<official-title>To amend title XIX of the Social Security Act to permit States the option to provide Medicaid coverage for low-income individuals infected with HIV.</official-title>

<section section-type="section-one" id="HB666120EAC5E4755B9DC501CE5A23E8E"> <enum>1.</enum> <header>Short title</header> <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text> </section> 
<section id="HB05D76BF155B49D7AAC88D1666136E91"> <enum>2.</enum> <header>Optional medicaid coverage of low-income HIV-infected individuals</header> 
<subsection id="H566040E3C29A4BBD8600A9488B6D08AF"> <enum>(a)</enum> <header>In general</header> <text>Section 1902 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended—</text> 
<paragraph id="HAAEA0D3D10754579BF50066FD1B293E0"> <enum>(1)</enum> <text>in subsection (a)(10)(A)(ii)—</text> 
<subparagraph id="HF36A9B59E85844F28242164D02C7A35C"> <enum>(A)</enum> <text>by striking <quote>or</quote> at the end of subclause (XVII);</text> </subparagraph> 
<subparagraph id="H449219F6D1BA4DEAB4FD3488BB25843"> <enum>(B)</enum> <text>by adding <quote>or</quote> at the end of subclause (XVIII); and</text> </subparagraph> 
<subparagraph id="H527C29FB467440629B85CF8B1C79FFD"> <enum>(C)</enum> <text>by adding at the end the following:</text>

<subclause id="H4A682748249147F19CFDDF43F8FC431B"> <enum>(XIX)</enum> <text>who are described in subsection (cc) (relating to HIV-infected individuals);</text> </subclause> <after-quoted-block>; and</after-quoted-block> </quoted-block> </subparagraph> </paragraph> 
<paragraph id="HDEF23A3F13B3411D8480CA9336B0540"> <enum>(2)</enum> <text>by adding at the end the following:</text>

<subsection id="HF5AE7D231C4F43698B243F8D51D741DE"> <enum>(cc)</enum> <text>HIV-infected individuals described in this subsection are individuals not described in subsection (a)(10)(A)(i)—</text> 
<paragraph id="H3603162A199E4356B2E3683526EE8D7E"> <enum>(1)</enum> <text>who have HIV infection;</text> </paragraph> 
<paragraph id="H45073241E0224B23A303C90096D3DCFD"> <enum>(2)</enum> <text>whose income (as determined under the State plan under this title with respect to disabled individuals) does not exceed the maximum amount of income a disabled individual described in subsection (a)(10)(A)(i) may have and obtain medical assistance under the plan; and</text> </paragraph> 
<paragraph id="H02D56BB3F55A4613B27FCDF45842F350"> <enum>(3)</enum> <text>whose resources (as determined under the State plan under this title with respect to disabled individuals) do not exceed the maximum amount of resources a disabled individual described in subsection (a)(10)(A)(i) may have and obtain medical assistance under the plan.</text> </paragraph> </subsection> <after-quoted-block>.</after-quoted-block> </quoted-block> </paragraph> </subsection> 
<subsection id="HA3536EFAB67E4979876100D043C4BB4"> <enum>(b)</enum> <header>Enhanced match</header> <text>The first sentence of section 1905(b) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(b)</external-xref>) is amended by striking <quote>section 1902(a)(10)(A)(ii)(XVIII)</quote> and inserting <quote>subclause (XVIII) or (XIX) of section 1902(a)(10)(A)(ii)</quote>.</text> </subsection> 
<subsection id="HB5B4332F896E476B94DE44A1FACBD7D"> <enum>(c)</enum> <header>Conforming amendments</header> <text>Section 1905(a) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended in the matter preceding paragraph (1)—</text> 
<paragraph id="H06DF930182674BF698664CE3AAE09837"> <enum>(1)</enum> <text>by striking <quote>or</quote> at the end of clause (xii);</text> </paragraph> 
<paragraph id="HA6AD1AF428CF4069BCB17F80F4389C72"> <enum>(2)</enum> <text>by adding <quote>or</quote> at the end of clause (xiii); and</text> </paragraph> 
<paragraph id="HCAC971D8E4D34133A700F1285C0188BC"> <enum>(3)</enum> <text>by inserting after clause (xiii) the following:</text>

<clause indent="paragraph" id="HC90C6323CEE04E8C9DC176DF0705C8FE"> <enum>(xiv)</enum> <text>individuals described in section 1902(cc);</text> </clause> <after-quoted-block>.</after-quoted-block> </quoted-block> </paragraph> </subsection> 
<subsection id="HE645AA342C8C4305A48EC8FC5D80AA6B"> <enum>(d)</enum> <header>Exemption from funding limitation for territories</header> <text>Section 1108(g) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1308">42 U.S.C. 1308(g)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="H8FA7D11BCC3E4323BFAD0094BC2D2E3D"> <enum>(3)</enum> <header>Disregarding medical assistance for optional low-income hiv-infected individuals</header> <text>The limitations under subsection (f) and the previous provisions of this subsection shall not apply to amounts expended for medical assistance for individuals described in section 1902(cc) who are only eligible for such assistance on the basis of section 1902(a)(10)(A)(ii)(XIX).</text> </paragraph> <after-quoted-block>.</after-quoted-block> </quoted-block> </subsection> 
<subsection id="HB9AFA9E88E934DBF9B2CC2C35080F2A3"> <enum>(e)</enum> <header>Effective date</header> <text>The amendments made by this section shall apply to calendar quarters beginning on or after the date of the enactment of this Act, without regard to whether or not final regulations to carry out such amendments have been promulgated by such date.</text> </subsection> </section>
