<section id="H3920EB798E784396B069D2811FC2991C" section-type="section-one"><enum>1.</enum><header>Transfer of functions</header> 
<subsection id="H8A2B49F74D1448BE0062B08F8DD87229"><enum>(a)</enum><header>Identification of certain countries</header><text>Section 182 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2242">19 U.S.C. 2242</external-xref>) is amended—</text> 
<paragraph id="HF4FF877E079F4DBFA212EE002EA30070"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H06FC050A284F4F78BA81794127244530"><enum>(A)</enum><text>by striking <quote>United States Trade Representative</quote> and inserting <quote>Secretary of Commerce</quote>; and</text></subparagraph> 
<subparagraph id="H0B79DC3BC172477D9D70FF79DC30244D"><enum>(B)</enum><text>by striking <quote>Trade Representative</quote> each subsequent place it appears and inserting <quote>Secretary</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HA72E4867A13343DB8433AB1C262DC4FE"><enum>(2)</enum><text>in subsections (b) through (g), by striking <quote>Trade Representative</quote> each place it appears and inserting <quote>Secretary</quote>. </text></paragraph></subsection> 
<subsection id="H545786C14BC9441D8C15C50066EE18B7"><enum>(b)</enum><header>Enforcement of United States rights under trade agreements and response to certain foreign trade practices</header><text>Chapter 1 of title III of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2411">19 U.S.C. 2411 et seq.</external-xref>) is amended as follows:</text> 
<paragraph id="HBAF1325B48964128A3B3C8F8634C758F"><enum>(1)</enum><text>Section 301(a)(1) is amended by striking <quote>United States Trade Representative</quote> and inserting <quote>Secretary of Commerce</quote>.</text></paragraph> 
<paragraph id="H10DFB4531C1543028C7BAC52DCFBB6D5"><enum>(2)</enum><text>Section 303(b)(1)(A) is amended by striking <quote>United States Trade Representative</quote> and inserting <quote>Secretary of Commerce.</quote></text></paragraph> 
<paragraph id="H3873E46EC588489B8F8DFA70CEACBA32"><enum>(3)</enum><text>Section 301(d)(8) is amended to read as follows:</text>

<paragraph id="HEDE117C9F86A432E88E101AC456FE300"><enum>(4)</enum><text>Sections 301 through 310 are amended by striking <quote>Trade Representative</quote> each place it appears and inserting <quote>Secretary</quote>.</text></paragraph></subsection></section> 
<section id="HE327EB5FD99F4A5882DB87D70086EA96"><enum>2.</enum><header>Applicability</header> 
<subsection id="H87253FD0FF5B425B9C0591EBE98AE3E"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), the amendments made by section 1 shall take effect 90 days after the date of the enactment of this Act.</text></subsection> 
<subsection id="H136E99E4B44F4DE69E46B4F678C3147D"><enum>(b)</enum><header>Pending petitions, investigations, and determinations</header><text>The amendments made by section 1 shall not affect any petition filed before, or investigation pending on, the effective date set forth in subsection (a), under chapter 1 of title III of the Trade Act of 1974. Such petitions and investigations shall proceed as if section 1 had not been enacted. The amendments made by section 1 shall not affect any determination made or action taken under chapter 1 of title III of the Trade Act of 1974 before the effective date set forth in subsection (a).</text></subsection></section> 
<section id="H93BCD558E2254105A92732A6FDD94E8D"><enum>3.</enum><header>Uruguay Round Agreements Act</header> 
<subsection id="HF782DABE11A44070BD4025EB0D68624"><enum>(a)</enum><header>Transfer of certain functions</header><text>Those functions of the United States Trade Representative under the following provisions of the Uruguay Round Agreements Act are transferred to the Secretary of Commerce, effective 90 days after the date of the enactment of this Act:</text> 
<paragraph id="H4FB10D806F6D4D0BA1403E7FE4BC6156"><enum>(1)</enum><text>Section 123.</text></paragraph> 
<paragraph id="H5463DB1EEA0D4C4FBCDFB0DB1D14FCF4"><enum>(2)</enum><text>Paragraphs (5), (6), and (7) of section 124.</text></paragraph> 
<paragraph id="H55859CB58AE949618505DBE9E008438"><enum>(3)</enum><text>Section 127.</text></paragraph> 
<paragraph id="H559F520DF24943D3849667EA6FF6D373"><enum>(4)</enum><text>Subsections (e) and (f) of section 281.</text></paragraph></subsection> 
<subsection id="HED76C4BE2EF74C55B6F10121C944A54B"><enum>(b)</enum><header>Conforming amendments</header><text></text> 
<paragraph id="HFA0BCE7542F442EC00FBA536D1D75F25"><enum>(1)</enum><header>Amendments</header> <text>Section 129 of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3538">19 U.S.C. 3538</external-xref>) is amended—</text> 
<subparagraph id="HEA791936CED4447AA34F5340F0239811"><enum>(A)</enum><text>by striking <quote>Trade Representative</quote> each place it appears and inserting <quote>Secretary of Commerce</quote>;</text></subparagraph> 
<subparagraph id="H6579FE4446354D90A1CEDA6B6D4D7F57"><enum>(B)</enum><text>in subsection (a)(6), by striking <quote>direct the administering authority to</quote>;</text></subparagraph> 
<subparagraph id="HB133F1D873D2450A97FBC7CEDCB3242D"><enum>(C)</enum><text>in subsection (b)—</text> 
<clause id="H856B294B7C594E19B621F6E34D095BC"><enum>(i)</enum><text>in paragraph (1), by striking <quote>the administering authority and</quote>;</text></clause> 
<clause id="H0962C32B2ECC484CA34C7F62F08F22C4"><enum>(ii)</enum><text>in paragraph (2), by striking <quote>shall,</quote> and all that follows through <quote>issue a determination</quote> and inserting <quote>may issue a determination</quote>;</text></clause> 
<clause id="H7A3E8188FDA1463AA6F525CA229EC1EF"><enum>(iii)</enum><text>in paragraph (3), by striking <quote>the administering authority and</quote>; and</text></clause>

<clause id="H6E74EF5622A34B25A3C45F008810B651"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>the date on which</quote> and all that follows through <quote>determination,</quote> and inserting <quote>the date on which the Secretary of Commerce revokes an order pursuant to that determination,</quote>; and</text></clause> 
<clause id="HD5569A364C8E4ECE99E283823BB5FFB5"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>the date on which</quote> and all that follows through the end of the sentence and inserting <quote>the date on which the Secretary of Commerce implements that determination</quote>.</text></clause></subparagraph></paragraph> 
<paragraph id="H39B6C77CDDD14BAC8D430400FCB72FA9"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall take effect 90 days after the date of the enactment of this Act.</text></paragraph></subsection></section>
