<official-title>To authorize the Secretary of Agriculture and the Secretary of the Interior to enter into an agreement or contract with Indian tribes meeting certain criteria to carry out projects to protect Indian forest land.</official-title>

<section id="H93C83C05BBBF4F46BF447D99E048989F" section-type="section-one"><enum>1. </enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section>
<section id="H6BD5DE526536491B8B0027B869A63E00"><enum>2.</enum><header>Tribal forest assets protection</header> 
<subsection id="H17A5ED1D009B4ABC993522ABEE10AE9E"> <enum>(a)</enum> <header>Definitions</header> <text>In this section:</text> 
<paragraph id="H29EC93B2CE284E14BAEDF5C76F69C88E"><enum>(1)</enum><header>Federal land</header><text>The term <term>Federal land</term> means—</text> 
<subparagraph id="H9856A11783734136B474849498E14269"><enum>(A)</enum><text>land of the National Forest System (as defined in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>)) administered by the Secretary of Agriculture, acting through the Chief of the Forest Service; and </text> </subparagraph> 
<subparagraph id="H6ABE33C2C3EC474BACBC3C0124007DC6"><enum>(B)</enum><text>public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>)), the surface of which is administered by the Secretary of the Interior, acting through the Director of the Bureau of Land Management. </text> </subparagraph></paragraph> 
<paragraph id="HC49B2C16B6A74B12A6E494006604DC4F"><enum>(2)</enum><header>Indian forest land</header><text>The term <term>Indian forest land</term> has the meaning given the term in section 304 of the National Indian Forest Resources Management Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3103">25 U.S.C. 3103</external-xref>).</text> </paragraph> 
<paragraph id="HE24E8DD74390414D00EBEBE1DA6566E1"> <enum>(3)</enum> <header>Indian tribe</header> <text>The term <term>Indian tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text> </paragraph> 
<paragraph id="H8B2A263AE1424ED3A50951DA9815CBFC"> <enum>(4)</enum> <header>Secretary</header> <text>The term <term>Secretary</term> means—</text> 
<subparagraph id="H8B2DE99D241146BB86CE00836CA330DC"> <enum>(A)</enum> <text>the Secretary of Agriculture, with respect to land under the jurisdiction of the Forest Service; and</text> </subparagraph> 
<subparagraph id="H9ECF6BC0ADCA4EEA90DB4184C0007FA6"> <enum>(B)</enum> <text>the Secretary of the Interior, with respect to land under the jurisdiction of the Bureau of Land Management.</text> </subparagraph></paragraph></subsection> 
<subsection id="H546C6662F2E84E168F5EFF3CF6D6F73B"> <enum>(b)</enum> <header>Authority to protect tribal forest assets</header> 
<paragraph id="H6793093FC7B34B6681AFB739E490B943"> <enum>(1)</enum> <header>In general</header> <text>Not later than 120 days after the date on which an Indian tribe submits to the Secretary a request to enter into an agreement or contract to carry out a project to protect Indian forest land that meets the criteria described in subsection (c), the Secretary may issue public notice of initiation of any necessary environmental review or of the potential of entering into an agreement or contract with the Indian tribe pursuant to section 347 of the Department of the Interior and Related Agencies Appropriations Act, 1999 (<external-xref legal-doc="usc" parsable-cite="usc/16/2104">16 U.S.C. 2104</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/105/277">Public Law 105–277</external-xref>) (as amended by section 323 of the Department of the Interior and Related Agencies Appropriations Act, 2003 (117 Stat. 275)), or such other authority as appropriate, under which the Indian tribe would carry out activities described in paragraph (3).</text> </paragraph> 
<paragraph id="HE7FC89C3E98C49E7006F6589F2E0CF30"> <enum>(2)</enum> <header>Environmental analysis</header> <text>Following completion of any necessary environmental analysis, the Secretary may enter into an agreement or contract with the Indian tribe as described in paragraph (1).</text> </paragraph> 
<paragraph id="H5350A7A226D54D7DA3DC37DDF7EB443"> <enum>(3)</enum> <header>Activities</header> <text>Under an agreement or contract entered into under paragraph (2), the Indian tribe may carry out activities to achieve land management goals for Federal land that is—</text> 
<subparagraph id="H5B70FF60C2E143899D369C4EEE52DA66"> <enum>(A)</enum> <text>under the jurisdiction of the Secretary; and</text> </subparagraph> 
<subparagraph id="HD24DF2FBAD91422FB9742F7E53AD91A"> <enum>(B)</enum> <text>bordering or adjacent to the Indian forest land under the jurisdiction of the Indian tribe.</text> </subparagraph></paragraph></subsection> 
<subsection id="HDB0263EBAAE14C1897E3EB52296C854"> <enum>(c)</enum> <header>Selection criteria</header> <text>The criteria referred to in subsection (b), with respect to an Indian tribe, are whether—</text> 
<paragraph id="H49F1E1050E104C7083B2CAA5B81EBC93"> <enum>(1)</enum> <text>the Indian forest land under the jurisdiction of the Indian tribe borders on or is adjacent to land under the jurisdiction of the Forest Service or the Bureau of Land Management;</text> </paragraph> 
<paragraph id="H834A0D79F717441DA20039B3AC53DF2"> <enum>(2)</enum> <text>Forest Service or Bureau of Land Management land bordering on or adjacent to the Indian forest land under the jurisdiction of the Indian tribe poses a fire, disease, or other threat to—</text> 
<subparagraph id="H0C9F79F9E26346B982919FB402B24AD"> <enum>(A)</enum> <text>the Indian forest land under the jurisdiction of the Indian tribe; or</text> </subparagraph> 
<subparagraph id="H63E71676539246A2B9B7BE47FA60C62D"> <enum>(B)</enum> <text>a tribal community;</text> </subparagraph></paragraph> 
<paragraph id="HF63A0E3CA06843759BE6AD46A3AEDE92"><enum>(3)</enum><text>the agreement or contracting activities applied for by the Indian tribe are not already covered by a stewardship contract or other instrument that would present a conflict on the subject land; and </text> </paragraph> 
<paragraph id="H7B49B46A60444ED09FFAE7C4C9F3090"> <enum>(4)</enum> <text>the Forest Service or Bureau of Land Management land described in the application of the Indian tribe presents or involves a feature or circumstance unique to that Indian tribe (including treaty rights or biological, archaeological, historical, or cultural circumstances).</text> </paragraph></subsection> 
<subsection id="HDBB5A65605F643F29B8131E16EA2DD1F"> <enum>(d)</enum> <header>Notice of denial</header> <text>If the Secretary denies a tribal request under subsection (b)(1), the Secretary may issue a notice of denial to the Indian tribe, which—</text> 
<paragraph id="H2EB69864C3794F96A5C951B4D45798D"> <enum>(1)</enum> <text>identifies the specific factors that caused, and explains the reasons that support, the denial;</text> </paragraph> 
<paragraph id="HB180C1074F734517895366C2401062A3"> <enum>(2)</enum> <text>identifies potential courses of action for overcoming specific issues that led to the denial; and</text> </paragraph> 
<paragraph id="HE641DCA0A7E445CF8128D0ADFAB1ECD0"> <enum>(3)</enum> <text>proposes a schedule of consultation with the Indian tribe for the purpose of developing a strategy for protecting the forest land of the Indian tribe and interests of the Indian tribe in Federal land.</text> </paragraph></subsection> 
<subsection id="H3CE8C597783D4ACFB27DC4B9F5AAB542"> <enum>(e)</enum> <header>Proposal evaluation and determination factors</header> <text>In entering into an agreement or contract in response to a request of an Indian tribe under subsection (b)(1), the Secretary may—</text> 
<paragraph id="H8B936DD834D44C290042777332AD89C8"> <enum>(1)</enum> <text>use a best-value basis; and</text> </paragraph> 
<paragraph id="H4AB9F837D8FB416CA017F19194686208"> <enum>(2)</enum> <text>give specific consideration to tribally-related factors in the proposal of the Indian tribe, including—</text> 
<subparagraph id="H4BC89FAA88B146BBA41DE9F0EDE88DF4"> <enum>(A)</enum> <text>the status of the Indian tribe as an Indian tribe;</text> </subparagraph> 
<subparagraph id="H5CFF6C1C8D574FA68421E2EF74EE8980"> <enum>(B)</enum> <text>the trust status of the forest land of the Indian tribe;</text> </subparagraph> 
<subparagraph id="H82B02A8C237A4E31A16C581993208D56"> <enum>(C)</enum> <text>the cultural, traditional, and historical affiliation of the Indian tribe with the land subject to the proposal;</text> </subparagraph> 
<subparagraph id="H3F0845A7666F420DA14D8EFEE7621E81"> <enum>(D)</enum> <text>the treaty rights or other reserved rights of the Indian tribe relating to the land subject to the proposal;</text> </subparagraph> 
<subparagraph id="HEB4DD6708F0640F4AB597283EEEF507"> <enum>(E)</enum> <text>the indigenous knowledge and skills of members of the Indian tribe;</text> </subparagraph> 
<subparagraph id="H3D5E9795C6D84784AD663939959C699E"> <enum>(F)</enum> <text>the features of the landscape of the land subject to the proposal, including watersheds and vegetation types;</text> </subparagraph> 
<subparagraph id="H813EE9BC4FC141E29F0423B12AE4F24"> <enum>(G)</enum> <text>the working relationships between the Indian tribe and Federal agencies in coordinating activities affecting the land subject to the proposal; and</text> </subparagraph> 
<subparagraph id="H5868686E2850452E9D00BD6DCE26A241"> <enum>(H)</enum> <text>the access by members of the Indian tribe to the land subject to the proposal.</text> </subparagraph></paragraph></subsection> 
<subsection id="H459630E21F66448DA396C839E25CE239"> <enum>(f)</enum> <header>No effect on existing authority</header> <text>Nothing in this Act—</text> 
<paragraph id="H3EC54138FDB14B43AA2B2BB5405C98FB"> <enum>(1)</enum> <text>prohibits, restricts, or otherwise adversely affects the participation of any Indian tribe in stewardship agreements or contracting under the authority of section 347 of the Department of the Interior and Related Agencies Appropriations Act, 1999 (<external-xref legal-doc="usc" parsable-cite="usc/16/2104">16 U.S.C. 2104</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/105/277">Public Law 105–277</external-xref>) (as amended by section 323 of the Department of the Interior and Related Agencies Appropriations Act, 2003 (117 Stat. 275)) or other authority invoked pursuant to this Act; or</text> </paragraph> 
<paragraph id="HB6F9C250D70F42FAACC8D3A6014C289C"> <enum>(2)</enum> <text>invalidates any agreement or contract under that authority.</text> </paragraph></subsection> 
<subsection id="H668844A8160D48E9B3CA1DF680047AF"> <enum>(g)</enum> <header>Report</header> <text>Not later than 4 years after the date of enactment of this Act, the Secretary shall submit to Congress a report that describes the Indian tribal requests received and agreements or contracts that have been entered into under this Act.</text> </subsection></section>
