<paragraph id="H892632BC79A44C978FD68FBD65007B99"><enum>(1)</enum><header>In general</header><text>The Secretary shall issue regulations directing States to develop and provide for the use of a standard form of agreement between each family or group day care sponsoring organization and the family or group day care homes participating in the program under such organization, for the purpose of specifying the rights and responsibilities of each party.</text></paragraph> 
<paragraph id="H417A9420C33540D1BEF0F2E45416A209"><enum>(2)</enum><header>Duration</header><text>An agreement under paragraph (1) shall remain in effect until terminated by either party to the agreement.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD39969AF91EF429A9EE45462004BAAF"><enum>(d)</enum><header>Management improvement initiative</header><text>Section 17(q)(3) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(q)(3)</external-xref>) is amended by striking <quote>1999 through 2003</quote> and inserting <quote>2004 through 2006</quote>.</text></subsection> 
<subsection id="H4B325E279FE045B9BA1DAE18BABE6B6F"><enum>(e)</enum><header>Audits</header><text>Section 17(i) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(i)</external-xref>) is amended to read as follows:</text>

<subsection id="H86C34BD61A514FD3B7392F6E2B7CACD"><enum>(i)</enum><header>Audits</header> 
<paragraph id="H968924F91022485E8823D7AFF5107830"><enum>(1)</enum><header>Funds for audits</header><text>The Secretary shall make available for each fiscal year to State administering the child care food program, for the purpose of conducting audits of participating institutions, an amount up to 1.5 percent (except in the case of fiscal years 2005 through 2007, 1 percent) of the funds used by each State in the program under this section during the second preceding fiscal year.</text></paragraph> 
<paragraph id="HDA25556F99994531B4824E5055CB9D48"><enum>(2)</enum><header>Audit Procedures</header><text></text> 
<subparagraph id="H327910987D7A4F70ACF6E0E426BC01B2"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), in conducting management evaluations, reviews, or audits of the program under their section, the Secretary or a State agency may disregard any overpayment to an institution if the total overpayment for any fiscal year does not exceed an amount, consistent with the disregards allowed in other programs under this Act, which recognizes the cost of collecting small claims.</text></subparagraph> 
<subparagraph id="H5698CB495C40486F882D2F4197FFC74E"><enum>(B)</enum><header>Criminal or fraud violations</header><text>In carrying out this subsection, the Secretary and a State agency shall not disregard any overpayment for which there is evidence of a violation of a criminal law or civil fraud law.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H60382F539DD64B34BE78007BFF81DD75"><enum>(f)</enum><header>Homeless and domestic violence shelters</header><text>Section 17(t)(5)(A)(i)() of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766(t)(5)(A)(i)</external-xref> is amended—</text> 
<paragraph id="H6725CBB8D4CA4B0BA307332DD0A97BA"><enum>(1)</enum><text>in subclause (I)—</text> 
<subparagraph id="HA87A09638B224A4100A21612A451B808"><enum>(A)</enum><text>by striking <quote>12</quote> and inserting <quote>18</quote>; and</text></subparagraph> 
<subparagraph id="H60586892B37348E98C161DC435025ECB"><enum>(B)</enum><text>by inserting <quote>or</quote> after the semicolon; and</text></subparagraph></paragraph> 
<paragraph id="HB42CBB80D6E54FAEAD2CF869ED25EB71"><enum>(2)</enum><text>by striking subclause (II) and redesignating subclause (III) as subclause (II).</text></paragraph></subsection> 
<subsection id="HE4FA0538E373459D8CC9E4A847D1939D"><enum>(g)</enum><header>Paperwork reduction</header><text>The Secretary of Agriculture, in conjunction with States and participating institutions, shall examine the feasibility of reducing paperwork resulting from regulations and record-keeping requirements for family child care homes, child care centers, and sponsoring organizations participating in the child and adult care food program established under section 17 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>).</text></subsection> </section></title> 
<title id="H5C8EB7DF20444A8FB2B604E0F2E19F41"><enum>II</enum><header>Improving Program Quality and Integrity</header> 
<section id="HF25A8241D6AF4540AEEDE1F7FB8D536"><enum>201.</enum><header>Eligibility and Certification for Free and Reduced Price Lunches</header><text display-inline="no-display-inline">Section 9(b) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758</external-xref>) is amended—</text> 
<paragraph id="HB63AE602F3EE4AB5A48C16663F6877C3"><enum>(1)</enum><text>by amending the subsection heading to read as follows:</text> 
<quoted-block style="OLC" id="HBBEA71EDEA9A453593EB7BE2279CC11" display-inline="no-display-inline"> 
<subsection id="H8E88C2AA700C4F108529EADAB6DC152E"><enum>(b)</enum><header>Eligibility for Free and Reduced Price Lunches</header></subsection><after-quoted-block>; and</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="H02C73A0147D34D50B9E01804B403D1AC"><enum>(2)</enum><text>by amending paragraphs (1) and (2) to read as follows:</text> 
<quoted-block style="OLC" id="HC37E9B75FF9140C7AAD8C1FD00CA927F" display-inline="no-display-inline"> 
<paragraph id="H795B5C9BFA5E453BB67873FF89EAE151"><enum>(1)</enum><header>Income Guidelines</header> 
<subparagraph id="HA7B5DD6FFD464716B0396FBB6A5DD00"><enum>(A)</enum><header>In general</header><text>Not later than June 1 of each fiscal year, the Secretary shall prescribe income guidelines for determining eligibility for free and reduced price lunches during the 12-month period beginning July 1 of such fiscal year and ending June 30 of the following fiscal year. The income guidelines for determining eligibility for free lunches shall be 130 percent of the applicable family size income levels contained in the nonfarm income poverty guidelines issued by the Secretary of Health and Human Services, as adjusted annually in accordance with subparagraph (B). The income guidelines for determining eligibility for reduced price lunches for any school year shall be 185 percent of the applicable family size income levels contained in the nonfarm income poverty guidelines issued by the Secretary of Health and Human Services, as adjusted annually in accordance with subparagraph (B). Such guidelines shall be revised at annual intervals, or at any shorter interval deemed feasible and desirable.</text></subparagraph> 
<subparagraph id="H3C953FEA0E104606A5C43DAAFAB278A4"><enum>(B)</enum><header>Formula for revision</header><text>The revision required by subparagraph (A) of this paragraph shall be made by multiplying—</text> 
<clause id="HCCF5D409E0924CB8B69BA073F8DE870"><enum>(i)</enum><text>the official poverty line (as defined by the Secretary of Health and Human Services); by </text></clause> 
<clause id="HB88E711E6E414458B7226F7E6CDFFE37"><enum>(ii)</enum><text>the percentage change in the Consumer Price Index during the annual or other interval immediately preceding the time at which the adjustment is made. </text></clause><continuation-text continuation-text-level="subparagraph">Revisions under this subparagraph shall be made not more than 30 days after the date on which the Consumer Price Index data required to compute the adjustment becomes available.</continuation-text></subparagraph></paragraph> 
<paragraph id="HBBF0422B9EB64B4F96D61955FB65640"><enum>(2)</enum><header>Certification of Eligibility</header><text></text> 
<subparagraph id="H64F246AB775C4F418B17CA98CC390457"><enum>(A)</enum><header>Announcement by State educational agency</header><text>Following the determination by the Secretary under paragraph (1) of this subsection of the income eligibility guidelines for each school year, each State educational agency shall announce the income eligibility guidelines, by family size, to be used by schools in the State in making determinations of eligibility for free and reduced price lunches. Local educational agencies shall, each year, publicly announce the income eligibility guidelines for free and reduced price lunches on or before the opening of school. </text></subparagraph> 
<subparagraph id="H0075BF4B8C2B45B1AE55B45369B891BB"><enum>(B)</enum><header>Applications</header> 
<clause id="HD1C8ED704D524D30B2B58076F5EE3D2B"><enum>(i)</enum><header>In general</header><text>Applications for free and reduced price lunches, in such form as the Secretary may prescribe or approve, and any descriptive material, shall be distributed at least annually to the parents or guardians of children in attendance at the school. </text></clause> 
<clause id="HE6E26D3AC4D84E5E90C429413F594919"><enum>(ii)</enum><header>Income levels</header><text>Applications and descriptive material shall contain only the family size income levels for reduced price meal eligibility, with the explanation that households with incomes less than or equal to these values would be eligible for free or reduced price lunches. Such forms and descriptive material may not contain the income eligibility guidelines for free lunches, and may be made available electronically via the Internet. </text></clause> 
<clause id="H8EA9DC54D5F648B59115F8A8DBE6BA52"><enum>(iii)</enum><header>Notification</header><text>Descriptive materials shall contain a notification that participants in the Special Supplemental Nutrition Program for Women, Infants, and Children authorized under Section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>) or the State program funded under part A of title IV of the Social Security Act are eligible for free or reduced price lunches. </text></clause> 
<clause id="H4FA6381FA71D4ED78E061E5F13AAC7CF"><enum>(iv)</enum><header>Electronic Availability</header><text>Applications and descriptive material may be made available electronically via the Internet.</text></clause></subparagraph> 
<subparagraph id="H43FE3AD61C524488B77D358C19F65870"><enum>(C)</enum><header>Eligibility</header> 
<clause id="HCD346363B7494A9D9C4B1C26F8F33B3C"><enum>(i)</enum><header>Household applications</header> 
<subclause id="HEF0E527355144547BBB9CE06DB9EB788"><enum>(I)</enum><header>In general</header><text>If an eligibility determination for a child is not made under clause (ii) or (iii), an eligibility determination shall be made on the basis of a complete household application executed by an adult member of the household.</text></subclause> 
<subclause id="HE1BBFBA1186248C08B540082423DD3DE"><enum>(II)</enum><header>Eligibility Determinants</header><text>Eligibility may be determined by the local educational agency on the basis of a complete application (including an electronic signature when the application is submitted electronically) executed by an adult member of the household if the application filing system meets confidentiality standards established by the Secretary.</text> </subclause> 
<subclause id="H648A78ECBF034C12B3538E5B5DA79D5E"><enum>(III)</enum><header>Children in household</header><text></text> 
<item id="H9B29A9E111A347218C29D752D7905B2B"><enum>(aa)</enum><header>In general</header><text>The application shall identify the names of each child in the household for whom meal benefits are requested.</text></item> 
<item id="HCD62C4285A164EF7A999F245E900C0B4"><enum>(bb)</enum><header>Separate applications</header><text>A State educational agency or local educational agency may not request a separate application for each child in the household.</text></item></subclause> 
<subclause id="HA789EF5D69E14001A6FD2BB052A3E206"><enum>(IV)</enum><header>Verification</header><text>The Secretary, State, or local educational agency may verify any data contained in such application. In accordance with guidance issued by the Secretary, each local educational agency shall verify the information contained in a sample of approved free and reduced price applications and shall make appropriate changes in the eligibility determination with respect to such applications on the basis of such verification. The sample selected for verification shall be as follows:</text> 
<item id="H24F08B0C99CF44589EC6B6C891CDEBCD"><enum>(aa)</enum><text>For local educational agencies able to obtain verification information for at least 75 percent of all applications selected for verification in the prior year, or local educational agencies receiving more than 20,000 applications and that in the prior year had a verification non-response rate that was 10 percent below the the verification non-response rate of the second prior year, the sample selected shall be either—</text> 
<subitem id="H66A43E1FA6C34B07A5CCA6F93DD710DA"><enum>(AA)</enum><text>the lesser of 3,000 or 3 percent of approved applications selected at random by the local educational agencies from all approved applications; or</text></subitem> 
<subitem id="H5BE2824A60344AFB92E8EBACC9E00DB"><enum>(BB)</enum><text>the lesser of 1,000 or 1 and <fraction>1/2</fraction> percent of all approved applications selected from applications that indicate monthly income that is within $100, or annual income that is within $1,200, of the income eligibility limitation for free or reduced price meals, plus the lesser of 500 or <fraction>1/2</fraction> of 1 percent of approved applications that provided a case number in lieu of income information in accordance with paragraph (6) of this subsection selected from those approved applications that provided a case number in lieu of income information in accordance with paragraph (6) of this subsection.</text></subitem></item> 
<item id="HB6204B84517E458DAE1532037E418CAD"><enum>(bb)</enum><text>For all other local educational agencies, the sample selected shall be the lesser of 3,000 or 3 percent of all approved applications selected from applications that indicate monthly income that is within $100, or annual income that is within $1,200, of the income eligibility limitation for free or reduced price meals. If, for any local educational agency, the total number of such applications is less than 3,000 or 3 percent of all approved applications, the local educational agency shall select additional applications at random from all approved applications in order to obtain a total sample for verification of 3,000 or 3 percent of all approved applications.</text></item> </subclause></clause> 
<clause id="H65912BEB25674074BB2F00295892682C"><enum>(ii)</enum><header>Direct certification for children in food stamp households</header> 
<subclause id="H0916CD602C404FF38E000370A1F34D42"><enum>(I)</enum><header>In general</header><text>Each State agency shall, to the extent practicable, enter into an agreement with the State agency conducting eligibility determinations for the food stamp program established under the Food Stamp Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>).</text></subclause> 
<subclause id="H874934EAA92642C8A7D755160BFABB2"><enum>(II)</enum><header>Procedures</header><text>Subject to clause (iv), the agreement shall establish procedures under which a child who is a member of a household receiving assistance under the program referred to in subclause (I) shall be certified as eligible for free meals under this Act, without further application.</text></subclause> 
<subclause id="H40B5B6C764A04E7B9100C466A5F1E422"><enum>(III)</enum><header>Direct certification</header><text>Subject to clause (iv), under the agreement, the local educational agency conducting eligibility determinations for a school meal program conducted under this Act shall certify a child who is a member of a household receiving assistance under the food stamp program established under the program referred to in subclause (I) as eligible for free meals under this Act without further application.</text></subclause> 
<subclause id="HA06E7CC49B94403C83FCA00002BB050"><enum>(IV)</enum><header>Notice</header><text>The appropriate local educational agency shall provide annually to the parents or guardians of all students who are members of a household receiving assistance under the program referred to in subclause (I), notification, in an understandable and uniform format, that any school-aged child in that household is eligible for free lunches or breakfasts.</text></subclause></clause> 
<clause id="HE3C0595FDEA446DB8B78C34D70389D8C"><enum>(iii)</enum><header>Certification of children in households receiving Temporary Assistance for Needy Families</header><text>Subject to clause (iv), any local educational agency may certify any child as eligible for free lunches or breakfasts, without further application, by directly communicating with the appropriate State or local agency to obtain documentation of such child's status as a member of a family that is receiving assistance under the State program funded under part A of title IV of the Social Security Act that the Secretary determines complies with standards established by the Secretary that ensure that the standards under the State program are comparable to or more restrictive than those in effect on June 1, 1995.</text></clause> 
<clause id="H10F7B7C238EE423783CA5D44D236C9C7"><enum>(iv)</enum><header>Disclosure of information</header><text>The use or disclosure of any information obtained from an application for free or reduced price meals, or from a State or local agency referred to in clauses (ii) and (iii), shall be limited to—</text> 
<subclause id="H9C8A013594FA4C8BA342FCCFC34BDC23"><enum>(I)</enum><text>a person directly connected with the administration or enforcement of this Act or the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>), or a regulation issued pursuant to either Act; </text></subclause> 
<subclause id="H4CD9D3ACB9144B1900E0174902A7D71C"><enum>(II)</enum><text>a person directly connected with the administration or enforcement of—</text> 
<item id="HD5BC6D89689B4398BA90CE2DA499CC68"><enum>(aa)</enum><text>a Federal education program; </text></item> 
<item id="H3CB4BC23313A4A699186A2EAD1BAB8FC"><enum>(bb)</enum><text>a State health or education program administered by the State or local educational agency (other than a program carried out under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>)); or </text></item> 
<item id="HC6A69E5A253A412E98E5ECB918D72755"><enum>(cc)</enum><text>a Federal, State, or local means-tested nutrition program with eligibility standards comparable to the program under this section; and </text></item></subclause> 
<subclause id="H46C1FA22F32548C192E9BD037F2E52E2"><enum>(III)</enum> 
<item id="HDFFABBE0D195495E9531B8003564F2CA" display-inline="yes-display-inline"><enum>(aa)</enum><text> the Comptroller General of the United States for audit and examination authorized by any other provision of law; and </text></item> 
<item id="HBF00B9D9BCD24AEABD4FDDBD7014FD99" indent="up1"><enum>(bb)</enum><text>notwithstanding any other provision of law, a Federal, State, or local law enforcement official for the purpose of investigating an alleged violation of any program requirements under paragraph (1) or this paragraph; and </text></item></subclause> 
<subclause id="HB3E26AF48C624104A2E34B5360FD3B4C"><enum>(IV)</enum><text>a person directly connected with the administration of the State Medicaid program under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) or the State children’s health insurance program under title XXI of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397aa">42 U.S.C. 1397aa et seq.</external-xref>) solely for the purpose of identifying children eligible for benefits under, and enrolling children in, such programs, except that this subclause shall apply only to the extent that the State and the local educational agency so elect. </text></subclause></clause> 
<clause id="H4ED615B16579458CBB2B58068CBCF4D1"><enum>(v)</enum><header>Limitation</header><text>Information provided under clause (iv)(II) shall be limited to the income eligibility status of the child for whom application for free or reduced price meal benefits was made or for whom eligibility information was provided under clause (ii) or (iii), unless the consent of the parent or guardian of the child for whom application for benefits was made is obtained.</text></clause> 
<clause id="H61541090FE6B42DFB37D3DDF49D6E7BC"><enum>(vi)</enum><header>Penalty for unauthorized disclosure</header><text>A person described in clause (iv) who publishes, divulges, discloses, or makes known in any manner, or to any extent not authorized by Federal law (including a regulation), any information obtained under this subsection shall be fined not more than $1,000 or imprisoned not more than 1 year, or both. </text></clause> 
<clause id="HF57CFCAD443847CCAF3D5084AAD23A2"><enum>(vii)</enum><header>Requirements for waiver of confidentiality</header><text>A State that elects to exercise the option described in clause (iv)(IV) shall ensure that any local educational agency acting in accordance with that option—</text> 
<subclause id="HDA4F0B23AEC349A3A1EBCAD5CE405633"><enum>(I)</enum><text>has a written agreement with the State or local agency or agencies administering health insurance programs for children under titles XIX and XXI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref> and 1397aa et seq.) that requires the health agencies to use the information obtained under clause (iv) to seek to enroll children in those health insurance programs; and </text></subclause> 
<subclause id="HDC9F357E7B214D358B472E15B74EB15D"><enum>(II)</enum><text></text> 
<item id="HE1BFEE5099D94292A91B17266594D100" display-inline="yes-display-inline"><enum>(aa)</enum><text>notifies each household, the information of which shall be disclosed under clause (iv), that the information disclosed will be used only to enroll children in health programs referred to in clause (iv)(IV); and </text></item> 
<item id="H7F26EB1DFC5940D683E462CCCB95CD39" indent="up1"><enum>(bb)</enum><text>provides each parent or guardian of a child in the household with an opportunity to elect not to have the information disclosed. </text></item></subclause></clause> 
<clause id="HFCB97C895C4441B7899112BC6F06F700"><enum>(viii)</enum><header>Use of disclosed information</header><text>A person to which information is disclosed under clause (iv)(IV) shall use or disclose the information only as necessary for the purpose of enrolling children in health programs referred to in clause (iv)(IV). </text></clause></subparagraph> 
<subparagraph id="HF93FE5A2D1294AF09783CF4BB2F900C3"><enum>(D)</enum><header>Free and reduced price policy statement</header><text>After the initial submission, a local educational agency shall not be required to submit a free and reduced price policy statement to a State educational agency under this Act unless there is a substantive change in the free and reduced price policy of the local educational agency. A routine change in the policy of a local educational agency, such as an annual adjustment of the income eligibility guidelines for free and reduced price meals, shall not be sufficient cause for requiring the local educational agency to submit a policy statement.</text></subparagraph></paragraph> <after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HBC0BFB06B30746EE8F52B2AA238020A4"><enum>202.</enum><header>Duration of eligibility for free and reduced price lunches</header><text display-inline="no-display-inline">Section 9(b)(3) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(3)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="H4922EB506FC84D1B0047A5FC46F10751" display-inline="no-display-inline"> 
<paragraph id="H170D0C046EE144DBA1876BF600604F7B"><enum>(3)</enum><header>Eligibility for Free and Reduced Price Lunches</header><text></text> 
<subparagraph id="H883A704A4F3F47A6914D5829D8EEAFD"><enum>(A)</enum><header>Free Lunches</header><text>Any child who is a member of a household whose income, at the time the application is submitted, is at an annual rate which does not exceed the applicable family size income level of the income eligibility guidelines for free lunches, as determined under paragraph (1), shall be served a free lunch.</text></subparagraph> 
<subparagraph id="H267DA44E4A4A46DAB8EBDDE4F869D421"><enum>(B)</enum><header>Reduced price lunches</header> 
<clause id="H955C3FBE8C2048F289E530D0B50000D9"><enum>(i)</enum><header>In general</header><text>Any child who is a member of a household whose income, at the time the application is submitted, is at an annual rate greater than the applicable family size income level of the income eligibility guidelines for free lunches, as determined under paragraph (1), but less than or equal to the applicable family size income level of the income eligibility guidelines for reduced price lunches, as determined under paragraph (1), shall be served a reduced price lunch.</text></clause> 
<clause id="HAFE3FF78CB07463D8EEAD8B8BBFC3524"><enum>(ii)</enum><header>Maximum Price</header><text>The price charged for a reduced price lunch shall not exceed 40 cents.</text></clause> </subparagraph> 
<subparagraph id="H498DACB98ACD4B1EB4C12F1BB4AED3D7"><enum>(C)</enum><header>Duration</header><text>Except as otherwise specified in section 11(a), eligibility for free or reduced price meals for any school year shall remain in effect—</text> 
<clause id="H3991131D3F9D43F08318B247DB00C107"><enum>(i)</enum><text>beginning on the date of eligibility approval for the current school year; and</text></clause> 
<clause id="H528D2E9869E44A5F96C7C61EA2741BBA"><enum>(ii)</enum><text>ending on the date of the beginning of school in the subsequent school year or as otherwise specified by the Secretary.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HD44DFF154AD640F4BAEBE5F75300B043"><enum>203.</enum><header>Certification by local educational agencies</header> 
<subsection id="H5CCB331B8FE94D6EB74EF55F15B0BB27"> <enum>(a)</enum><header>Certification by local educational agency</header><text>Section 9 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758</external-xref>) is further amended—</text> 
<paragraph id="HC187E6C3C7154228B5B14DFBE668A565"><enum>(1)</enum><text>in subsection (b)(5), by striking <quote>Local school authorities</quote> and inserting <quote>Local educational agencies</quote>; and</text></paragraph> 
<paragraph id="H71241BFD16CC48A9A2683438AACCB0F3"><enum>(2)</enum><text>in subsection (d)(2)—</text>

<subsection id="HAEACF54E15DA4B1380F56487548300EE"><enum>(b)</enum><header>Definition of local educational agency</header><text>Section 12(d) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1760">42 U.S.C. 1760(d)</external-xref>) is amended</text>

<section id="H0E6A621E3C984DAAA1D64757A56C92CD"><enum>204.</enum><header>Compliance and accountability</header><text display-inline="no-display-inline">Section 22 of the Richard B. Russell National School Lunch Act (42 U.S.C. 1769<italic>c</italic>) is amended by inserting <quote>and local educational agencies</quote> after <quote>food service authorities</quote> each place it appears.</text></section> 
<section id="H0FFBA48798EF417B828D9F55CFC5D950"><enum>205.</enum><header>Technology Improvement</header> 
<subsection id="HB13D79F258EB496FBA9CB846856C366F"><enum>(a)</enum><header>Priority for Reallocated Funds</header><text>Section 7(a)(5)(B)(ii) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1776">42 U.S.C. 1776(a)(5)(B)(ii)</external-xref>) is amended by inserting the following new sentence at the end: <quote>The Secretary shall give priority consideration to States that will use the funds for improvements in technology and information management systems described in subsection (e)(2).</quote></text></subsection> 
<subsection id="H431F39FDFCDF4A5392DEDF66AD67F6BB"><enum>(b)</enum><header>Technology Infrastructure Improvement</header><text>Section 7(e) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1776">42 U.S.C. 1776</external-xref>) is amended—</text> 
<paragraph id="H3FA906897619492C98A1AFCF3777ED00"><enum>(1)</enum><text>by striking <quote>Each State</quote> and inserting <quote>(1) Each State</quote>; and </text></paragraph> 
<paragraph id="H2969D176D5AD48BEBF32BD82B42C87B9"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text>

<subparagraph id="H0288958611D04EC289E0815029DBB6E2" indent="up1"><enum>(B)</enum><text>training schools and school food authorities how to utilize technology and information management systems for activities such as menu planning, collecting point of sale data, and processing applications for free and reduced price meals; and</text></subparagraph> 
<subparagraph id="H690CD71D8A7C45258126F561D1EB13" indent="up1"><enum>(C)</enum><text>using electronic data to establish benchmarks to compare and monitor program integrity, program participation, and financial data across schools and school food authorities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H7B3046DCFEF1440BB2CDBE12DF00BDAC"><enum>(c)</enum><header>Conforming amendment</header><text>Section 7(b) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1776">42 U.S.C. 1776(b)</external-xref>) is amended by striking <quote>and for staff development.</quote> and inserting <quote>; for staff development; and technology and information management systems.</quote>.</text></subsection></section>

<subparagraph id="HAFDF6182661F49D59F7DED967BCDB84"><enum>(B)</enum><header>Minimum amount</header><text>In the case of each of fiscal years 2005 through 2007, the Secretary shall make available to each State for their administrative costs not less than the initial allocation made to the State under this subsection for fiscal year 2004.</text></subparagraph>

<subsection id="H3ED72FE82E6A47CD8EB674ADFB497F0"><enum>(a)</enum><header>Federal support for training and technical assistance</header><text>Section 21 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769b-1">42 U.S.C. 1769b-1</external-xref>) is amended—</text> 
<paragraph id="HD54C086EE7684F45A2B08B7ECC60673F"><enum>(1)</enum><text>by redesignating subsection (e) as subsection (g); and</text></paragraph> 
<paragraph id="H186C97962B46482D9223597E1C735060"><enum>(2)</enum><text>by inserting after subsection (d) the following:</text>

<subsection id="H1DECC00CA83F4682BF3F91EC08474EE4"><enum>(e)</enum><header>Administrative training and technical assistance materials</header><text>In collaboration with State educational agencies, school food authorities, and local educational agencies of varying sizes, the Secretary shall develop and distribute training and technical assistance materials relating to the administration of school meal programs that are—</text> 
<paragraph id="HE18F9E0C31604598BF081C89B6154D94"><enum>(1)</enum><text>prepared by the Secretary (based on research or other sources), a State educational agency, a school food authority, or a local educational agency; and</text></paragraph> 
<paragraph id="H89279AA7AD2A48F38742F4AA27BDB79"><enum>(2)</enum><text>representative of the best management and administrative practices of State agencies, school food authorities, and local educational agencies as determined by the Secretary.</text></paragraph> </subsection> 
<subsection id="HB7502D718AA44CC0B5660945FAD3BEE"><enum>(f)</enum><header>Use of funds</header><text>The Secretary may—</text> 
<paragraph id="H167C1A11C6DA4B0CB072BA43FFF0336"><enum>(1)</enum><text>provide training and technical assistance related to administrative practices designed to improve program integrity and administrative accuracy in school meals programs (including administrative requirements established by the <short-title>&short-title1;</short-title> and amendments made by that Act) to State educational agencies and, to the extent determined by the Secretary, to school food authorities and local educational agencies; and</text></paragraph> 
<paragraph id="H91166B268C694647831200E41D3B002"><enum>(2)</enum><text>assist State educational agencies in reviewing the administrative practices of school food authorities, to the extent determined by the Secretary.</text></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HE220857CA5C14703A0C302DB3C076B9"><enum>(b)</enum><header>Selected administrative reviews</header><text>Section 22(b) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769c">42 U.S.C. 1769c(b)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph id="HE88AD0F4272B41EAA4FC3645AA5742D9"><enum>(A)</enum><header>Definition of selected school food authority or local educational agency</header><text>In this paragraph, the terms <term>selected school food authority</term> and <term>select local educational agency</term> mean a school food authority or local educational agency that has a demonstrated high level of, or a high risk for, administrative error, as determined by the Secretary.</text></subparagraph> 
<subparagraph id="HB532625C069042DBABC8D994E55604A3"><enum>(B)</enum><header>Additional administrative review</header><text>In addition to any review required by subsection (a) or paragraph (1), each State educational agency shall conduct an administrative review of each selected school food authority and local educational agency during the review cycle established under subsection (a).</text></subparagraph> 
<subparagraph id="H6BFAE123BF1043ACAB09A2DC1139DE44"><enum>(C)</enum><header>Scope of review</header><text>In carrying out a review under subparagraph (B), a State educational agency shall only review the administrative processes of a selected school food authority or local educational agency, including application, certification, verification, meal counting, and meal claiming procedures.</text></subparagraph> 
<subparagraph id="H77E7196A5FBF4036AA8C00DD2BB1B132"><enum>(D)</enum><header>Results of review</header><text>If the State educational agency determines (on the basis of a review conducted under subparagraph (B)) that a selected school food authority or local educational agency fails to meet performance criteria established by the Secretary, the State educational agency shall—</text> 
<clause id="H52C41FC78FEA4E53BE3B25A4AC126640"><enum>(i)</enum><text>require the selected school food authority or local educational agency to develop and carry out an approved plan of corrective action;</text></clause> 
<clause id="H6C7E32C0F0824945A9DEF25E76BC2B3"><enum>(ii)</enum><text>except to the extent technical assistance is provided directly by the Secretary, provide technical assistance to assist the selected school food authority or local educational agency in carrying out the corrective action plan; and</text></clause> 
<clause id="HB8CB1D4E81174F1C9D25D521AD27E12C"><enum>(iii)</enum><text>conduct a follow-up review of the selected school food authority or local educational agency under standards established by the Secretary.</text></clause></subparagraph></paragraph> 
<paragraph id="H067AA446BC0D4AB5A84FD631A8701369"><enum>(4)</enum><header>Recovering funds after administrative reviews</header><text></text> 
<subparagraph id="H12675D2FCD8B49B08352E6DF1E953034"><enum>(A)</enum><header>In general</header><text>Subject to subparagraphs (B) and (C), if the school food authority or local educational agency fails to meet administrative performance criteria established by the Secretary in both an initial review and a follow-up review under paragraph (1) or (3) or subsection (a), the Secretary may require the State educational agency to recover funds that would otherwise be paid to the school food authority or local educational agency for school meals programs under procedures prescribed by the Secretary.</text></subparagraph> 
<subparagraph id="H4E7867DF6307406888A5008EAD3CCA9E"><enum>(B)</enum><header>Amount</header><text>The amount of funds recovered under subparagraph (A) shall equal the value of the error during the time period described in subparagraph (C).</text></subparagraph> 
<subparagraph id="HF74E509D48984FF4BC9E0055B4F14937"><enum>(C)</enum><header>Time period</header><text>The period for determining the value of the error under subparagraph (B) shall be the period—</text> 
<clause id="H7803A2571AD044C5BE6DE12502D525FA"><enum>(i)</enum><text>beginning on the date the error was made; and</text></clause> 
<clause id="H1DAB42245D284DD59788428DC0AD6052"><enum>(ii)</enum><text>ending on the earlier of the date the error is corrected or—</text> 
<subclause id="HF5CB8C9944FA4EEC904EEC2C5D7C8489"><enum>(I)</enum><text>in the case of the first review conducted by the State educational agency of the school food authority or local educational agency under this section after July 1, 2005, the date that is 60 days after the beginning of the period under clause (i); or</text></subclause> 
<subclause id="H0EAAD97A7C814D3B97E800A6F45303F0"><enum>(II)</enum><text>in the case of any subsequent review conducted by the State educational agency of the school food authority or local educational agency under this section, the date that is 90 days after the beginning of the period under clause (i).</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H474D16995FCA41DBA183299B07967D3C"><enum>(5)</enum><header>Use of recovered funds</header> 
<subparagraph id="H4BCF95036B2E4589BD0011825E750029"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), funds recovered under paragraph (4) shall—</text> 
<clause id="HB1172928D1304B5A8D5F19DB6FDAA9"><enum>(i)</enum><text>be returned to the Secretary under procedures established by the Secretary, and may be used—</text> 
<subclause id="H0F1522E1FA6245AF89276645E937BCA3"><enum>(I)</enum><text>to provide training and technical assistance related to administrative practices designed to improve program integrity and administrative accuracy in school meals programs (including administrative requirements established by the <short-title>&short-title1;</short-title> and amendments made by that Act) to State educational agencies and, to the extent determined by the Secretary, to school food authorities and local educational agencies;</text></subclause> 
<subclause id="HDD14CEB6810A4616A05308AE23769B42"><enum>(II)</enum><text>to assist State educational agencies in reviewing the administrative practices of school food authorities, to the extent determined by the Secretary; and</text></subclause> 
<subclause id="HF2C6602518CD4EE7BBB05C359D88172F"><enum>(III)</enum><text>to carry out section 21(e); or</text></subclause> 
<subclause id="H40F661941317450894E619E276D2D9C"><enum>(IV)</enum><text>be credited to the child nutrition programs appropriation account.</text></subclause></clause></subparagraph> 
<subparagraph id="HCC94551A34F340C1AA6DA03EFFE953F8"><enum>(B)</enum><header>State share</header><text>Subject to subparagraph (C), a State educational agency may retain not more than 25 percent of an amount recovered under paragraph (4), to carry out school meals program integrity initiatives to assist school food authorities and local educational agencies that have repeatedly failed (as determined by the Secretary) to meet administrative performance criteria.</text></subparagraph> 
<subparagraph id="HC2CB7C9281E444C3AE2B00F0974FC02F"><enum>(C)</enum><header>Requirement</header><text>To be eligible to retain funds under subparagraph (B), a State educational agency shall—</text> 
<clause id="HE23010F54C7D4EB8B00035355FB9C073"><enum>(i)</enum><text>submit to the Secretary a plan describing how the State educational agency will use the funds to improve school meals program integrity, including measures to give priority to school food authorities and local educational agencies from which funds were retained under paragraph (4); and</text></clause> 
<clause id="H9AB4C4C504D546D99B418278ABCD135C"><enum>(ii)</enum><text>obtain the approval of the Secretary for the plan.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE147B39DA9774C24AAED7476005571AF"><enum>(c)</enum><header>Training and technical assistance</header><text>Section 7 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1776">42 U.S.C. 1776</external-xref>) is amended—</text>

<paragraph id="HD2D8A4F7FD974048B1AC2B180021E86E"><enum>(2)</enum><header>Federal role</header><text>The Secretary shall—</text> 
<subparagraph id="H4F13C09F15CB49F8ACF3299086B1AB"><enum>(A)</enum><text>provide training and technical assistance (including training materials and information developed under subsections (e) and (f) of section 21 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769b-1">42 U.S.C. 1769b-1</external-xref>)) to a State to assist the State in carrying out paragraph (1); or</text></subparagraph> 
<subparagraph id="H3F84FAF29331494FA3DDF92EAB7E10C3"><enum>(B)</enum><text>at the option of the Secretary, directly provide training and technical assistance described in paragraph (1).</text></subparagraph></paragraph> 
<paragraph id="H080E5F1EC77A4AFD818CC998C6CD1DCA"><enum>(3)</enum><header>Third-party contracting</header><text>In carrying out this subsection, the Secretary or a State may contract with a third party under procedures established by the Secretary.</text></paragraph> 
<paragraph id="H941162D3E5DD4BC39EFB008F9EC8D566"><enum>(4)</enum><header>Required participation</header><text>Under procedures established by the Secretary that consider the various needs and circumstances of school food authorities, each school food authority or local educational agency shall ensure that an individual conducting or overseeing administrative procedures described in paragraph (1) receives training at least annually, unless determined otherwise by the Secretary.</text></paragraph></subsection> 
<subsection id="HD5ED1A2F4D3244CC9454A641F02B505"><enum>(h)</enum><header>Training and administrative reviews</header><text>The Secretary may assist States in carrying out subsection (g) and administrative reviews of selected school food authorities and local educational agencies under section 22(b)(3) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769c">42 U.S.C. 1769c(b)(3)</external-xref>).</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> </title> 
<title id="HA23EC1E162444C11B100B7BD931B6FD0"><enum>III</enum><header>Promoting Nutrition Quality and Preventing Childhood Obesity</header> 
<section id="HA73D2899816242A687B23EE9BF17252F"><enum>301.</enum><header>Local school wellness policy</header> 
<subsection id="H040506AF5B3E4559A4FC9F6DF4E9562F"><enum>(a)</enum><header>In general</header><text>Not later than the first day of the school year beginning after June 30, 2006, local educational agencies participating in the programs authorized by the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) and the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>) shall establish a local school wellness policy for such local agency that at a minimum—</text> 
<paragraph id="H38B701961DF44B8A99804B05AE43CC50"><enum>(1)</enum><text>includes goals for nutrition education, physical activity and other school-based activities designed to promote student wellness that the local educational agency determines are appropriate;</text></paragraph> 
<paragraph id="HC9AF10250F914DF983FFEC2BE1EAB9A6"><enum>(2)</enum><text>includes nutrition guidelines selected by the local educational agencies for all foods sold on school campus during the school day with the objective of promoting student health and reducing childhood obesity;</text></paragraph> 
<paragraph id="H70EBD751DA364EF5AF7D069C5E5464A"><enum>(3)</enum><text>establishes a plan for ensuring implementation of the local wellness policy, including designation of a person or persons within the local educational agency, or at each school as appropriate, charged with operational responsibility for ensuring that such school meets the local wellness policy; and</text></paragraph> 
<paragraph id="H2BB4DCA22D3F4FF8907BCC059F8EE69E"><enum>(4)</enum><text>involves parents, students, representatives of the school food authority, the school board, school administrators, and public in the development of the school wellness policy.</text> </paragraph></subsection></section> 
<section id="HFC106C1BC4E0429FBBE5402D853F9F39"><enum>302.</enum><header>Supporting Nutrition Education, Improving Meal Quality, and Access to Local Foods</header> 
<subsection id="H97AD23E4108C45919C132D11C2016BF4"><enum>(a)</enum><header>In general</header><text>Section 19 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1788">42 U.S.C. 1788</external-xref>) is amended—</text> 
<paragraph id="H1DC0331FF1E94A2A00162FAA299F8141"><enum>(1)</enum><text>by amending subsection (b) to read as follows:</text> 
<quoted-block style="OLC" id="HE0742C91142843D0AB06A27F00EA74A3" display-inline="no-display-inline"> 
<subsection id="HF162D9E496E249CB8416E0987995F344"><enum>(b)</enum><header>Purpose</header><text>It is the purpose of this section to establish a system of grants to State educational agencies to support effective nutrition education through assistance to State agencies, schools, and nonprofit entities for Team Nutrition and other nutrition education projects that improve student understanding of healthful eating patterns, the quality of school meals and access to local foods in schools and institutions operating programs under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) and section 4 of this Act.</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph> 
<paragraph id="H5BE35CD74F184F509F87FC2BB878867E"><enum>(2)</enum><text>by striking subsections (c) through (h) and inserting after subsection (b) the following:</text> 
<quoted-block style="OLC" id="HD2114643717246F500969842FAD7CADE" display-inline="no-display-inline"> 
<subsection id="HF8A70AC6549A4897A0784BAD5066778C"><enum>(c)</enum><header>Team Nutrition Network</header> 
<paragraph id="H6F4432636D4C459F98B6CF93F3B4A0CC"><enum>(1)</enum><header>Purpose</header><text>The purpose of the Team Nutrition Network is to—</text> 
<subparagraph id="H3EE00F3E9C034E99B446C3009C64B7B6"><enum>(A)</enum><text>promote the nutritional health of the Nation's school children through nutrition education, physical fitness and other activities that support healthy lifestyles for children;</text></subparagraph> 
<subparagraph id="HDAC569D35BA04F8ABFC5F40DB8F0005"><enum>(B)</enum><text>provide grants to States for the development of State-wide, comprehensive, and integrated nutrition education and physical fitness programs; and</text></subparagraph> 
<subparagraph id="H75C21535E7224C0B8EC1EB7DA23A13B"><enum>(C)</enum><text>provide training and technical assistance to States, school and community nutrition programs, and child nutrition food service professionals.</text></subparagraph></paragraph> 
<paragraph id="HE38AB1D272CE431EAB00718963FD79C"><enum>(2)</enum><header>State coordinator</header><text>The State Team Nutrition Network Coordinator shall—</text> 
<subparagraph id="HEB7DFB7400A34F7294B4CC63DD0113EA"><enum>(A)</enum><text>administer and coordinate a comprehensive integrated statewide nutrition education program; and</text></subparagraph> 
<subparagraph id="HA5EF2EEE24D94B048DD53B4C06EE8BB"><enum>(B)</enum><text>coordinate efforts with the Food and Nutrition Service and State agencies responsible for children's health programs.</text></subparagraph></paragraph> 
<paragraph id="HEB79F1A48ED648139D92E58FD3414656"><enum>(3)</enum><header>Team Nutrition Network</header><text>The Secretary, in consultation with the Secretary of Education, shall, on a competitive basis, provide assistance to States for the purpose of creating model nutrition education and physical fitness programs, consistent with current dietary and fitness guidelines, for students in elementary schools and secondary schools. </text></paragraph> 
<paragraph id="H35F99FD85F4D4A27A219DA20BF005FF4"><enum>(4)</enum><header>Requirements for State Participation</header><text>To be eligible to receive assistance under this subsection, a State Coordinator shall submit an application to the Secretary at such time, an in such manner, and containing such information as the Secretary may require, including—</text> 
<subparagraph id="H54D3256686EB4B1A975856EFB7F8FE2"><enum>(A)</enum><text>a description of how the proposed nutrition and physical activity program will promote healthy eating and physical fitness and address the health and social consequences of children who are overweight or obese;</text></subparagraph> 
<subparagraph id="HD91742DFE79D433FBBCB0076D6377800"><enum>(B)</enum><text>information describing how nutrition activities are to be coordinated at the State level with other health activities conducted by education, health and agriculture agencies;</text></subparagraph> 
<subparagraph id="HDF4113926EBC4ABC93E6B0DE497EAA5E"><enum>(C)</enum><text>information describing how physical fitness activities are to be coordinated at the State level with other fitness activities conducted by education, health, and parks and recreation agencies;</text></subparagraph> 
<subparagraph id="H4170C9C9E7D24898B4DF25309ED34F26"><enum>(D)</enum><text>a description of the consultative process that the State Coordinator employed in the development of the model nutrition and physical fitness program, including consultations with individuals and organizations with expertise in promoting public health, nutrition, or physical activity, and organizations representing the agriculture, food and beverage, and fitness industries; and</text></subparagraph> 
<subparagraph id="H096FF03469B34257A7914D489848099C"><enum>(E)</enum><text>a description of how the State Coordinator will evaluate the effectiveness of its program.</text></subparagraph></paragraph> 
<paragraph id="H04AA96276EFB43CC8F001512027B154B"><enum>(5)</enum><header>Duration</header><text>Subject to the availability of funds made available to carry out this subsection, a State Coordinator shall conduct the project for a period of 3 successive school years.</text></paragraph> 
<paragraph id="H3F2188C25EFC48179D2E12BC87B1E219"><enum>(6)</enum><header>Authorized activities</header><text>An eligible applicant that receives assistance under this subsection may use funds to carry out one or more of the following activities:</text></paragraph> 
<paragraph id="H98C2B5B7B2BA4BE5B715FB1865498AB"><enum>(7)</enum><header>Use of funds</header><text>Funds authorized under paragraph (3) may be used for—</text> 
<subparagraph id="H2AA30B4C5B5E4948887FC110EBD3C8A1"><enum>(A)</enum><text>collecting, analyzing, and disseminating data regarding the extent to which children and youth in the State are overweight or physically inactive and the programs and services available to meet those needs;</text></subparagraph> 
<subparagraph id="H3B557FFF1A344D618B8F270057A513F"><enum>(B)</enum><text>developing and implementing model elementary and secondary education curricula to create a comprehensive, coordinated nutrition and physical fitness awareness and obesity prevention program;</text></subparagraph> 
<subparagraph id="H96CF13E3E73A4AF7B043E63C99EA08F1"><enum>(C)</enum><text>developing and implementing pilot programs in schools to increase physical fitness and to enhance the nutritional status of students, including through the increased consumption of fruits and vegetables, whole grains, and lowfat dairy products;</text></subparagraph> 
<subparagraph id="H184598B6F7D44BAA8579A0102C459DE4"><enum>(D)</enum><text>developing and implementing State guidelines in health, which include nutrition education, and physical education and emphasize regular physical activity during school hours;</text></subparagraph> 
<subparagraph id="H4D2F4C63282F457C93A752857516549F"><enum>(E)</enum><text>collaborating with community based organizations, volunteer organizations, State medical associations, and public health groups to develop and implement nutrition and physical education programs targeting lower income children, ethnic minorities, and youth at a greater risk for obesity;</text></subparagraph> 
<subparagraph id="HBCEEFC729ECE4E689B2B0706E3931195"><enum>(F)</enum><text>collaborating with public or private organizations that have as a mission the raising of public awareness of the importance of a balanced diet and an active lifestyles; and</text></subparagraph> 
<subparagraph id="HCFB8DF0561A84E5C9386D69ED3698FD9"><enum>(G)</enum><text>providing training and technical assistance to teachers and school food service professionals consistent with the purpose of this section.</text></subparagraph></paragraph> 
<paragraph id="H282BEA808061439DA567EFA82EC96929"><enum>(8)</enum><header>Limitation</header><text>Materials prepared under this subsection regarding agricultural commodity, food, or beverages must be factual and without bias. </text></paragraph> 
<paragraph id="H3EB8EAD06AFA4C17A1008E10AAE9FE97"><enum>(9)</enum><header>Report</header><text>Within 18 months of completion of the projects and the evaluations, the Secretary shall submit to the Committee on Education and the Workforce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Agriculture, Nutrition and Forestry of the Senate a report describing the results of the evaluation of the demonstration programs and shall make such reports available to the public, including through the Internet. </text></paragraph></subsection> 
<subsection id="H1A3E4511D3EC4CEE9E9B494B08FAB5AF"><enum>(d)</enum><header>Local nutrition and physical fitness project</header><text></text> 
<paragraph id="HB9A43D9B9E6B481285F8894D8C0009AD"><enum>(1)</enum><header>In general</header><text>Subject to the availability of funds made available, the Secretary, in consultation with the Secretary of Education, shall provide assistance to not more than 100 local educational agencies, at least one per State, for the establishment of pilot projects for purposes of promoting healthy eating habits and increasing physical fitness, consistent with the Dietary Guidelines for Americans established by the Department of Agriculture, among elementary and secondary education students. </text></paragraph> 
<paragraph id="H16782CAEA4154FBFBB2032987FE0104D"><enum>(2)</enum><header>Requirement for participation in pilot project</header><text>To be eligible to receive assistance under this subsection, a local educational agency shall, in consultation with individuals who possess education or experience appropriate for representing the general field of public health, including nutrition and fitness professionals, submit to the Secretary an application that shall include—</text> 
<subparagraph id="H86AC487C49544D1DB63B6726D2B32B35"><enum>(A)</enum><text>a description of the local educational agency’s need for nutrition and fitness programs; </text></subparagraph> 
<subparagraph id="H9B009FBB8FDA42ACB398008D61E7D03B"><enum>(B)</enum><text>a description of how the proposed project will improve health and nutrition through education and increased access to physical activity; </text></subparagraph> 
<subparagraph id="H740791DD8395410E8B64B3D8002D6725"><enum>(C)</enum><text>a description of how funds under this subsection will be coordinated with other programs under this Act, the Richard B. Russell National School Lunch Act, or other Acts, as appropriate, to improve student health and nutrition; </text></subparagraph> 
<subparagraph id="H3893761ABCED468483FD87BA9DE1E00"><enum>(D)</enum><text>a statement of the local educational agency’s measurable goals for nutrition and fitness education and promotion; </text></subparagraph> 
<subparagraph id="H4EA106C0CC5F4265903900AB3D238EA4"><enum>(E)</enum><text>a description of how the proposed project will be aligned with the local wellness policy required under the Act; and</text></subparagraph> 
<subparagraph id="HF0017A8530D74385005B4E8B6517DABC"><enum>(F)</enum><text>a description of the procedures the agency will use for assessing and publicly reporting progress toward meeting those goals. </text></subparagraph></paragraph> 
<paragraph id="H20DFCBF1482C44B387F9ACD653C4E702"><enum>(3)</enum><header>Duration</header><text>Subject to the availability of funds made available to carry out this subsection, a local educational agency receiving assistance under this subsection shall conduct the project during a period of 3 successive school years. </text></paragraph> 
<paragraph id="H851347E7C06347BE87FB55A34B008556"><enum>(4)</enum><header>Authorized activities</header><text>An eligible applicant that receives assistance under this subsection—</text> 
<subparagraph id="H87B03E72E58942ADBAD887A16B1F3E8"><enum>(A)</enum><text>shall use funds provided to—</text> 
<clause id="HCAFEA6C8605B4A8E00F34307ABE493F6"><enum>(i)</enum><text>promote healthy eating through the development and implementation of nutrition education programs and curricula;</text></clause> 
<clause id="H44B1C4A1C1F440DAA0220324329DF26F"><enum>(ii)</enum><text>increase opportunities for physical activity through after school programs, athletics, intramural activities, and recess; and</text></clause></subparagraph> 
<subparagraph id="H25AB3D7357C2449A963986CD32B770CE"><enum>(B)</enum><text>may use funds provided to—</text> 
<clause id="HD21752655D2B4351B53824079CFFDB00"><enum>(i)</enum><text>educate parents and students about the relationship of a poor diet and inactivity to obesity and other health problems;</text></clause> 
<clause id="H951F37DECFEA430B8F01034B558F48A0"><enum>(ii)</enum><text>develop and implementing physical education programs that promote fitness and lifelong activity;</text></clause> 
<clause id="HAE4C31C5387F49A195E030EE82CE7BF5"><enum>(iii)</enum><text>provide training and technical assistance to food service professionals to develop nutritious, more appealing menus and recipes;</text></clause> 
<clause id="H234C1F286A364C65ABD9EF602F50009"><enum>(iv)</enum><text>incorporate nutrition education into physical education, health education, and after school programs, including athletics;</text></clause> 
<clause id="HCF177749B7E14CE4AF2CBED500575F4E"><enum>(v)</enum><text>involve parents, food service staff, educators, community leaders, and other interested parties in assessing the food options in the school environment and developing and implementing an action plan to promote a balanced and healthy diet;</text></clause> 
<clause id="H72F305FBF8B2484F8C1E9C00E678BEB8"><enum>(vi)</enum><text>provide nutrient content or nutrition information on meals served through the school lunch or school breakfast programs and items sold a la carte during meal times;</text></clause> 
<clause id="HA2BE803F5B6F407088E394146CB0D212"><enum>(vii)</enum><text>encourage the increased consumption of a variety of healthy foods through new initiatives such as salad bars and fresh fruit bars; and</text></clause> 
<clause id="HB2ABC0AEA61A41DB001600C600FBE6C7"><enum>(viii)</enum><text>provide nutrition education, including sports nutrition education, for teachers, coaches, food service staff, athletic trainers, and school nurses. </text></clause></subparagraph></paragraph> 
<paragraph id="HBB2AB6C7F27444D6A952CBCDA0AE6C98"><enum>(5)</enum><header>Limitation</header><text>Materials prepared under this subsection regarding agricultural commodity, food, or beverages must be factual and without bias. </text></paragraph> 
<paragraph id="HFC16561C4B0141C4ADFB81EBAAF8D592"><enum>(6)</enum><header>Report</header><text>Within 18 months of completion of the projects and evaluations, the Secretary shall transmit to the Committee on Education and the Workforce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions and the Committee on Agriculture, Nutrition and Forestry of the Senate a report describing the results of the evaluation of the pilot projects and shall make such reports available to the public, including through the Internet. </text></paragraph></subsection> 
<subsection id="H118D1E99AE4346ADA7A71790BEC051A9"><enum>(e)</enum><header>Nutrition Education Support</header><text></text> 
<paragraph id="HF31127EECFFF434EBCC14D7250A78FEE"><enum>(1)</enum><header>In general</header><text>In carrying out the purpose of this section to support nutrition education, the Secretary may provide for technical assistance and grants to improve the quality of school meals and access to local foods in schools and institutions. </text></paragraph> 
<paragraph id="H1847E47CE7384E1E9647BF9287FE67B0"><enum>(2)</enum><header>Meal Quality Improvement</header><text>The Secretary may provide assistance to enable State educational agencies to—</text> 
<subparagraph id="HA3E78DBA33C54908A81D36D45D4E4BA9"><enum>(A)</enum><text>implement the recommendations of the Secretary’s School Meals Initiative for Healthy Children;</text></subparagraph> 
<subparagraph id="H6C3F50E89A584A4685FB57F260FBC7FD"><enum>(B)</enum><text>increase the consumption of fruits, vegetables, low-fat dairy products, and whole grains;</text></subparagraph> 
<subparagraph id="H09B5C58DDDB24D9D9E43EB27E0D52675"><enum>(C)</enum><text>reduce saturated fat and sodium in school meals;</text></subparagraph> 
<subparagraph id="HCE6532653734461DBBAEF8F3C5FE9DED"><enum>(D)</enum><text>improve school nutritional environments; and</text></subparagraph> 
<subparagraph id="HD3973CEBA1F44BB5A8942B015C390500"><enum>(E)</enum><text>conduct other activities that aid schools in carrying out the Secretary’s School Meals Initiative for Healthy Children. </text></subparagraph></paragraph> 
<paragraph id="H3E51DCE275B7477D98491B09F70026C8"><enum>(3)</enum><header>Access to Local Foods</header><text>The Secretary may provide assistance, through competitive matching grants and technical assistance, to schools and nonprofit entities for projects that—</text> 
<subparagraph id="H88B597BBDD9F4E0993926858EE4FF592"><enum>(A)</enum><text>improve access to local foods in schools and institutions participating in programs under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) and Section 4 of this Act through farm-to-cafeteria activities that may include the acquisition of food and appropriate equipment and the provision of training and education; </text></subparagraph> 
<subparagraph id="H917053F4A7B240CA9C8B617CD80308B4"><enum>(B)</enum><text>are, at a minimum, designed to procure local foods from small- and medium-sized farms for school meals; </text></subparagraph> 
<subparagraph id="H88B583577D3C4ACA00A0C4A927723070"><enum>(C)</enum><text>support nutrition education activities or curriculum planning that incorporates the participation of schoolchildren in farm and agriculture education activities;</text></subparagraph> 
<subparagraph id="HB5140D6B98FF48FAB77200BD69649984"><enum>(D)</enum><text>develop a sustained commitment to farm-to-cafeteria projects in the community by linking schools, agricultural producers, parents, and other community stakeholders; </text></subparagraph> 
<subparagraph id="HE17F223D13DC45E5A1BF25C2EAA1E9A4"><enum>(E)</enum><text>require $100,000 or less in Federal contributions; </text></subparagraph> 
<subparagraph id="H37356E2C40E84798A500E74E83312000"><enum>(F)</enum><text>require a Federal share of costs not to exceed 75 percent; </text></subparagraph> 
<subparagraph id="H6C3288495AD94B49B973B3118357D1D0"><enum>(G)</enum><text>provide matching support in the form of cash or in kind contributions (including facilities, equipment, or services provided by State and local governments and private sources); and </text></subparagraph> 
<subparagraph id="H298C5928BC314E2B9DB61EF36422DF88"><enum>(H)</enum><text>cooperate in an evaluation to be carried out by the Secretary.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HAC0B74DA58AE437D89A5F93F5C78C7BC"><enum>(3)</enum><text>in subsection (i)—</text> 
<subparagraph id="H6007EDC0642A4B499F3CFEA47986396"><enum>(A)</enum><text>in paragraph (1), by striking subparagraph (B);</text></subparagraph>

<subsection id="H393A473A5637435287A4BCAB4655F696"><enum>(b)</enum><header>Conforming amendments</header><text>Section 19 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1788">42 U.S.C. 1788</external-xref>) is further amended—</text>

<section id="H51298698E1DA430B999B9FCBBAE42480"><enum>303.</enum><header>Fruits and vegetable commodities</header><text display-inline="no-display-inline">Section 6(c)(1)(D) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1755">42 U.S.C. 1755(c)(1)(D)</external-xref>) is amended by inserting <quote>, and fruits and vegetables</quote> before the period.</text></section> 
<section id="HF2679B112D244ADCA12DFEAA275F115D"><enum>304.</enum><header>Fruit and vegetable pilot program</header><text display-inline="no-display-inline">Section 18(f) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769">42 U.S.C. 1769</external-xref>) (as redesignated by this Act) is amended—</text> 
<paragraph id="HEC59151C9DD849698B00382DB7D53586"><enum>(1)</enum><text>in paragraph (1), by striking <quote>In the school year beginning</quote> and inserting <quote>Beginning</quote></text></paragraph> 
<paragraph id="H7AB0AA1DAD58470A8007E474DD6127DE"><enum>(2)</enum><text>by striking paragraph (3) and redesignating paragraphs (2) and (4) as paragraphs (4) and (5), respectively, and inserting after paragraph (1) the following:</text>

<paragraph id="HA1959E1D092249A899479F9BE300D810"><enum>(2)</enum><header>Additional States</header><text>In addition to the States participating under subsection (1), the Secretary shall make available free fresh and dried fruits and fresh vegetables to students in 25 elementary or secondary schools in each of 4 additional States, and 1 Indian reservation.</text></paragraph> 
<paragraph id="H95897BD102C0462B8C2877622236D71D"><enum>(3)</enum><header>Selection of schools</header> 
<subparagraph id="H7BCE820D856A46C900F3A3B9F2A6067E"><enum>(A)</enum><header>In general</header><text>In selecting additional schools to participate in the pilot program authorized by this subsection, the Secretary shall—</text> 
<clause id="H6114CB30782A4A559987AC326600716C"><enum>(i)</enum><text>to the maximum extent practicable, ensure that the majority of schools selected are those in which not less than 50 percent of students are eligible for free or reduced price meals under this Act;</text></clause> 
<clause id="H8EB2CE120F9E4A0D885CD6838E265D54"><enum>(ii)</enum><text>solicit applications from interested schools that include—</text> 
<subclause id="HA469CB196AEF416196F660F600221C13"><enum>(I)</enum><text>information pertaining to the percentage of students enrolled in the school submitting the application who are eligible for free or reduced price school lunches under this Act;</text></subclause> 
<subclause id="H761BCEAA88DC4750B4527668D479C574"><enum>(II)</enum><text>a certification of support for participation in the pilot program signed by the school food manager, the school principal, and the district superintendent (or their equivalent positions, as determined by the school); and</text></subclause> 
<subclause id="H72917BA9AB3F417F805D9CD282571107"><enum>(III)</enum><text>a plan for implementation of the pilot program that includes a local partnership with an entity or entities of the fruit and vegetable industry, which shall contribute not less than 15 percent, in cash or in kind, for the acquisition, handling, and distribution of fresh and dried fruits and fresh vegetables provided under this program; and</text></subclause> 
<subclause id="H84FADDD9DB7D477082D12533E9FBBFAD"><enum>(IV)</enum><text>such other information as may be requested by the Secretary; and</text></subclause></clause> 
<clause id="HBC8598C91B1D406CB2C380EB3F00C2D6"><enum>(iii)</enum><text>for each application received, determine whether the application is from a school in which not less than 50 percent of students are eligible for free or reduced price meals under this Act.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H306892C080CB41F2AAAB23E6A2343643"><enum>(4)</enum><text>by amending paragraph (5) (as redesignated by this section) to read as follows:</text>

<subsection id="H27698CBEC8194364BCB6C2D48FEFB37"><enum>(a)</enum><header>In general</header><text>Section 9(a)(2) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(a)(2)</external-xref>) is amended to read as follows:</text>

<paragraph id="H0FE719437FE540E7AC9DC5925007CFDF"><enum>(2)</enum><header>Fluid Milk</header><text></text> 
<subparagraph id="H50345F4CCF9E4EE9ABE544DFFECB84F"><enum>(A)</enum><header>In general</header><text>Lunches served by schools participating in the school lunch program under this Act—</text> 
<clause id="H904D3193C8C0490E86C441D9C97EFA34"><enum>(i)</enum><text>shall offer students fluid milk in a variety of fat contents; </text></clause> 
<clause id="HAD9C8FC631FE4474B3E191A4325B34EE"><enum>(ii)</enum><text>may offer students flavored and unflavored fluid milk and lactose-free fluid milk; and</text></clause> 
<clause id="HD77A61331D50475A935CCB4475DB0026"><enum>(iii)</enum><text>shall provide a substitute for fluid milk for students whose disability restricts their diet, upon receipt of a written statement from a licensed physician that identifies the disability that restricts the student’s diet and that specifies the substitute for fluid milk; </text></clause></subparagraph> 
<subparagraph id="H0ED59317681B4F8EBA9864A02573FFD0"><enum>(B)</enum><header>Substitutes</header><text></text> 
<clause id="H20432154B4F940A588141312DB27CB9F"><enum>(i)</enum><header>Standards for substitution</header><text>Schools may substitute for the fluid milk provided under subparagraph (A), a non-dairy beverage that is nutritionally equivalent to fluid milk and meets nutritional standards as established by the Secretary (which shall, among other requirements to be determined by the Secretary, include fortification of calcium, protein, vitamin A, and vitamin D to levels found in cow’s milk) for students who cannot consume fluid milk because of a medical or other special dietary need other than a disability described in subparagraph (A)(iii).</text></clause> 
<clause id="H4AF0DABF8A1143AAB06F5EC997D8A2B2"><enum>(ii)</enum><header>Notice</header><text>Such substitutions may be made if the school notifies the State agency that it is implementing a variation allowed under this subparagraph, and if such substitution is requested by written statement of a medical authority or by a student’s parent or legal guardian that identifies the medical or other special dietary need that restricts the student’s diet, provided that the school shall not be required to provide beverages other than those it has identified as acceptable substitutes.</text></clause> 
<clause id="HAEA96987D7A347EDA7D8C766AC7159A5"><enum>(iii)</enum><header>Excess expenses borne by the school district</header><text>Expenses incurred in providing substitutions pursuant to this subparagraph that are in excess of those covered by reimbursements under this Act shall be paid by the school district.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section> 
<section id="HDAFFAE01FAEF488000BCA5D49125C55D"><enum>306.</enum><header>Waiver of requirements for weighted averages for nutrient analysis</header><text display-inline="no-display-inline">Section 9(f)(5) of the Richard B. Russell National School Lunch Act (42 U.S.C 1758(f)(5)) is amended to read as follows: </text> 
<quoted-block style="OLC" id="HB0067046D3C5474E9FF98381350186A4" display-inline="no-display-inline"> 
<paragraph id="H7661099187964E3A9DEAD74E60BDAB45"><enum>(5)</enum><header>Waiver of requirements for weighted averages for nutrient analysis</header><text>State educational agencies may grant waivers to school food authorities to the requirement for weighted averages for nutrient analysis of menu items and foods offered or served as part of a meal offered or served under the school lunch program under this Act or the school breakfast program under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>) if—</text> 
<subparagraph id="H8C2C806BC4B7489888C95BFD506C1370"><enum>(A)</enum><text>the school food authority has an equivalent system for conducting a nutrient analysis, subject to State agency approval; and</text></subparagraph> 
<subparagraph id="H816800BFD68E4B93978723C00979CC3"><enum>(B)</enum><text>the equivalent system adequately documents the extent to which the school food authority is meeting the Dietary Guidelines for Americans and other nutrition standards. </text></subparagraph><continuation-text>In addition, the Secretary may waive, on a case by case basis, the requirement for a State agency to use weighted averages when conducting a nutrient analysis as part of a review (of compliance with the Dietary Guidelines and other nutrition standards) of a school food authority not using nutrient standard menu planning, when, in the Secretary’s determination, an alternative analysis would yield results that would adequately measure a school food authority’s compliance with current nutrition standards for school meals.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H741F5F8FF4584AC58126EF427E08C439"><enum>307.</enum><header>Whole grains</header><text display-inline="no-display-inline">Not later than 12 months after the date of enactment of this Act, the Secretary shall issue guidance, based on Federal nutrition guidelines, to inform school food authorities and other sponsors of strategies to increase the presence of whole grains in foods offered in school nutrition programs under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) and the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>).</text></section> 
<section id="H8C4D637B494E4812906C43955540F9B6"><enum>308.</enum><header>Study on Healthy School Environments</header><text display-inline="no-display-inline">Section 10 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1779">42 U.S.C. 1779</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="H714107D7EA8E45C4B7CA1CCB4D93065B" display-inline="no-display-inline"> 
<subsection id="HB2FD68F36473424580FA0807CF661259"><enum>(d)</enum><header>Study</header> 
<paragraph id="H267594DF15FD490EA8C738D7FFDD9E34"><enum>(1)</enum><header>In general</header><text>The Secretary shall enter into an agreement with a science-based organization to conduct a 12 month study, based on sound nutritional science, to determine appropriate nutritional standards for foods available to students in school. The study shall take into consideration the role of all foods available to students in school as they relate to the total daily dietary intake of students participating in the school foods program. The organization conducting the study shall transmit a report of the study, including recommendations to the Secretary within 12 months after the date of enactment of this subsection.</text></paragraph> 
<paragraph id="H5EAFD00D913B442F8E0490A46D8B492E"><enum>(2)</enum><header>Dissemination</header><text>Upon receipt of recommendations, the Secretary shall disseminate such recommendations to States and local educational agencies via the Internet and other methods of dissemination. </text></paragraph> 
<paragraph id="H044E00AA1121469F8D94FA613F235B8"><enum>(3)</enum><header>Technical assistance</header><text>Not less than 120 days after receipt of recommendations, the Secretary shall provide technical assistance to schools, upon their request, on how to implement such recommendations.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> </title> 
<title id="H17AEA073625347EB9E75861885B8179E"><enum>IV</enum><header>Improving the Women, Infants, and Children Program</header> 
<section id="HBA0B38B8B72D49E38F36BF32275C7B70"><enum>401.</enum><header>Definition of nutrition education</header><text display-inline="no-display-inline">Section 17(b)(7) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(b)(7)</external-xref>) is amended—</text> 
<paragraph id="H4626F77DDDBE425FA7EB2537A2FB68C1"><enum>(1)</enum><text>by inserting <quote>and physical activity,</quote> after <quote>dietary habits</quote>; and</text></paragraph>

<section id="HFDF535777BA2468F8E40B02745E3DA81"><enum>402.</enum><header>Definition of supplemental foods</header><text display-inline="no-display-inline">Section 17(b)(14) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(b)(14)</external-xref>) is amended by inserting after <quote>children</quote> the following: <quote>and foods that promote health as indicated in the most recent Dietary Guidelines for Americans published under section 301 of the National Nutrition Monitoring and Related Research Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/5341">7 U.S.C. 5341</external-xref>)</quote>.</text></section>

<subsection id="H14C5AA4B26C542CF93FEC88F701B6085"><enum>(a)</enum><header>Certification of women who are breastfeeding</header><text>Section 17(d)(3)(A) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(d)(3)(A)</external-xref>) is amended by adding at the end the following: <quote>A State may certify breast-feeding women for up to 1 year, or until women stop breast-feeding, whichever is earlier.</quote></text></subsection> 
<subsection id="H607ACA4A503944B99CDDE2B4CBB54352"><enum>(b)</enum><header>Physical presence requirement</header><text>Section 17(d)(3)(C)(ii) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(d)(3)(C)(ii)</external-xref>) is amended—</text>

<subsection id="HC84A13F419E646EC82FF9569D23EBBE8"><enum>(a)</enum><header>Scientific review</header> <text>Section 17(f)(11) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(f)(11)</external-xref>) is amended to read as follows:</text>

<subparagraph id="H6A23BA88BE964EFDB941F18D00833EDC" display-inline="yes-display-inline"><enum>(A)</enum><text>The Secretary shall prescribe by regulations the supplemental foods to be made available in the program under this section. To the degree possible the Secretary shall ensure that the fat, sugar, and salt content of the prescribed foods is appropriate.</text></subparagraph> 
<subparagraph id="H7CF6AD91740E4596AA613D8F82099499" indent="up1"><enum>(B)</enum><text>Beginning in 2013 and every 10 years thereafter, or more frequently if determined by the Secretary to be necessary to reflect current scientific knowledge, the Secretary shall conduct a scientific review of the supplemental foods available in the program and recommend, as necessary, changes to reflect nutrition science, current public health concerns, and cultural eating patterns.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H5D7B9659CCD74BE594D08D2F23229CAF"><enum>(b)</enum><header>Rulemaking</header> <text>The Secretary shall promulgate a rule updating the prescribed supplemental foods available through the program authorized under section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>) within 6 months of receiving the review of the food package for such program undertaken by the National Academy of Sciences, Institute of Medicine in September 2003.</text></subsection></section> 
<section id="HD04B7FACBE1145040009D291561D00B5"><enum>405.</enum><header>Notification of violations and infant formula benefits</header><text display-inline="no-display-inline">Section 17(f) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(f)</external-xref>) is amended by adding at the end the following: </text> 
<quoted-block style="OLC" id="H2F3A74506779456F89CD35D480EC11C" display-inline="no-display-inline"> 
<paragraph id="H8A779757611C483F951088D78C00E665"><enum>(25)</enum><header>Notification of violations</header><text>If a State agency finds that a vendor has committed a violation that requires a pattern of occurrences in order to impose a sanction, the State agency shall notify the vendor of the initial violation in writing prior to documentation of another violation, unless the State agency determines that notifying the vendor would compromise its investigation.</text></paragraph> 
<paragraph id="H319B5F69E13F4A9AB301EFFDB885E7C"><enum>(26)</enum><header>Infant formula benefits</header><text>The State agency may round up to the next whole can of infant formula to ensure that all infants receive the full-authorized nutritional benefit specified by regulation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H64363A17680F4F45AFF45C1FF9545DDE"><enum>406.</enum><header>Competitive bidding</header><text display-inline="no-display-inline">Section 17(h)(8)(A) of the Child Nutrition Act of 1966 is amended by adding at the end the following: </text> 
<quoted-block style="OLC" id="H5240C8A654CD426CAB8779B7AC3FA7B" display-inline="no-display-inline"> 
<clause id="H0D70D76E62F945F8919F8E90FC5410DD"><enum>(iv)</enum><header>Rebate invoices</header><text>Each State agency shall have a system to ensure that infant formula rebate invoices, under competitive bidding, provide a reasonable estimate or an actual count of the number of units sold to participants in the program under this section.</text></clause> 
<clause id="H85B39464C196468199DC48D622962DCB"><enum>(v)</enum><header>Cent-for-cent adjustments</header><text>A bid solicitation for infant formula under the program made on or after October 1, 2004 shall require the manufacturer to adjust the price changes subsequent to the opening of the bidding process in a manner that requires—</text> 
<subclause id="H31A75F2A1917441DB1A28D76D58EB5F5"><enum>(I)</enum><text>a cent-for-cent increase in the rebate amounts if there is an increase in the lowest national wholesale price for a full truckload of the particular infant formula; or</text></subclause> 
<subclause id="H556C242928864D5B8FD5978659BB352F"><enum>(II)</enum><text>a cent-for-cent decrease in the rebate amounts if there is a decrease in the lowest national wholesale price for a full truckload of the particular infant formula.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H17EC8B02752F438D8200A5830016C3A0"><enum>407.</enum><header>Fruit and vegetable projects</header><text display-inline="no-display-inline">Section 17(h)(10)(B)(ii) is amended by inserting after <quote>under this section</quote> the following: <quote>, which may include demonstration projects in up to 10 local sites, determined to be geographically and culturally representative of local States and Indian agencies, to evaluate the inclusion of fresh, frozen, or canned fruits and vegetables (to be made available through private funds) as an addition to the supplemental food provided under this section</quote>.</text></section> 
<section id="HEF4523DF57DE4216A0C1DCE0E7E85E62"><enum>408.</enum><header>Management information systems</header><text display-inline="no-display-inline">Section 17(h)(12) of the Child Nutrition Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(h)(12)</external-xref>) is amended—</text> 
<paragraph id="H38A9C3B0E0404903B833DF741D4C3D91"><enum>(1)</enum><text>by amending subparagraph (B) to read as follows:</text>

<clause id="HD17DC59730D14B23B19494CC18B00064"><enum>(i)</enum><header>in general</header><text>All States that receive Federal funds for design or implementation of electronic benefit transfer (EBT) systems for the program under this section shall use technical specifications or standards, as applicable, as determined by the Secretary, except as provided in clause (ii).</text></clause> 
<clause id="H057186424B83465DA448D68672527204"><enum>(ii)</enum><header>existing systems</header><text>EBT systems for the program under this section that are in development or are issuing benefits as of the date of enactment shall be required to submit within 6 months after the date of enactment of this subparagraph a plan for compliance.</text></clause> 
<clause id="HE1576A028E3948DFB66423CB31C8ECBF"><enum>(iii)</enum><header>waiver</header><text>The Secretary may waive compliance with this subparagraph for State EBT systems for the program under this section that are issuing benefits as of the date of enactment of this subparagraph until such time that compliance is feasible.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="H9D21A08912BC47B5BAD88F67BFC149FF"><enum>(2)</enum><text>by amended subparagraph (C) to read as follows:</text>

<section id="H3FE853EFA74442FA8B67921BBC2500F4"><enum>409.</enum><header>Infant formula fraud prevention</header><text display-inline="no-display-inline">Section 17(h) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(h)</external-xref>) is further amended by adding at the end the following:</text>

<subparagraph id="H5ECF9194DF41439CA7F204E66C7900CA"><enum>(A)</enum><header>In general</header><text>The State agency shall maintain a list of infant formula manufacturers, wholesalers, distributors, and retailers approved to provide infant formula to vendors.</text></subparagraph> 
<subparagraph id="H8E2A1A8586D242F8A2629926000050B9"><enum>(B)</enum><header>List</header><text>The list required under paragraph (A) shall include food manufacturers, wholesalers, distributors, and retailers licensed in the State in accordance with State law and regulations to distribute infant formula and food manufacturers registered with the U.S. Food and Drug Administration that provide infant formula. </text></subparagraph> 
<subparagraph id="HEFA766D868FB4D8792C4A890D296FA75"><enum>(C)</enum><header>Purchase requirement</header><text>Vendors authorized to participate in the program under this section shall purchase infant formula from the list required under paragraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HB96B956C75354E989380FD49B7FE346F"><enum>410.</enum><header>State alliances</header><text display-inline="no-display-inline">Section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>) is amended—</text> 
<paragraph id="H2C3E7B195EDA470BBAF9A1E746771D9"><enum>(1)</enum><text>in subsection (b) by adding at the end the following:</text>

<paragraph id="HEBD8ED4D41064EC9BBB16510768D8D9D"><enum>(22)</enum><text><quote>State alliance</quote> means 2 or more State agencies that join together for the purpose of procuring infant formula by soliciting competitive bids.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H3B1C62EF5CB34D07AE9755B0A8D1C92F"><enum>(2)</enum><text>in subsection (h)(8)(A) by adding at the end the following:</text>

<clause id="HE6129BDEC02F4FBE94496C49F8B47FEA"><enum>(iv)</enum><header>Size of State alliances</header><text>No State alliance may form among States whose infant participation exceeds 200,000 based on program participation as of October 2003, except that—</text> 
<subclause id="H61B36ED527EF479C00E5BB75847E4454"><enum>(I)</enum><text>an alliance among States with a combined 200,000 infant participants as of October 2003 may continue, and may expand to include more than 200,000 infants, but may not expand to include any additional State agencies that were not included in the alliance as of October 1, 2003, other than as provided in subclause (II); and</text></subclause> 
<subclause id="H06FF3C63EF5F4C7D8CDE15F240EC2DA2"><enum>(II)</enum><text>any State agency serving fewer than 5,000 infant participants as of October 2003, or any Indian Tribal Organization, may request to join any State alliance.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HA660B753F8C746BA8BBC2500C7FB4CB3"><enum>411.</enum><header>Limits on expenditures</header><text display-inline="no-display-inline">Section 17(i)(3)(A)(ii)(I) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(i)(3)(A)(ii)(I)</external-xref>) is amended by striking <quote>1 percent</quote> and inserting <quote>3 percent</quote>.</text></section>

<section id="HD356B295564D4692A2A99DB996C4EEB7"><enum>501.</enum><header>Training, Technical, and Other Assistance</header><text display-inline="no-display-inline">Section 21(a)(1) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769b-1">42 U.S.C. 1769b–1(a)(1)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="H7843642381244986BBF26ECE9F00172D" display-inline="no-display-inline"> 
<paragraph id="H055E26442368403EA5A22DFAEDC62331"><enum>(1)</enum><text>subject to the availability of and from amounts appropriated pursuant to subsection (e)(1), shall provide—</text> 
<subparagraph id="HC4D6BFBAD0684CC88FC2B6996F5CEAA9"><enum>(A)</enum><text>training and technical assistance to improve the skills of individuals employed in food service programs carried out under this Act, section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>), and, as appropriate, other federally assisted feeding programs; </text></subparagraph> 
<subparagraph id="HEAE49AD878EC43BAB9FDC9761534547D"><enum>(B)</enum><text>training and technical assistance to States, State agencies, schools, and school food authorities in the procurement of goods and services for programs under this Act and the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771 et seq.</external-xref>), including training and technical assistance to ensure compliance with section 12(n) of this Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1760">42 U.S.C. 1760(n)</external-xref>). </text></subparagraph> 
<subparagraph id="H438BE3C070F447B6AD5576FCCAF85476"><enum>(C)</enum><text>assistance, on a competitive basis, to State agencies for the purpose of aiding schools and school food authorities with at least 50 percent of enrolled children certified to receive free or reduced price meals, in meeting the cost of acquiring or upgrading technology and information management systems for use in food service programs carried out under this Act and section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>) if the school or school food authority submits to the State agency an infrastructure development plan that addresses the cost savings and improvements in program integrity and operations that would result from the use of new or upgraded technology in—</text> 
<clause id="HD66FD6BC3303451EAB7000B6FB8F85BE"><enum>(i)</enum><text>methods to ensure that there shall not be any overt identification of any such child by special tokens or tickets, announced or published list of names, or by any other means; (ii)</text></clause> 
<clause id="HA2CE8596E5A54E5EA2FDAB59063971CC"><enum>(ii)</enum><text>processing and verifying applications for free and reduced price school meals;</text></clause> 
<clause id="H93A636706F4C4B65816D2097C7DDA210"><enum>(iii)</enum><text>integrating menu planning, production, and serving data to monitor compliance with section 9(f)(1); and</text></clause> 
<clause id="H37ED167985DE48D79556C4E20114F01C"><enum>(iv)</enum><text>establishing compatibility with statewide reporting systems. </text></clause></subparagraph> 
<subparagraph id="H2990387143664369A68B1454E3BBC3F8"><enum>(D)</enum><text>assistance, on a competitive basis, to State agencies with low proportions of schools or students that participate in the school breakfast program under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>) and that demonstrate the greatest need, for the purpose of aiding schools in meeting costs associated with initiating or expanding a school breakfast program under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>), including outreach and informational activities; and</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC3E49DD82C6C41E2B92E7E9CBE5BC624"><enum>502.</enum><header>Notice of irradiated food</header><text display-inline="no-display-inline">Section 14 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1762a">42 U.S.C. 1762a</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="H6A5723BBC6E9463986B3E19DFD99329" style="OLC"> 
<subsection id="H9D945F9F66444FCCA9695F7EF3730329"><enum>(h)</enum><header>Notice of irradiated food</header><text>The Secretary shall develop policy and establish procedures for the purchase and distribution of irradiated food products in Federal school meals programs. The policies and procedures shall ensure at a minimum that—</text> 
<paragraph id="HDC917777B81A49FA8301F30006000300"><enum>(1)</enum><text>irradiated food products are made available only at the request of States and school food authorities;</text></paragraph> 
<paragraph id="H6DF5DB5E6AE447219EEB1900B782CE00"><enum>(2)</enum><text>reimbursements to schools for irradiated food products are equal to reimbursements to schools for non-irradiated products;</text></paragraph> 
<paragraph id="H6CD6D65AF7E74FC89347E33B540406B5"><enum>(3)</enum><text>States and school food service authorities are provided factual information on the science and evidence regarding irradiation technology, including notice that irradiation is not a substitute for safe food handling techniques and any such other information necessary to promote food safety in school meal programs;</text></paragraph> 
<paragraph id="H85BB3BDD09D74C588839B7006084BAF3"><enum>(4)</enum><text>States and school food service authorities are provided model procedures for providing factual information on the science and evidence regarding irradiation technology and any such other information necessary to promote food safety in school meals to school food service authorities, parents, and students regarding irradiation technology; </text></paragraph> 
<paragraph id="HAA6BF8D552EA40E7B0AB472202B19D3"><enum>(5)</enum><text>irradiated food products distributed to the Federal school meals program are labeled with a symbol or other printed notice indicating that the product was treated with irradiation and is prominently displayed in a clear and understandable format on the container;</text></paragraph> 
<paragraph id="H72214015F580401EBAE9AAD06982E3D5"><enum>(6)</enum><text>irradiated products are not commingled with non-irradiated products in containers; and</text></paragraph> 
<paragraph id="H867A8AE0310549700030003522AA7476"><enum>(7)</enum><text>encourages schools that offer irradiated foods to offer alternatives to irradiated food products as part of the meal plan used by schools.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H9614956F96F44B00A02B3BB6AAC3C2CB"><enum>503.</enum><header>Reauthorization of programs</header>

<section id="H3C16CE707613474898E14743AB027C7E"><enum>504.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by sections 101, 104, 105(a), 201, 301, 304, 308, 408, 414, and 503 shall take effect on the date of enactment of this Act. The amendment made by section 202 shall take effect on July 1, 2005. All other amendments made by this Act shall take effect October 1, 2004.</text></section></title>
