<official-title>To amend part C of title XVIII of the Social Security Act to prohibit the comparative cost adjustment (CCA) program from operating in the State of New Mexico.</official-title>

<section id="H3E246C05DE49453C8BA68D1032B9A66E" section-type="section-one"><enum>1.</enum><header>Prohibition on operation of medicare Comparative Cost Adjustment (CCA) program in New Mexico</header> 
<subsection id="H43481F29672B44E199FFBA282DB198A5"><enum>(a)</enum><header>In general</header><text>Section 1860C–1(b) of the Social Security Act, as added by section 241 of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>), is amended by adding at the end the following:</text>

<paragraph id="HE91F848C9A794639B3A3E79F61FA49C7"><enum>(3)</enum><header>No cca areas within New Mexico</header><text>A CCA area shall not include an MSA any portion of which is within the State of New Mexico.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H38339CB18FCE4F7AB05E477632F03F99"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall take effect as if included in the enactment of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003.</text></subsection></section>
