<official-title>To amend title 10, United States Code, and the Homeland Security Act of 2002 to improve the ability of the Department of Defense to establish and maintain Senior Reserve Officer Training Corps units at institutions of higher education, to improve the ability of students to participate in Senior ROTC programs, and to ensure that institutions of higher education provide military recruiters entry to campuses and access to students that is at least equal in quality and scope to that provided to any other employer.</official-title>

<section id="H514B9146364F4F1A943B96B4F9EE1BA2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text> </section> 
<section id="H01BE8B53E5A2403897C9B0264E3E88"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text> 
<paragraph id="HA5DFCA6E72A34133A9FDCAB11734F95"><enum>(1)</enum><text>The Reserve Officers Training Corps (ROTC) program is the most common path for undergraduates to become United States military officers.</text></paragraph> 
<paragraph id="HA981F14EB9DF4A72ABCFA5FB14653937"><enum>(2)</enum><text>The inclusion of both public and private undergraduate institutions in the ROTC program insures a more racially, ethnically, and socially diverse pool for leadership in the higher ranks of the Armed Forces.</text></paragraph> 
<paragraph id="H5BA444C3CBA24043BF87059743282D14"><enum>(3)</enum><text>The majority of both minority officers and female officers in the Armed Forces are acquired through undergraduate ROTC programs.</text></paragraph> 
<paragraph id="HA858675E0EFD4D8688675703F492B108"><enum>(4)</enum><text>The presence of ROTC programs on college campuses benefits even those students who are not enrolled by making them aware of the presence and role of the United States military.</text></paragraph> 
<paragraph id="H003ADE64BB2C4D79B547FCE1F9EC1550"><enum>(5)</enum><text>Land-grant colleges received land from the United States on the condition that they offer some military instruction in addition to their regular curriculum, forming the basis for the Nation’s tradition of college and university acceptance of responsibility to contribute to the Nation’s readiness.</text></paragraph> 
<paragraph id="HBD2C0462C8E8443DB3D982F23ED6B94"><enum>(6)</enum><text>The Armed Forces face a constant challenge in recruiting top-quality personnel that ROTC programs are ideally suited to meet.</text></paragraph> 
<paragraph id="H82424CB4A8B14EAD9EB337912E9F0376"><enum>(7)</enum><text>Military recruiters should have access to college campuses and to college students equal in quality and scope to that provided all other employers.</text></paragraph> 
<paragraph id="HE2E59C075C7C4A06801CAB5721117091"><enum>(8)</enum><text>If any college or university discriminates against ROTC programs or military recruiters, then under current law that college or university becomes ineligible for certain Federal taxpayer support, especially funding for many military and defense programs.</text></paragraph> 
<paragraph id="H50ABFC99051A41C9A3FC65ACB6BFA55E"><enum>(9)</enum><text>The personnel and programs of the Department of Homeland Security and the Department of Energy are mutually dependent upon a high caliber of well-educated, professional leadership in the Armed Forces in order to protect the people and territory of the United States.</text></paragraph> 
<paragraph id="H133C6B7323B840CAA8C924938BDB29D7"><enum>(10)</enum><text>In order to more fully promote the ability of the Nation's Armed Forces to recruit on college campuses and to facilitate the ability of students to participate in ROTC programs on campus, the laws to prevent discrimination against ROTC and military recruiters should be updated.</text></paragraph></section> 
<section id="H4DBA928F7832488F92F0F093213B0039"><enum>3.</enum><header>Prohibition on provision of homeland security-related funding to post-secondary schools that prevent ROTC access or military recruiting on campus</header> 
<subsection id="HEE9B57F3ACF84356AD4DACC6F0372338"><enum>(a)</enum><header>In general</header><text>The Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>) is amended by adding at the end the following new title:</text>

<title id="H52C6E2AA78FD49AB886F2983AED1EEA"><enum>XVIII</enum><header>Additional Provisions</header> 
<section id="HB03DAE41658F4F25A0D1257FEAF0D455"><enum>1801.</enum><header>Prohibition of funds being provided to institutions of higher education that prevent ROTC access or military recruiting on campus</header><text display-inline="no-display-inline">No funds made available for the Department may be provided by contract or by grant to an institution of higher education (including any subelement of such institution) that, by reason of a determination by the Secretary of Defense under subsection (a) or (b) of <external-xref legal-doc="usc" parsable-cite="usc/10/983">section 983</external-xref> of title 10, United States Code, is ineligible for the receipt of a contract or grant from funds specified in subsection (d) of that section.</text></section></title><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H24298669E7844D479EDBE3EDE92D28CA"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of such Act is amended by adding at the end the following new items:</text>

<section id="H0EB8FD21B4184A17894308F73756CB2D"><enum>4.</enum><header>Certification of compliance with ROTC access provisions</header><text display-inline="no-display-inline">Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/10/983">section 983</external-xref> of title 10, United States Code, is amended—</text> 
<paragraph id="H3BBE8DB05144418195F8A2003E419936"><enum>(1)</enum><text>by inserting <quote>(1)</quote> before <quote>No funds</quote>;</text></paragraph> 
<paragraph id="HD87FB305044144BFB136B60857AF8003"><enum>(2)</enum><text>by striking <quote>prevents—</quote> and inserting <quote>prevents, either (or both) of the following:</quote>;</text></paragraph> 
<paragraph id="H06A4DA31DFDA4EBE99F66800E97D00ED"><enum>(3)</enum><text>by striking <quote>(1) the</quote> and inserting <quote>(A) The</quote>;</text></paragraph> 
<paragraph id="HDC1AA9060B76499181FAF15177FB8CF5"><enum>(4)</enum><text>by striking <quote>; or</quote> and inserting a period;</text> </paragraph> 
<paragraph id="HF88E730CA2DD4147B037FE3D95263B47"><enum>(5)</enum><text>by striking <quote>(2) a</quote> and inserting <quote>(B) A</quote>; and</text></paragraph> 
<paragraph id="H66B14F876E984103BA15AF3D8713445B"><enum>(6)</enum><text>by adding at the end the following:</text>

<paragraph id="H03FCD14C08E2415686FD96D207CB5705" indent="up1"><enum>(2)</enum> 
<subparagraph id="H3D0C28436A2A4184A6CAD4F019C37089" display-inline="yes-display-inline"><enum>(A)</enum><text>Not later than 180 days after the date of the enactment of the <short-title>&short-title1;</short-title> and annually thereafter, the Secretary of Defense shall request from each institution of higher education that has students participating in a Senior Reserve Officer Training Corps program during the then-current academic year of that institution a certification that such institution, during the next academic year of the institution, will—</text> 
<clause id="H9DBD672E887A4E54ACCF30C2ED5328" indent="up1"><enum>(i)</enum><text>permit the Secretary of each military department to maintain a unit of the Senior Officer Training Corps (in accordance with subsection (a)) at that institution (or any subelement of that institution), should such Secretary elect to maintain such a unit; and</text></clause> 
<clause id="H74BA2B721D82417FAEB22913137C62E" indent="up1"><enum>(ii)</enum><text>if the Secretary of the military department concerned elects not to establish or maintain a unit of the Senior Reserve Officer Training Corps at that institution, permit a student of that institution (or any subelement of that institution) to enroll in a unit of the Senior Reserve Officer Training Corps at another institution of higher education.</text></clause></subparagraph> 
<subparagraph id="H7842CFD3314E4CBB86F1281B2074AE91" indent="up1"><enum>(B)</enum><text>Any certification under subparagraph (A) shall be made by the president of the institution (or equivalent highest ranking administrative official) and shall be submitted to the Secretary of Defense no later than 90 days after receipt of the request from the Secretary.</text></subparagraph> 
<subparagraph id="HA2A11BB2C6074092A34D22C804D8C9B" indent="up1"><enum>(C)</enum><text>In the case of any institution from which a certification is requested under subparagraph (A), if the Secretary of Defense does not receive a certification in accordance with subparagraph (B), or if the certification does not state that the university will comply with both clauses (i) and (ii) of subparagraph (A) during its next academic year, the Secretary shall make a determination under paragraph (1) as to whether the institution has a policy or practice described in that paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HAA8C618C1F9940F595FC4B5455FFEB29"><enum>5.</enum><header>Equal treatment of military recruiters with other recruiters</header><text display-inline="no-display-inline">Subsection (b)(1) of <external-xref legal-doc="usc" parsable-cite="usc/10/983">section 983</external-xref> of title 10, United States Code, is amended—</text> 
<paragraph id="HC73123D66C7740EE853291B4616400C5"><enum>(1)</enum><text>by striking <quote>entry to campuses</quote> and inserting <quote>access to campuses</quote>; and </text></paragraph> 
<paragraph id="HD23569DC52DA4F7C8B4CDD040060B415"><enum>(2)</enum><text>by inserting before the semicolon at the end the following: <quote>in a manner that is at least equal in quality and scope to the degree of access to campuses and to students that is provided to any other employer</quote>.</text></paragraph></section> 
<section id="H8A8A3A25BBCA4B6692131330B8A6BEE6"><enum>6.</enum><header>Prohibition of funding for post-secondary schools that prevent ROTC access or military recruiting</header> 
<subsection id="H9DEFB08E1FAD4D678616ADAE0177F1EC"><enum>(a)</enum><header>Covered funds</header><text>Subsection (d) of <external-xref legal-doc="usc" parsable-cite="usc/10/983">section 983</external-xref> of title 10, United States Code, is amended—</text> 
<paragraph id="HC3C2EAC47E0045218170847DD118B5F"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="HCF25BC283BD14FBB9D428F70ABA0C686"><enum>(A)</enum><text>by striking <quote>limitation established in subsection (a) applies</quote> and inserting <quote>limitations established in subsections (a) and (b) apply</quote>;</text></subparagraph> 
<subparagraph id="HFD4F5F22EA604E65A7BA3D3DBFB627BA"><enum>(B)</enum><text>in subparagraph (B), by inserting <quote>for any department or agency for which regular appropriations are made</quote> after <quote>made available</quote>; and</text></subparagraph> 
<subparagraph id="H5FD960CA74F6486D9F196F2732669609"><enum>(C)</enum><text>by adding at the end the following new subparagraphs:</text>

<subparagraph id="H3550A64C655E4D3C864738107DB3F767" indent="up1"><enum>(C)</enum><text>Any funds made available for the Department of Homeland Security.</text></subparagraph> 
<subparagraph id="H305FC6BF8D5742B68C03992F3650961E" indent="up1"><enum>(D)</enum><text>Any funds made available for the National Nuclear Security Administration of the Department of Energy.</text></subparagraph> 
<subparagraph id="HD8062A6A37B641249903C261B19B10B5" indent="up1"><enum>(E)</enum><text>Any funds made available for the Department of Transportation.</text></subparagraph> 
<subparagraph id="H5EFA2412249744FDB70647434B603907" indent="up1"><enum>(F)</enum><text>Any funds made available for the Central Intelligence Agency.</text></subparagraph> <after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H9858B799DA1E42DBB800CDAE15A2AD"><enum>(2)</enum><text>by striking paragraph (2).</text></paragraph> </subsection> 
<subsection id="HB238153B5DE446ADAFE20041B738EAB7"><enum>(b)</enum><header>Conforming amendments</header><text></text> 
<paragraph id="H5EF2B13FCF7E4BA4889FEEBF48F8A776" display-inline="yes-display-inline"><enum>(1)</enum><text>Subsection (b) of such section is amended by striking <quote>subsection (d)(2)</quote> and inserting <quote>subsection (d)(1)</quote>.</text></paragraph> 
<paragraph id="H516CFB05FDC641A7814D24369F85EE32" indent="up1"><enum>(2)</enum><text>Subsection (e) of such section is amended by inserting <quote>, to the head of each other department and agency the funds of which are subject to the determination,</quote> after <quote>Secretary of Education</quote>. </text></paragraph></subsection></section> 
<section id="HD47E94DFD9A74A53BA8768D3C782F269"><enum>7.</enum><header>Exclusion of amounts to cover individual payments</header> 
<subsection id="H8F2BE5DCC97F4E0F982CC9E14DE0AA1C"><enum>(a)</enum><header>Codification and extension of exclusion</header><text>Subsection (d) of <external-xref legal-doc="usc" parsable-cite="usc/10/983">section 983</external-xref> of title 10, United States Code, as amended by section 6(a), is further amended—</text> 
<paragraph id="H4C616553042545DCAF1913BAEF1228F2"><enum>(1)</enum><text>by striking <quote>The</quote> after <quote>(1)</quote> and inserting <quote>Except as provided in paragraph (2), the</quote>; and</text></paragraph> 
<paragraph id="HF82A795CB2544A00B398006F44E72DAD"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="HDAD2349F2E0349BE851EB9AA8546FADA" indent="up1"><enum>(2)</enum><text>Any Federal funding specified in paragraph (1) that is provided to an institution of higher education, or to an individual, to be available solely for student financial assistance, related administrative costs, or costs associated with attendance, may be used for the purpose for which the funding is provided.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H19EEAF70E9F548FEB52B478000379E80"><enum>(b)</enum><header>Conforming amendments</header><text>Subsections (a) and (b) of such section are amended by striking <quote>(including a grant of funds to be available for student aid)</quote>. </text></subsection>
<subsection id="HC342C9DF0A734C40ADA001E7F27E93D"><enum>(c)</enum><header>Conforming repeal of codified provision</header><text>Section 8120 of the Department of Defense Appropriations Act, 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/79">Public Law 106–79</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/983">10 U.S.C. 983</external-xref> note), is repealed</text> </subsection></section> 
<section id="H9F35D5246E23482CA80000B7E84EC08E"><enum>8.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply with respect to funds appropriated for fiscal year 2005 and thereafter.</text></section>
