<official-title>To direct the Secretary of Energy to make incentive payments to the owners or operators of qualified desalination facilities to partially offset the cost of electrical energy required to operate such facilities, and for other purposes.</official-title>

<section section-type="section-one" id="H2ED5D704922D480BAB9131146050B09D"><enum> 1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>&short-title1;</short-title></quote>.</text></section> 
<section id="H4D7A463232A24FC2AC00B944EE9FCB"><enum>2.</enum><header>DESALINATED WATER PRODUCTION INCENTIVE PAYMENTS</header> 
<subsection id="H91F6706DE1644988AF1972DBBA98F28"><enum>(a)</enum><header>Incentive Payments</header><text>The Secretary of Energy (in this section referred to as the <quote>Secretary</quote>) shall make incentive payments in an amount determined under subsection (e) to the owners or operators of qualified desalination facilities to partially offset the cost of electrical energy required to operate such facilities.</text></subsection> 
<subsection id="H5553FE2FDD364350AF3B599B1DA7EE43"><enum>(b)</enum><header>Qualified Desalination Facility</header><text>For purposes of this section, the term <quote>qualified desalination facility</quote> means a facility that—</text> 
<paragraph id="H92354EF7401E488AB092EA92B5C12B66"><enum>(1)</enum><text>produces for sale to domestic customers desalinated seawater, brackish groundwater, or surface water whose source water is greater than 1,000 parts per million total dissolved solids;</text></paragraph> 
<paragraph id="H13E60195EB194B969847AF8517A897D4"><enum>(2)</enum><text>is owned or operated by—</text> 
<subparagraph id="H270EC43F11984DA1BF32D2D08FEE9D7F"><enum>(A)</enum><text>a State or any political subdivision, agency, authority, or instrumentality of a State; or</text></subparagraph> 
<subparagraph id="H2AA57BFFC4EE42A4B122ADDE1F6F2922"><enum>(B)</enum><text>a corporation responsible for providing municipal water service pursuant to State law; and</text></subparagraph></paragraph> 
<paragraph id="H064D358F855E4F9ABBCD8ED8B4ED881"><enum>(3)</enum><text>is first used to produce desalinated water during the 10-year period beginning on October 1 of the first full fiscal year occurring after the date of the enactment of this section.</text></paragraph></subsection> 
<subsection id="H30A38E93763442439FC343F0BA7E41C6"><enum>(c)</enum><header>Agreement; deadline</header><text>The Secretary may not make any payment to the owner or operator of a qualified desalination facility under this section, unless not later than the end of fiscal year 2015 the Secretary enters into a written agreement with the owner or operator to make such payment.</text></subsection> 
<subsection id="H1E614746CC30493193065E09CFA06100"><enum>(d)</enum><header>Payment period</header><text>The Secretary may make payments to the owner or operator of a qualified desalination facility under this section for a period not to exceed 10 years—</text> 
<paragraph id="H51F697269ACB42B287DE256F673E4DBA"><enum>(1)</enum><text>beginning on the date on which the facility is first used to produce desalinated water; and</text></paragraph> 
<paragraph id="HE93CD7058D494A37AE788E6DA021E15"><enum>(2)</enum><text>ending not later than September 30, 2015.</text></paragraph></subsection> 
<subsection id="H12C67AD704A0429A9E0839F16BBCD7FE"><enum>(e)</enum><header>Amount of Payment</header> 
<paragraph id="H7900F5C944ED4893B8F5D600885675F6"><enum>(1)</enum><header>In general</header><text>Payments made by the Secretary under this section to the owner or operator of any qualified desalination facility shall be based on the amount of desalinated water produced by the facility during the payment period described in subsection (d). For any facility, the amount of such payment shall be 62 cents for every thousand gallons of desalinated water produced and sold, adjusted as provided in paragraph (2).</text></paragraph> 
<paragraph id="H9ED20CFE265C4C239150A8C84BFE9E57"><enum>(2)</enum><header>Adjustments</header><text>The amount of the payment made to any person under this subsection as provided in paragraph (1) shall be adjusted for inflation for each fiscal year beginning after calendar year 2005 in the same manner as provided in the provisions of <external-xref legal-doc="usc" parsable-cite="usc/26/29">section 29(d)(2)(B)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/29">26 U.S.C. 29(d)(2)(B)</external-xref>), except that in applying such provisions the calendar year 2005 shall be substituted for calendar year 1979.</text></paragraph></subsection> 
<subsection id="HC8E7CDEDA5994AEDA2C24F655EF933C4"><enum>(f)</enum><header>Application</header><text>The Secretary may not make a grant to the owner or operator of a qualified desalination facility under this section unless the facility submits an application to the Secretary in such form, at such time, and containing such information and assurances as the Secretary may require.</text></subsection> 
<subsection id="H45C34A74DF2B4E499DBC3011D753F80"><enum>(g)</enum><header>Limitation</header><text>In any fiscal year not more than 60 percent of the funds made available by the Secretary under this section shall be made available to the owners or operators of qualified desalination facilities that obtain source water directly from the sea, an estuary, or from in-bank extraction wells that are of seawater origin.</text></subsection> 
<subsection id="HFADF522094154D2A9BC157CFC0AFDFD9"><enum>(h)</enum><header>Budget act compliance</header><text>The authority provided by this section may be exercised only in such amounts or to such extent as provided in advance in appropriations Acts.</text></subsection> 
<subsection id="H4D4D8384F82D47DF92C4C37B3FAA2444"><enum>(i)</enum><header>Authorization of Appropriations</header><text>There is authorized to be appropriated to the Secretary $200,000,000 to carry out this section for the period of fiscal years 2005 through 2015.</text></subsection></section>
