<official-title>To amend the Animal Health Protection Act to direct the Secretary of Agriculture to implement the United States Animal Identification Plan developed by the National Animal Identification Development Team, and for other purposes.</official-title>

<section section-type="section-one" id="H3BFB4265C5844ED59107448DCF4FE89"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title2;</short-title></quote>.</text></section> 
<section id="H99907C7463914ABBA2173E9386876442"><enum>2.</enum><header>Animal identification plan</header><text display-inline="no-display-inline">Section 10411 of the Animal Health Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/8310">7 U.S.C. 8310</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HF05B297B65394B2B9C5F191CD3F317FF"><enum>(f)</enum><header>Animal identification plan</header> 
<paragraph id="H6498FC00669E42ECBBC09AA6C54DAB4"><enum>(1)</enum><header>Definition of animal identification plan</header> 
<subparagraph id="H8E1604F4E9674ADA9BC56B30DB95DC00"><enum>(A)</enum><header>In general</header><text>The term <term>animal identification plan</term> means the United States Animal Identification Plan developed by the National Animal Identification Development Team.</text></subparagraph> 
<subparagraph id="H1536A139AD96476AA636BAC400A5DE67"><enum>(B)</enum><header>Inclusions</header><text>The term <term>animal identification plan</term> includes—</text> 
<clause id="H3020BA5D91FF444A90EE84C435BC079D"><enum>(i)</enum><text>the operational premises identification allocation system;</text></clause> 
<clause id="H224BC2D67E1247029522C7BEFC82F01"><enum>(ii)</enum><text>the operational certification system able to certify State premises and animal number allocation systems;</text></clause> 
<clause id="HA2A059C0566E44FE8C9FED7C9C09C07F"><enum>(iii)</enum><text>the operational premises repository; and</text></clause> 
<clause id="H10B22FB00392481F85251384C152F3A5"><enum>(iv)</enum><text>the operational identification database.</text></clause></subparagraph></paragraph> 
<paragraph id="H7E19D0E4C04C410885E0E7F000603961"><enum>(2)</enum><header>Implementation priority</header><text>Subject to the availability of appropriations and cost-share agreements, the Secretary shall implement the animal identification plan—</text> 
<subparagraph id="H9A971B38B3D648A600F2C27742ED29B"><enum>(A)</enum><text>for beef and dairy cattle that are at least 30 months old on the date of enactment of this subsection, not later than 60 days after the date of enactment of this subsection;</text></subparagraph> 
<subparagraph id="H80C405F22AD747358088A35B3F4DF966"><enum>(B)</enum><text>for all other beef and dairy cattle, not later than 90 days after the date of the enactment of this subsection;</text></subparagraph> 
<subparagraph id="H81996B6C14B444FAA190B71455179397"><enum>(C)</enum><text>for all other ruminate livestock, not later than 180 days after the date of enactment of this subsection; and</text></subparagraph> 
<subparagraph id="H8C213491E7954EAAB1BA9122FB53A8F1"><enum>(D)</enum><text>for all other livestock, not later than 1 year after the date of enactment of this subsection.</text></subparagraph></paragraph> 
<paragraph id="HCD0EF4988BA54CF28E8472C438AAEB24"><enum>(3)</enum><header>Participation by State and third-party vendors</header><text>The Secretary may enter into agreements to collect information for the animal identification plan with States or third-party vendors that meet the requirements of the animal identification plan.</text></paragraph> 
<paragraph id="H534B481720214AEEB5036CED21D9B6F3"><enum>(4)</enum><header>Confidentiality of information</header> 
<subparagraph id="HFE4D0C40C50D44039BDF8BC5326D7335"><enum>(A)</enum><header>In general</header><text>In implementing the animal identification plan, the Secretary shall ensure the privacy of producers by—</text> 
<clause id="H7848EAD926B24D25853BEF11842C0569"><enum>(i)</enum><text>collecting only data necessary to establish and maintain the animal identification plan; and</text></clause> 
<clause id="HDC6457860A8B4A14BDB2A038324C1623"><enum>(ii)</enum><text>maintaining the confidentiality of information collected from producers.</text></clause></subparagraph> 
<subparagraph id="HA55DD8473CD645418F0043EB3E25657"><enum>(B)</enum><header>Nonapplication of foia</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/552">Section 552</external-xref> of title 5, United States Code, shall not apply to the animal identification plan.</text></subparagraph> 
<subparagraph id="H88AE6E6F69FF48BDB576719844A0044"><enum>(C)</enum><header>Application of privacy Act</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/552a">Section 552a</external-xref> of title 5, United States Code, shall apply to any information collected to implement this subsection.</text></subparagraph></paragraph> 
<paragraph id="H08B4D2E09BFB400984C41110F067FCD7"><enum>(5)</enum><header>Financial assistance</header><text>The Secretary may provide financial assistance to producers to assist the producers in complying with the animal identification plan.</text></paragraph> 
<paragraph id="H10E3006D1B334D1200799D809DB1F672"><enum>(6)</enum><header>Authorization of appropriations</header> 
<subparagraph id="H8BB3A3BFCB6241D881F4216876D84EE0"><enum>(A)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this subsection $50,000,000 for fiscal year 2004, of which at least $25,000,000 shall be available to carry out paragraph (5).</text></subparagraph> 
<subparagraph id="H3831B68EEE8F49E3B04000C5C483B2C1"><enum>(B)</enum><header>Use of Commodity Credit Corporation funds</header><text>Subject to subparagraph (C), if less than $50,000,000 is appropriated for fiscal year 2004, the Secretary may use up to $50,000,000 of the funds of the Commodity Credit Corporation to carry out this subsection.</text></subparagraph> 
<subparagraph id="H4290875FF2084F69B67F3522002BE65B"><enum>(C)</enum><header>Limitation on amount of funds</header><text>No more than $50,000,000 may be used to carry out this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HEF98889FAB28487D80A8F57CCBE444EE"><enum>3.</enum><header>Ruminant feed ban</header> 
<subsection id="H1794F7B7150949EB9D8500E3365E9C78"><enum>(a)</enum><header>In general</header><text>The Secretary of Health and Human Services, acting through the Commissioner of Food and Drugs, shall—</text> 
<paragraph id="H592C5B55170749E6864BAD3047E110DB"><enum>(1)</enum><text>monitor the implementation of <external-xref legal-doc="cfr" parsable-cite="cfr/21/589.2000">section 589.2000</external-xref> of title 21, Code of Federal Regulations (relating to animal proteins prohibited in ruminant feed);</text></paragraph> 
<paragraph id="H744ED809CEEF4AAF9090DABED346BAB1"><enum>(2)</enum><text>conduct an annual formal evaluation of the effectiveness and implementation of that section; and</text></paragraph> 
<paragraph id="H7DE8A1BFCF034254B525F58C993CA9DA"><enum>(3)</enum><text>submit to Congress an annual report that describes the formal evaluation.</text></paragraph></subsection> 
<subsection id="HC39CAB059CAE4524927752AD03C5B5F"><enum>(b)</enum><header>Enforcement plan</header> 
<paragraph id="HB3E08E992FE540B5877839933337DC80"><enum>(1)</enum><header>In general</header><text>The Secretary shall develop and implement a plan for enforcing <external-xref legal-doc="cfr" parsable-cite="cfr/21/589.2000">section 589.2000</external-xref> of title 21, Code of Federal Regulations.</text></paragraph> 
<paragraph id="H5F241600D33E4E97835C85CFE8A41C10"><enum>(2)</enum><header>Inclusions</header><text>The plan shall include—</text> 
<subparagraph id="H1ACF0F99D6434A129320AD6353CBDDF5"><enum>(A)</enum><text>a hierarchy of enforcement actions to be taken;</text></subparagraph> 
<subparagraph id="H9F054689029D4F42B87C5B9E40006242"><enum>(B)</enum><text>a timeframe to allow a person subject to <external-xref legal-doc="cfr" parsable-cite="cfr/21/589.2000">section 589.2000</external-xref> of title 21, Code of Federal Regulations, to correct violations; and</text></subparagraph> 
<subparagraph id="H9B8BBCDB2B40452E8010B0AA7E8B4DF2"><enum>(C)</enum><text>a timeframe for subsequent inspections to confirm that violations have been corrected.</text></subparagraph></paragraph></subsection></section>
