Congressional Budget and Impoundment Control Act of 1974 is amended by adding at the end the following new paragraph:</text> 
<quoted-block id="HAD7C6146960042F8B3E24079FA1D345" style="OLC"> 
<paragraph id="H3121375199EB4C0B92939B3818B7CE6"><enum>(11)</enum> 
<subparagraph id="H0EE49106553A4A71B2F36F622100BFC" display-inline="yes-display-inline"><enum>(A)</enum><text>The term <quote>emergency</quote> means a situation that—</text> 
<clause id="H167CA0F6CAD440C4A79DAAFD139D2744"><enum>(i)</enum><text>requires new budget authority and outlays (or new budget authority and the outlays flowing therefrom) for the prevention or mitigation of, or response to, loss of life or property, or a threat to national security; and</text></clause> 
<clause id="HBBD46D23050C4B8DB8A9B89188EA9075"><enum>(ii)</enum><text>is unanticipated.</text></clause></subparagraph> 
<subparagraph id="HA179980DF10D490981D63074A7BF55A4"><enum>(B)</enum><text>As used in subparagraph (A), the term <quote>unanticipated</quote> means that the situation is—</text> 
<clause id="H3013EDEDEEEB4D549F11B74FBD745D53"><enum>(i)</enum><text>sudden, which means quickly coming into being or not building up over time;</text></clause> 
<clause id="HE05EF80130DD4089957ED999C545B643"><enum>(ii)</enum><text>urgent, which means a pressing and compelling need requiring immediate action;</text></clause> 
<clause id="HC27B38BF21E44E0BBF4472B1EC2AB00"><enum>(iii)</enum><text>unforeseen, which means not predicted or anticipated as an emerging need; and</text></clause> 
<clause id="HE0748B94111545D6BFC88B4BF41F7182"><enum>(iv)</enum><text>temporary, which means not of a permanent duration.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H89A01F84711946F6A276BD4F4889CB1F"><enum>(b)</enum><header>Development of guidelines for Application of emergency definition</header><text>Not later than five months after the date of enactment of this Act, the chairmen of the Committees on the Budget (in consultation with the President) shall, after consulting with the chairmen of the Committees on Appropriations and applicable authorizing committees of their respective Houses and the Directors of the Congressional Budget Office and the Office of Management and Budget, jointly publish in the Congressional Record guidelines for application of the definition of emergency set forth in section 3(11) of the Congressional Budget and Impoundment Control Act of 1974.</text></subsection> 
<subsection id="HEF419783C42E4BAA936500ADDF5E88D9"><enum>(c)</enum><header>Separate house vote on emergency designation</header> 
<paragraph id="H9006FF767C344B76A23F05EE0826F2AC" display-inline="yes-display-inline"><enum>(1)</enum><text>Rule XXII of the Rules of the House of Representatives is amended by adding at the end the following new clause:</text> 
<quoted-block style="OLC" id="HDA4033CED3CA410FAE86FB00F5DC0952" display-inline="no-display-inline"> 
<subsection id="H49637B0DD8E74903B568D59D0008844D"><enum>13. </enum><text>In the consideration of any measure for amendment in the Committee of the Whole containing any emergency spending designation, it shall always be in order unless specifically waived by terms of a rule governing consideration of that measure, to move to strike such emergency spending designation from the portion of the bill then open to amendment.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H4BBA943FAF4F4C13B87841316D523883" indent="up1"><enum>(2)</enum><text>The Committee on Rules shall include in the report required by clause 1(d) of rule XI (relating to its activities during the Congress) of the Rules of the House of Representatives a separate item identifying all waivers of points of order relating to emergency spending designations, listed by bill or joint resolution number and the subject matter of that measure.</text></paragraph></subsection> 
<subsection id="H51800E5648A2423A9CC8562EA8B1E80"><enum>(d)</enum><header>Committee notification of emergency legislation</header><text>Whenever the Committee on Appropriations or any other committee of either House (including a committee of conference) reports any bill or joint resolution that provides budget authority for any emergency, the report accompanying that bill or joint resolution (or the joint explanatory statement of managers in the case of a conference report on any such bill or joint resolution) shall identify all provisions that provide budget authority and the outlays flowing therefrom for such emergency and include a statement of the reasons why such budget authority meets the definition of an emergency pursuant to the guidelines described in subsection (b).</text></subsection></section> 
<section id="HD3C2ED0ED58D41389E490045FBDA6A4"><enum>7.</enum><header>Application of budget act points of order to unreported legislation</header> 
<subsection id="HCF9587F18456414485B7A800624F92D1"><enum>(a)</enum><text>Section 315 of the Congressional Budget Act of 1974 is amended by striking <quote>reported</quote> the first place it appears.</text></subsection> 
<subsection id="H0B022D1A529B4232AAE26FCFB8000057"><enum>(b)</enum><text>Section 303(b) of the Congressional Budget Act of 1974 is amended—</text> 
<paragraph id="H789BDE4AB4D94627936EC8C7C803D900"><enum>(1)</enum><text>in paragraph (1), by striking <quote>(A)</quote> and by redesignating subparagraph (B) as paragraph (2) and by striking the semicolon at the end of such new paragraph (2) and inserting a period; and</text></paragraph> 
<paragraph id="H2ED685974FBF4EDCA547621EDE348537"><enum>(2)</enum><text>by striking paragraph (3).</text></paragraph></subsection></section> 
<section id="H1E6C28769AC844508D72769DDAE1B49"><enum>8.</enum><header>Budget compliance statements</header><text display-inline="no-display-inline">Clause 3(d) of rule XIII of the Rules of the House of Representatives is amended by adding at the end the following new subparagraph:</text> 
<quoted-block id="H12ACF163D3A24DDAA4B32E6F4323DB9" style="OLC"> 
<paragraph id="H2A687628A7D74279A973F3BEA3794894"><enum>(4)</enum><text>A budget compliance statement prepared by the chairman of the Committee on the Budget, if timely submitted prior to the filing of the report, which shall include assessment by such chairman as to whether the bill or joint resolution complies with the requirements of sections 302, 303, 306, 311, and 401 of the Congressional Budget Act of 1974 or any other requirements set forth in a concurrent resolution on the budget and may include the budgetary implications of that bill or joint resolution under section 251 or 252 of the Balanced Budget and Emergency Deficit Control Act of 1985, as applicable.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H4267266844DB416F9C8824F0A9AE2128"><enum>9.</enum><header>Requirements for Budget Act waivers in the House of Representatives</header> 
<subsection id="H30194F4981E343E6BC1F6EE0625153A4"><enum>(a)</enum><header>Justification for Budget Act waivers</header><text>Clause 6 of rule XIII of the Rules of the House of Representatives is amended by adding at the end the following new paragraph:</text> 
<quoted-block id="H784AB3A7CDFB414594B3C2DCF11E8D27" style="OLC"> 
<subsection id="H7515FF1591114F0498D176E765E03E16"><enum>(h)</enum><text>It shall not be in order to consider any resolution from the Committee on Rules for the consideration of any reported bill or joint resolution which waives section 302, 303, 311, or 401 of the Congressional Budget Act of 1974, unless the report accompanying such resolution includes a description of the provision proposed to be waived, an identification of the section being waived, the reasons why such waiver should be granted, and an estimated cost of the provisions to which the waiver applies.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H25F09F2A87234567BAC65FEC2B59E7EB"><enum>(b)</enum><header>Separate vote to waive major budget act point of order</header> 
<paragraph id="H01E8D416773C424F86955590183E3567" display-inline="yes-display-inline"><enum>(1)</enum><text>Section 905 of the Congressional Budget Act of 1974 is amended by adding at the end the following new subsection:</text>

<subsection id="H8CEAE5913DB74ADD83FFE910DF43D3B1"><enum>(h)</enum> 
<paragraph id="HDE7097851D24492D8EBAD910A526A1B2" display-inline="yes-display-inline" indent="up1"><enum>(1)</enum><text>It shall not be in order in the House of Representatives to consider a rule or order that waives the application of a major budget act point of order as defined in paragraph (2).</text></paragraph></subsection> 
<paragraph id="H3228F9E1A87D49169FDD093F4EEC67B8" indent="up1"><enum>(2)</enum><text>For the purposes of this subsection, the term <quote>major budget point of order</quote> means any point of order arising under any section listed in section 904.</text></paragraph> 
<paragraph id="H949109FBB3024B40A1D930AB576C759D" indent="up1"><enum>(3)</enum> 
<subparagraph id="H5E1BBCED6FE14818995E93D445813FC7" display-inline="yes-display-inline"><enum>(A)</enum><text>In order to be cognizable by the Chair, a point of order under the sections referenced in paragraph (2) must specify the precise language on which it is premised.</text></subparagraph>

<section id="HE5B7BBE4B4FF4DB78B000796E64C3086"><enum>10.</enum><header>CBO scoring of conference reports</header> 
<subsection id="H9213E59046DF4816AE3FC8B9E233EFE2"><enum>(a)</enum><text>The first sentence of section 402 of the Congressional Budget Act of 1974 is amended as follows:</text> 
<paragraph id="H15912C622DA7485CA98E00F75B426C13"><enum>(1)</enum><text>Insert <quote>or conference report thereon,</quote> before <quote>and submit</quote>.</text></paragraph>
