<official-title>To amend the Federal Food, Drug, and Cosmetic Act with respect to the sale of prescription drugs through the Internet.</official-title>

<section section-type="section-one" id="HAEBB3EAB7C3E479CA6D971602DF366A8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="H391BDAC54C3B49CCBA6451C2EBA5ACB5"><enum>2.</enum><header>Internet sales of prescription drugs</header> 
<subsection id="H406991605A564E19B5D9B1E31F699B9"><enum>(a)</enum><header>In general</header><text>Chapter 5 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/351">21 U.S.C. 351 et seq.</external-xref>) is amended by inserting after section 503A the following section:</text>

<section id="HAA8F3E6FB51243BC82E08E1FE69BEF07"><enum>503B.</enum><header>Internet sales of prescription drugs</header> 
<subsection id="H91DD659704284F26BD7398B90016C7F6"><enum>(a)</enum><header>Requirements regarding information on Internet site</header> 
<paragraph id="H44F111FC2B294BBCBF175FA0E3E7AB88"><enum>(1)</enum><header>In general</header><text>A person may not dispense a prescription drug pursuant to a sale of the drug by such person if—</text> 
<subparagraph id="HD3F8D8AF98964BF082CD5D6B27ED22E3"><enum>(A)</enum><text>the purchaser of the drug submitted the purchase order for the drug, or conducted any other part of the sales transaction for the drug, through an Internet site; and</text></subparagraph> 
<subparagraph id="HD21E43FBC27A4D3DAF2DE5E520E2CD9F"><enum>(B)</enum><text>such site, or any other Internet site used by such person for purposes of sales of a prescription drug, fails to meet each of the requirements specified in paragraph (2) (other than a site or pages on a site that are not intended to be accessed by purchasers or prospective purchasers or that provide an Internet information location tool within the meaning of section 231(e)(5) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/231">47 U.S.C. 231(e)(5)</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="H8BAAEC2A068045F698333200B57CD055"><enum>(2)</enum><header>Requirements</header><text>With respect to an Internet site, the requirements referred to in subparagraph (B) of paragraph (1) for a person to whom such paragraph applies are as follows:</text> 
<subparagraph id="H52DB87B51A6D417597E0B1D83B86DF0"><enum>(A)</enum><text>Each page of the site shall include either the following information or a link to a page that provides the following information:</text> 
<clause id="HEBBD5CFA8E25489BA55CB4697013B16"><enum>(i)</enum><text>The name of such person; the address of the principal place of business of the person with respect to sales of prescription drugs through the Internet; and the telephone number for such place of business.</text></clause> 
<clause id="H59600D128256420700FA644C67C65060"><enum>(ii)</enum><text>Each State in which the person is authorized by law to dispense prescription drugs.</text></clause> 
<clause id="HEE097DC640F14CA1A6F962ADB37F60EF"><enum>(iii)</enum><text>The name of each individual who serves as a pharmacist for purposes of the site, and each State in which the individual is authorized by law to dispense prescription drugs.</text></clause> 
<clause id="H7355F9E371DF4C76A94545296F11E5DD"><enum>(iv)</enum><text>If the person provides for medical consultations through the site for purposes of providing prescriptions, the name of each individual who provides such consultations; each State in which the individual is licensed or otherwise authorized by law to provide such consultations or practice medicine; and the type or types of health professions for which the individual holds such licenses or other authorizations.</text></clause></subparagraph> 
<subparagraph id="H1F5090B6A04046FFA510D6A16BEA957C"><enum>(B)</enum><text>A link to which paragraph (1) applies shall be displayed in a clear and prominent place and manner, and shall include in the caption for the link the words <quote>licensing and contact information</quote>.</text></subparagraph></paragraph> </subsection> 
<subsection id="H1B99265E914741A390259760E3B5EEEA"><enum>(b)</enum><header>Internet sales without appropriate medical relationships</header> 
<paragraph id="HB253AB69D749459E92C807C851830325"><enum>(1)</enum><header>In general</header><text>A person may not dispense a prescription drug, or sell such a drug, if—</text> 
<subparagraph id="HCC7119B05B674BAB9B2291391300433D"><enum>(A)</enum><text>for purposes of such dispensing or sale, the purchaser communicated with the person through the Internet;</text></subparagraph> 
<subparagraph id="H145AACF9852C47D695E9A9CF00F1B273"><enum>(B)</enum><text>the patient for whom the drug was dispensed or purchased did not, when such communications began, have a prescription for the drug that is valid in the United States;</text></subparagraph> 
<subparagraph id="H16BA64287EFA4C3584CD1E8DBEC400B8"><enum>(C)</enum><text>pursuant to such communications, the person provided for the involvement of a practitioner, or an individual represented by the person as a practitioner, and the practitioner or such individual issued a prescription for the drug that was purchased;</text></subparagraph> 
<subparagraph id="HBA23C109C6274F2C8E60BB848CC5801D"><enum>(D)</enum><text>the person knew, or had reason to know, that the practitioner or the individual referred to in subparagraph (C) did not, when issuing the prescription, have a qualifying medical relationship with the patient; and</text></subparagraph> 
<subparagraph id="H7DB7932CAB524D20898B6DE54CFFCA1"><enum>(E)</enum><text>the person received payment for the dispensing or sale of the drug.</text></subparagraph> <continuation-text continuation-text-level="paragraph">For purposes of subparagraph (E), payment is received if money or other other valuable consideration is received.</continuation-text></paragraph> 
<paragraph id="HBC408BA5DFAF406300CB595F583D8248"><enum>(2)</enum><header>Qualifying medical relationship</header> 
<subparagraph id="HE80A9818B62A4143AE128BD336A8C56C"><enum>(A)</enum><header>In general</header><text>With respect to issuing a prescription for a drug for a patient, a practitioner has a qualifying medical relationship with the patient for purposes of this section if at least one in-person medical evaluation of the patient has been conducted by the practitioner. </text></subparagraph> 
<subparagraph id="HA880041B51464E90B6BE30EE89DF7C02"><enum>(B)</enum><header>In-person medical evaluation</header><text>A medical evaluation by a practitioner is an in-person medical evaluation for purposes of this section if the practitioner is in the physical presence of the patient as part of conducting the evaluation, without regard to whether portions of the evaluation are conducted by other health professionals.</text></subparagraph></paragraph> 
<paragraph id="H62DD2052AAC04DBDB7D4A37C003782AE"><enum>(3)</enum><header>Rules of construction</header> 
<subparagraph id="H4E4BAD7B79DF497797E975182524102F"><enum>(A)</enum><header>Individuals represented as practitioners</header><text>A person who is not a practitioner (as defined in subsection (d)(2)) lacks legal capacity under this section to have a qualifying medical relationship with any patient.</text></subparagraph> 
<subparagraph id="HACE71D4ABF644A339E8F05C248F733F9"><enum>(B)</enum><header>Applicability of requirements</header><text>Paragraph (1) may not be construed as having any applicability beyond this section, and does not affect any State law, or interpretation of State law, concerning the practice of medicine.</text></subparagraph> 
<subparagraph id="H2D2CF018BEFE4CFB838D3CB5ABB269B3"><enum>(C)</enum><header>Standard practice of pharmacy</header><text>Paragraph (1) may not be construed as prohibiting any conduct that is a standard practice in the practice of pharmacy.</text></subparagraph></paragraph> </subsection> 
<subsection id="HED21B03CA4734AB990BC77B4F269DA3F"><enum>(c)</enum><header>Actions by States</header> 
<paragraph id="HFDBBC9A2FE13441A84AC44BC583ED233"><enum>(1)</enum><header>In general</header><text>Whenever an attorney general of any State has reason to believe that the interests of the residents of that State have been or are being threatened or adversely affected because any person has engaged or is engaging in a pattern or practice that violates section 301(l), the State may bring a civil action on behalf of its residents in an appropriate district court of the United States to enjoin such practice, to enforce compliance with such section (including a nationwide injunction), to obtain damages, restitution, or other compensation on behalf of residents of such State, to obtain reasonable attorneys fees and costs if the State prevails in the civil action, or to obtain such further and other relief as the court may deem appropriate.</text></paragraph> 
<paragraph id="HBB782F7110C14ED7B146CBB2210096A4"><enum>(2)</enum><header>Notice</header><text>The State shall serve prior written notice of any civil action under paragraph (1) or (5)(B) upon the Secretary and provide the Secretary with a copy of its complaint, except that if it is not feasible for the State to provide such prior notice, the State shall serve such notice immediately upon instituting such action. Upon receiving a notice respecting a civil action, the Secretary shall have the right—</text> 
<subparagraph id="H5C39291D5C2041A7AA017B03F8569524"><enum>(A)</enum><text>to intervene in such action;</text></subparagraph> 
<subparagraph id="H020A6E70637544ADACF785F410DB2E86"><enum>(B)</enum><text>upon so intervening, to be heard on all matters arising therein; and</text></subparagraph> 
<subparagraph id="HC4C4135AFFF34BB7BBE9981B5EC9B3AC"><enum>(C)</enum><text>to file petitions for appeal.</text></subparagraph></paragraph> 
<paragraph id="H00E9D020AE70426D9C1F49A6C3350779"><enum>(3)</enum><header>Construction</header><text>For purposes of bringing any civil action under paragraph (1), nothing in this chapter shall prevent an attorney general of a State from exercising the powers conferred on the attorney general by the laws of such State to conduct investigations or to administer oaths or affirmations or to compel the attendance of witnesses or the production of documentary and other evidence.</text></paragraph> 
<paragraph id="H56359CA5F0B34DF5B007B14F3D1D38C6"><enum>(4)</enum><header>Venue; service of process</header><text>Any civil action brought under paragraph (1) in a district court of the United States may be brought in the district in which the defendant is found, is an inhabitant, or transacts business or wherever venue is proper under <external-xref legal-doc="usc" parsable-cite="usc/28/1391">section 1391</external-xref> of title 28, United States Code. Process in such an action may be served in any district in which the defendant is an inhabitant or in which the defendant may be found.</text></paragraph> 
<paragraph id="H9F8A0E2A7F4B4651A01218CD07BEF0AF"><enum>(5)</enum><header>Actions by other State officials</header> 
<subparagraph id="H626DD27C857A4393962C907D9FB4692F"><enum>(A)</enum><text>Nothing contained in this section shall prohibit an authorized State official from proceeding in State court on the basis of an alleged violation of any civil or criminal statute of such State.</text></subparagraph> 
<subparagraph id="HCB2415AED64043DF9F5E6787AA1C2BA0"><enum>(B)</enum><text>In addition to actions brought by an attorney general of a State under paragraph (1), such an action may be brought by officers of such State who are authorized by the State to bring actions in such State on behalf of its residents.</text></subparagraph></paragraph></subsection> 
<subsection id="H970DD24E346A49AB8ECFB5E2D4DEE6F9"><enum>(d)</enum><header>Definitions</header> 
<paragraph id="H4060ACB57A8442B5857645284C6E831E"><enum>(1)</enum><header>Internet-related definitions</header><text>For purposes of this section:</text> 
<subparagraph id="HD7BD219485154A70A5989D22540119B"><enum>(A)</enum><text>The term <term>Internet</term> means collectively the myriad of computer and telecommunications facilities, including equipment and operating software, which comprise the interconnected world-wide network of networks that employ the transmission control protocol/internet protocol, or any predecessor or successor protocols to such protocol, to communicate information of all kinds by wire or radio.</text></subparagraph> 
<subparagraph id="H25AD3746F10547809B761DEF6BA62000"><enum>(B)</enum><text>The term <term>link</term>, with respect to the Internet, means one or more letters, words, numbers, symbols, or graphic items that appear on a page of an Internet site for the purpose of serving, when activated, as a method for executing an electronic command—</text> 
<clause id="H08A1B056A4FA4D1BA359E45473FED5EF"><enum>(i)</enum><text>to move from viewing one portion of a page on such site to another portion of the page;</text></clause> 
<clause id="H70C0CAD7DAC24EDFA85B85E7A8964420"><enum>(ii)</enum><text>to move from viewing one page on such site to another page on such site; or</text></clause> 
<clause id="H7DE274C8C2D243F7A5D7CE36A2A9559C"><enum>(iii)</enum><text>to move from viewing a page on one Internet site to a page on another Internet site.</text></clause></subparagraph> 
<subparagraph id="H06AA9EDF2A2A4BC881A7A5ACDA41994D"><enum>(C)</enum><text>The term <term>page</term>, with respect to the Internet, means a document or other file accessed at an Internet site.</text></subparagraph> 
<subparagraph id="H31C382AEE82C4733AC63746E4840D5C6"><enum>(D)</enum> 
<clause display-inline="yes-display-inline" id="H9536186841BA4C9F85006F3648872600"><enum>(i)</enum><text>The terms <term>site</term> and <term>address</term>, with respect to the Internet, mean a specific location on the Internet that is determined by Internet Protocol numbers. Such term includes the domain name, if any.</text></clause> 
<clause indent="up1" id="HB2D0C49CA3BB4EDF8C82082D4797F41E"><enum>(ii)</enum><text>The term <term>domain name</term> means a method of representing an Internet address without direct reference to the Internet Protocol numbers for the address, including methods that use designations such as <quote>.com</quote>, <quote>.edu</quote>, <quote>.gov</quote>, <quote>.net</quote>, or <quote>.org</quote>.</text></clause> 
<clause indent="up1" id="H4DD9403DAA74416900A04EE13D389FE1"><enum>(iii)</enum><text>The term <term>Internet Protocol numbers</term> includes any successor protocol for determining a specific location on the Internet.</text></clause></subparagraph></paragraph> 
<paragraph id="HA34B70DC0EB2460BA6C76948575180F7"><enum>(2)</enum><header>Other definitions</header><text>For purposes of this section:</text> 
<subparagraph id="H47BEC3CEB000486C93A3AD6B48DA94D"><enum>(A)</enum><text>The term <term>practitioner</term> means a practitioner referred to in section 503(b)(1) with respect to issuing a written or oral prescription.</text> </subparagraph> 
<subparagraph id="H8B7CF7D2199F423A83023CAE384C7653"><enum>(B)</enum><text>The term <term>prescription drug</term> means a drug that is subject to section 503(b)(1).</text></subparagraph> 
<subparagraph id="H10490A678A7844DB986B28A97A8CFCC"><enum>(C)</enum><text>The term <term>qualifying medical relationship</term>, with respect to a practitioner and a patient, has the meaning indicated for such term in subsection (b).</text></subparagraph></paragraph></subsection> 
<subsection id="H11F6D2D82E754AD4B8E99F4BD6B34EA"><enum>(e)</enum><header>Interactive computer service; advertising</header><text>No provider of an interactive computer service, as defined in section 230(f)(2) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)(2)</external-xref>), or of advertising services shall be liable under this section for dispensing or selling prescription drugs in violation of this section on account of another person’s selling or dispensing such drugs, provided that the provider of the interactive computer service or of advertising services does not own or exercise corporate control over such person.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H2BCA6621EA4E43EF90FC6D1661002026"><enum>(b)</enum><header>Inclusion as prohibited Act</header><text>Section 301 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) is amended by inserting after paragraph (k) the following:</text> 
<quoted-block act-name="Federal Food, Drug, and Cosmetic Act" id="H2876A4C002714655BA1256E4B06246B1"> 
<subsection id="H59ABA9E8C05D434B87F483CA9E0030D2"><enum>(l)</enum><text>The dispensing or selling of a prescription drug in violation of section 503B.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HBDDA9A2EFA7B4172AC73EA66563DBE67"><enum>(c)</enum><header>Internet sales of prescription drugs; consideration by Secretary of practices and procedures for certification of legitimate businesses</header><text>In carrying out section 503B of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (as added by subsection (a) of this section), the Secretary of Health and Human Services shall take into consideration the practices and procedures of public or private entities that certify that businesses selling prescription drugs through Internet sites are legitimate businesses, including practices and procedures regarding disclosure formats and verification programs.</text></subsection> 
<subsection id="H6F91CFC21E3048C3B6BCD5EA14259F10"><enum>(d)</enum><header>Effective date</header><text>The amendments made by subsections (a) and (b) take effect upon the expiration of the 60-day period beginning on the date of the enactment of this Act, without regard to whether a final rule to implement such amendments has been promulgated by the Secretary of Health and Human Services under section 701(a) of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name>. The preceding sentence may not be construed as affecting the authority of such Secretary to promulgate such a final rule.</text></subsection></section> 
<section id="H357A189D247B4DD5B9B2C7ABE6A17513"><enum>3.</enum><header>Reports regarding internet-related violations of State and Federal laws on dispensing of drugs</header> 
<subsection id="H8173367CBEC6437D90FF9125959F487"><enum>(a)</enum><header>In general</header><text>The Secretary of Health and Human Services (referred to in this section as the <quote>Secretary</quote>) shall, pursuant to the submission of an application meeting the criteria of the Secretary, make an award of a grant or contract to the National Clearinghouse on Internet Prescribing (operated by the Federation of State Medical Boards) for the purpose of—</text> 
<paragraph id="HA5F73E343C6249A88786EE80744B4866"><enum>(1)</enum><text>identifying Internet sites that appear to be in violation of State or Federal laws concerning the dispensing of drugs;</text></paragraph> 
<paragraph id="H2AF8D8AA9A3D458C83A34BA6EF1751D"><enum>(2)</enum><text>reporting such sites to State medical licensing boards and State pharmacy licensing boards, and to the Attorney General and the Secretary, for further investigation; and</text></paragraph> 
<paragraph id="HA718F002A73B4724B17B9490A86E1DA"><enum>(3)</enum><text>submitting, for each fiscal year for which the award under this subsection is made, a report to the Secretary describing investigations undertaken with respect to violations described in paragraph (1).</text></paragraph></subsection> 
<subsection id="H122F7E3434C54D76B68800F9F2008C03"><enum>(b)</enum><header>Authorization of appropriations</header><text>For the purpose of carrying out subsection (a), there is authorized to be appropriated $100,000 for each of the fiscal years 2004 through 2006.</text></subsection></section>
