<section section-type="section-one" id="H92FCFEA565B94D79A9052FF9B2543BEE"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="HE8336F1E221E4DD1A300621E1939BB1F"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HBC3394491DE742F2A05D9CE7EB3C3412"><enum>(1)</enum><header>Criminal offense against a victim who is a minor</header><text>The term <term>criminal offense against a victim who is a minor</term> has the same meaning as in section 170101(a)(3) of the Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act (<external-xref legal-doc="usc" parsable-cite="usc/42/14071">42 U.S.C. 14071(a)(3)</external-xref>).</text></paragraph> 
<paragraph id="H05B9777209F24D9AAD3661D360C76923"><enum>(2)</enum><header>Minimally sufficient sexual offender registration program</header><text>The term <term>minimally sufficient sexual offender registration program</term> has the same meaning as in section 170102(a) of the Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act (<external-xref legal-doc="usc" parsable-cite="usc/42/14072">42 U.S.C. 14072(a)</external-xref>).</text></paragraph> 
<paragraph id="H18A5A5BD9A6942398D73529E09121C77"><enum>(3)</enum><header>Sexually violent offense</header><text>The term <term>sexually violent offense</term> has the same meaning as in section 170101(a)(3) of the Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act (<external-xref legal-doc="usc" parsable-cite="usc/42/14071">42 U.S.C. 14071(a)(3)</external-xref>).</text></paragraph> 
<paragraph id="HCA59D6E1901449F29BFA1F50325B005B"><enum>(4)</enum><header>Sexually violent predator</header><text>The term <term>sexually violent predator</term> has the same meaning as in section 170102(a) of the Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act (<external-xref legal-doc="usc" parsable-cite="usc/42/14072">42 U.S.C. 14072(a)</external-xref>).</text></paragraph></section> 
<section id="H9D21C370786D4F41AB6095EB15A20923"><enum>3.</enum><header>Establishment of database</header> 
<subsection id="H0DB0816E875544D3906652F6918000E4"><enum>(a)</enum><header>In general</header><text>The Attorney General shall establish a National sex offender registry that—</text> 
<paragraph id="H989EEA797E8D492D8DC3CB79AFD28D75"><enum>(1)</enum><text>makes publicly available, via the Internet, all information required to be submitted by States to the Attorney General under subsection (b); and</text></paragraph> 
<paragraph id="H3AB4EB6052AE4BA3BFC901D24740D4B6"><enum>(2)</enum><text>allows for users of the registry to determine which registered sex offenders are currently residing within a radius, as specified by the user of the registry, of the location indicated by the user of the registry.</text></paragraph></subsection> 
<subsection id="HD858A06103264A7CBCD7A141476678F5"><enum>(b)</enum><header>Information from States</header> 
<paragraph id="H676B4A65E1834516A79FF755AD16A2EC"><enum>(1)</enum><header>In general</header><text>If any person convicted of a criminal offense against a victim who is a minor or a sexually violent offense, or any sexually violent predator, is required to register with a minimally sufficient sexual offender registration program within a State, including a program established under section 170101 of the Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act (<external-xref legal-doc="usc" parsable-cite="usc/42/14017">42 U.S.C. 14017(b)</external-xref>), that State shall submit to the Attorney General—</text> 
<subparagraph id="H7D2DDCDEC5AE4AE7A16351DDD22172D5"><enum>(A)</enum><text>the name and any known aliases of the person;</text></subparagraph> 
<subparagraph id="HBA5892CDE23B45D3BB3CE500734BD321"><enum>(B)</enum><text>the date of birth of the person;</text></subparagraph> 
<subparagraph id="H3812CB409AC94BD7A9B01018CC900025"><enum>(C)</enum><text>the current address of the person and any subsequent changes of that address;</text></subparagraph> 
<subparagraph id="H1A2F8ABEBB53476981D2C445BC4BACA"><enum>(D)</enum><text>a physical description and current photograph of the person;</text></subparagraph> 
<subparagraph id="H95489D36B5A54BD7B15866348F466529"><enum>(E)</enum><text>the nature of and date of commission of the offense by the person; and</text></subparagraph> 
<subparagraph id="H405E78D2673344FBA500173FF13429DB"><enum>(F)</enum><text>the date on which the person is released from prison, or placed on parole, supervised release, or probation.</text></subparagraph></paragraph> 
<paragraph id="H7330708AAB2F4918A8BA283BDFB5F777"><enum>(2)</enum><header>States without registration program</header><text>The Federal Bureau of Investigation shall collect from any person required to register under section 170102(c) of the Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act (<external-xref legal-doc="usc" parsable-cite="usc/42/14072">42 U.S.C. 14072(b)</external-xref>) the information required under paragraph (1), and submit that information to the Attorney General for inclusion in the National sex offender registry established under section 2.</text></paragraph></subsection></section> 
<section id="H03A475CBAB1442EAABDB113507ECA389"><enum>4.</enum><header>Release of high risk inmates</header> 
<subsection id="H5BB4056C4D404D1185F3912F12A6D4E"><enum>(a)</enum><header>Civil commitment proceedings</header> 
<paragraph id="H6593C17BCBA84195BABE72F7855B6485"><enum>(1)</enum><header>In general</header><text>Any State that provides for a civil commitment proceeding, or any equivalent proceeding, shall issue timely notice to the attorney general of that State of the impending release of any person incarcerated by the State who—</text> 
<subparagraph id="H061C734D2FB7461EA3AD7D54007876BD"><enum>(A)</enum><text>is a sexually violent predator; or</text></subparagraph> 
<subparagraph id="H2E19693DEFD94088BB9CA1E972A2D406"><enum>(B)</enum><text>has been deemed by the State to be at high-risk for recommitting any sexually violent offense or criminal offense against a victim who is a minor.</text></subparagraph></paragraph> 
<paragraph id="H80932B755E9F46C8872764F26D24D610"><enum>(2)</enum><header>Review</header><text>Upon receiving notice under paragraph (1), the State attorney general shall consider whether or not to institute a civil commitment proceeding, or any equivalent proceeding required under State law.</text></paragraph></subsection> 
<subsection id="H770DD0C9F6A5493EB44FE8BDE1CDB5D2"><enum>(b)</enum><header>Monitoring of released persons</header> 
<paragraph id="H56B6EE26BCE34A458E8907006D7E00F6"><enum>(1)</enum><header>In general</header><text>Each State shall intensively monitor, for not less than 1 year, any person described under paragraph (2) who—</text> 
<subparagraph id="HD6ADC57147C043D29914DFF146080047"><enum>(A)</enum><text>has been unconditionally released from incarceration by the State; and</text></subparagraph> 
<subparagraph id="H630BA36C7CC647CC88765F9176EF5E41"><enum>(B)</enum><text>has not been civilly committed pursuant to a civil commitment proceeding, or any equivalent proceeding under State law.</text></subparagraph></paragraph> 
<paragraph id="H4E3E8EF4E38048F2AD39DEB24F2000B3"><enum>(2)</enum><header>Applicability</header><text>Paragraph (1) shall apply to—</text> 
<subparagraph id="H5CB9A96546E441DE00B66829267373DF"><enum>(A)</enum><text>any sexually violent predator; or</text></subparagraph> 
<subparagraph id="H4405703093B04A23A84DD08185D5467F"><enum>(B)</enum><text>any person who has been deemed by the State to be at high-risk for recommitting any sexually violent offense or criminal offense against a victim who is a minor.</text></subparagraph></paragraph></subsection></section> 
<section id="H3830F1457AD44EA0919E6D619BC1AAA0"><enum>5.</enum><header>Compliance</header> 
<subsection id="HD7885A47860C4BFEA7AEEF16CDC56460"><enum>(a)</enum><header>Compliance date</header><text>Each State shall have not more than 3 years from the date of enactment of this Act in which to implement the requirements of sections 3 and 4.</text></subsection> 
<subsection id="H1E3292E5AF914917B9D2A9104056D9B"><enum>(b)</enum><header>Ineligibility for funds</header><text>A State that fails to submit the information required under section 3(b) to the Attorney General, or fails to implement the requirements of section 4, shall not receive 25 percent of the funds that would otherwise be allocated to the State under section 20106(b) of the <act-name parsable-cite="VCCLEA94">Violent Crime Control and Law Enforcement Act of 1994</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/13706">42 U.S.C. 13706(b)</external-xref>).</text></subsection> 
<subsection id="HC59D357AEC244A8FA5685EF5D5277320"><enum>(c)</enum><header>Reallocation of funds</header><text>Any funds that are not allocated for failure to comply with this section shall be reallocated to States that comply with sections 3 and 4.</text></subsection></section>
