<official-title>To amend the Communications Act of 1934 to strengthen the limitations on the holding of any license, permit, operating authority by a foreign government or any entity controlled by a foreign government.</official-title>

<section section-type="section-one" id="H4D5ADA10D8EE4D568FB0D02E5E00EF43"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="H3283BAFF95554A57942EFBF3009BF1C7"><enum>2.</enum><header>Foreign government</header><text display-inline="no-display-inline">Title VII of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/601">47 U.S.C. 601 et seq.</external-xref>) is amended by adding at the end thereof the following:</text>

<section id="HFB491F779BE5489886CB7F5278F36939"><enum>715.</enum><header>Limitations on foreign government ownership</header> 
<subsection id="H3B5CACA09B5445C895BC074B30FDA2F8"><enum>(a)</enum><header>Prohibition</header><text>Notwithstanding any other provision of this Act or any other law to the contrary, no license, permit, or operating authority under this Act may be granted to or held by a corporation, joint venture, partnership, other business organization, trust, or other entity after the date of enactment of the &short-title1;, if that corporation, joint venture, partnership, other business organization, trust, or other entity is directly or indirectly controlled by a foreign government or its representative, as determined under <internal-xref idref="H3EDD67B059CB4F1C9740B5C96E87114E" legis-path="715.(c)">subsection (c)</internal-xref>.</text></subsection> 
<subsection id="H85BE817760C449CA89B88F3489E37592"><enum>(b)</enum><header>Prohibition is absolute</header><text>The Commission may not waive the application of <internal-xref idref="H3B5CACA09B5445C895BC074B30FDA2F8" legis-path="715.(a)">subsection (a)</internal-xref> under any other authority granted to the Commission under this or any other Act or under any Commission order or rule.</text></subsection> 
<subsection id="H3EDD67B059CB4F1C9740B5C96E87114E"><enum>(c)</enum><header>Test of control</header><text>A corporation, joint venture, partnership, other business organization, trust, or other entity shall be considered to be directly or indirectly controlled by a foreign government or its representatives if—</text> 
<paragraph id="H784A18D1DF944B7DB03693D9CB2E33EB"><enum>(1)</enum><text>more than 25 percent of the ownership, voting rights, capital stock, or other interest in that corporation or other entity is owned, held, or controlled, directly or indirectly, by a foreign government or its representatives;</text></paragraph> 
<paragraph id="H4101F14C75154373A7699B71FD6FACCE"><enum>(2)</enum><text>a foreign government or its representatives has the authority to approve or disapprove the appointment or employment of any officer of the corporation, joint venture, partnership, other business organization, trust, or other entity; or</text></paragraph> 
<paragraph id="H8DBDBCCE3A654F639E9B5F8859749144"><enum>(3)</enum><text>a foreign government or its representative has the authority to exercise control over such corporation, joint venture, partnership, other business organization, trust, or other entity in any other manner.</text></paragraph></subsection> 
<subsection id="H8DE72478370F442EA23E21102E9F005F"><enum>(d)</enum><header>Representatives</header><text>A representative of a foreign government shall include any person or entity that acts on the instruction of a foreign government.</text></subsection> 
<subsection id="H41CBD796C5D64D08B579B2AD00B922BD"><enum>(e)</enum><header>Enforcement</header><text>The Commission shall—</text> 
<paragraph id="H341B1D559AB74BB8B282F9099968A389"><enum>(1)</enum><text>revoke any license, permit, or operating authority held in violation of <internal-xref idref="H3B5CACA09B5445C895BC074B30FDA2F8" legis-path="715.(a)">subsection (a)</internal-xref>; and</text></paragraph> 
<paragraph id="H4518040AD1384ED5949FD068B29CD2C8"><enum>(2)</enum><text>auction or otherwise reassign any such license, permit, or operating authority revoked under <internal-xref idref="H341B1D559AB74BB8B282F9099968A389" legis-path="715.(e)(1)">paragraph (1)</internal-xref> within 90 days after it is revoked.</text></paragraph></subsection> 
<subsection id="H1468A6BB7C3C4222B78BB73899283ED4"><enum>(f)</enum><header>Transition period</header><text>Notwithstanding <internal-xref idref="H41CBD796C5D64D08B579B2AD00B922BD" legis-path="715.(e)">subsection (e)</internal-xref>, the Commission may not commence enforcement action under that subsection against a corporation, joint venture, partnership, other business organization, trust, or other entity to which this section applies for 6 months following the date of enactment of the &short-title1;.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
