<legis-type>A BILL</legis-type> 
<official-title>To authorize the Secretary of Transportation to transfer to the Administrator of the National Highway Traffic Safety Administration a certain percentage of apportionments of funds made available from the Highway Trust Fund from States that do not enact laws to prohibit driving under the influence of an illegal drug, and for other purposes.</official-title>

<section id="HA6F48A2129374CD0968FAA48752B2833" section-type="section-one"><enum>1.</enum><header>Driving under the influence of an illegal drug</header> 
<subsection id="H3B53BB24432246EC8518D9A481B7FC17"><enum>(a)</enum><header>Duties</header><text>The Administrator shall—</text> 
<paragraph id="H0A4C517DD3144204AA1EB4C49BED2DD"><enum>(1)</enum><text>advise and coordinate with other Federal agencies on how to address the problem of driving under the influence of an illegal drug;</text></paragraph> 
<paragraph id="H9B09E49EFFDB4653A25BB4BC33698423"><enum>(2)</enum><text>conduct research on the prevention, detection, and prosecution of driving under the influence of an illegal drug; and</text></paragraph> 
<paragraph id="HF2CA2F79D52D44BFBAF243A532382092"><enum>(3)</enum><text>transmit to the Congress on an annual basis a report including—</text> 
<subparagraph id="HA5C4943F0EEB4F40A05D4E6843E0E829"><enum>(A)</enum><text>a description of the extent of the problem of driving under the influence of an illegal drug in each State and any available information relating thereto, including a description of any laws relating to the problem of driving under the influence of an illegal drug;</text></subparagraph> 
<subparagraph id="H4C5E28868DDE4DDDB8985D80A662C9D2"><enum>(B)</enum><text>a description of the progress that each State has made in meeting the requirement of subsection (c); and</text></subparagraph> 
<subparagraph id="HF02B9A5C637445D7AA977E3737809411"><enum>(C)</enum><text>recommendations for addressing the problem of driving under the influence of an illegal drug.</text></subparagraph></paragraph><continuation-text continuation-text-level="subsection">The Administrator shall transmit the first report under paragraph (3) not later than one year after the date of enactment of this Act. </continuation-text></subsection> 
<subsection id="H52EF2F6AAB4E47AC9B1D9B2657D38487"><enum>(b)</enum><header>Transfer of funds</header> 
<paragraph id="HA27649B0E4E64A2DAEE25709611B647B"><enum>(1)</enum><header>Fiscal year 2007</header><text>On October 1, 2006, if a State has not met the requirement of subsection (c), the Secretary shall transfer to the Administrator 1 percent of the funds apportioned to the State on that date under each of paragraphs (1), (3), and (4) of <external-xref legal-doc="usc" parsable-cite="usc/23/104">section 104(b)</external-xref> of title 23, United States Code.</text></paragraph> 
<paragraph id="H9FF4E2E262B748DFB879B4315FAEFD2C"><enum>(2)</enum><header>Fiscal year 2008</header><text>On October 1, 2007, if a State has not met the requirement of subsection (c), the Secretary shall transfer to the Administrator 2 percent of the funds apportioned to the State on that date under each of paragraphs (1), (3), and (4) of <external-xref legal-doc="usc" parsable-cite="usc/23/104">section 104(b)</external-xref> of title 23, United States Code.</text></paragraph> 
<paragraph id="H944AEE8D8D364FD5002B8D141E57DFF3"><enum>(3)</enum><header>Fiscal year 2009</header><text>On October 1, 2008, if a State has not met the requirement of subsection (c), the Secretary shall transfer to the Administrator 4 percent of the funds apportioned to the State on that date under each of paragraphs (1), (3), and (4) of <external-xref legal-doc="usc" parsable-cite="usc/23/104">section 104(b)</external-xref> of title 23, United States Code.</text></paragraph> 
<paragraph id="H4ECA7E03533348EF00E44F9871FE419E"><enum>(4)</enum><header>Fiscal year 2010</header><text>On October 1, 2009, if a State has not met the requirement of subsection (c), the Secretary shall transfer to the Administrator 8 percent of the funds apportioned to the State on that date under each of paragraphs (1), (3), and (4) of <external-xref legal-doc="usc" parsable-cite="usc/23/104">section 104(b)</external-xref> of title 23, United States Code.</text></paragraph> 
<paragraph id="HBA59DADFF8494803AF61591596E18400"><enum>(5)</enum><header>Fiscal year 2011</header><text>On October 1, 2010, if a State has not met the requirement of subsection (c), the Secretary shall transfer to the Administrator 16 percent of the funds apportioned to the State on that date under each of paragraphs (1), (3), and (4) of <external-xref legal-doc="usc" parsable-cite="usc/23/104">section 104(b)</external-xref> of title 23, United States Code.</text></paragraph> 
<paragraph id="H366B0FCEDE9B47DAA03D862870653528"><enum>(6)</enum><header>Fiscal year 2012</header><text>On October 1, 2011, if a State has not met the requirement of subsection (c), the Secretary shall transfer to the Administrator 32 percent of the funds apportioned to the State on that date under each of paragraphs (1), (3), and (4) of <external-xref legal-doc="usc" parsable-cite="usc/23/104">section 104(b)</external-xref> of title 23, United States Code.</text></paragraph> 
<paragraph id="H338E8F14E749468A82C852B36C9D84B6"><enum>(7)</enum><header>Fiscal years thereafter</header><text>On October 1, 2012, and each October 1 thereafter, if a State has not met the requirement of subsection (c), the Secretary shall transfer to the Administrator 50 percent of the funds apportioned to the State on that date under each of paragraphs (1), (3), and (4) of <external-xref legal-doc="usc" parsable-cite="usc/23/104">section 104(b)</external-xref> of title 23, United States Code.</text></paragraph></subsection> 
<subsection id="HC7E674C11D4F4C698BD2357086BFA4BE"><enum>(c)</enum><header>Requirement</header><text>A State meets the requirement of this subsection if—</text> 
<paragraph id="HC4ECD810179C4FC394011E0135F4A8AA"><enum>(1)</enum><text>the State has transmitted to the Administrator a plan for addressing the problem of driving under the influence of an illegal drug that includes enacting a law that—</text> 
<subparagraph id="HBE017B46DF6843569D87CCCCAADC5156"><enum>(A)</enum><text>prohibits an individual from driving under the influence of an illegal drug; and</text></subparagraph> 
<subparagraph id="HFD3D95C12D544139B50991507E9531B3"><enum>(B)</enum><text>includes a mandatory minimum penalty for an individual convicted of driving under the influence of an illegal drug; </text> </subparagraph></paragraph> 
<paragraph id="H3DD87BADD45E4EFC9DBC63AFA848BB77"><enum>(2)</enum><text>the Administrator has approved the plan transmitted under paragraph (1); and </text></paragraph> 
<paragraph id="H5B421BF1DECA494E94CD772E3110C700"><enum>(3)</enum><text>the State has enacted and is enforcing the law included in the plan approved by the Administrator under paragraph (2).</text> </paragraph> </subsection> 
<subsection id="H14C44AB6A1F640FBAC8CB89500CE0090"><enum>(d)</enum><header>Use of transferred funds</header><text>Any funds transferred to the Administrator under subsection (b) shall be used for the purpose of carrying out the duties of the National Highway Traffic Safety Administration.</text></subsection> 
<subsection id="HB35058EEBE35439F93FCFEE003A711DD"><enum>(e)</enum><header>Transfer of obligation authority</header><text></text> 
<paragraph id="H63A406EF3F4A48939323E9D7D1F6676"><enum>(1)</enum><header>In general</header><text>If the Secretary transfers any funds to the Administrator under subsection (b) with respect to a State for a fiscal year, the Secretary shall transfer to the Administrator an amount, determined under paragraph (2), of obligation authority distributed for the fiscal year to the State for Federal-aid highways and highway safety construction programs.</text></paragraph> 
<paragraph id="HBE0AB8332F344F539552DDE21F14DAA"><enum>(2)</enum><header>Amount</header><text>The amount of obligation authority referred to in paragraph (1) shall be determined by multiplying—</text> 
<subparagraph id="H3E4CC3FCAECB4003A1EE3CD4C3536919"><enum>(A)</enum><text>the amount of funds transferred under subsection (b) to the Administrator with respect to a State for the fiscal year, by</text></subparagraph> 
<subparagraph id="HE7D8D02791954092971C16C013475829"><enum>(B)</enum><text>the ratio that—</text> 
<clause id="H0B1A0A48E3534C73957B08A5BCC947A8"><enum>(i)</enum><text>the amount of obligation authority distributed for the fiscal year to the State for Federal-aid highways and highway safety construction programs, bears to</text></clause> 
<clause id="H182AD3288D574967A090E093B4BDCF46"><enum>(ii)</enum><text>the total of the sums apportioned to the State for Federal-aid highways and highway safety construction programs (excluding sums not subject to any obligation limitation) for the fiscal year.</text></clause></subparagraph></paragraph></subsection></section> 
<section id="HA8D9656846534563BBFD74D7CFFB8EB3"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act—</text> 
<paragraph id="H670252A2B06F4DE7949D85309266B75E"><enum>(1)</enum><text>the term <term>Administrator</term> means the Administrator of the National Highway Traffic Safety Administration; and</text></paragraph> 
<paragraph id="H79AF4C9BFD0643E4B0597C4823DE8805"><enum>(2)</enum><text>the term <term>Secretary</term> means the Secretary of Transportation. </text> </paragraph></section>
