<official-title>To amend the Trade Act of 1974 to extend the trade adjustment assistance program to the service sector, and for other purposes.</official-title>

<section id="H729A96E99D5E4980A206184B0056B508" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="H7601191FC9D04715946205D726A52D93"><enum>2.</enum><header>Extension of trade adjustment assistance to services sector</header> 
<subsection id="H6DDB7E1F95374F82968F408D73C7009E"><enum>(a)</enum><header>Adjustment assistance for workers</header><text>Section 221(a)(1)(A) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2271">19 U.S.C. 2271(a)(1)(A)</external-xref>) is amended by striking <quote>firm)</quote> and inserting <quote>firm, and workers in a service sector firm or subdivision of a service sector firm or public agency)</quote>.</text> </subsection> 
<subsection id="HDB80C35F32684E81B4490610D2BC7DE1"><enum>(b)</enum><header>Group eligibility Requirements</header><text>Section 222 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2272">19 U.S.C. 2272</external-xref>) is amended—</text> 
<paragraph id="H35393082C45D4780B1A13EE371D57EAF"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="HEE8CDD7928C64F8DB89F941E091BB9CF"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>agricultural firm)</quote> and inserting <quote>agricultural firm, and workers in a service sector firm or subdivision of a service sector firm or public agency)</quote>;</text></subparagraph> 
<subparagraph id="H7C7A1D6C340648FEB1B550CA0096CC17"><enum>(B)</enum><text>in paragraph (1), by inserting <quote>or public agency</quote> after <quote>of the firm</quote>; and</text></subparagraph>

<paragraph id="HE0ECC1D7CB3B4B5EB4C7EFE0F62449DA"><enum>(2)</enum><text>in subsection (b)—</text> 
<subparagraph id="H874CF8C4A89A4E97B066D016F5EB4D65"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>agricultural firm)</quote> and inserting <quote>agricultural firm, and workers in a service sector firm or subdivision of a service sector firm or public agency)</quote>;</text></subparagraph>

<subsection id="HDF0922CAAD834FBFBD7F1B8D6F615CE9"><enum>(d)</enum><header>Basis for Secretary’s determinations</header> 
<paragraph id="H724EB2D716B94225861878ACB06DDEE8"><enum>(1)</enum><header>Increased imports</header><text>For purposes of subsection (a)(2)(A)(ii), the Secretary may determine that increased imports of like or directly competitive articles or services exist if the workers’ firm or subdivision, or customers of the workers’ firm or subdivision accounting for not less than 20 percent of the sales of the workers’ firm or subdivision, certify to the Secretary that they are obtaining such articles or services from a foreign country.</text></paragraph> 
<paragraph id="H3501FD12C8214FAFAB612CD94477E830"><enum>(2)</enum><header>Obtaining services abroad</header><text>For purposes of subsection (a)(2)(B)(ii), the Secretary may determine that the workers’ firm, subdivision, or public agency has obtained or is likely to obtain like or directly competitive services from a foreign country based on a certification thereof from the workers’ firm, subdivision, or public agency.</text></paragraph> 
<paragraph id="H527EBF8683914EA78574FEABD326BBD6"><enum>(3)</enum><header>Authority of the Secretary</header><text>The Secretary may obtain the certifications under paragraphs (1) and (2) through questionnaires or such other manner as the Secretary determines is appropriate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H453AC873E84749C2B4BBA8C04B6E000"><enum>(c)</enum><header>Training</header><text>Section 236(a)(2)(A) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2296">19 U.S.C. 2296(a)(2)(A)</external-xref>) is amended by striking <quote>$220,000,000</quote> and inserting <quote>$440,000,000</quote>.</text></subsection> 
<subsection id="H8408F557D4D046B5A91B7F7F62F30207"><enum>(d)</enum><header>Definitions</header><text>Section 247 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2319">19 U.S.C. 2319</external-xref>) is amended—</text>

<subsection id="HA67E9E444BDD4D27A2E181E6B9CC44E"><enum>(a)</enum><header>Basis for waiver</header><text>Section 231(c)(1) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2291">19 U.S.C. 2291(c)(1)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph id="HA389A194EAF64423AC3F4BB382F4A802"><enum>(G)</enum><header>Advanced degree or certification</header><text>The worker possesses a postgraduate degree from an institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965) or equivalent foreign institution), or has received an equivalent postgraduate certification in a specialized field, and there is a reasonable expectation of employment at equivalent wages in the foreseeable future.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H999B2ABA4C5A4B7BB30943925956BCBF"><enum>(b)</enum><header>Training programs</header><text>Section 236(a)(5) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2296">19 U.S.C. 2296(a)(5)</external-xref>) is amended—</text>

<subsection id="HCC9A61CCC8664E539700B6B02B6339AC"><enum>(a)</enum><header>Firms</header> 
<paragraph id="H771197F8EA63475B94C868F6ED3B76BE"><enum>(1)</enum><header>Assistance</header><text>Section 251 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2341">19 U.S.C. 2341</external-xref>) is amended—</text> 
<subparagraph id="H221664701E6C49E4833C6F32AC1ED4E6"><enum>(A)</enum><text>in subsection (a), by inserting <quote>or service sector firm</quote> after <quote>(including any agricultural firm</quote>;</text></subparagraph> 
<subparagraph id="H2F9442F746374C2DB03E856D81002C12"><enum>(B)</enum><text>in subsection (c)(1)—</text>

<paragraph id="HFB036C4994964CAA9FCF85BC1750E1F"><enum>(2)</enum><header>Authority of the Secretary</header><text>The Secretary may obtain the certifications under paragraph (1) through questionnaires or such other manner as the Secretary determines is appropriate. The subpoena power described in section 249 shall be extended to the Secretary for purposes of carrying out this subsection.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HCA23F78283374B9EAF054C71411884D2"><enum>(2)</enum><header>Authorization of appropriations</header><text>Section 256(b) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2346">19 U.S.C. 2346(b)</external-xref>) is amended—</text> 
<subparagraph id="H37D583EFE8F64D94AA14E21DC7E9B74"><enum>(A)</enum><text>by striking <quote>$16,000,000</quote> and inserting <quote>$32,000,000</quote>; and</text></subparagraph> 
<subparagraph id="HB53E146CAA8042BDBAC1D1AEF885FEC1"><enum>(B)</enum><text>by adding at the end the following: <quote>If the amount appropriated pursuant to this subsection in any fiscal year is less than the amount authorized to be appropriated by this subsection, the Secretary shall consult with the Committee on Ways and Means and the Committee on Appropriations of the House of Representatives, the Committee on Finance and the Committee on Appropriations of the Senate, and any other committee of appropriate jurisdiction in Congress on allocating the amount so appropriated.</quote>.</text></subparagraph></paragraph>

<subsection id="HC5976B3780C14998BBAF53E8A74276ED"><enum>(b)</enum><header>Collection of data and reports</header> 
<paragraph id="HDE6398B4F0DA44D198CE61B9537B4E50"><enum>(1)</enum><header>Secretary of Labor</header> 
<subparagraph id="HDFDD2ED1CA924179A8B61694E2C2E826" display-inline="yes-display-inline"><enum>(A)</enum><text>Not later than 3 months after the date of the enactment of the Trade Adjustment Assistance Equity Service Workers Act of 2004, the Secretary of Labor shall implement a system to collect data on all adversely affected workers who receive adjustment assistance under this chapter, including the number of workers by State, industry, the cause of dislocation of each worker, the adjustment assistance received by each worker, and outcomes relating to employment, retention, and earnings.</text></subparagraph> 
<subparagraph id="H97760987151946C8BB43EE55AB59617D" indent="up1"><enum>(B)</enum><text>Not later than 16 months after such date of enactment, the Secretary of Labor shall report to the Committee on Ways and Means of the House of Representatives, the Committee on Finance of the Senate, and any other committee of appropriate jurisdiction, on whether changes to eligibility requirements, benefits, or training funding should be made based on the data collected under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="HB704E491B5CC4096833705E970C1E3D"><enum>(2)</enum><header>Secretary of Commerce</header><text>Not later than 6 months after such date of enactment, the Secretary of Commerce shall, in consultation with the Secretary of Labor, conduct a study and report to the Congress on ways to improve the timeliness and coverage of data on trade in services, including methods to identify increased imports due to the relocation of United States firms to foreign countries, and increased imports due to United States firms obtaining services from firms in foreign countries.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HD909C6D77CE843B8806962A6BAF0C0D0" section-type="subsequent-section"><enum>6.</enum><header>Modifications relating to credit for health insurance costs of certain TAA and PBGC pension recipients</header> 
<subsection id="H8D0BDDE810FA4DC593672500E5240387"><enum>(a)</enum><header>Presumptive status as a TAA recipient</header> 
<paragraph id="H20F802E6608548B7B640C5DD277518F"><enum>(1)</enum><header>In general</header><text>Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/26/35">section 35</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new paragraph:</text>

<paragraph id="H8163682FAFF440D9A797E314EF1FC22E"><enum>(5)</enum><header>Presumptive status as a taa recipient</header> 
<subparagraph id="H5674E43AC51D4F808EB600A6B459B599"><enum>(A)</enum><header>In general</header><text>The term <quote>eligible individual</quote> shall include any individual who is covered by a petition filed with the Secretary of Labor under section 221 of the Trade Act of 1974. This paragraph shall apply to any individual only with respect to months which—</text> 
<clause id="HE4AB76800A8A4BCF9CC1962234901682"><enum>(i)</enum><text>end after the date that such petition is so filed, and</text></clause> 
<clause id="H7E06E3C8815A4C39B424EAC40C5F655"><enum>(ii)</enum><text>begin before the Secretary of Labor makes a final determination with respect to such petition.</text></clause></subparagraph> 
<subparagraph id="H3AD61FE800454F02BE35F30BA0056F8"><enum>(B)</enum><header>Exception</header><text>If the Secretary, after consultation with the Secretary of Labor, determines that, at the time of the filing of such petition, there was not reasonable cause to believe that the petition would result in a certification by the Secretary of Labor, with respect to individuals covered by such petition—</text> 
<clause id="H0F64F7CB0EF24992A0ABF8FF71E1AE00"><enum>(i)</enum><text>subparagraph (A) shall not apply to such individuals, and</text></clause> 
<clause id="H10E680F8A11841D896F7AA6741AA2546"><enum>(ii)</enum><text>in the case of any such individual on whose behalf a payment is made under section 7527 with respect to a month described in paragraph (1), the tax imposed under this subtitle for the taxable year of such individual which includes the date of such determination shall be increased by the amount of such payments.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HE945B99FD1904E10929DB260FCBC71F2"><enum>(2)</enum><header>Conforming amendment</header><text>Paragraph (1) of section 7527(d) of such Code is amended by striking <quote>or an eligible alternative TAA recipient (as defined in section 35(c)(3))</quote> and inserting <quote>, an eligible alternative TAA recipient (as defined in section 35(c)(3)), or an individual who is an eligible individual by reason of section 35(c)(5)</quote>. </text></paragraph></subsection> 
<subsection id="H5C3C96C48C14483499683C85E3E49B6"><enum>(b)</enum><header>100 percent credit for first month of health insurance costs</header><text>Subsection (a) of section 35 of such Code is amended by inserting <quote>(100 percent in the case of the taxpayer’s first eligible coverage month)</quote> after <quote>65 percent</quote>.</text></subsection> 
<subsection id="H6B64FF06CC244FC1B0AE3604558F0044"><enum>(c)</enum><header>Additional requirements for individual health insurance costs</header> 
<paragraph id="HA2D7829041FD405F9F1E75D1A356D6BA"><enum>(1)</enum><header>In general</header><text>Subparagraph (A) of section 35(e)(2) of such Code is amended by striking <quote>subparagraphs (B) through (H) of paragraph (1)</quote> and inserting <quote>paragraph (1) (other than subparagraphs (A) and (I) thereof)</quote>. </text></paragraph> 
<paragraph id="H461E26E9DA8A4CA9BBDB79562F3E3766"><enum>(2)</enum><header>Rating system requirement</header><text>Subparagraph (J) of section 35(e)(1) of such Code is amended by adding at the end the following: <quote>Such term does not include any insurance unless the premiums for such insurance are restricted based on a community rating system or rate-band system.</quote>.</text></paragraph></subsection> 
<subsection id="H5544F63620274D39B10778FB42CF0647"><enum>(d)</enum><header>Period of creditable coverage measured from date of separation from employment</header><text></text> 
<paragraph id="HDF73E83881F34A2DA6DBCD7570EC7B38"><enum>(1)</enum><header>In general</header><text>Clause (i) of section 35(e)(2)(B) of such Code is amended by striking <quote>the date on which the individual seeks to enroll in the coverage described in subparagraphs (B) through (H) of paragraph (1)</quote> and inserting <quote>the end of the 30-day period described in paragraph (1)(J)</quote>.</text></paragraph> 
<paragraph id="H8577C9EB56E846B79CE0EBE2BCDA46F"><enum>(2)</enum><header>Special rule for eligible pbgc pension recipients</header> 
<subparagraph id="HFE94F731DA0A44F7A828C1FDDB8F2D7C"><enum>(A)</enum><header>In general</header><text>Subsection (e) of section 35 of such Code is amended by adding at the end the following new paragraph:</text>

<paragraph id="H63A202E1113B4CABAC22E42BD9921FB"><enum>(4)</enum><header>Special rule for eligible pbgc pension recipients</header><text>In the case of an eligible PBGC pension recipient (and any qualifying family member of such recipient), the term <quote>qualified health insurance</quote> shall not include any coverage described in paragraph (1) (other than subparagraphs (A) and (I) thereof) unless such recipient enrolls in such coverage during the 90-day period beginning on the later of—</text> 
<subparagraph id="H09103E06DA644D9C9C0224CCDF7C3840"><enum>(A)</enum><text>the last day of the first month with respect to which such recipient becomes an eligible PBGC pension recipient, or</text></subparagraph> 
<subparagraph id="H3BAF23CA989C40A397A2326D6124BAAC"><enum>(B)</enum><text>the date of the enactment of the Trade Adjustment Assistance Equity for Service Workers Act of 2004.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HB9632F0AFF784A63970094C918D7ADE"><enum>(B)</enum><header>Outreach</header><text>The Secretary of the Treasury shall carry out a program to notify individuals prior to their becoming eligible PBGC pension recipients (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/35">section 35</external-xref> of the Internal Revenue Code of 1986) of the requirement of subsection (e)(4) of such section.</text></subparagraph></paragraph></subsection> 
<subsection id="HD13E0CA983C3488488ACC5A667DF6B6"><enum>(e)</enum><header>Continued qualification of family members after eligible individual becomes medicare eligible</header><text>Subsection (g) of section 35 is amended by redesignating paragraph (9) as paragraph (10) and inserting after paragraph (8) the following new paragraph:</text>

<paragraph id="H36D172CA2E734613BF49D2C9C3EA1A6"><enum>(9)</enum><header>Continued qualification of family members after eligible individual becomes medicare eligible</header><text>In the case of a month which would be an eligible coverage month with respect to an eligible individual but for subsection (f)(2)(A), such month shall be treated as an eligible coverage month with respect to any qualifying family member of such eligible individual (but not with respect to such eligible individual).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H64D38FCEBF604851BBC89EA9088FFDA9"><enum>(f)</enum><header>Offering of Federal fallback coverage in States not offering State qualified health insurance</header> 
<paragraph id="H7BB9E261900E4B63826643F96CFFC20"><enum>(1)</enum><header>Provision of fallback coverage</header> 
<subparagraph id="H2C8A547ABD11477F952767175D4CC480"><enum>(A)</enum><header>In general</header><text>The Director of the Office of Personnel Management jointly with the Secretary of the Treasury shall establish a program under which individuals described in subparagraph (B) are offered enrollment under health benefit plans that are made available under FEHBP.</text></subparagraph> 
<subparagraph id="HCA7E619DAC6B4690AF00F2B837E7CA98"><enum>(B)</enum><header>Individuals described</header><text>For purposes of subparagraph (A), individuals described in this subparagraph are eligible individuals (as defined in subsection (c)(1) of <external-xref legal-doc="usc" parsable-cite="usc/26/35">section 35</external-xref> of the Internal Revenue Code of 1986) who reside in a State in which any qualified health insurance described in subparagraphs (B) through (I) of subsection (e)(1) of such section is not offered. </text></subparagraph></paragraph> 
<paragraph id="HF0BDE7B3CB8647DD9DC4DADACDE2F74E"><enum>(2)</enum><header>Terms and conditions</header><text>The terms and conditions of health benefits plans under paragraph (1) shall be the same as the terms and coverage offered under FEHBP, except that the premium charged for such health benefit plans offered under such paragraph shall be equal to the full premium (including both employer and beneficiary share) charged for such coverage for full-time employees under FEHBP.</text></paragraph> 
<paragraph id="H6D0008D8A96146259C03B96F27DED9B9"><enum>(3)</enum><header>Study</header><text>The Director of the Office of Personnel Management jointly with the Secretary of the Treasury shall conduct a study of the impact of the offering of health benefit plans under this subsection on the terms and conditions, including premiums, for health benefit plans offered under FEHBP and shall submit to Congress, not later than 2 years after the date of the enactment of this Act, a report on such study. Such report may contain such recommendations regarding the establishment of separate risk pools for individuals covered under FEHBP and eligible individuals covered this subsection as may be appropriate to protect the interests of individuals covered under FEHBP.</text></paragraph> 
<paragraph id="H42571AB8BCDD4F6386F437C76C57E190"><enum>(4)</enum><header>FEHBP defined</header><text>For purposes of this subsection, the term <quote>FEHBP</quote> means the Federal Employees Health Benefits Program offered under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/89">chapter 89</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="H6BBA54351C7145E082CD000BA924CAD"><enum>(5)</enum><header>Conforming amendment</header><text>Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/26/35">section 35(e)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text>

<subparagraph id="H2D9C184E8CC841D591BFD3847BA64583"><enum>(K)</enum><text>Coverage under a health benefits plan offered under section 6(e) of the Trade Adjustment Assistance Equity for Service Workers Act of 2004.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HD57985319C4640C697F374A7C26B49BA"><enum>(g)</enum><header>Report to Congress</header><text>Not later than 18 months after the date of the enactment of this Act, the Secretary of the Treasury shall transmit to the Congress a report which includes the recommendations of the Secretary regarding increasing the number eligible individuals who are covered by qualified health insurance, including increasing such number by increasing the credit subsidy under <external-xref legal-doc="usc" parsable-cite="usc/26/35">section 35</external-xref> of the Internal Revenue Code of 1986 to make the premiums for such insurance more affordable. Terms used in this subsection which are defined in such section shall have the meaning given such terms by such section.</text></subsection> 
<subsection id="HE0CA9FA66C9A4217A5FBD96F4ECDB35E"><enum>(h)</enum><header>Effective date</header><text>The amendments made by this section shall apply to months beginning after the date of the enactment of this Act in taxable years ending after such date.</text></subsection> </section>
